ZBA Appeal 2004-133 —Anthony & JustinQ$and__ er= son, 70 Crocker Dr., Hyannis, MA ` Xt Legal Ref. # 2004-0339 (Sanderson) ro OPINION REQUESTED: M The Zoning Board of Appeals requested the following review: In the Sanderson case, a 1978 Approval Not required Plan was signed and recorded to divide a lot upon which two dwellings existed. That plan created the subject lot— Lot No. 1 as shown on the plan. The lot, when created, was 7,867 sq. ft. However, in 1978, the Residence B Zoning District required 10,000 sq. ft. minimum lot area. Thus the lot did not conform to that minimum area requirement and no relief is known to exist. What is now the status of this lot with respect to zoning? Specifically, is this a lot that can now seek MGL Chapter 40A, Section 6 findings and a special permit for the demolition of the dwelling and reconstruction of a new dwelling — as per the Dugas ruling? SUMMARY OF APPLICABLE STATUTES AND CASE LAW. We were surprised to discover that there have been no appellate decisions directly deciding the issue of the legal status of lots created under G.L. c. 41, §81 L containing existing structures. As a starting point, G.L. c. 41, §81 L [2004-0339/zbamemsnaderson] 1 a provides in part: "the division of a tract of land on which two or more buildings were standing when the subdivision control law went into effect in the city or town in which the land lies into separate lots on each of which one of such buildings remains standing, shall not constitute a subdivision." It is axiomatic that a planning board's approval-not-required endorsement is not a final determination of compliance with the zoning ordinance. "The finality of such an endorsement for purposes of the Subdivision Control Law ... has no bearing on compliance with zoning requirements." Gattozzi v. Director of Inspection Services of Melrose, 6 Mass. App. Ct. 889, 890, (1978). " 'An endorsement under §81 P does not mean that the lots within the endorsed plan are buildable lots.' ', Cricones v. Planning Board of Dracut, 39 Mass.App.Ct. 264, 268, 654 N.E.2d 1204 (1995). The seminal appellate court case interpreting the provisions of section 81 L as they relate to an ANR endorsement which was based upon the existence of two or more buildings which predated the existence of subdivision control is the case of Smalley v. Planning Bd. of Harwich, 10 Mass .App .Ct. 599, 603, 410 N.E.2d 1219 (1980). There the planning board refused an ANR endorsement because the lots in question failed to meet the minimum area requirements of the zoning bylaw. The Appeals Court reversed the decision of the Planning Board refusing the ANR endorsement stating that "[i]n acting under §81 P, a planning board's judgment is confined to determining whether a plan shows a subdivision." Id. at 604, 410 N.E. 2d 1219. The Court went on to opine that a section 81 P endorsement does not give a lot any standing under the zoning by-law. Id. at 603. It is clear from the Smalley case and its progeny that the planning board's approval-not-required endorsement does not relieve the building inspector or the board of appeals from the responsibility to determine whether a lot satisfies the zoning ordinance. Frankly, we had believed that the language and analysis in Smalley could be interpreted as requiring undersized lots containing existing structures created under chapter 41, section 81 L as requiring variances. However, a recent series of Land Court cases poses the question of whether [2004-0339/2bamemsnaderson] 2 under certain limited circumstances such lots may be treated as legal pre- existing nonconformities under the so-called "second except clause" of G.L. c. 40A, s. 6 which provides, in pertinent part : Except as hereinafter provided, a zoning ordinance or by-law shall not apply to structures or uses lawfully in existence or lawfully begun...before the first publication of notice of the public hearing on such ordinance or by-law... but shall apply to any change or substantial extension of such use, to a building or special permit issued after the first notice of said public hearing, to any reconstruction, extension or structural change of such structure and to any alteration of a structure begun after the first notice of said public hearing mg to provide for its use for a substantially different purpose or for the same purpose in a substantially different manner or to a substantially greater extent except where alteration, reconstruction, extension or structural change to a single or two-family residential structure does not increase the nonconforming nature of said structure. The case of Norwell Arch, LLC v. Opdyke WL 1146574, 3-4 (Mass.Land Ct., 2004) (see copy attached) involved the denial by the zoning board of a property owner's request for a special permit finding under G.L. c. 40A, s.6 to allow for the alteration of a residential dwelling which predated the subdivision control law and resided on a lot created under s. 81 L which lot failed to comply with the frontage and setback requirements of the zoning law. The Court annulled the zoning board of appeals' decision which required the property owner to seek a variance, determining that "to fully protect single and two-family residential structures, G.L. 41, s. 81L and G.L. c. 40A s. 6, must be read together". The Court goes on to cite the language in Smalley to the effect that a lot created under section 81 L is not necessarily buildable but then indicates that As the Board is aware from its experience with the Dugas case, the language contained in the multiple"except"clauses in the first two sentences of G.L. c. 40A, s. 6 has been described as "difficult and infelicitous"Fitzsimonds v. Board of Appeals of Chatham, 21 Mass. App. Ct. 53, 55 (1985);. Willard v. Board of Appeals of Orleans, 25 Mass. App. Ct. 15, 20, (1987).("[t]he first paragraph ... contains an obscurity of the type which has come to be recognized as one of the hallmarks of the chapter"). Donahue, WL 1045455, 4 -6 (2004) (see copy attached) written by the same Land Court judge determined that the Planning Board erred in failing to endorse a plan under section 81 L. However, the Court then upheld the denial of the issuance of a building permit that would have permitted the demolition of an existing barn on one of the lots (Lot B) created under the ANR plan. Although Lot B met the minimum lot requirements, the Court concluded that Lot A which contained an existing dwelling would be rendered nonconforming "...[ujnder the doctrine of infectious invalidity a property owner may not create a valid building lot by dividing it from another parcel rendered nonconforming by such division. As the town views it, allowing a nonconforming lot to continue to exist under a provision of a zoning by-law is one thing, but allowing the creation of a new non-conforming lot is quite another. I agree." It is difficult to reconcile these two cases. The Court does not suggest that the property-owner in the Norton case should or could apply for a Section 6 finding. Rather, the Court appears to rule that based on the "infectious invalidity" doctrine that the property owner is not entitled to raze and build a new residential structure on the newly created conforming lot when it has the effect of making the other newly-created lot containing an existing dwelling nonconforming. One possible way to read these two Land Court decisions written by the same judge together is to conclude that the Section 6 finding is only available for lots created under section 81 L where the applicant can demonstrate that each lot so created contained separate residential dwellings that were principal permitted uses prior to the time that the subdivision control law went into effect. That way you are providing protection to residential single— family structures that served as such prior to the time that the subdivision control law went into effect, rather than allowing a property-owner to use an accessory Y _ ►Y 2/We spoke with the town counsel for Norwell who indicated that the town intended to appeal the decision but the case became moot when the property-owner simply chose to raze the existing structures and to apply for subdivision approval. [2004-0339/zbamemsnaderson] 4 I structure that predated the subdivision control law as a basis for creating an otherwise illegal undersized lot. ANALYSIS APPLIED TO FACTS. Suffice it to say that the law is in a state of flux and that there is no bright line test or appellate decisions available to determine whether a variance or a section 6 finding is appropriate. As we understand it, a 1978 Approval Not required Plan was signed and recorded to divide a lot upon which two structures existed. That plan created the subject lot— Lot No. 1 as which was 7,867 sq. ft. which was not in conformance with the minimum 10,000 sq. ft. minimum lot area in this zoning district. The other lot so created was also less than 10,000 square feet. Prior to the creation of the lots through the ANR endorsement, the lot was in excess of the 10,000 square feet required. As a threshold matter evidence would have to be presented by the applicant demonstrating that each structure which was the subject of the section 81 L endorsement was an independent residential buildings serving its occupants as principal dwellings before the subdivision control law went into effect. Exploration to verify that neither of the structures were actually accessory structures or dwellings would be in order. If the Board were satisfied that each structure was a principal permitted residential use prior the subdivision control law, it would be in the Board's discretion to proceed with Section 6 finding rather than a variance, if the Board so desired. According to the Assessor'' record, the lot is a 0.18-acre developed with a one-story,two-bedroom, single-family dwelling building in 1946. It has a living area of 715 sq.ft., and a wood deck of 160 sq.ft. The applicants,Anthony and`Jne Sanderson have owned the property since 1989. The applicants are proposing to demolish the existing house and reconstruct a new single-family dwelling. The applicants had proposed to construct the new dwelling on the existing footprint of the non-conforming building. The new dwelling is to be a two-bedroom, 2.5-story building of 1,840 sq.ft. living area. A full basement is also proposed. The existing structure and deck are non-conforming with respect to today's 10-foot rear yard setback as is the existing shed. Rebuilding of the dwelling in the existing location provides only a 5.3 foot setback to the building. The deck and shed,which are to remain, intrude more than 5.3 feet into the rear setback. Procedural& Hearing Summary: This appeal was filed at the Town Clerk's,Office and at the Office of the Zoning Board of Appeals on June 30, 2004. An extension of time for holding the public hearing and for filing of the decision was executed by the applicants' representative and Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 29, 2004, and continued to November 3,2004,December 8, 2004, January 5, 2005, and to January 12, 2005, at which time the Board found to grant the appeal. Board Members deciding this appeal were, Jeremy Gilmore, Gail Nightingale,Randolph Chiles and Acting Chairman Ron S Jansson. The applicant's builder,Mr. Bert deMartin,represented the appeal before the Board. At the opening of the hearing the Board noted that a letter from the applicants did authorize Mr. deMartin to represent them. Mr. deMartin explained that proposal to demolish the existing single-story structure and rebuild a two and half story structure on the existing footprint including the existing decks. The Board and applicant discussed the issue of retaining the non-conformity in setbacks and the Board requested that the applicant moved the new structure to comply with today's setback requirements. i It was also cited that the undersized lot was created by a 1978 Approval Not Required(ANR)plan that,it did not meet the minimum lot area requirement of the Residential B. Zoning District in effect at that time. The Board explained to Mr. deMartin that the issue was being reviewed by the Town Attorney's Office and further relief via a Variance may be required. Public comment was requested and Richard Mulroy, 28 Crocker Drive, Hyannis, MA.,raised concern for Crocker Drive and requested provisions to repair the road should it be damaged by the applicant's building process. The Board continued the appeal to November 03,2004. They requested that the applicants submit plans to conform to setback requirements and also referred the ANR issue to the Town Attorney's Office for an opinion. At the November 3, 2004 hearing,no testimony was taken and the appeal was further continued to December 8, 2004,January 5, 2005, and to January 12,2005. At the January 12, 2005 hearing, it was noted that only four member were present to hear the continuance. The applicants'representative,Mr. deMartin agreed to proceed with the four members. Mr. deMartin submitted copies of the Assessor's Card records for the property and the neighboring property to the east. Those two properties were the subject lot created by the Approval Not Required Plan. It was noted that the structures that were divided by the 1978 ANR plan date to 1946 and 1920 and that both were used as residences. Given those facts, the Board determined that the special permit would be sufficient relief as suggested by the Town Attorney's Office Memorandum dated October 28, 2004. At the January 12th.hearing,Mr. deMartin presented a new plan that showed the proposed new dwelling to be in conformity with the required setback. However the deck was still infringing. The Board noted that the deck would also have to be relocated so as to conform to the required setbacks for the district. The Board also cited that the elevation of the proposed structure exceeded 30-feet. As this would be a zoning violation they could not approve the plan as drawn. Mr. deMartin stated that he could get a revised elevations that would conform to the height limitations. Those plans were presented later in the evening showing the maximum height of the structure to be 29-feet, 11-inces. The Board determined it could proceed. Findings of Fact: At the hearing of January 12, 2005, the Board made the following findings of fact: 1. The applicants in Appeal 2004-133 are Anthony and Justine Sanderson. They are seeking a Special Permit in accordance with Section 4-4.3(2)Nonconforming Buildings or Structures Used as Single or Two-Family Residences and findings under MGL Ch. 40A, Section 6 for the demolition and reconstruction of a single-family dwelling on a nonconforming lot. The property is located as shown on Assessor's Map 306,Parcel 028 001 addressed 70 Crocker Drive, Hyannis,MA in a Residence B Zoning District. 2. The property is located on Crocker Drive off Ocean Street in Hyannis. It is a 0.18-acre lot developed with a one-story,two-bedroom, single-family dwelling building in 1946. It has a living area of 715 sq.ft., and a wood deck of 160 sq.ft. The applicants have owned the property since 1989. 2 3. The applicants propose to demolish the existing structure and reconstruct a new single-family dwelling. The new dwelling is to be a two-bedroom, 2.5-story building of 1,840 sq.ft. living area. A fall basement is also proposed. The plans for the new structure conform to the required setbacks for the district and the height of the building is to be 29-feet, 11-inches, in conformance with the ordinance. The applicant has stated that he will comply with the required setbacks by altering the location/configuration of the deck and relocating the shed so as to conform. 4. The proposed location of the dwelling is within 100 feet of wetlands but beyond the 50 foot setback requirement from wetlands. 5. According to the Board of Health records,the existing lot is grandfathered for a two bedroom on-site septic system. The system is located eastward of the dwelling and was installed in 1988. 6. The proposed new dwelling does intensifies the nonconformity in terms of the area of the building on the undersized lot. The new building is considerable larger and that is and intensification of structure on the lot. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years,the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land,the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to this Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 9. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection"(or, "MA DEP"] "File Number SE3-4436 " 10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before DEP. 11. Upon completion of the work described herein,the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A)to the Conservation Commission. 12. The work shall conform to the plans and special conditions referenced in this order. 13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 14. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Upon completion of the foundation,the project surveyor or engineer shall verify in writing or by plan to the Commission the correct location of the foundation and work limit line and note any discrepancies from the approved plan. If verification is in the form of an as-built plan,the plan provided shall be drawn at the same scale as the approved plan. 9. Any fill used for this project shall be clean fill. Fill shall contain no trash,refuse,rubbish,or debris. 10. Drywells or graveled trenches along the drip lines shall be installed to accommodate roof runoff. 11. The driveway shall be constructed of pervious material(gravel or shell)or alternate as approved by the Conservation Commission. 12. Sediment controls(haybales,silt fence)shall be deployed on an as-needed basis. 13. No area shall be left unvegetated for more than 30 days.All areas disturbed during construction shall be revegetated immediately following completion of work at the site. Mulching shall not serve as a substitute for the requirement to revegetate disturbed areas at the conclusion of work. 14. All proposed lawn areas shall be underlain with a minimum of 6 inches of loam. 15. Herbicide,pesticide and fertilizer use is discouraged on lawns within Conservation Commission jurisdiction. If fertilizer is used,only slow-release low-nitrogen fertilizer(with 30-50%water insoluble nitrogen or `W.I.N') shall be applied. Over-fertilizing shall be avoided(not-to-exceed limit= 1 pound of nitrogen per 1,000 sq.ft.of lawn per application).Ensure that no fertilizer is spread on hard surfaces like driveways and sidewalks. IV. After all work is completed,the following condition shall be promptly met: 16. At the completion of work,or by the expiration of this Order,the applicant shall request in writing a Certificate of Compliance for the work herein permitted.
