Mr. Florence, Regarding your commitment or intent to act this week, I suggest you try to visit the residential Channel Point properties sometime after the work day has begun and then again,just after work(after 5:30) in the evening so you can see that the actual residential driveway @ 15 Channel Point Rd is vacant of cars in the day time, and tenants have returned after work.....and the driveway is full after working hours, as normal tenant cycle would be. However the spaces that are on the right of way marked.with a"tenant parking only signs" are actually used for employee (commercial) parking, and you will note that these spaces are full of cars in the day time (during working hours) and empty after working hours...just like employee spaces would be expected to be used. Problem is , these spaces are on residentially zoned land., Hy-Line does NOT have a special permit to park employee cars here. They have been using this residential property to park employee cars for years. They have been abusing the zoning and uses of this property for years. It is difficult for me to take accurate photos of this, since I would be trespassing on their property, which I will not do. Just to set a benchmark for you, I am attaching anaerial photo for you, taken in the mid 80's. In the center of the photo is "Lot 5". (dirt lot @ 266 Ocean St)This parcel was granted a special permit to park cars in 1984. It is a legal commercial parking lot. Note that.immediately north of this lot is a shelled surface "parking lot".with cars parked around its perimeter and in the center. (15 Channel Point Rd) This lot was NOT permitted to park cars. It is residentially zoned, and is the front yard of the residential house to its immediate left. The point is: upon receiving the special permit to park cars at 266 Ocean Street, Hy-Line immediately began to also park cars on the residential lot, until I complained.. The fact is that this parcel (15 Channel Point Rd)and the parcel next to it @ 23 Channel Point Rd are zoned.residential, and ever since Hy-Line purchased these properties, they have been using them for commercial purposes. Sometime they use them for commercial parking,sometimes for employee parking, sometime as office space, sometimes to store gear and luggage racks, etc. The also use them for commercial signage. It's hard for them to deny this. I will send more photos in another email. Both properties are residential in a residential zone. Note the new signs in front of 23 Channel Point which say"15 min parking". If this property was conforming to"a residential use, why would it say 15 min.parking?? They used to say"No Parking". The driveway&basement of this property are now and have always been used for commercial use. Note:the spaces in question on 15 Channel PointRdproperty have signs posted that say Tenant Parking only. But that's not true. It's a lie. It's all a deception.The cars that park there are clearly employee parking.They show up between 8- 8:30 in the morning and they leave between 4-4:30.Spaces are empty all night. I can see people parking there &walking to work. I believe the person u probably spoke to was Marty DeMartino???? FYI: I have lived in my house since 1953. 1 have owned the house since 1979. My presence here pre-dates Hy-Line. Mr Scudder( Dick) used to b my bus.driver in elementary school. I went to school w these guys. I have witnessed their zoning abuses over the years. I know first hand of.the use abuses of 23 Channel Point since they moved the house there from Nantucket St. because my(now) husband used to rent the property from them in the 80's. I thank u for looking into these issues. I'm sure it isn't easy, seeing who the property owners are...but that shouldn't matter. Just to clarify,there were multiple complaints issued by me re: 15 Channel Point Rd &23 Channel Point Rd. They include: commercial parking(employee)on residential property. (Both properties) Commercial use of basement of 23 Channel Point Rd and 15 Channel Point Rd. Both properties are residential in a residential zone. Note the new signs in front of 23 Channel Point which say"15 min parking". If this property was conforming to a residential use,why would it say 15 min parking?? , They used to say"No Parking". The driveway& basement of this property are now and have always been used for commercial Use. Note:.the spaces in question on 15 Channel Point Rd property have signs posted that say Tenant Parking only. But that's not true. It's a lie. It's all a deception.The cars that park there are clearly employee parking.They show up.between 8- 8:30 in the morning and they leave between 4-4:30.Spaces are empty all night. I can see people parking there &walking to work., believe the person u probably spoke to was Marty DeMartino???? FYI: I have lived in my house since 1953. 1 have owned the house since 1979. My presence here pre-dates Hy-Line.Mr Scudder( Dick) used to b my bus driver in elementary school. I went to school w these guys. I have witnessed their zoning abuses over the years. I know first hand of the use abuses of 23 Channel Point since they moved the house there from Nantucket St. because my(now) husband used to rent the property from them in the 80's. Said Scudder family owns and operates the Hy-Line Cruises and Hyannis Harbor Tours out of Hyannis Harbor. 4. Lot 104 is located within a residential zoning district. (See Zoning Map, Town of Barnstable) 5. Approximately one and one-half years ago, Fred("Skip") Scudder related to me in a conversation that the residential use on said Lot 104 was not desirable. The property had been run as an illegal multiple family residential unit for several years before Town Building Inspector Joseph Daluz shut it down. 6. Fred Scudder went on to tell me that the property was going to be converted for use as an office by David Scudder, a relative and employee of Hy-Line Cruises and/or Hyannis Harbor Tours. Recently,the Scudders have applied to the Conservation Commission to add on a three- bay garage believed to be for uses incidental to the family business (es) including storage of . materials and parking of company vehicles. 7. Since the Summer of 1995, 1 have personally viewed the activities taking place on said Lot 104 on an almost daily basis. 8. For well over a year, the property has been run as and generally referred to as David Scudder's office. 9. A company vehicle bearing the name of the family business "Hy-Line Cruises" is parked in the driveway of said Lot 104 each day of the business week, and seven(7) days a week during the Summer season. There have been several parking spaces delineated on the subject parcel which have been used for the parking of company vehicles. Two (2) of these spaces have signage specifically limiting their use to Hy-Line vehicles. 10. In the evenings and on the off-season weekends,the property is not inhabited. There are not lights on in the building during these times, nor are there any vehicles, except for company vehicles, parked at the location. 11. For the past two (2) Summers, a commercial dumpster has been brought to the said Lot 104 and placed next to the building, at the end of the driveway. I have personally seen employees of Hy-Line Cruises/Hyannis Harbor Tours make use of the dumpster to discard what appears to be trash of the business. 12. When the dumpsters are not in use,the area at the end of the driveway has been used for the outside storage of parking signage and cones. 13. It has recently come to my attention that the Scudders have submitted building plans for the construction of a three-bay garage on the subject property to the Conservation Commission. An application to the Building Commissioner,Ralph Crossen, should follow shortly after a scheduled Conservation Commission hearing on November It 1996. 14. I strongly oppose the present use of the residentially-zoned property as an office incidental to a commercial activity. The only plausible explanation for the Scudder's application for a three-bay garage is that said garage is intended for business use or for use incidental to the present business use. The building permit application should be denied. 15. If a Building Permit is issued for the construction of said garage structure, I will appeal its issuance to the Zoning Board of Appeals. I don't believe that the use of the proposed garage will be an accessory use to the property, which again, is zoned for single family use only. Hyannis Harbor Tours has consistently"stretched"their privileges and rights over the years in this neighborhood. For example: the parking lot on Ocean Street(former sight of the Landing): a variance was sought for the purpose of parking cars for the Pilgrim Belle, the cruise ship. They explicitly stated that this would be used for only 60 cars, and only biweekly for the Cruise ship. That there would not be"daily"usage of the lot. The Pilgrim Belle is long gone, and this is now their primary parking lot,used seven days a week, from 7:00 a.m. `til after the 10:00 boat in season...They also parked at least 40 cars on the adjacent residential property over July 4th weekend. (yes, I have pictures)... They have a commercial dumpster in the driveway of 23 Channel Point Road, which they use daily in season(clearly not for residential, single family usage)... And they have used this same property for every reason other than the one it is zoned for, with the exception of the first year or so it was moved there. I appeal to you, as Building Inspector,to help the neighborhood preserve its integrity. I cannot bear the thought that my house will be once again devalued because they are trying to run a commercial business in a residential zone.
