The site contains a one story automobile repair building of 3,738 sq.ft. addressed as 121 Route 28 and a 2 story residential structure of 2,104 sq.ft. living area. The applicant is seeking to remove the residential structure arld to utilize that lot as additional area for storage of vehicles. Improvements to the lot include paving, fencing, drainage, lighting and landscaping. The proposed improvements were reviewed and approved by Site Plan Review on July 6, 2000. The petitioners has requested a Special Permit for this proposal either as a: • Conditional Use in the Highway Business District-Section 3-3.6(3)(a) or • Change of a Nonconforming Use to Another Nonconforming Use- Residential Use to an Auto Storage Use-Section 4-4.5(1). Staff Review: It appears that either form of relief could be granted. The site is zoned HB Highway Business and residential use is not permitted within that district. According to the Assessor's Records the residential dwelling was built in 1930 and would predate the 1951 inception of Zoning in Hyannis. The legal pre-existing Nonconforming use is the single family residential use and the proposed new non-conforming use would be that of auto storage. However, staff would also remark that a Conditional Use Special Permit would be the easier form of relief. Under Section 3-3.6(3)(a)-Conditional Uses HB District, the applicant only needs to show that the use fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. A Special permit under Section 4-4.5(1)-Change of a Nonconforming Use to Another Nonconforming Use has a series of additional criteria that the applicant must address and substantiate to the Boards satisfaction (see attached Section 44.5(1)). Town of Barnstable-Planning Department-Staff Report Tracy Volkswagen - Appeal 2000-80 The property is located in the WP-Well Head Protection Overlay District. The applicant redesigned the drainage system utilizing a drainage swale to provide for a degree of natural filtration and removal of suspended solids prior to entering the man-made leaching system. This drainage concept is now recognized as the best known technology for handling surface run-off within the WP-Wellhead Protection Overlay District. Special Permit Findings: In addition to meeting those provisions cited above, two other findings are required regardless of the permit issued. They are; • that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, and, • that a site plan has been reviewed by the Site Plan Review Committee and found approvable. Suggested Conditions: If the Board should find to grant a permit, it may wish to consider the following conditions: 1. Development of the site shall be as proposed in a entitled "Proposed Parking Plan"drawn by Baxter, Nye and Holmgren Inc., prepared for We're Here Realty Trust, dated 05/31/00 revised date 6/29/00 Drawing Number CA 2. This permit is issued for only the storage of vehicles. There shall be no maintenance or washing of vehicles on this subject lot No. 162. 3. Lighting shall not exceed 18 feet in height and shall only be directed onto the site. No light shall be directed on to Cedar Street or Route 28. 4. Fencing shall not exceed 6 feet in height and shall not include the use of any razor or barb wire. 5. There shall be no unloading of vehicles on the Cedar Street nor on Route 28. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 14, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 13,2000 at which time -� the Board granted a Conditional Use Special Permit for an auto storage area with conditions. Board Members hearing this appeal were Gail Nightingale Jerry Gilmore, Richard Boy, Dan Creedon, and Chairman Ron Jansson. Attorney Bruce Gilmore represented the applicant before the Board. Mr. Gilmore presented the history of the site and explained the proposal to improve the site for the storage of up to 35 new automobiles. The neighboring site is used to maintain vehicle and body work however this site would not be used for that activity. Public Comment: Jeffrey Donadio and his mother Mrs Donadio, and Dr. and Mrs. William Johnson, voiced their concern for parked vehicles along Cedar Street causing conjestion and noise and the lighting of the parking lot. After discussion with the Board and Mr. Tracy, the Board requested staff report these conditions to the appropriate authority, and determined that the parking problem was not as a result of the applicants activities, but rather caused by a neighboring auto t1igiiiiII01 use. Findings of Fact: At the hearing of September 13, 2000 the Board unanimously found the following findings of fact as related to Appeal 2000-80: 1. In Appeal 2000-80, Tracy Volkswagen has requested a Special Permit pursuant to Section 3-3.6(3)(a) HB Highway Business District-Conditional Uses, or in the alternatives, a Special Permit pursuit to Section 4-4.5(1) Change of a Nonconforming Use to Another Nonconforming Use 2. The Petitioner's are Tracy Volkswagen and We're Here Realty. It turns out that Mr.Tracy has not talked to us about this project at all. He apparently talked to Bruce Gilmore who told him it would cost all of that. It generally takes one set of plans and one revision before a plan is approved by site plan. His problem will be that.due to extremely tight zoning language enacted by Planning two years ago having to do with non-conforming uses and structures, he will have to go to ZBA after site plan.This generally results in a project being delayed for a few months and also carrys with it the likelyhood that several plan revisions will also be requested by ZBA. Some of the handcuffing zoning enactments over the pasy few years have resulted in just about everyone having to go to the ZBA and have taken away the discretion that I as zoning enforcement officer use to have.We will talk to him as you request and get back to you. Ward ' 140 Cedar Street Hyannis, MA 02601 V 508-771-7257 January 19, 1995 ' Mrs. Connie Tracy 83 Blantyre Road Centerville, MA 02632 RE: Conditions at 140 Cedar Street, Hyannis Dear Mrs. Tracy: We have been experiencing quite a bit of difficulty with regards to the plumbing/construction in our apartment and feel you need to be aware of the problems. None of these problems have been rectified. To date, the bedroom wall and ceiling are both cut open,.as well as the ceiling in the corner of the kitchen. The wall in the kitchen has suffered serious water damage/staining from the leaks. The linoleum is coming up all around the wall. The carpet in the bedroom, which I already alerted you to has water stains. As soon as one leak has been fixed, another sprouts. This has been so awful for us. We have a piece of carpet which covers most of the kitchen floor which, has just been soaked " a from the leaks. Unfortunately, unless we were home at the time of the leaks we could not locate them to stick pots under each leak. When the carpet became so wet we were squishing water when we walked and our socks were soaked, we realized we had a much bigger problem. Sure enough, Saturday morning when we were home we experienced a rain storm in our kitchen and realized what was happening. It started off with the upstairs sink, moved to the shower, then the toilet and then back to the shower (according to the plumber). The wood in the ceiling (which is clearly exposed) is wet and rotting; you can see where it leaked on the walls, and the.linoleum around that area is all coming up. The plumber/contracter left the light switch dangling from the wall.from which the sheet rock was ripped down, and the thermostat which was left unbalanced between_ two pieces of wood, has to be adjusted in order for it to work. We also have a great deal of concern,with regards to the presence of lead paint. As you know, I work ' for the County Health and Human Service Department at Superior Court and was speaking with one of the agents about the effects of lead paint. It was brought to my attention that any renovations/work which involve cutting into the paint can be extremely hazardous to our health due to the lead dust and during such work we should not be residing in the house. This has made us very nervous. We have been given very specific cleaning instructions to prevent hazards from the dust and chips on the carpet and the walls to help prevent poisoning. There are very specific hazards involved with vacuuming up the dust and chips from the lead paint. We have received specific instructions not to vacuum as the dust will continue to be spread throughout your house each time it is vacuumed. We do not know if the plumber/contractor are aware of lead paint precautions, however,the last time the plumber was in, he used our vacuum to clean up the mess. This has been a major catastrophe. In addition, I have had to arrange to be out of my office for significant periods of time in order to be present at the house for the plumber/contractor to get in to do work. The last two days they did not even show as previously scheduled. The windows in that house are extremely drafty. We have bought shades to put in the windows (in the bedroom and kitchen) underneath the blinds you already have up to help prevent some of the draft. Unfortunately, it does not help very much. In the bedroom especially, we can feel a major draft and even with a shade in the window, we can still watch the blinds go back and forth. checked to make sure the storm windows were down and they are in place, however, one of them doesn't fit just right, is immovable and bows. It's awfully drafty. The livingroom is always freezing as only one of the heating vents is working. Unfortunately, at this time, we have been unable to afford to purchase shades for all the windows. The stove in the kitchen is not working right either. On the left side of the stove, the burners are constantly off. I need to light the main pilot on that side almost every night. After use, it goes out again and there is always a faint smell of gas. In the oven, the lining around the door inside is falling off, the door is always slightly ajar, which causes difficulty in the use of the oven�v As far as the water situation, hot water is scarce. The capacity of hot water is inadequate to provide sufficient hot water to cover the most basic needs. We realize there are 5 people living in this building, but we do believe there should be enough hot water. Hot water is not only used for showering, but for dishes and there is definitely not enough. In speaking with everyone, there are days when we haven't taken a shower or they haven't taken a shower and there is still not enough water to do dishes or for someone to take a shower if they so choose. This can be a terrible inconvenience especially when we are getting ready for work in the morning We both take pride in our home and our living conditions. We work really hard for our money, most of which gets paid to you for our rent. We realize that you are on vacation for the winter and have stated that you do not want to be bothered with issues concerning the problems constantly occurring at the house. However, the lack of timely and appropriate repairs has and will continue to contribute . to further damage occurring in the apartment. David Desruisseax, my co-habitator, was in the basement cleaning up the mess from the cesspool spillage and removing some of our items which had been damaged. On one of his trips down the basement stairs, one of the steps (2nd or 3`d from the bottom) broke completely in-half and he fell through to the floor hurting his neck and back. The exact extent of the injuries was not determined as he did not see a doctor, however, he has been experiencing both neck and back pain. He works for Willowbend in Mashpee in the Land Design division so we are hoping this will not impact his work as he is "out-in-the-field". I am also enclosing for your records a letter which we sent to the Tracys spelling out some of the problems with the property to which we never received a response. This letter was written a month after we moved in to the apartment. Since that time, the circumstances in the building have changed a bit (tenants), the problems have grown and new ones have arisen. We are somewhat nervous about calling her with regards to problems, as she always reverses the situation to make us feel like we are in the wrong or by threatening to "pass on the costs" or "up the ante".
