Information and Instructions
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from the"law", an employee is defined as every person in the service of another under any contract
of hire, express or implied, oral or written.
An employer is defined as an individual,partnership, association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or
trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a .
dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of
another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or
building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal
.of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the
commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until
acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting
authority.
Applicants
Please fill in the workers' compensation affidavit completely,by checking the box that applies to your situation and
supplying company names,address and phone numbers along with a certificate of insurance as all affidavits may be
submitted to the Department of Industrial Accidents for confirmation of insurance coverage. Also be sure to sign and
date the affidavit. The affidavit should be returned to the city or town that the application for the permit or license is
being requested, not the Department of Industrial Accidents. Should you have any questions regarding the"law"or if you
are required to obtain a workers' compensation policy,please call the Department at the number listed below.

Background:
The property that is the subject of this appeal is a 0.19 acre lot improved with a two story 3,072 sq. ft.
dwelling. It is serviced by public sewer and water. The building is currently being used as a multi-family
dwelling. The property is located in an RB Residential B Zoning District,which only allows single-family
residential dwellings as-of-right. The current use of the property is in violation of the Town's Zoning
Ordinance. This violation has existed since the previous owner, Michael Finn. A review of ZBA records
indicates that no Special Permit or Variance was ever approved to allow either a two-family or multiple-
family dwelling on the subject site. This case is pending an outcome in District Court.
To legitimize the current use of the property, the applicant is applying for a Special Permit pursuant to
Section 3-1.1(3)(A)of the Zoning Ordinance to permit the renting of rooms to no more than 6 lodgers in
one multiple-unit dwelling. The renting of rooms to no more than 6 lodgers in one multiple-unit dwelling is
permitted as a conditional use in the RB District provided a Special Permit is first approved by the Zoning
Board of Appeals.
Zoning History:
According to Assessor's records, the building was constructed around 1962. In 1962,the property was
zoned RA-1 Residential A-1 Zoning District. The 1962 Zoning By-law allowed as-of-right detached one-
family dwellings or two-family dwellings if authorized by the Zoning Board of Appeals, and the taking of
not more than 6 lodgers by a family resident in the dwelling. In April of 1972,this area was rezoned to an
RB Residential B Zoning District. The permitted uses became detached one-family dwellings and the
renting of rooms for not more than 6 lodgers by a family resident in the dwelling.
In November of 1987, the number of rooms rentable to non-family members as an accessory use to
single-family dwellings was reduced from six(6)to three(3)in RB, RD-1, RF-2, RC-1 and RF Districts
(ATM 11/7/87,Art. 12). Assessor's records indicate that the use of this dwelling as a rooming house was
picked up in July of 1992.
Procedural Summary:This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April
8, 1998. An extension of time to file the decision was executed by the applicant and Board Chairman. A

Standing:
The latest assessor's records, dated 07/09/95, show the owner of the property to be Michael Finn. The
petitioner's application states that Jodi Becal has owned the property for approximately 2 years. Staff
suggests the applicant provide the Board with a copy of the deed to show standing.
Background:
The property that is the subject of this appeal is a 0.19 acre lot improved with a two story 3,072 sq. ft.
dwelling. It is serviced by public sewer and water. The building is currently being used as a multi-family
dwelling. The property is located in an RB Residential B Zoning District,which only allows single-family
residential dwellings as-of-right. The current use of the property is in violation of the Town's Zoning
Ordinance. This violation has existed since the previous owner, Michael Finn. A review of ZBA records
indicates that no Special Permit or Variance was ever approved to allow either a two-family or multiple-
family dwelling on the subject site. The Board should be aware that this case is pending an outcome in
District Court.
To legitimize the current use of the property, the applicant is applying for a Special Permit pursuant to
Section 3-1.1(3)(A)of the Zoning Ordinance to permit the renting of rooms to no more than 6 lodgers in
one multiple-unit dwelling. The renting of rooms to no more than 6 lodgers in one multiple-unit dwelling is
permitted as a conditional use in the RB District provided a Special Permit is first approved by the Zoning
Board of Appeals.
Zoning History:
According to Assessor's records, the building was constructed around 1962. In 1962, the property was
zoned RA-1 Residential A-1 Zoning District. The 1962 Zoning By-law allowed as-of-right detached one-
family dwellings or two-family dwellings if authorized by the Zoning Board of Appeals, and the taking of
not more than 6 lodgers by a family resident in the dwelling. In April of.1972, this area was rezoned to an
RB Residential B Zoning District. The permitted uses became detached one-family dwellings and the
renting of rooms for not more than 6 lodgers by a family resident in the dwelling.

Special Permit Pursuant to Section 3-1.1(3)(A)-Conditional Uses in RB District
In November of 1987, the number of rooms rentable to non-family members as an accessory use to
single-family dwellings was reduced from six(6)to three(3) in RB, RD-1, RF-2, RC-1 and RF Districts
(ATM 11/7/87, Art. 12). The applicant's attorney, Pat Butler, has looked into whether the resent use is a
pre-existing nonconforming use but was unable to prove any use other than single-family . Assessor's
records indicate that the use of this dwelling as a rooming house was picked up in July of 1992.
Staff Review/Comments:
The subject property has had several complaints in the last few years. On 12/09/96, an inspection of the
premises was completed by the Building Division (see attached Inspection Correction Notice). During this
inspection it was noted that up to 9 separate rentals may exist in this dwelling. It was also noted that the
units are all bedrooms with a common bath, kitchen and living room. Assessor's records lists the building
as having a total of 10 rooms, 6 of those being bedrooms. Staff suggests the applicant submit a floor plan
of the premises to the Board to clarify the number and types of rooms in the building.
The building currently has two separate kitchens, making this a two-family dwelling with a multi-family
use. In order to be in compliance with the Zoning Ordinance, one of the kitchens would have to be
removed. Staff recommends the Board condition the removal of one of the existing kitchens if the
requested relief is granted.
Parking
There is an existing gravel parking area in the front of this residence. It appears there is enough space for
5 or 6 cars in this area. For lodging houses, the Zoning Ordinance requires 1.2 parking spaces per
bedroom. A total of 8 spaces are required for 6 guest rooms. There doesn't appear to be enough room
for 8 parking spaces in the front yard. However, there is additional space in the applicant's rear yard.
Neighboring Land Uses
The property is surrounded by single-family homes on all sides. There is an existing wooden fence along
the western lot line that helps screen the parking area from the residence on the adjacent lot to the west.
Trees and shrubs are located along the eastern side of the property which helps to screen the parking
area from the residence to the east.
Special Permit Findings:
The standards for granting a special permit require the following findings of fact to be made by the Board
(Section 5-3.3(2)):
• that the application falls within a category specifically excepted in the ordinance for a grant of a
Special Permit, (the renting of rooms to no more than 6 lodgers in 1 multiple-unit dwelling is a
Conditional Use allowed by a Special Permit pursuant to Section 3-1.1(3)(A) of the Zoning
Ordinance),
• that a site plan has been reviewed and found approvable in accordance with Section 4-7 (detached
single-family and two-family dwellings are exempt from this section of the Zoning Ordinance), and,
• that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the
Zoning Ordinance and would not represent a substantial detriment to the public good or the
neighborhood affected.

1. The property shall be converted to a single-family residence by removing one of the two kitchens that
exist in this dwelling.
2. A total of 8 off-street parking spaces shall be provided on the property.
3. A minimum 5 foot high wooden fence shall be continually maintained along the western property line
to screen the parking area from the residence to the west. Dense plantings not less than 5 feet in
height shall be continually maintained along the eastern portion of the property to screen the parking
area from the residence to the east.
4. The dwelling shall be the primary year-round residence of the property owner.
5. One non-illuminated sign not to exceed 4 sq. ft, in area shall be permitted on the property to identify it
as a lodging house.
6. All requirements of the Health and Building Division, and Hyannis Fire Department must be met. The
applicant shall also obtain a Lodging House License from Consumer Affairs.
7. This special permit shall not be transferable to a subsequent property owner.

Pursuant to our meeting on April 2, 1998,I expect that by Sunday,April 5, 1998,all water craft in your
yard at 34 Circuit Avenue will be permanently removed.
The current Court Case against you for the illegal two-family use is still on-going. If you agree to modify
the current use and bring it into a conforming status,we will drop all charges.
In order to do this,you would need to restore the premises to a single-family home with a single kitchen.
You could rent out rooms to up to three(3)lodgers or boarders. Prior to taking any action,you will need
to submit plans so that we can agree on your approach.

dampers in the oil hot water heater(CO2 gas)and a lack of windows in this room as well as to two bedrooms used
by children.
Before I can order these repaired,the use of the building must be changed to a conforming single family use. In
order to do this,you MUST: ,
1) empty the basement apartment of all people
2) move into the upstairs and BLOCK off the door opening to the basement
3) evict all third floor tenants except for three(3)people
4) open basement windows to ventilate basement
Once the above is completed,I will order the unsafe situations repaired. You must notify me that the above have
been complied with so that I may inspect the premises.
If your tenants refuse to vacate the structure or you refuse to vacate the basement,I will be forced to take police
action against you.
Please understand that this action,while severe, is being taken in your best interest as it is for your tenants. I regret

I was called to the property at 2:45 pm at the request of Ralph Crossen,Barnstable Building Commissioner
and the Hyannis Fire Chief. Following are my observations:
The greatest bum damage was in the vicinity of the basement hall closet area containing ammunition. The
floor above was unsafe due to heavy fire damage to the floor joists which were burned through for
approximately six feet(6')above the closet. At 3:15 pm Mr.James Rogers,Fire Investigator,was on the
scene along with a State Trooper from the State Fire Marshall's Office. I then assisted them in a portion of
their investigation in the basement area. During this time,Mr.Becal was at the property answering
questions asked by the Investigators.
At one point Mr.Rogers asked Mr.Becal if any electrical work had been done on the property either by
himself or others. Mr.Becal answered"never". The State Trooper later told me that Mr.Becal had told
him the day prior that both electrical and plumbing had been done by Mr.Becal which contradicts the
answer given to Mr.Rogers.
Mr.Becal stated to Mr.Rogers that he first observed an orange glow at approximately 3:50 am from the
left side,second floor area window,outdoors at the front of the house. He then woke up his sleeping wife

and others on the second floor and then he went to the basement to wake up the tenant in the rear left
bedroom. He stated that he saw no fire at that time but that he did smell smoke.
I then left Mr.Rogers with Mr.Becal to investigate the fire scene.
Two observations were made
1) Electrical wiring violations written in my report dated June 8, 1998 for recent electrical
work installed without a permit had not been corrected,nor has application been made
for a permit.
2) Recent electrical work to the rear right room had been installed. Coils of wire and other
electrical equipment were in the living room as was also noted by Mr.Crossen. A
portion of the wall board had been recently installed and was taped but not finished. This
area is believed to be an area designated for the installation of a hot tub to be relocated
from the basement. All visual inspections indicate that this work had been done by an
experienced person in the electrical field. Newly installed plumbing was also observed
and noted.
My investigation was completed for the day at 5:50 pm at which time the fire investigators finished for the
day also. To the best of my knowledge,the investigators had not completed their investigation and any
cause had not yet been determined. I have entered the date of both inspections in the computer.

Information and Instructions to
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from the "law", an employee is defined as every person in the service of another under any contr,.c,
of hire, express or implied, oral or written.
An employer is defined as an individual, partnership; association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receive, c-
trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a
dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of
another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or
building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal
of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the
commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until
acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting
authority. ,

Please fill in the workers' compensation affidavit completely, by checking the box that applies to your situation and
supplying company names, address and phone numbers along with a certificate of insurance as all affidavits may be
submitted to the Department of Industrial Accidents for confirmation of insurance coverage. Also be sure to sign and
date the affidavit. The affidavit should be returned to the city or town that the application for the permit or license is
being requested, not the Department of Industrial Accidents. Should you have any questions regarding the"law"or if you
are required to obtain a workers' compensation policy,please call the Department at the number listed below.

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less
and to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner
acts as su ep rvisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under the building4jermit. (Section 109.1.1)

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the
State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for
hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,
particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would
with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used
by several towns. You may care to amend and adopt such a fomi/certification for use in your community.

completed my title examination and factual history investigation concerning this property and
have:also spoken with the owners. In addition, this office has conducted a site visit and
interviews of surrounding neighbors concerning the history of the property.
Based upon the foregoing, I will be preparing for you a memorandum outlining our
interpretation of the factual history as it relates to the nonconforming nature of the use. I
anticipate completion of that correspondence in the next two to three business days. Upon
your receipt of that correspondence we can meet to discuss whether or not relief is

This correspondence is forwarded to you with reference to the above property. Please
be advised that this office has been conducting an ongoing investigation regarding the status
of this property with reference to the zoning ordinances of the Town of Barnstable. In
particular, we have been attempting to determine the grandfathered status of the use of the
property as a multi-family dwelling.
In this regard, we have conducted inspections of the records of the Town of
Barnstable Building Commissioner's office, the Assessors' office and the records of the
Barnstable County Registry of Deeds.
As I previously have advised the Building Commissioner's office, we have spoken
with several of the prior property owners and attorneys representing prior owners or prior
mortgagees. We have been diligently involved in the process of obtaining notarized
affidavits concerning the prior use of the property as a multi-family dwelling.
More importantly, however, is that recent investigation has determined that there may
be records generated by Home Federal Savings and Loan Association of Worcester which
may be relevant to the determinations under discussion. In particular, appraisal and site
visits by the mortgagee bank's representatives may be relevant. Home Federal Savings is no
longer in existence, and we believe the records are in the possession of the Federal Deposit
Insurance Corporation and possibly the Bank of Boston. We have had discussions.with the
FDIC and are continuing to pursue these records.

.As I have previously indicated to the Building Commissioner, it is my intention to file
a formal memorandum on behalf of the owner with him, together with the affidavits
referenced above and the additional information obtained from the mortgagee bank. I would
then seek a decision from him regarding the grandfather nature of the property which, if
adverse to my clients, I would appeal to the Zoning Board of Appeals. At the same time, I
would file a petition for special permit and/or variance based upon the relevant statutory
factors.
While this matter has taken a substantial period of time, we are diligently proceeding
to obtain the information. If necessary, I am prepared to immediately file a preliminary
memorandum with the Building Commissioner, pending receipt of the information from the
FDIC. In addition, my clients are prepared to immediately address any licensure or Board of
Health issues which may be outstanding at this juncture.
I would be happy to meet with you to discuss this matter more specifically and to
allow you to review the materials presently in hand.

AFFIDAVIT
The following affidavit is recorded with the Barnstable County Registry of Deeds
pursuant to Massachusetts General Law Chapter 183, Section 5B.
1. My name is Patrick Butler and I am an attorney licensed to practice in the
Commonwealth of Massachusetts with offices in Hyannis, Massachusetts.
2. I record this affidavit in accordance with the provisions of Massachusetts
General Law Chapter 183, Section 5(B), with regard to the property located at
34 Circuit Avenue, Hyannis, Massachusetts, which property is more
specifically described in a deed recorded with the Barnstable County Registry
of Deeds in Book 10305, Page 163.
3. This office has conducted extensive research with reference to the records of
the Town of Barnstable and information from prior owners of the property
regarding the use of the structure, and more specifically, the construction of an
apartment and related kitchen and bathroom facilities in the basement of the
property.
4. Based upon information obtained from prior owners of the property, it was
confirmed that there existed a basement apartment containing two (2)
bedrooms, 1 1/2 baths, living room with a large stone fireplace and a full
kitchen including sink, refrigerator and stove constructed at some point in time
prior to 1976. Attached herewith as Exhibit A are Affidavits of Kenneth F.
Komenda, Trustee of Closers Realty Trust and Jean E. Manoog confirming the
existence and utilization of the downstairs apartment as described above from
1976.
5. On or about August 8, 1998, the Building Commissioner of the Town of
Barnstable issued an enforcement notice whereby he deemed the use of the
downstairs apartment as a separate dwelling to be a violation of the Zoning
Ordinances of the Town of Barnstable. In response, copies of the above-
referenced Affidavits were provided to the Building Commissioner, together
with other documentation confirming the existence of the apartment since
1976. While the Assessors' records of the Town of Barnstable confirmed a
basement apartment, a thorough review of the records of the Building
Department did not disclose the existence of the building permit for the
construction of the apartment.
6. On August 12, 1998, the Building Commissioner confirmed that he could not
compel removal of the downstairs apartment in conformance with
Massachusetts General Laws, Chapter 40A, §7, but that the use of the
apartment was not allowed.
7. Based upon the foregoing, the property owner and the Building Commissioner
entered into a letter agreement dated November 23, 1998 which confirmed that
the property owner, Jodi Becal, had agreed to waive her rights to any
utilization of the above-referenced property as a two family dwelling, subject
to her right to utilize the dwelling in accordance with Section 3-1.4(2)(a) of the
Barnstable Zoning Ordinances for lodging of up to three non-family members
within the dwelling. Further, it was agreed that the configuration of the
basement would remain, consistent with such use.
8. In accordance with the terms and provisions of that letter agreement, this
Affidavit is filed.

The undersigned, Kenneth F. Komenda, on oath says and deposes as follows
1. My name is Kenneth F. Komenda and I served as a trustee of Closers Realty Trust
under Declaration of Trust dated June 11, 1986.
2. In my capacity as trustee, I took title to and was the owner of record in my capacity
as trustee of the property located at 34 Circuit Avenue, Hyannis, Massachusetts,
which property is also shown as Parcel 88 on Barnstable Assessors' Sheet 324.
3. At the time of our purchase of the property on June 9, 1986, the property consisted of
a single structure containing two separate, multi-family residences. These consisted
of a basement apartment containing two bedrooms, one and one-half baths, living
room with large stone fireplace and a full kitchen, including sink, refrigerator and
stove.
4. The remainder of the house consisting of the main floor and„the upper floor consisted
of a kitchen with washer and dryer, bathroom and two living rooms on the main floor

Pursuant to a requested inspection at 34 Circuit Avenue by the owner's attorney, my
electrical inspector,my plumbing inspector and I went through the house to try to
determine uses and specifically the age of these uses. It was immediately apparent that
the house is equipped with two full kitchens; one in the basement and one on the first
floor. Other observations surfaced as well.
First and foremost it is obvious that a lot of work has been done without permits inside
this house. This work includes electrical, plumbing, insulation and of course the actual
installation of the illegal apartment around 1983. From a zoning standpoint it is actually
zoned for single-family use. There have never been any special permits or variances at
this address; and therefore, from our perspective the use of that basement apartment by a
second family is illegal. The State Zoning Act 40a says I am not allowed to seek the
removal after 10 years of construction without a permit, but it says nothing about the use
of that space. We are,therefore, only agreeable to not seek the removal of the unit in the
basement; however,we will pursue the rooming house non-use as well as the two-family
non-use.
Historically this structure has been a thorn in our side as long as I have been the Building
Commissioner(1994) in Barnstable. During the summer of 1994 the address was the site
of a BIRST raid due to the illegal rental of rooms and an illegal kitchen. We have been
pursuing compliance ever since then; however, many delays occurred along the way.
Finally,we are close to a day of reckoning both in the court as well as the Zoning Board
of appeals.

Today's visit uncovered numerous other violations that amount to building code issues
that are public safety concerns:
1. We found unsafe wiring in numerous areas including hanging wires from both
switches and from overhead receptacles.
2. The hot water heater had no damper in the flue pipe.
3. No fire unit separation over boiler.
4. Two infant bedrooms with no emergency escape windows.
5. No GFI on basement kitchen counter.
6. Illegal waste and vent pipes in basement with sewer gasses leaking into
apartment.
7. No smoke detector in one location.
8. Lack of any air intake for heating unit in basement which will cause oxygen
shortage in winter.
9. Questionable hot tub wiring.
10. Unpermitted ejector pump
11. Questions regarding the lack of natural light and ventilation.
12. An overloaded electrical panel.
The above concerns are so convincing to me that I feel I must act,at the present time. The
apartment in the basement having been constructed without permits is considered unsafe
at this time. The owner and her family live in this basement with their infant. Mrs. Becal
is also expecting another child in September. We are concerned that the health and safety
of her and her child are at stake given the emission of sewer gasses and carbon monoxide
into the apartment.
The effect on the neighborhood has been extremely noticeable as well. Recently we had
to order the removal of 13 boats from the yard; boats that are part of Mr. Becal's
business. The yard has a chain link fence around it, and the owners have three large
rotweilers that would scare anyone. The upstairs is currently being rented out to over five
people. All five upstairs bedrooms were either occupied or locked during our visit. We
talked to two tenants who admit to renting rooms there. This results in 5-7 cars at a time
on and off the property. Noise has been a common concern in the past.

To sum up, currently there exists a two-family structure with a rooming house use. Only
a single-family home is legal here. We urge the court to move this as expeditiously as
possible in that there are serious building.code and zoning concerns that have continued
at this location for much too long.

in the RB, RD-1 and RF-2 Districts :

2) Accessory Uses : The following uses are permitted as
accessory uses in the RB, RD-1 and RF-2 Districts :
A) Renting of rooms for not more than three (3) non-family
members by the family residing in a single-family
dwelling.
B) Keeping, stabling and maintenance of horses subject to

a) Horses are not kept for economic gain.
b) A minimum of twenty-one thousand, seven hundred

Dear Jack:
I met yesterday with my client, Mrs. Jodi Becal. Mrs. Becal, who is the owner of
record of the property located at 34 Circuit Avenue, Hyannis, MA (also shown on Assessors'
Map 324, Parcel 88) informs me that she and her husband recently met with you and Ralph
Crossen, Building Commissioner, to discuss the above-referenced property. It is my
understanding that based upon that meeting all watercraft located in the yard at 34 Circuit
Avenue have been removed by Mrs. Becal.
I am further informed that Mr. and Mrs. Becal have been advised bYyou that a
complaint has been lodged against Mr. Becai's father with the Clerk of the Barnstable
District Court seeking application for a criminal complaint for violation of zoning laws. This
office, representing the Becals, has not received a copy of that application, nor has Mrs.
Becal been properly served with notice of the application. We are further informed by our
client that the notice may have been delivered to 46R Wequaquet Lane in Centerville, which
is no longer a valid address for either Mr. or Mrs. Becal.
I have been further updated by my clients that subsequent to our original
representation of them that they, together with their young child, have moved into the
premises at 34 Circuit Avenue and have made substantial upgrades to the premises. Based

permit pursuant to Section 3-1.1(3)(a). At the same time, I anticipate receipt within the next
week to ten days affidavits from owners of record and material witnesses dating back to 1975
confirming the existence of two kitchen facilities within the premises prior to that date and
the presence of at least six lodgers on the premises at all times commencing prior to that
date. It is my intention, upon receipt of those affidavits,-to file a formal request for
determination with the Building Commissioner regarding the status of the property, which
may make the application for special permit moot.
In light of the failure of proper notice to be given to the property owner and my
anticipated report to the Building Commissioner, I would request that the show cause hearing
scheduled for this coming Thursday, April 9, 1998 at the Barnstable District Court be
continued. This office will be happy to accept service of notice of the filing of the complaint
on behalf of Mrs. Becal and we will appear on her behalf at any subsequently scheduled
show cause hearing.
