compenMassachusetts General Laws chapter 152 section 25 requires all employers to provide workers'

the foregoing engaged in a joint enterprise, and including the legal representatives of a decease employer,
trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a
three apartments and who resides therein, or the occupant of the dwelling house of
dwelling house having not more than p �grounds or
another who employs persons to do maintenance, construction or repair work on such dwelling house or on
building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal
of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neitherthe
commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until
insurance of this chapter have been presented to the contracting
acceptable evidence of compliance with the requirements -
authority. ' /

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or
less and to allow homeowners to engage an individual for hire who does not possess a license,provided that
the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is
intended to be, a one or two-family dwelling,attached or detached structures accessory to such use and/or
farm structures. A person who constructs more than one home in a two-year period shall not be considered
a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the
Building Official,that he/she shall be responsible for all such work performed under the building permit.

with the State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a
person(s)for hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see
Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in
serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the
unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit
application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a
form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community.

Applicant's Request: Section 4-4.2 Change from one Non-Conforming Use to Another.
Activity Request: The applicant is proposing to divide an undersized lot upon which exist two
structures and to rebuild the second structure in another location on the new lot.
Procedural Provisions: 5-3.3 Special Permit Provisions.
Background:
The lot,located on the east side of Chase Street is 0.55 acres,and contains two single-family dwellings
The principal dwelling is 1 1/2 stories and contains 1,860 sq.ft.of gross area and second structure is 1
story with 540 sq.ft. of gross area and is damaged by fire. Records indicate that the structures were built
in 1940.
According to the"Plan of Land in Hyannis,Ma.prepared for Tim Luff'by Yankee Survey Consultants,
Marston Mills,MA dated July 7, 1994(Rev:Aug 30, 1994)and submitted with the application,the
Parcel is divided into a north-west corner Lot l(of 0.24 acres) and south east portion Lot 2(0.34 acres).
This Plan has been endorsed by the Planning Board as an Approval Not Required(ANR)Plan on
September 12, 1994.
Procedural Summary:
The application was filed with the Town Clerk and with the Zoning Board of Appeals Offices on August
29, 1994. A public Hearing duly noticed under Ch.40A was opened and closed on October 5, 1994. The
appeal was and continued to October 19, 1994 for the Board to review the site and testimony given. At
the continuance the Board decided to deny this petition. Board Members sitting on this appeal were Rob
Thorne,Ron Jansson,Emmett Glynn,Dexter Bliss and Chairman Gail Nightingale. This appeal was
heard concurrently with Appeal No. 1994-84 for a variance to the Minimum Lot Size required for the
district.
Attorney Ford representing Timothy Luff submitted a memorandum that addresses both Appeal No.s
1994-84 and 85. The proposal was to relocate a burned out cottage onto its own.separate lot created by
Decision and Notice 19940 •

the division of the present single lot that exists and contains both structure. He submitted a Planning
Board signed ANR plan for the creation of the two lots and stated that it was approved in accordance with
M.G.L. Chapter 41 Section 81L as a plan not requiring approval of the Planning Board. Attorney Ford
described the relief sought as seeks to rebuild and relocate this cottage out to the front,on to Chase Street,
of newly created lot and that the two lots created by the Planning Board ANR be considered buildable.
Attorney Ford summary of the facts as he saw applicable in this case. He noted that the site addressed as
140 Chase Street contains two separate houses existing since the 1940's. At present one is a single-family
dwelling and the other is a burned out cottage.The cottage was a four room structure,having two
bedrooms,combination kitchen/living room with a full bath. Real Estate tax evaluation sheets provides
evidence of history of the buildings pre-dating zoning in Hyannis(1952)and that the Certified Plot Plan
documented the existence of two structures. The cottage was built in 1938,tax records establish it back to
1948 and the year round usage started in 1986.
In addressing the special permit criteria to allow the cottage structure to be moved and altered,the
proposed new structure would comply with all setbacks,would have better access,would be upgraded to a
Title V septic system that would be a benefit to the neighborhood. The increase in size of the cottage from
540 sq.ft. to 864 sq.ft.would still have only two bedrooms,a dining and living room and a kitchen. The
house and cottage will be upgraded to Title V. The new lots are in keeping with the neighborhood in size.
The public was asked to comment on the proposal. In opposition was Irene Almer and James Alves,
citing the history of problems in the buildings caused by over-crowding,renting of the structures and the
lack of on-site supervision.Len Gobiel submitted photographs of the cottage in disrepair before the fire.
Attorney Ford said it is important to keep perspective,rebuilding the cottage would be an improvement to
what is there now. If the property sells then the residential quality of neighborhood could be improved by
a permanent individual resident.
It was determined by the Board to close the hearing on this appeal and to continue its discussion to
October 19, 1994 to provide the Board with time to view the property and neighborhood and to review
materials submitted.
Findings:
At the meeting of October 19, 1994,the Board proposed the following findings of facts as it relates to
Appeal No. 1994-85.
1. There is not sufficient evidence presented to establish a non-conforming use exists in the cottage
structure or on the site.
2. The building in question,the cottage is an accessory building to the single family dwelling and
use of the property.
3. If a non-conforming use special permit were granted it would increase the intensity of the
existing permitted uses by creating a buildable second lot.
4. There has been numerous complaints of neighbors as to conduct and activities occurring at this
location and they are opposed to the plan.
5. The appeal if granted would be substantially detrimental to the neighborhood.
The vote was as follows:
AYE:Emmett Glynn,Ron Jansson,Rob Thorne and Chairman Gail Nightingale.
