Settlers Landing, a subdivision on Castlewood Circle in Hyannis, MA, shown on Barnstable Assessor's Map 273 as Parcels, 122, 122-001 through 122-01.1, 32 & 32-001. 3. This application concerns a Comprehensive Permit, `40B,' Project, originating ° ion August`3, 2000, that sought approval to develop 168 multi-family, condominium units. The project is located on approximately 13 acres abutting the Cobblestone Landing subdivision in Hyannis. The Barnstable ZBA did not ultimately issue a Comprehensive Permit for the requested 168 multi- family units, but only for either 44 multi-family units or single family homes. This decision was appealed to the Massachusetts Housing Appeals Committee ("HAC"). HAC subsequently encouraged the parties, Morin and the ZBA, to mediate this dispute. A nine month mediation followed, and has resulted in a successful resolution. Pursuant to the mediation, the parcel will be divided into 21 lots. First, 20 single family homes will be developed on approximately 5.6 acres of the entire, l3+ acre parcel pursuant to a `40B' Comprehensive Permit, requiring 25% affordable units. The single remaining lot will compose the remaining acreage. 1 I That remaining lot will eventually be subdivided into 29 lots and developed under the prevailing town zoning and subdivision control laws. When subdivided, these 29 lots will be regulated by a new zoning amendment, a "Private Housing Initiative- Affordable Housing Development," ("PHI- AHD"), requiring approval by Special Permit, connected to town sewer and that 20% of construction consist of affordable units. The Amendment has . been proposed by and will be adopted by the Barnstable Town Council in September 2004. The neighbors of the locus in both the Cobblestone Landing and Castlewood Circle areas support the mediation settlement, including the proposed PHI-AHD, Barnstable zoning amendment that is subject to public hearing. 4. Settlers Landing is a subdivision project involving 13 acres on Castlewood Circle in Hyannis, MA, abutting the Cobblestone Landing subdivision. 5. a. i 3Q: "For purposes of sections twenty to twenty-three, inclusive, of Chapter Forty B of the General Laws, the Commission shall be considered a local board." b. 12 c 5 : "The following developments shall be presumed to be Developments of Regional Impact ("DRIs"):...Any development which proposes to divide land in common ownership into thirty or more residential dwelling units... " As the overall Project here is undertaken pursuant to M.G.L. c. 4013, the Commission's. jurisdiction is limited to that of a local board, its authority limited to that of`commenting' 2 I C� as a local board would. The CCC does not have broad jurisdiction to review the Project as a DRI . The single lot that will remain after the first 20 lots are developed pursuant to `40B' will not be a DRI, though it will be developed pursuant to and in compliance with the Town of Barnstable Zoning and Subdivision Control Laws.
