HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall,be exempt from the provisions Of this scction.(Scction 109.1.1 -Licensing of construction Superyisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." 10ny homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Scction 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/ccrtifrcation for use in your conununity. Location: 310 Castlewood Circle, Hyannis, Massachusetts This house was moved mid to late June of 2000. This is in a densely populated neighborhood with young children and elderly citizens. The cellar'is filled with stagnant water posing a health threat and the breeding of mosquitos and other insects. There is nothing to protect children from falling into the cellar hole. Sewer Connection The proposed density of 56 units at Settlers Landing is predicated in part upon the assumption that the developer will be able to connect to a Town sewer line currently located within the Cobblestone residential subdivision. The second page of the applicant's "Preliminary Site Development Plan of Settlers Landing" dated August 4,2000.shows a connection to the sewer line on Daybreak Lane in Cobblestone Landing across an area shown as open space designated as belonging to Cobblestone Landing, Inc. However, there is no right to cross the open space at Cobblestone Landing in order to gain access to Daybreak Lane. If there is no right to cross the open space at Cobblestone Landing for the purpose-of installing a sewer connection to Settlers Landing, then there is no means by which the developer can in fact connect'to the Town sewer. Mr. Ron S. Jansson November 8, 2000 Page 2 .By means of an instrument dated September 30, 1997, the Cobblestone Landing developer, namely Cobblestone Landing, Inc., granted a sewer easement to the Town of Barnstable which was recorded on December 1, 1997 in the Barnstable County Registry of Deeds in Book 11090 at Page 172. A copy of that sewer easement is attached hereto as Exhibit 1. Under the terms of the sewer easement (Exhibit 1) the Town of Barnstable was given the right "...to lay, maintain, operate, repair and replace sewer pipe, apparatus, equipment and other usual fixtures..: in the streets and ways shown on a plan ..." (emphasis added) Further, the Town was given the "...perpetual right and easement to relocate said pipe, apparatus, equipment and other fixtures within said streets and ways." (emphasis added) The easement did not include the right to install sewer lines across open space.belonging to Cobblestone Landing, Inc. The open space at Cobblestone Landing now belongs to the Trustees of Cobblestone Landing 11 Trust, which is the Unit Owners Association at Cobblestone Landing. Cobblestone II Trust obtained title to the open space by means of a deed dated December 3, 1997 recorded on May 23,2000 in the Barnstable County Registry of Deeds in Book 13025 at Page 176. A photocopy of the "Deed of Open Space" is attached hereto as Exhibit 2. The Trustees of Cobblestone II Trust, whom I represent, have given no rights to the applicant for the Settlers Landing comprehensive permit to cross the open space for the purpose of installing sewer lines or any related apparatus. I have reviewed the Cobblestone Landing title and at this juncture can find no.such right across the open space having been given by any predecessor in title. The easement to the Town of Barnstable is limited to the "streets and ways" shown on the Cobblestone Landing subdivision plan. As a result, the Settlers Landing applicant has no right to cross the open space to obtain access to the sewer on Daybreak Lane and as a result, cannot connect to the Barnstable Town sewer. Compliance With Comprehensive Plan The Town of Barnstable Local Comprehensive Plan recognizes that the Village of Hyannis bears the greatest burden of affordable housing within the Town of Barnstable. The Comprehensive Plan states the following: The Town provides a microcosm of the unequal distribution in affordable housing throughout the region. The Village of Hyannis communicates the same concerns about being overburdened that the Town.of Barnstable expresses on the regional level. Hyannis contains 877o of the Town's affordable housing stock, also a reflection of the regional picture—The other villages do not have the infrastructure necessary to support high density developments, but must in turn assume some of the responsibility for providing affordable housing. Local Comprehensive Plan Page 5-9. I Mr. Ron S. Jansson November 8, 2000 Page 3 Recognizing the disproportionate share of affordable housing within Hyannis,the Local Comprehensive Plan has set forth Goal 5.3, to wit: "Ensure the decentralization of affordable housing throughout the Town of Barnstable." Situated within Hyannis, the Settlers Landing proposal will exacerbate the unequal ' burden of affordable housing within Hyannis. .It is entirely inconsistent with Goal 5.3 since it is the opposite of decentralization. The Settlers Landing.proposal is also.inimical to the open space objectives set forth within the Local Comprehensive Plan, particularly with regard to Hyannis. While Hyannis has nearly 90%of all affordable housing units within the Town of Barnstable, it is second only to Centerville in having the least amount of open space. Authors of the Local Comprehensive Plan wrote the following in regard to open space within.the Village of Hyannis: "On the village scale,Centerville,with only 289 acres of open land, and Hyannis with 1,443 acres, seriously lack neighborhood open spaces. Many of the large recreational areas that exist in Centerville and Hyannis are regional facilities...in Hyannis, Kalmus Beach ,Aselton Park,Veterans Memorial Park and other areas around the Hyannis Harbor(78 acres) are regional facilities. Hyannis' open space also includes the 438 acre Barnstable Municipal Airport... Centerville and Hyannis,with a total of 23,310 persons or 57%of the Town's 1990 population, have a total of 1,727 acres of open space or 14.4%of all open land. Hyannis has practically no conservation land. Both Hyannis and Centerville are deficient in lands for Wellfield protection and open land for visual landscape relief. Hyannis has the largest acreage devoted to schools, with 1.56 acres of public and semi-public land...both Hyannis and Centerville are densely populated with an average of 324 persons per square mile, yet these areas have few neighborhood playgrounds. Local Comprehensive Plan Page 6-4 Policy 6.1.2 of the Local Comprehensive Plan states that"The Town shall encourage the preservation of open space and secure public access through creative means of conservation, restrictions, fee interests, land easements, tax abatements, gifts and zoning." Jansson November 8, 2000 Page 4 Development of the 13 acres comprising the proposed Settlers Landing Development is . arguably in and of itself a breach of Policy 6.1.2 of the Local Comprehensive Plan. Within the development, high density precludes open space and therefore as a development plan, Settlers Landing breaches Policy 6.1.2.' Massachusetts General Laws,Chapter 40B is a regional planning statute of which the affordable housing provisions are a portion. When the statute is read in its entirety, it is obvious that affordable housing is considered to be one component of regional planning. Hence, an affordable housing project such as Settlers Landing which is entirely inconsistent with specific objectives of Barnstable's Local Comprehensive Plan is likewise inconsistent with the general objectives of Massachusetts General Laws, Chapter 40B when read in its entirety. While this may.be insufficient grounds for rejecting the development, it may serve as a persuasive grounds at the Housing Committee level for reducing the density of the development to a density which is consistent with the Local Comprehensive Plan. Specifically,since the proposed development will increase the disproportionate share of affordable housing in Hyannis,while offering no open space and in fact eliminating a substantial parcel from the otherwise limited open space stock within Hyannis, a decision of this Board which significantly reduces the developer's density, is concordant with Barnstable's Local Comprehensive Plan and is defensible before the Housing Appeals Committee. Klimm,Town Manager Re: Settlers Landing,Realty Trust,comprehensive Permit Date: November 7,2000 As part of the request for the above referenced comprehensive permit, certain waivers from rules,regulation and design standards have been requested. One such waiver requested is to enable the developer to construct a sewer collection system within his development and connect it to the Town's collection and treatment system. If this waiver is granted, it in essence removes the requirement for compliance with any type of generally accepted construction design standards. There will be no review conducted of either the design or the installation of the system. This should not be if the applicant wishes to be connected to the Town's sewer system. His design should be subject to the design and construction standards that the Town has established for itself. Sub-standard construction of sewer main and house service connection could result in harm to the environment, Cape Cod's sole source aquifer—it's sole drinking water supply, and can result in public health exposures to the residents of the proposed homes. The plans and construction should be subject to review and approval of the Engineering Division. The question should also be asked of the developer's long-term intention with regard to the operation and maintenance of the collection system that he is proposing to construct. He should plan to turn it over to the Town for operation and maintenance and it most certainly should be designed and installed to the Town's requirements. If the Town can accept the sewer mains the annual cost to residents of the proposed development will be greatly reduced,thereby making the affordable units more affordable. The Town should not be obligated to take over and maintain something not built to its standards. If the developer does not propose to turn it over to the Town then he should be required to post a long term and economic renewable bond to insure that the system will be properly maintained and not become a burden to the people who buy the homes. The developer has also requested that he not be required to provide storm water retainage for the 100-year storm. He proposes to provide leaching capacity for the 25-year storm. If you waive the 100-year retention requirements all water above the 25-year flow will be allowed to flow onto private property with the potential for causing damage. I would suggest that the developer, as a minimum,be required to retain the difference between the pre and post development 100-year storm flow. If this is done then the potential storm impact on private property will be no greater with the project than without the project. The owners buying the affordable units are the residents least likely to be able to correct potential flooding of their property or the private roads on which they will be residing. The applicant has asked that he be relieved of paying any fees to the Town. With regard to sewer related fees,the Water Pollution Control Division of the Department of Public Works is an enterprise fund operating system which derives all of its funding from collected fees and sewer rates. To deprive that division of fees from this project requires that other sewer users pay more to make up for lost revenue. The users of the sewer system make up only a small portion of the citizens of the Town of Barnstable. It does not seem fair that these few should be required to underwrite some of the cost of this project. The Board asked me to suggest the following conditions be considered in your review. The BHA supports the recent policy of the Zoning Board of Appeals to seek long term affordability commitments from developers for increased density relief and believes the units at Settler's Landing should be made affordable in perpetuity. The BHA would like to see the time lines for resale of affordable properties extended beyond the present 120 days. If an eligible buyer could not be found in 120 days, as specified in the current New England Fund guidelines, then an additional 120 days should be granted to eligible non-profit organizations or public agencies to purchase the affordable unit. The Board feels that all of the market rate homes should be reserved for families living year round in Barnstable. This would adhere to the guidelines of the Governor's Executive Order 418 and help working families at 150%of median income purchase housing locally. The BHA would like to be designated an eligible buyer for four of the affordable units at a purchase price of$90,000.00 each. These units would be added to our permanent rental stock and rented to families at or below 65%of median income. The BHA has concerns about the density of the project but also recognizes that there has been little housing built for families in this price range. While we would prefer less density the BHA would not want to see a corresponding decrease in the number of affordable units. Normally the BHA would comment on the need for single family housing. However,the BHA does not have numbers available on families waiting to purchase single family homes in the suggested price range of Settler's Landing. The crisis for families presently on our wait lists is the lack of affordable rental housing. As you know the BHA is building seven three bedroom single family homes on BHA property in Marston Mills. When we conduct our own lottery for these homes on Gallagher Way, Marstons Mills, we.will be in a better position to comment on homeownership needs. Equal Housing Opportunity Agency The BHA is aware that both the Housing Assistance Corporation(HAC) and Habitat for Humanity, which have been soliciting applicants and conducting homeownership lotteries, may have better data regarding homeownership need. They indicated that they would consult Willi you oil their questions. 1 would like to review the questions, as l understand then), and provide you with the Applicant's position. First, there was a question about control ol'the land, in that an approximately 24,000'sq. f3. portion of the lot shown on Assessor's Map 273 as Lot 122 is not part of the development plan. As explained to (lie Board, the answer is that said portion constitutes a portion of the land that Weill through a Land Court confirn)ation process; and as part of that process, Flatley claimed title to the 24,000 sq. n. portion, and Martha Morin agreed to convey it to hint for one dollar. That deed has now been delivered to Flailey's atturney, and a copy is enclosed belewitl). In any event, this did not and does nut constitutc.a Dick of control of the locus for the proposed development, because the proposal, as shown on the submitted plan by Down Cape Engineering, Inc., does not include said 24,000 sq. R. portion. Second, there was a question about control of the land from the viewpoint that the contract between Marlin Morin and Jacques N. Morin, Trustee of Settlers Landing Realty Tn1st, is not All Ann's length contract, because Jacques Morin and Martha Morin are husband and wife. The apparent insinuation is that the contract is therefore not enforceable. That would be false. See Garrity 399 Mass. 367 (1987), at page 371, where the Court gave a very broad reading to the statute in denying a husband's claim that the statute was limited to marital contracts, such as antenuptial and separation agreements. The Courrt stated: "The clear language of the statute indicates that the Legislature conferred on a married woman the broad right to contract, including the right to contract with her husband." This is further supported by Massachusetts General Laws Chapter 209, Section 3, which stales: "Transfers of real and personal property between husband and wife shall be valid to the same extent as if they were solo." This should dispose orany concern on this question. Third, there was discussion, if not questions, about the Applicant's status as a limited dividend organization. I pointed out that although it was not required, the Applicant in fact had specific language in its trust document requiring that it be a limited dividend organization, pursuant to M.G.L. Chapter 40B, Sections 20-23. The trust document was submitted with the application. I enclose a copy herewith. Sec, in particular, Section 4. Also, Mr. Jansson suggested.that the Trust be amended w require that the provisions concerning limited dividend could not be modified or deleted. However, Section 4 already contains such a provision, where it says. "...the Trust will operate under the fullowing restrictions which may not be amended or deleted until every such development has been completed and all program requirements complied with...." Therefore, the Applicant is a limited dividend organization, irregardless of anything else. Even without such language, the Applicant would be a limited dividend Organization, because it is proposing to build low and n-roderate housing under an eligible governmental program, the New England fund Program ("NEF), and is eligible to receive the subsidy under NEF(the project eligibility letter from Compass.Bank was submitted with the application). This is all that is required under the court cases dealing with the issue: Board of Appeals of aynard v. Housing .Appeals Committeq, 370 Mass. 64 (1976), at page 67; and Laticlers v, I oa �pcalL of Falmouth, 31 Mass, App. Ct. 939 (1991), at page 940. Further, the Applicant agrees to the profit limitation contained in the town's housing guidelines, and to execute the Regulatory Agreement under NEF. This complies with the requirements for NEF under the Stubgrn case, and with the review of the standing requirements under Chapter 40B by Assistant Town Attormey Ruth J. Weil, in her March 16, 2000 letter to the Zoning Board of Appeals. Fourth, there was a question by attorney Charlcs Sabbatt, representing some Cobblestone Landing neighbors, about the project eligibility letter from Compass Bank. See copy of said letter, enclosed. Ile questioned whether it was satisfaclory, and pointed to language in the final paragraph that began: "Once your proposed project is deenicd eligible under the requirements of the NEI, Program....". However, that letter followed, almost to the word, the language in the "model" NEF bank project eligibility letter that was attached to, and referred to in, Ms. Weil's March 16, 2000 letter. Said model letter was the December 29, 1997 letter from Cape Cod Bank and Trust Company to Stuart Bornstein, Stuborn Limited Partnership. See copy enclosed. As Ms. Weil stated in her letter, this site approval letter was found acceptable by the Housing Appeals Committee. Thus, the Applicant's "site approval" or "project eligibility" letter from Compass Bank is sufficient. lf, for sonic reason, you think that additional language is needed from the bank, I would appreciate hearing Fruin you in advance of the next Zoning Board of Appeals hearing on November 15, 2000, so that illy client will have an opportunity to request the OCT-11-00 12 :55 PM ATTY PETER FREEMAN 5O83628281 P . O5 bank to revise [lie letter. Fifth, there was discussion about the pro forma. SpeciCcally, there were questions about the appropriate land value, which related to Ilia same issue of arm's length contract, or related party status, witli the Morins that was discussed above; and broker's fees and construction costs, again related to related party status of the Applicant with Morin Really and Bayberry Building Company, Inc. As to land value, both Mr, Jansson and Mr. Sabbatt suggested that perhaps the Applicant is only entitled to the actual cost to Martha Morin of tier portion of the locus, and the actual cost of the one access lot owned by Jacques Morin. We strenuously disagree. First, based on the statutory and case law cited above, the contract between the Applicant and Martha Morin is totally appropriate and enforceable. It is a realistic price, not inflated, and if the Applicant was someone else, say, XYZ Company with no Nlorins involved, the actual transaction cost to the developer would be totally appropriate to use as a real project cost. There is no logical reason, whether under 4OB or other wise, to penalize the Applicant because Martha Morin made a wise business investment years Ago. To limit the land value as described above would be at odds with the real world of real estate development, and does not constitute a windfall to the Applicant, which, as supported by the above-cited statutes and case, is o separate entity. . However, the Applicant does not simply rest on the above argument. More importantly, although it disagrees with the policy and reserves its rights to make the above argument should this issue be litigated, the Applicant is willing to abide by the policy and guidelines established by. the Barnstable Housing Committee on land value. Said policy and guidelines specifically state that the land value for pro forma purposes, on which the 20% profit limitation will be calculated, is the hlgbet-of Ilia actual cost to the applicant. or the appraised fair market value before Ilia granting of the Comprehensive Permit. To reiterate, we believe that the actual cost to the Applicant is the Purchase and Sales Agreement price For the large parcel, plus the cost of the one access.lot.. However, we also have, and submitted, a current appraisal of fair market value for the entire locus based on the value before the granting of the Comprehensive Permit, showing a value of$730,000.00. By the way, contrary to questions at the firs( hearing, that appraisal covers only the actual, correct locus for the proposed 56 unit development, not the 24,000 sq. n. portion deeded to Flaky. Therefore, the proper land value, as per the 'P mn's airn exper-I arc!►ho/y bvct'y my nffol-thrble houshig, should be at least the "$730,000.00 Further, the Applicant spent many months reviewing this and engaging in candid discussion with the Mousing Committee. The result was a formal vote by the Committee on April 13, 2000 where the following was approved: 'to (a) accept the value of Ilia land for the project based upon the greater value of either the acquisition costs plus carrying costs or its appraised value prior to the issuance of It comprehensive permit, and that (b) the current ownership and required transaction to the developer will not render Ilia project ineligible under the Guidelines assuming (a) above is satisfied." This vote was, of course, reiterated in the Committee's formal review of this project, as contained in their September 15. 2000 letter to the Zoning Board of Appeals. When I informed Mr. Jansson of this, and handed him a copy of the minutes of that meeting, he stated that the Housing Committee was only advisory, and that the ultimate decision rests with the Zoning Board of Appeals. While technically true, ,[ respect frilly submit that such a view cannot be supported as fair or appropriate. The I Iousing Committee was specifically organized to include experts familiar with affordable housing; it established guidelines which, unless there is compelling reason to the contrary, developers of affordable housing 4mokJ and do rely on; and the Housing Committee arrived at its determination on this project alter considerable review, discussion and analysis. To offhandedly disregard their position strikes me as potentially arbitrary and capricious. As to the other budget items, t can only say that it is common-place for developers to wear many hats. To say that a developer cannot earn the industry-standard reasonable fees from construction and/or marketing defies economic logic. The town would be creating a huge d4iiieewive for developers to even think about 40B to develop housing, This, of course, would be antithetical to the whole purpose of 40B. See Board of Appeals of Ildnover v. Housing- Appeals Cominittce, 363 Mass. 339 (1973), What's nwre the blousing Committee has reviewed the pro forma, and included a section on"Reasonable Costs" in its letter to the Zoning Board of Appeals dated September 15, 2000. The Committee expressed no concern over the reasonableness of construction or marketing costs(although it noted that there was no category for"construction contingency"). In fact, at a May 17, 2000 meeting of the Housing Committee, with regard to NEC Guidelines, the Committee stated that the Guidelines"will have to be revised to clarify related party costs and which costs can be included as Project Costs." See copy of minutes, enclosed. Inherently, by so noting, in May and in favorably reviewing the Applicant's pro forma in September, the Committee supports the reasonableness of the construction and marketing costs, notwithstanding the relationship between the Applicant, Morin Realty, and Bayberry Construction Company. In sum, I believe that the Applicant has more than adequately responded to the questions, and that the correct legal position is that the Applicnnt has mct all jurisdictional requirements, and that the pro forma is reasonable. 1 would certainly appreciate a copy of your advisory opinion to the Zoning Board of Appeals ahead of the next hearing.
