Please be informed that a building permit is necessary prior to any construction. Upon completion of all work, the letter of certification required by Section 4-7.8 (7) of the Town of Barnstable Zoning Ordinances must be submitted. Michael and Evelyn presented the proposal. Changed the proposal to Wholesale used car license only. Bayside Auto uses 2 bays. Addressed staff concerns. • Planning addressed previous uses. Applicants are now requested office use only. Discussed possibility of Zoning Board of Appeals. Planning stated if this is wholesale only, then parking is not an issue. • Building Commissioner clarified that the Applicant has changed the proposal. No vehicles will be on site. This is only office use of 15 X 14. • Planning stated office use is allowed and only one parking space is required. • Engineering visited the site. Possible problems with parking on site. Narrow access. Discussed screening from residential use. Applicant stated they will not do any repairs. • Hyannis Fire Department addressed use of building. Bayside Auto has been there about 2 1/2 years. Applicant stated the building appears to have been built in 1988. Applicant stated the prior uses were a milk company and bicycle storage. Fire Department concerned with hazardous materials and emergency access. • Health reviewed records. Fire shows a 1996 hazardous materials registration form for 54 Cedar Street. Health addressed washing vehicles. Applicant will not do any washing of vehicles. Health is concerned with site and recommended the Site Plan Review staff invite the owner of the property in to .discuss site. Gx ner is Mr. Koch. • Building Commissioner stated the office use is allowed. A letter to Mr. Koch will be sent. Applicant stated the upstairs is being used for office currently. Zoning:.........................................PRD Professional Residential Zoning District Groundwater Overlay:..................WP Well Protection District Background: The property is located at 58B Cedar Street in Hyannis in a PRD Professional Residential Zoning District. The site is improved with a three bay metal building currently being used by Bayside Auto Service. The applicant proposes to operate a used auto sales business from one of the other bays in this building. He has stated there will be no repairs done by Steel Dreams on-site. Required: Use The retail sale of automobiles is not permitted in PRD Professional Residential Zoning Districts. Auto service is also not allowed in PRD Districts. However, the current use by Bayside Auto Service may be a pre-existing nonconforming use. Are the other two bays in this building currently being used? If not, how long have they been vacant? Zoning Relief The applicant may be able to apply for a special permit from the Zoning Board of Appeals pursuant to Section 4-4.5(1) - Change of a Nonconforming Use to Another Nonconforming Use, depending on the previous uses of the proposed bay. The applicant does have the option of applying for a use variance from the Zoning Board of Appeals. However, the Board does not generally approve use variances unless there are very good extenuating circumstances. It is not likely the Board would approve a use variance in this case due to the nature of this site and its proximity to single-family residences. Parking The applicant purports that there is enough parking for 10 to 12 vehicles for sale and 4 to 6 spaces for customer parking on-site. The Zoning Ordinance requires 3 spaces/service bay or 1/100 sq. ft. of gross floor area, whichever is greater, for auto service. For 1,000 sq. ft., a minimum of 10 parking spaces is required for Bayside Auto Service alone. The application states that the second floor will be used as office space. What is the square footage of this area? The Zoning Ordinance requires 1 space/300 sq. ft. of GFA of office space. It appears there is very limited parking on this site. On a recent site visit, all but a few available parking spaces were occupied. There may not be enough parking available for the proposed business and the current use of this building. To ensure there is an adequate number of parking spaces available, a 1 1 scaled parking plan showing the layout and dimensions of all parking spaces on this site needs to be provided. Groundwater The property is located within a WP Well Protection District. Motor vehicle cleaning, service and repair are prohibited in WP Districts. Is any cleaning of vehicles proposed for this site? What type of activity is proposed for the 1,000 sq. ft. bay? Comments: Staff recommends that a scaled plot plan of the property be provided showing the location, setbacks and dimensions of the existing building, the location and width of the curb cut and access drive, as well as the layout and dimensions of all the parking on-site. Parking calculations, drainage, the zoning classification and groundwater classification should also be shown on the site plan. Due to the proximity of residences to the west, staff recommends that a 6' high fence be shown on the site plan along the western boundary of the site to screen the view of the proposed use from these residences. Are there any signs proposed for this business? The location of any proposed signs should also be shown on the site plan. Local Comprehensive Plan The Hyannis Village Plan discourages expanding non-residential uses in residential districts. Policy 7.8 Maintain existing residential boundaries and restrict non-residential uses from encroaching into residential neighborhoods. Strategy 7.8.1 Remove the "use variance"from the residential districts. Allow only the uses which are compatible with residential uses, including home occupations.
