A public hearing by the Board of Appeals of the Town of Barnstable was held at the Town Office Building, Hyannis, Mass., at 3:1 November 223 . M 1972 upon said petition under zoning by-laws. O'Donnell seeking permission to construct a single family. dwelling on lot , 8, this lot having less than the required number of square feet., Richard C. Anderson, Esq. represented the Petitioners and stated that when the lot was purchased the zoning requirement called for 7500 square feet. After the 1°72 Annual Town Meeting, the zoning requirement was changed to 10,000 square feet. The Board found that this lot is lacking only 85 square feet of the required 10,000 square feet. At the time of purchase this was a buildable lot and lots in the immediate area are of equal size and in many cases smaller. These other lots are built upon. The relief sought is minimal. The Board finds that there are conditions especially affecting this parcel not affecting the zoning district in which it is located generally; and that a literal enforcement of the provisions of the by-law would involve substantial hardship; and that relief maybe granted without substantial detriment to the public good and with- out derogating from the intent or purpose of the by-law. ` The vote of the Board was unanimous to allow the Petitioners to use this lot for a single family residence.
