The lots in question are non-conforming in terms of area. According to the application and plans submitted; • apart of Parcel 211 shown as Lot Area A (7,645 sq.ft.)is to be deeded to from Macheras to Galipeau • a part of Parcel 30 shown as Lot Area B ( 16, 830 sq.ft.) is to be deeded from Galipeau to Macheras. i Background: '. The locus consist of three lots: 1. Parcel 211 is an undersized lot of 0.36 acres developed with a 3,484 sq.ft. 2 story, 4 bedroom single- family owned by Macheras. 2. Parcel 30 is a 1.50 acre lot developed with 6 detached single-family dwellings. The site is commonly known as the "Sea Breeze Condominiums". The units are free-standing condominium units ranging from 1 bedroom units to 3 bedrooms units. All of the units are owned by Galipeau. The lot is non- conforming in terms of use. 3. Parcel 210 is an undersized lot of.17 acre developed with a 1,936 sq.ft. 2 story, 4 bedroom single- family owned by Macheras. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on February 02, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 04) 2001, at which time the Board found to grant the special permit with conditions. Board Members deciding this appeal were Tom DeRiemer,Dan Creedon, Gail Nightingale,Richard Boy, and Chairman Ron S.Janson. Attorney Steven J. Pizzuti represented the applicant. Mr. Pizzuti explained the request was to transfer land between the applicants. The respective individuals are presently utilizing those areas as there respective yards and the intent is to accommodate each of the 1 parties with a transfer of those areas. No new lots will be created with the transfer and there is no intent to build upon those areas to be transferred. Lot Area A (7,645 sq.ft.) is to be deeded to Parcel 210-a transfer from Macheras to Galipeau. Lot Area B ( 16, 830 sq.ft.) is to be deeded to Parcel 211 -a transfer from Galipeau to Macheras. Findings of Fact: At the hearing of April 04, 2001, the Board unanimously found the following findings of fact: 1. In Appeal 2001-32 for a Special Permit in accordance with Section 4-4.2(5) Merged Lots,the applicant Monique Galipeau and Michael Macheras, Trustee of YA.S.A.C. Realty Trust seek to transfer land amongst themselves. The locus in issue is addressed as 60 and 34 Crocker Street, Hyannis, MA, Assessor's Map 306, Parcels 030.00A through OOE, Parcel 210 and Parcel 211. The land is zoned Residential B and is in the Aquifer Protection Overlay District. 2. Michael Macheras is the owner of Parcel 211, a developed undersized lot of 0.36 acres, and desires to transfer.7,645 sq.ft. shown as Lot A on the plan to Monique Galipeau. Lot A is to be combined with- Mr. Galipeau developed lot, Parcel 210. 3. Monique Galipeau owner of Parcel 030, units OOA through OOE, known as "Sea Breeze Condominiums" with a lot area of 1.5 acres, desires to transfer 16, 830 sq.ft shown as Lot B on the plan to Michael Macheras. Lot B is to be combined with Mr. Macheras developed lot, Parcel 211. i 4. The transfer of the lots is to reconfigure the shape of the lots. No new developable lots are being created. 5. The proposed reconfiguration of the lots enhances the quality of the lots,increasing the size of the respective lots by making the lots more compliant with zoning. 6. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, 7. The proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following conditions: 1. The exchange of land shall be as presented to the Board and as illustrated on a plan entitled"Plan of Land "Sea Breeze Condominiums" Hyannis Massachusetts" prepared for Monique A. Galipeau by Baxter Nye&Holmgren, Inc. dated January 30, 2001, and initialed by the Chairman. 2. The exchange of land is specifically restricted for the reconfiguration of existing lots and shall not create any new buildable lots. l 2 Y 3. No portion of the land area added to the residential lots is to be constructed on. 4. This decision shall be referenced on the Approval Not Required (ANR) Plan to be signed by the Planning Board. 5. The ANR')Ian shall reference Lots A and B as not being buildable areas. There shall be no further sub-division of these lots nor shall there be any construction thereon. 6. The ANR Plan and this decision shall be recorded at the Registry of Deeds at the same time.Each owner Ms. Galipeau and Mr. Macheras, shall deed the property as is set forth in this decision. There shall be no third part ownership on the lots being conveyed. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Appeals of this decision,if any, shall be made pursuant to MGL Chapter 40A, Section 17,within twenty } (20) days after the date of the filing of this decision.
