Last month after reviewing the plans for the new Hy-Line terminal,Mr. DeMartino asked
me if I would object to the.company using'the residential property next door to me at 23
Channel Point Road as temporarNffices during the construction.
It is my understanding that this use would exist for a period starting this month and
ending no later than May 30, 1998. The house would serve as three temporary offices
with hours of operation from 8 AM to 5 PM,Monday through Friday.
As long as these guidelines are adhered to and meet with your approval,I have no
objection to Hy-Lines request for temporary usage of this residential property.

The Petitioner, M. Virginia Ray, has appealed to the Board of Appeals from
a decision of the Building Inspector andpetitions for a variance from Section
I 1 Use Regulations - Residence Districts, Barnstable Zoning By-Law as revised
April 2, 1975, to allow conversion of existing residence and lodging house to
residence and three apartments at 33 Channel Point Road., Hyannis in an RB
Zoning District.
Attorney Stephen C. Jones of Hyannis represented Petitioner. Through.
circumstances and foreclosure on a first mortgage on which Petitioner held
the second mortgage; Petitioner found herself forced to purchase locus after
previous owner had removed illegal apartments of long-standing. -Petitioner
has now moved to locus and has attempted to rent the former apartments as
rooms, as permitted by the zoning by-Law. However, Petitioner finds a
financial hardship in an inability to rent this space as rooms. on a permanent
and ecomonically feasible basis. In addition, to allow conversion to three
apartments would not be detrimental to an area already heavily commercial
in nature (although residentially zoned) as it abutts the boatline ticket
office and is near several restaurants. In addition, Petitioner will live at
locus in a fourth unit, and, , thus will eliminate the previous absentee landlord`
problems. There is little di$erence in a rooming house of six lodgers and a
• owner on premises house with three apartments.
Opposition was based on detriment to an area which the residents have fo-_t ; t
hard to. maintain as' residential and that -this is not permitted by the by-law..
The Board found that there was no hardship as defined in Chapter 40A of the
Massachusetts General Laws ter, ed. as amended in as much as Petitioner wasaware of the zoning at the time of purchase and locus as restored to its
single. family status can be used as such. Therdore, the Board found that to
grant this 'variance would be in derogation of the Barnstable Zoning By-Law
as well as detrimental to the area involved_ and voted unanimously to deny-
this application for variance.
