The last three years we have had noise at all hours, parties and a multitude of cars that also come and go throughout the night hours at the abutting house 127"Bristol-Ave. Two years ago we went to the town meetings with other couples on our street trying to get some resolvement of this problem. The authorities did come out and closed down the makeshift basement apartment plus a law was passed limiting the amount of cars in accordance with the number of bedrooms. For awhile things calmed down. We spent some time in Florida this past winter and came back to find that they now have 9 cars and a boat parked in the driveway and back yard. They have parties every weekend and the music & loud talking keeps us up most of the night. We know this is causing other neighbors the same problems as we have spoken with them and they have had to call the police a multitude of times. We live in a residental neighborhood and yet we have "rooming houses" along the street. There is a house about 5 houses down the street from us that we can hear the music so it is not just this house but many have turned homes into these "rooming houses" I did call the town hall and spoke with a woman secretary and she said that the house at 127 Bristol Ave had applied for a permit to have 5 bedrooms and it was approved giving them the right to have 6 cars.....but we see 9 cars in the.a.m. and am not even sure how many people are living there. We have even seen more than 9 cars. We obey the laws, pay our taxes and are good neighbors. My mother is 88 years old and lives with us plus we are retired. We had hoped that retirement would give us an opportunity to relax and enjoy life without always worrying about what the day or night will bring with this shattering noise and flowing of cars day & night. The neighbor across the street seems to be so tired and he has problems with the house behind him also.... We would like to sell our house but who would buy it with just looking at all the cars parked next door....I know the housing is poor on the Cape for people, and we are in sympathy for this, but there must be another avenue that can be pursued. I have found that there is NO apartment in the basement.. The property legally has 5 bedrooms. They are entitled to 6 cars. I believe that all but one person is related to the primary tenant but that is extremely difficult to prove or disprove especially when the occupants were born in another country. I have to tell you that as a whole the residents have been very cooperative. They have done everything I have asked and kept me informed. You have suggested that you are being - disturbed late at night by noise and out of hand parties; this is a police matter. Hosting parties is not a zoning violation and it is anticipated that guests and visitors will have automobiles, perhaps even over night as our culture now discourages drinking and driving. The police can also take note of the number of cars and reg numbers when they respond. This information will assist in sorting out which cars belong to the Bristol address and which one belong to the visitors. There is no question that late night disturbances are best handled by our police department but the issue you raise with regards to the rat is one that should be handled by the Health Division. I will tell you that the property in question is very clean and well maintained. The rat you saw may be from a property behind you on County Seat as I previously worked with Health on a couple of issues including trash complaints in that area. At this point I can only suggest that you photograph (and date) each disturbance so I have something tangible in hand in order to discuss and show proof positive to the landlord and tenants that the complaints have merit. If there is evidence of a zoning violation as outlined under Chapter 240 we will address it. As I indicated above many of the issues you identified .. currently fall under the jurisdiction of another department. Be assured that I continue to monitor the property and I often pass through the area at varying times of the day. I will share my observations with other departments as necessary. Recently,there were 5 adults residing here—all related. On this date, there is a primary tenant (Zelli) and her significant other, Fabio, her sister and two children. The owner, Josue Souza is in Brazil and is unable to return as he does not have a green card. Mr. Souza lost his other property to foreclosure and now the bank is mailing notices to the tenant at 127 Bristol. Zellie &Fabio believe that the landlord is keeping the rent money and not paying the mortgage. She believes this will result in her being evicted by the bank. I advised Mr. Best that while we are unable to address the number of vehicles, we do recognize the number of vehicles on site usually corresponds to the number of resident occupants and as such is indicative of overcrowding. 127 BRISTOL As a result of this complaint I called the property owner, Josue Souza(508-737-5149) of #127 and left a message for him to call me. We inspected interior of both the main house and basement dwelling unit. MAIN HOUSE The main house (first and second floors) contained four bedrooms, one kitchen, living room and dining room. It appeared to be very neat and tidy throughout. All the smoke detectors were operational. I did not observe any violations there. BASEMENT In the basement, the woman who answered the rear walk-out basement door, did not speak any English. She was busy cooking a meal within the basement kitchen. The basement unit contained three bedrooms , a bathroom , and a kitchen. Within two of the three bedrooms, there were no windows present whatsoever. The third bedroom contained a very small (basement-size) window. There were no second means of egress provided within any of these rooms. I attempted to call the complainant back this morning at 11:30 a.m. to let him know that Dave Mattos and I inspected the property this morning, that we observed several violations and that I will be mailing the owner a certified letter ordering him to correct the violations. I photographed the property with the owner's expressed permission. • The existing driveway on this date exceeded the 20' maximum allowance. • A walkout basement apartment was found to.the rear. • This unit contained a kitchen, one bedroom with egress, one den with stairway to first floor and one storage room with no means of egress. • All parties expressed concern that the den and storage area can be used as additional bedrooms. • The storage area in fact contained mattresses. • We were informed earlier in the day that mattresses were moved out of the basement and into the garage. The owner initially denied this but when pressed admitted the tenants did relocate mattresses to the garage in order to tidy up the apartment. • There was also an old oil storage tank that was not removed when the natural gas system was installed in 2005. • There were visible wiring violations including bare wires and extension cords exposed to outdoor elements. • The kitchen did not contain a stove but otherwise meets the determining criteria including a food preparation area, refrigerator and dining area. • The electrical inspector condemned the apartment wiring as "disastrous". • The septic system accommodates 5 bedrooms. • The primary unit contained 4 bedrooms, 2 down and 2 up. • The stairway to the 2°a floor may need a railing on the outside (no building inspector was present to confirm). • The garage is full of items being stored. • We were informed that there are 2 occupants in the basement apartment. • We were informed that there are 5 occupants in the primary dwelling. • We were informed that the primary dwelling is rented to one female individual (she did not speak English). • This tenant explained (Adriana translated) that she has rented the dwelling and lives there with her two cousins. In turn, they have two roommates. • She collects rent from her roommates and cousin and pays the landlord. • She has nothing to do with the apartment downstairs or those tenants. • The owner insists that he has spent upward of$30,000 upgrading the property property in accordance with what town officials have told him. • I asked to see his permits or any documentation he has. He does not have possession of it, somebody else does. • I explained that he needs to come and see me that obtaining a permit to do work only allows for that work and does not give him permission for a 2r'a dwelling unit. • It is my opinion that the tenants in the primary unit are not in violation of the ordinance as the agreement (explained to me via our translator) falls within the allowed uses—being one family- who has 2 unrelated lodgers as roommates to share the housing expenses. A single tenant alone pays the entire rent. her arrangement to collect rent from the other occupants sharing this dwelling is separate and distinct from the landlord. • Rent from the basement apartment is paid directly to the landlord.
