Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for their employees.
Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire,
express or implied,oral or written."
An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to constrict buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 152,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."
Applicants

insurance. Limited Liability Companies(LLC)or Limited Liability Partnerships(LLP)with no employees other than the,

Background
In application No. 20167-006 Lucinda Haddock sought a variance from the side yard setback:
requirements of the RCA District to allow the construction of a 16' x 20' carport accessory, to-the
single-family dwelling at 108 Buckwood Drive. The carport will be located on the:south end of the
dwelling and will be open on three sides. The subject property is a quarter-acre, irregularly shaped
lot in a 1960's subdivision in Hyannis.. The:property is,improved with a 1,952 gross sq.ft (896 sq.ft
living area), two-bedroom, single-family dwelling, constructed in'1971..
It appears that the lot,upon which the dwelling is located on may have been adjusted after the
construction of the dwelling. The plan of record; Land Court Plan 35404-B appears:#o show a land
swap with the adjoining;parcel to the south, perhaps to correct setback encroachments'identified
at.the time of construction of the dwellings.
Proposal& Hearing'Summary
Variance No. 2016-006 to allow the,construction of a carport at;108 Buckwood Drive,`Hyannis;was
filed at the Town Clerks office and the office of the'`Zoning Board.of Appeals on January, 19, 2016.
A Public Hearing before the Zoning Board of Appeals was duly advertised,,and notice sent to.all
abutters and interested parties in.accordance with M.G.L. Chapter 40A; The hearing was opened
on February 10, 2016 and continued to March 23, 2016 and April 27,2016'at which time the Board
found to grant the variance subject to conditions: Board members deciding this appeal were Brian
Florence,Alex M. Rodolakis,Robin'Young, and David Hirsch:
The hearing was,opened,on February 10, 2016 with Matt White representing the"Applicant., The
Board continued the hearing. to,allow the Applicant time'to present`additional information. The
Applicant presented the appeal before the Board on April 27; .2016. Ms. ;Haddock.presented
photos of neighborhood carports and noted support from abutters: She reviewed the variance
criteria and stated that due to a land swap,,the lot is unique in shape compared to other lots. She
also stated the possible location of`the carport is limited due to the septic system,:the bulkhead
and floor plan of the house. She concluded that it would create a financial hardship to locate the
carport elsewhere, and described the.need for protection ftom inclement weather.
The Board Chair requested public comment and no one spoke.

Findings of Fact
At the hearing on April 27, 2016, the Board voted and made the following finds of fact in Variance
No. 2016-006, a request for the construction of a carport located within-the side yard setback.
1. In Application No.2016-006,'Lucinda Haddock petitioned for a variance to Section 240-14E
Bulk Regulations.
2. The Petitioner sought to construct a new,16 foot by20 foot carport at the southerly side of the
dwelling.
3. The proposed carport will have a southerly sideline setback of two(2)feet.
4. The subjectproperty is located at 108 Buckwood Drive, Hyannis, MA as shown on.Assessors
Map 272, Parcel082. It is located withinthe.Residence C-1 Zoning District.
5. There are circumstances related to shape or topography of such land or structures and
especially affecting such land or structures but not affecting generally the zoning district`in.
which it is located. Due to. a land swap, the shape of the lot is unique. The location of the
septic system and bulkhead:precludes the construction of the carport:elsewhere:
6. A literal enforcement of the provisions of the zoning ordinance would involve substantiaC
hardship,financial or otherwise to the:petitioner: To construct the carport in conformance with..
setback requirements would necessitate relocating;the septic system or requiring significant
interior and.exteriorrenovations, creating.a hardship to the Petitioner.
7. Desirable relief may be granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent or purpose of the zoning ordinance. The
design of the structure will be compatible with the neighborhood. There was no objection from
surrounding neighbors and one'letter of support was submitted.

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required ..
shall be exempt from the-pr'ovisions of this section(Section 109.1.1-Licensing of construction Supervisors);
provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act .
as supervisor."
Many-homeowners who use this exemption are unaware that they are assuming the responsibilities of
a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15)
This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed
persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,
as part of the permit application,that the homeowner certify.that he/she understands the responsibilities of a
Supervisor. On the last page of this issue is a form currently used by several towns. You may care to amend
and adopt such a form/certification for use in your community.

Background
In application No. 2016-006, Lucinda Haddock sought a variance from the side yard setback
requirements of the RC-1 District to allow the construction of a 16' x 20' carport accessory to the
single-family dwelling at 108 Buckwood Drive. The carport will be located on the south end of-the
dwelling and will be open on three sides. The subject property is a quarter-acre, irregularly shaped
lot in a 1960's subdivision in Hyannis. The property is improved with a 1,952 gross sq.ft (896 sq.ft
living area), two-bedroom, single-family dwelling, constructed in 1971.
It appears that .the lot upon which the dwelling is located on may have been adjusted after the
construction of the dwelling. The plan of record, Land Court Plan 35404-B appears to show a land
swap with the adjoining parcel.to the south, perhaps to correct setback encroachments identified
at the time of construction of the dwellings.
Proposal & Hearing Summary
Variance No. 2016-006 to allow the construction of a carport at 108 Buckwood Drive, Hyannis, was
filed at.the Town Clerks office and the office of the Zoning Board of Appeals on January 19, 2016.
A Public Hearing before the Zoning Board of Appeals was duly advertised and notice sent to all
abutters and interested parties in accordance with M.G.L. Chapter 40A. The hearing was opened
on February 10, 2016 and continued to March 23, 2016 and April 27, 2016 at which time the Board
found to grant the variance subject to conditions. Board members deciding this appeal were Brian
Florence, Alex M. Rodolakis, Robin Young, and David Hirsch.
The hearing was opened on February 10, 2016 with Matt White representing the Applicant. The
Board continued the hearing to allow the Applicant time to present additional information. The
Applicant presented the appeal before the Board on April 27, 2016. Ms. Haddock presented
photos of neighborhood carports and noted the support from abutters. She reviewed the variance
criteria and stated that due to a land swap, the lot is unique in shape compared to other lots. She
also stated the possible location of the carport is limited due to the septic system, the bulkhead
and floor plan of the house. She concluded that it would create a financial hardship to locate the
carport elsewhere, and described the need for protection from inclement 1weatoq.DEPT.
The Board Chair requested public comment and no one spoke.

3. The proposed carport will have a southerly sideline setback of two (2)feet.
4. The subject property is located at 108 Buckwood Drive, Hyannis,-MA as shown on Assessors
Map 272, Parcel 082. It is located within the Residence C-1 Zoning District.
5. There are circumstances related to shape or topography of such land or structures and
especially affecting such land or structures but not affecting generally the zoning district in
which it is located. Due to d land swap,the shape of the lot is unique. The the construction of the carport elsewhegtion of the
septic system and bulkhead precludes
6. A literal enforcement of the provisions of the zoning ordinance would involve substantial
hardship, financial or otherwise to the petitioner. To construct the carport in conformance with
setback requirements would necessitate relocating the septic system or requiring significant
interior and exterior renovations, creating a hardship to the Petitioner.
7. Desirable relief may be granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent or purpose of the zoning ordinance. The
design of the structure will be compatible with the neighborhood. There was no objection from
surrounding neighbors and one letter of support was submitted.

Zoning Board of Appeals file entitled "Proposed house with new carport"and "Front elevation

4. The carport will remain open on three(3)sides as proposed. It shall not be altered from the
approved plan without further relief from the Board.
5. This decision shall be recorded at the Barnstable County Registry of Deeds and copies of the
recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building
Division prior to issuance of a building permit. The rights authorized by this variance must be
exercised within one year, unless extended.
