As quoted from the"law", an employee is defined as every person in the service of another under any contract of hire, express or implied, oral or written. An employer is defined as an individual,partnership, association, corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the.legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership, association or other legal entity, employing employees. Boy, Ralph Copeland, Thomas A. DeRiemer and Vice Chairman, Gail Nightingale. Attorney John W. Kenney, represented the applicant who was also present during the hearings. Mr. Kenney stated that the applicant had received a Variance from the Zoning Board in 1995,for an undersized lot, He summarized the history of the site, noting that the lot was originally created as Lot 65 by a 1961 plan recorded with the Registry of Deeds Plan Book 165, Page 41. That lot and an adjoining Lot 66 were acquired by the applicant's parents,John J. Driscoll and Barbara D. Driscoll, by a deed dated June 5, 1979 recorded in Book 2929, Page 308. In 1985, the minimum lot area for the zoning district was increased to 1 acre. Lots 65 and 66 were in common ownership and five years later were united for zoning purposes in accordance with MGL Chapter 40A and the merger requirements of undersized lots held in common ownership. Driscoll by deed dated December 18, 1995 and recorded with the Ba=table County Registry of Deeds in Book 9982, Page IL However, the 1995 variance decision was never recorded and remains unrecorded to this date. The Board discussed the situation, agreeing that the transfer of the property would be considered executing of the agreement and that with reference to the recording of variance,MGL Chapter 40A Section 11 requires the recording of the variance, but it doesn't specify the time fume in which it must be recorded, The board differed on the nature of the conveyance noting that it was to the daughter for the nominal fee of only $1.00. The Board asked if plans for the dwelling had been made. Mr. Kenney responded that preliminary plans had been drawn up, however he did not have a copy of those plans with him, but he could provide a copy if the board requested one. Public comment was requested and Walter Lacey, an abutter, would prefer to see more than a one-bedroom home built on the lot. Mr. Kenney noted that restriction was imposed by the Health Division with regards of the on-site septic system and Title 5 regulations. Findings of Fact: At the hearing of.August 07, 2002, the Board made the following findings of fact: I. Appeal 2002-101 is that of Ellen M. Driscoll requesting a Variance to Section 3-1.1(5) Bulk Regulations Minimum Lot Area of 1-acre to permit an undersized lot of 0.24-acm to be buildable under zoning. The property is shown on Assessor's Map 248, Parcel 091, commonly addressed 6 Carla Road, Hyannis, MA in a Residential B Zoning District. 2. There is no available vacant land that the applicant can acquire to make the lot conform to the current bulk requirements. 7: Because many of the lots, in the area are similar size, the granting of the relief to allow the construction of a dwelling on the vacant parcel would not be in derogation of the spirit and intent of the zoning ordinance. It would not cause substantial detriment to the neighborhood. The vote was as follows: AYE: Daniel M. Creedon, Richard L.Boy, Thomas A. Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. The property is a 0.24-acre vacant lot. The property had been issued a Bulk Variance Number 1995-07 to minimum lot area on March 01, 1995. The property was transferred to Ellen Driscoll on December 15, 1995 however, the variance was never recorded and the applicant is now seeking a new variance to be recorded to . assure that the lot is buildable under zoning. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 08, 2002. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 07, 2002, at which time the Board found to grant the variance request. Board members deciding this appeal were Daniel M. Creedon, Richard L. Boy, Ralph Copeland, Thomas A. DeRiemer and Vice Chairman, Gail Nightingale. Attorney John W. Kenney, represented the applicant who was also present during the hearings. Mr. Kenney stated that the applicant had received a Variance from the Zoning Board in 1995, for an undersized lot. He summarized the history of the site, noting that the lot was originally created as Lot 65 by a 1961 plan recorded with the Registry of Deeds Plan Book 165, Page 41. That lot and an adjoining Lot 66 were acquired by the applicant's parents,John J. Driscoll and Barbara D. Driscoll, by a deed dated June 5, 1979 recorded in Book 2929, Page 308. In 1985, the minimum lot area for the zoning district was increased to 1 acre. Lots 65 and 66 were in common ownership and five years later were united for zoning purposes in accordance with MGL Chapter 40A and the merger 4 requirements of undersized lots held in common ownership. The Driscolls held both lots in common ownership from 1979 until 1995. On March 1, 1995, the Driscolls secured a variance from the Board to permit the vacant undersized lot, Lot 65 to be buidlbale under zoning. After receiving the variance, Mr. and Mrs., Driscoll conveyed the undersized lot to their daughter Ellen M. Driscoll by deed dated December 18, 1995 and recorded with the Barnstable County Registry of Deeds in Book 9982, Page H. However, the 1995 variance decision was never recorded and remains unrecorded to this date. The Board discussed the situation, agreeing that the transfer of the property would be considered executing of the agreement and that with reference to the recording of variance, MGL Chapter 40A Section 11 requires the recording of the variance, but it doesn't specify the time frame in which it must be recorded. The board differed on the nature of the conveyance noting that it was to the daughter for the nominal fee of only $1.00. The Board asked if plans for the dwelling had been made. Mr. Kenney responded that preliminary plans had been drawn up, however he did not have a copy of those plans with him, but he could provide a copy if the board requested one. Public comment was requested and Walter Lacey, an abutter, would prefer to see more than a 6ne-bedroom home built on the lot. Mr. Kenney noted that restriction was imposed by the Health Division with regards of the on-site septic system and Title 5 regulations. Findings of Fact: At the hearing of August 07, 2002, the Board made the following findings of fact: 1. Appeal 2002-101 is that of Ellen M. Driscoll requesting a Variance to Section 3-1.1(5) Bulk Regulations Minimum Lot'Area of 1-acre to permit an undersized lot of 0.24-acres to be buildable under zoning. The property is shown on Assessor's Map 248, Parcel 091, commonly addressed 6 Carla Road, Hyannis, MA in a Residential B Zoning District. 2. Despite the merger of Lot 65A with Lot 66A as a result of the zoning ordinance change in 1985, the Town of Barnstable, continued to, and does to this day, assess the property as a separate buildable lot . 5. After receiving a variance in 1995 to make their undersized lot buildable the Driscolls acted `. = upon the variance by conveying the lot to their daughter within one year from the date of the 2 f granting of the variance, Unfortunately, they were not aware of the requirement that the variance decision had to be recorded at the Barnstable County Registry of Deeds and that was never done. 6. There are numerous lots in the vicinity that are of similar size. To require the applicant to conform to a different lot size than many of the lots in the neighborhood in this development would impose a hardship upon the applicant. There is no available vacant land that the applicant can acquire to make the lot conform to the current bulk requirements. 7. Because many of the lots, in the area are similar size, the granting of the relief to allow the construction of a dwelling on the vacant parcel would not be in derogation of the spirit and intent of the zoning ordinance. It would not cause substantial detriment to the neighborhood. The vote was as follows: AYE: Daniel M. Creedon, Richard L. Boy, Thomas A. DeRiemer and Gail Nightingale NAY: Ralph Copeland Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following conditions: 1. The on-site septic system shall be required to meet Title 5 without variance from the Board of Health. 2. Development on the lot shall conform to all other setback requirements of zoning.
