Dear Mr. Crossen:
I am writing to request a determination from you that for zoning purposes,
the above-referenced lot is a "non-conforming lot" exempted from the current
minimum lot size provisions of the Barnstable Zoning ordinance.
The facts regarding the lot are as follows:
1. The lot was established on'a plan of land dated September, 1961. The
plan is recorded at the Barnstable County Registry of Deeds in Plan
Book 165, Page 41. Locus is shown as Lot 61 on said plan. The subject
locus has 11,000 square feet of land(25 acres) and one hundred ten
(110) feet of frontage on an approved way. Said lot was conveyed on
December 24, 1980 by a deed from Joseph Sodaitis and Aldona Sodaitis
to Spiros Balodimas recorded in Book 3215, Page 190. Spiros
Balodimas conveyed Lot 61 to Eleni Balodimas by a deed dated
December 8, 1982 and recorded in Book 3625, Page 9. Eleni Balodimas
conveyed it to Spiros A. Balodimas and Eleni Balodimas, Trustees of the
Vivian Trust by a deed dated.October 11, 1985, and recorded in Book .
4754, Page 040. On February 29, 1996, Spiros A. Balodimas and Eleni

Balodimas, Trusatees of the Vivian Trust conveyed the lot to Anthony
Zombas by a deed at Book 11079, Page 15, (who had in 1992 sold the
abutting Lot 63). Anthony Zombas conveyed the lot to Fidelity
Financial, Inc. by deed dated December 28, 1998 and recorded at Book
11945,page 55. A copy of these deeds are attached for your reference.
Abutters
2. Lot 59 on plan at Plan Book 165, Page 41 was conveyed to ownership
separate from the subject Lot 61 on October 22, 1977 by a deed from
Roger E. Clapp, Jr. and Patricia M.Clapp to Walter J. Lacey and
Deborah H. Lacey recorded in Book 2606, Page 331. A copy of this
deed is attached for your reference. Since October 28, 1977, Lot 59 has
remained in ownership separate from the subject Lot 61.
3. The parcel of land-currently belonging to David A. Aldrich which is the
westerly abutter to locus is shown on the plan at Plan Book 165, Page 41,
as Lot 63. Ervin W. Brensen sold Lot 63 to Harry S. Dane and Leah S.
Dane by deed dated April 5, 1972 and recorded in Book 1627, Page 292.
Leah S. Dane, surviving tenant by the entirety, sold Lot 63 to Vincent V.
Fantegrossi, Trustee of Erand Trust by deed dated September 15, 1987
and recorded in Book 5927, Page 332. He in turn sold Lot 63 to Kevin
B. Shearer, Trustee of KBS Realty Trust by deed dated April 25, 1988
and recorded in Book 6229, Page 219. Kevin Shearer, Trustee, sold Lot
63 to Anthony Zombas by deed dated July 19, 1988 and recorded in

Trustee of Carla Realty Trust by deed dated June 3, 1992 and recorded in
Book 8050, Page 257 (prior to ever acquiring title to Lot 61). Karen A.
Powell, Trustee sold Lot 63 to the current owner David A. Aldrich by
deed dated October 23, 1992 and recorded in Book 8281, Page 246. A
copy of these deeds are attached for your reference. Since at least April
5, 1972, Lot 63 has remained in ownership separate from the subject Lot
61.

these deeds are attached for your reference. Since at least July 3, 1974,
Lot 62 has remained in ownership separate from the subject Lot 61.
5. Therefore, Lot 61 has been held in ownership separate from adjoining
lots since at least October 28, 1977.
6. On February 28, 1985 by Article 1 of the Town Meeting of the Town of
Barnstable, the minimum lot size for the subject area was increased to
43,560 square feet.
Based on the foregoing, it is my opinion that under Section 4—4.2(1)
of the Town of Barnstable zoning Ordinance this lot was not held in common in
ownership with any adjoining land at the time of the Zoning change, which made it
non-conforming; and has a minimum of 5,000 square feet of area and 50 feet of
frontage; and conformed to the existing zoning when legally created; and was
separately owned at the time of every zoning change which made it non-
conforming. Therefore, it is my opinion that this lot is "grandfathered" and may be
built upon for residential purposes because the lot conforms with Section 4-4.2(1) of
the Zoning Ordinance.

as to whether or not in your opinion this lot may be built upon for residential
