Upon visiting the premises we spoke with the tenants and entered the premises . The house is ' a two story Cape which has been recently converted to a duplex. One section of the first floor and the entire second floor is occupied by one tenant while the second tenant occupies approximately. half the first floor. The basement is shared . As the documents show, Mr. and Mrs. Cataldo acquired Lot 3 on October 7 , 1950 and did not acquire Lots 4 and 5 with the 1 1/2 story woodframe dwelling until March 28, 1960 . Although the properties remained in common ownership from 1960 there existed two independent buildings thereon and the situation would seem to be governed by c. 41 § 81L.
