Based upon the results of this research, it is my opinion that Lot 35 is a buildable lot for zoning purposes. This opinion is based upon the following: 1. Lot 35 was created by a definitive subdivision plan under the Open Space Subdivision provisions of the Barnstable Zoning Ordinance approved by the Barnstable Planning Board'on August 10, 1994 and registered with the Land Court Division of the Barnstable County Registry of Deeds as Land Court Plan 36669-C at the Barnstable County Registry of Deeds. A copy of said plan is attached hereto for your review. 2. At the time of the subdivision approval, all the lots on Land Court Plan 36669-C were owned by Brian T. Dacey, Trustee of Lake Isle Woods Development Trust. 3. On January 17, 2002, Brian T. Dacey, Trustee of Lake Isle Woods Development Trust conveyed Lot 35 on Land Court Plan 36669-C to Brian T. Dacey, Trustee of Bayside Investment Trust. Said deed is registered as Document Number 858,174 with Certificate of Title Number 164877. This transfer occurred during the eight year plan protection afforded under Brian T Dacey, Trustee May 21, 2013 Page 2 MGL c. 40A, Section 6. Lot 35 is the only lot on Land Court Plan 36669-C that Bayside Investment Trust has ever owned. 4. The schedule of beneficiaries for Lake Isle Woods Development Trust and Bayside Investment Trust reveal that the beneficiaries of Lake Isle Woods Development Trust are different from the beneficiaries of Bayside Investment Trust. There is no common ownership among the beneficiaries. 5. Abutting Lot 29, which is Open.Space., was conveyed by Brian T. Dacey, Trustee of Lake Isle Woods Development Trust to Brian T. Dacey as Trustee of the Lake Isle Woods Open Space Trust. The beneficiaries of the Lake Isle Woods Open Space Trust are all the owners of lots within the subdivision. 6. Abutting Lot 34 was conveyed by Brian T. Dacey, Trustee of Lake Isle Woods Development Trust to the current owner, Brian T. Dacey, Trustee of Emerald Investment Trust, by deed dated January 17, 2002 and registered as Document Number 858,173 with Certificate of Title Number 164076. A review of your trust records reveals that the beneficiary of Emerald Investment Trust is different from the beneficiaries of Lake Isle Woods Development I"rust, Bayside Investment Trust, and Lake Isle Woods Open Space Trust. 7. Abutting Lot 36 was conveyed by Brian R. Dacey, Trustee of Lake Isle Woods Development Trust to Ann L. Burchill by deed dated June 28, 1996, registered as Document Number 669,888 with Certificate of Title. Number 141203. Lot 36 has been conveyed three additional times to parties who have never owned an interest in Lot 35 or any other lot on said plan. 8. Abutting Lot 37 was conveyed by Brian T. Dacey, Trustee of Lake Isle Woods Development Trust to Victoria M. Zimmer and Margaret A. Duffy, Trustees of the Victoria M. Zimmer Trust by deed dated April 25, 1996 and registered as ocument Number 663,850 with Certificate of Title Number 140422. On May 28, 2005, Lot 37 was conveyed to Victoria M.
