Anderson who, with his wife, Barbara A. Anderson, purchased the property in May of 1979 as. a two family home. From and after the date of their purchase the Andersons have used the property as a two family home, currently renting each unit to an elderly woman on fixed income at a very affordable rate. The Andersons have received a letter dated July 11, 2007 from your office indicating that the property is in violation of Town Zoning Ordinance 240-11 and must be brought into compliance. The property is presently located in a Residence RB zoning district allowing only a single family residence. In my examination of the record title to the property and of the zoning ordinances of the Town, I have determined that the structure was constructed by Breakwater Shores, . Inc. in or about 1960 (see plan of Breakwater Shores Inc. dated August 12, 1961 and recorded on November 1, 1961 in Plan Book 165, Page ill on which the property is shown as LOT 4 with the structure thereon. At the time the building was constructed, the property was located in a residence RA-1 zone in which two family homes were. allowed by special permit. I could find no evidence of a special permit at , - the registry of deeds and there is no record at Town hall of one having been issued. I did locate a special permit 1966-46 (copy of Petition and decision attached) relating to three other properties also constructed by Breakwater Shores, Inc. on lots 21A, 22A. and 23A as shown on the above plan. From the decision it is apparent that the three houses were constructed and. used as two families and the special permit was applied for to conform to the zoning bylaw. I mention the three properties because the residences thereon are mirror images of my client I.s structure. Enclosed herewith is a sketch of the layouts of the two apartments contained within my client's property. It is clear from an examination of the. property that the structure was built as a two family house. Your records indicate that a building permit #19542 was issued to John Brewer(from whom my client purchased the . property)on August 24, 1977 for the construction of a second floor exit, exterior staircase and deck. There is also in your file a copy of the Assessors' field card referencing building permit #19542 and the conversion to two apartments as of 1/1/78 . As I understand the process the building department forwards to the Assessing department copies of the building permits issued to assist it in updating the assessments. I believe that it is a fair inference that the Assessors characterized the property as a conversion to two apartments as of 1/1/1978 from information it received from the building department. If you agree with the above analysis, it appears that the six. year limitation on enforcement actions set forth in MGL c.40A, s. 7 would apply and protect the Andersons from the need to convert the premises to a single .family. Enforcement of zoning regulations; violations; penalties;jurisdiction of superior court Section 7. The inspector of buildings,building commissioner or local inspector, or if there are none, in a town, the board of selectmen, or person or board designated by local ordinance or by-law, shall be charged with the enforcement of the zoning ordinance or by-law and shall withhold a permit for the construction, alteration or moving of any building or structure if the building or structure as constructed, altered or moved would be in violation of any zoning ordinance or by-law; and no permit or license shall be granted for a new use of a building, structure or land which use would be in violation of any zoning ordinance or by-law. If the officer or board charged with enforcement of zoning ordinances or by-laws is requested in writing to enforce such ordinances or by-laws against any person allegedly in violation of the same and such officer or board declines to act, he shall notify, in writing, the party requesting such enforcement of any action or refusal to act, and the reasons therefor,within fourteen days of receipt of such request. No local zoning law shall provide penalty of more than three hundred dollars per violation; provided, however, that nothing herein shall be construed to prohibit such laws from providing that each day such violation continues shall constitute a separate offense. No action, suit or proceeding shall be maintained in any court, nor any administrative or other action taken to recover a fine or damages or to compel the removal, alteration, or relocation of any structure or part of a structure or alteration of a structure by reason of any violation of any zoning by-law or ordinance except in accordance with the provisions of this section, section eight and section seventeen; provided, further, that if real property has been improved and used in accordance with the terms of the original building permit issued by a person duly authorized to issue such permits, no action, criminal or civil, the effect or purpose of which is to compel the abandonment, limitation or modification of the use allowed by said permit or the removal, alteration or relocation of any structure erected in reliance upon said permit by reason of any alleged violation of the provisions of this chapter, or of any ordinance or by-law adopted thereunder, shall be maintained, unless such action, suit or proceeding is commenced and notice thereof recorded in the registry of deeds for each county or district in which the land lies within six years next after the commencement of the alleged violation of law; and provided, further that no action, criminal or civil, the effect or purpose of which is to compel the removal, alteration, or relocation of any_structure by reason of any alleged violation of the provisions of this chapter, or any ordinance or by-law adopted thereunder, or the conditions of any variance or special permit, shall be maintained, unless such action, suit or proceeding is commenced and notice thereof recorded in the registry of deeds for each county or district in which the land lies within ten years next after the commencement of the alleged violation. Anderson who, with his wife, Barbara A. Anderson, purchased the property in May of 1979 as a two family home. From and after the date of their purchase the Andersons have used the property as a two family home, currently renting each unit to an elderly woman on fixed income at a very affordable rate. The Andersons have received a letter dated July 11, 2007 from your office indicating that the property is in violation of Town zoning Ordinance 240-11 and must be brought into compliance. The property is presently located in a Residence RB zoning district allowing only a single family residence. In my examination of the record title to the property and of the zoning ordinances of the Town, I have determined that the structure was constructed by Breakwater Shores, Inc. in or about 1960 (see plan of Breakwater Shores Inc. dated August 12, 1961 and recorded on November 1, 1961 in Plan Book 165, Page 111 on which the property is shown as LOT 4 with the structure thereon. At the time the building was constructed, the property was located in a residence RA-1 zone in which two family homes were allowed by special permit. I could find no evidence of a special permit at the registry of deeds and there is no record at Town hall of one having been issued. I did locate a special permit 1966-46 (copy of Petition and decision attached) relating to three other properties also constructed by Breakwater Shores, Inc. on lots 21A,. 22A and 23A as shown on the above plan. From the decision it is apparent that the three houses were constructed and. used as two families and the special permit was applied for to conform to the zoning bylaw. I mention the three properties because the residences thereon are mirror images of my clients structure. Enclosed herewith is a sketch of the layouts of the two apartments contained within my clients property. It is clear from an examination of the property that the structure was built as a two family house Your records indicate that a building permit #19542 was issued to John Brewer(from whom my client purchased the property)on August 24, 1977 for the construction of a second floor exit, exterior staircase and deck. There is also in your file a copy of the Assessors , field card referencing building permit #19542 and the conversion to two apartments as of 1/1/78 . As I understand the process the building department forwards to the Assessing department copies of the building permits issued to assist it in updating the assessments. I believe that it is a fair inference that the Assessors characterized the property as a conversion to two apartments as of 1/1/1978 from information it received from the building department. If you agree with the above analysis, it appears that the six year limitation on enforcement actions set forth in MGL c.40A, s.7 would apply and protect the Andersons from the need to convert the premises to a single family.
