NOTICE OF ZONING VIOLATION
Notice of Zoning Ordinances Violation(s)and Order to Cease,Desist and Abate: 92 Barnstable Rd
LLC,Juliano S. Coutinho, and all persons having notice of this order. As owner/occupant of the
premises/structure located at 79 Center Street,Hyannis,MA 02601 Map 327 Parcel 065,you are
hereby notified that you are in violation of the Town of Barnstable Zoning Ordinances and are
ORDERED this date, September 14,2018,to:
1. CEASE AND DESIST IMMEDIATELY, all functions connected with this violation on or at
the above mentioned premises.
SUMMARY OF VIOLATION:
On Sept. 7, 2018,I observed an unpermitted parldng lot on the vacant lot at 79 Center St.
containing 4 unregistered vehicles and a large plow. The use of this property as a parking facility
(g or accessory parking lot is a violation of the Town of Barnstable Zoning Ordinances. The Hyannis
Village Business District under Chapter 240 Section 24.1.3 A prohibits any use not expressly
identified as a principal use 1 (a)—(w).
Current Zoning: Chapter 240 Section 24.1.3 -HVB Village Business District
2. SUMMARY OF ACTION TO ABATE:
Take immediate measures to remove and relocate all vehicles and equipment.
And, if aggrieved by this notice and order,you may file an appeal with the Town Clerk of
Barnstable, specifying the ground thereof within thirty(30)days of the receipt of this order(in
accordance with Chapter 40A Section 15 of the Massachusetts General Laws). If,at the expiration
of the time allowed, action to abate this violation has not commenced, further action as the law
requires will be taken.

• This approval is based upon the plans entitled,,"Proposed Renovations for Nauset Marine,Inc.,
92 Barnstable Road,Hyannis,MA:, Sheet and Job#SP1-327,dated April 10,2006; and SD-1
and SD-2, drainage and calculation plan dated 2-28-06,prepared by Conserve Group,Inc.,2277
State Road, Suite H,Plymouth,MA 02360.
• All landscaping, signage, lighting and other design information complies with the Design
Infrastructure Plan or as discussed and agreed with design consultants,Patty Daley and Kate
Kennen of the Growth Management Department and depicted on a revised site plan with
landscaping added, signed by Patty Daley and dated 4/10/06.
• Continued compliance with the hazardous materials and waste materials proposed and approved
by the Board of Health.
• Hazardous Materials and Waste Plan in compliance with the DIP will have to be filed in the

Today I spoke with Dawson Farber(and his consultant Roy at ConServe) regarding Nauset Marine.
As far as the DIP review, I have the following comments:
1) the project is all set with respect to stormwater drainage (no raingarden required)..
2) the project is all set with respect to hazardous materials as currently proposed (as approved by the Board of
Health, the site has adequate containment for outdoor storage and the proposed indoor storage was approved.)
In the event Nauset Marine applies to service boats/etc. on-site, a Hazardous Materials and Waste Plan will have
to be filed at that time. i
I understand from Roy that a new site plan showing all three portions of the lot will be,provided by Monday.
