The current exemption for `homeowners include dwellings was extended to clude owner-oc of si
x units or less and to allow
homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or.is intended to be,a one or two-
family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one
home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form
acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit.. (Section
109.1.1)
The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,
bylaws,rules and regulations.
The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection
procedures and requirements and that he/she will comply with said procedures and requirements.

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code
Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt
from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner
engages a person(s)for hire to do such work,that such Homeowner shall-act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor
(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often
results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot
proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is
ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the

I visited the subject property on Friday August 7th, 2015, and found that a rear door that had been boarded
up was compromised. The plywood panel has been ripped in half allowing access to the house. Please be
advised that the Barnstable Police were called and responded. This property must be secured today.
There is a significant amount of trash on the front yard also. Maybe the person that is sent out can do a

I am not sure if you can be of help on this one. Safeguard Properties apparently has had this property for some time? It is
not registered with the Town of Barnstable and is a very dangerous property. It appears that another break in has
occurred and the Town of Barnstable Police Department has notified this department this morning of a potential life safety
issue there. I need to either speak to someone today, before 4:30 PM eastern time, or the process will be started ASAP to
secure the property at the banks expense. This process will be more costly than having someone do it for you today. In
addition it must be brought into compliance with The Town of Barnstable General Ordinance 224. Non compliance will
result in further action.
I understand the the Barnstable Police have been in touch with a Julie at Safeguard, ext. 3431 today and the answer that
they were given is not acceptable.
Please, if you cannot do anything about this property, notify me immediately with the person that can, so that the Town of

I'm not sure when the contractor was at this address but expect that there was a fairly sound snow cover present.
I visited the site on Friday, March 27, 2015 late in the day and observed the following:
1.) It appears that the building is secure. It also appears that attempts have been made to breach the security
(bulkhead, some window/door panels, garage door) but have not been successful.
2.) There is still debris around the structure and the mattresses, etc. are still present in the back yard.
The property has some snow cover around it and it might be better to delay another clean up until that snow has
melted. That way your contractor will be able to remove all of the debris with one visit.

and cans, paper and plastic, etc that will interfere with the mowing of the yard. I presume that whomever the
Bank has contracted with to perform that service will dispose of this before they mow.
3.) The plywood panels over the doors, windows and bulkhead appear to be showing some wear from people
trying to pry them off to gain entry. There are areas where additional fasteners should be used to prevent
the removal of the panels. Some have been cracked and are loose. It is unknown at this time if
the attempts at gaining entry have been successful. It would be helpful if more fasteners are added soon.
