Dear Mr. Pilicy:
On Wednesday, March 5th, my assistant and I made an inspection at the
above referenced property. After being informed by your builder, Mr.
Bruce McCorry that only electrical work was being done we questioned
the pile of building debris in the back yard. Upon further inspection
we observed your plumber, Mr. Jack bell installing a laundry room on
the first floor. There was no explanation for the remodeling work being
done. Upon questioning the builder stated that a stove was to be in-
stalled. �~
Needless to say, this has the 'appearance of an aAarrmPnx. It was then
ordered that the electrician not hook up .electricity for a stove and
further that if an apartment was created a complaint would be sought
in the First District Court at Barnstable. In addition, your builder
did not have any proof that he was licensed as a builder by the Common-
wealth of Massachusetts.
Please be advised that a building permit is required to remodel the
basement in your dwelling. An apartment is not permitted in the dwelling.

Appeals found
Attorney Frank Green represented the petitioner and said the dwelling in
question was constructed in 1965 when the area was then zoned residence A which 1
required a 72 ft. sideline setback. Due to an error at the time the house was

constructed, the sideline setback is 5.25 ft.. A building permit was issued
for a different numbered, lot, due to a mistake on the part of the building
inspector and now that the house is being .sold, a variance is necessary for the
5.25 ft. sideline setback. Atty. Green said the building inspector is in favor
of the variance being issued. It is not possible to purchase land from the
adjoining property owner to comply with the sideline requirement and if the
variance is not granted, hardship to the petitioner would result since the house
would have to be moved a distance of 22 feet.
No one spoke in favor of or in objection to the petition.
The Board found that allowing a variance on the sideline setback would not be
detrimental to the neighborhood involved nor in derogation of the Barnstable
Zoning by—laws. Due to an oversight on the part of the Building Inspector's
office, a permit was issued for a different numbered lot so that the petitioners
are not able to enjoy the benefit of Chapter 40A9 Section 229 the Statute of
of Limitations. These particular circumstances affect this lot and building
only and not the zoning district generally. The Board found that uniqueness
and hardship do exist as defined in Chapter 40A of the Mass. Gen. Laws ter.ed.
as amended, and the Board voted unanimously to allow on the sideline setback
of 5.25 ft. rather than the 7.5 ft., in effect at the time the dwelling was
• constructed.
