MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of.compliance with the insurance coverage required." Additionally,MGL chapter 152, §25CO states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." HOMEOWNER'S EXEMPTION. The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of.construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting.as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require, as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. Oil ._ __ .._ June 1 __._. ................... ..........__:_._.........._...._... 19 .77, the Board of Appeals found The Petitioners, Paul J. & Rosaria M: Merlesena have appealed to the Board of Appeals and petition for the re-establishment of a variance to allow construction of a singe family dwelling, one each, on two lots with insufficient square footage and width at Daisy Hill Road, Hyannis in an RB Zoning District. The Petitioners were represented by Attorney James Wilson of Hyannis, The Petitioners have owned locus, lots 170 and 171 on plan submitted in case #1975-80 on file with the Board for more than twenty years and until a 1972 zoning change to 10.,000 square foot lots, locus contained two buildable lots. Now, However, Petitioners find themselves with one lot of more than 18,000 square feet in an area developed on lots of 8,000 square feet. Petitioners had hoped to build a retirement home on one lot and sell the other to finance the retirement home and it would be financially unfeasible for Petitioners to build a house on the 18,000 square foot lot. Therefore, Petitioners have a hardship to their lot which is unique to this area and to build on lots which are substantially the size of others in the area .would not be detrimental to the area or in derogation of the by-law. The Board found in May of 1976 in case #1975-80 that this was a minimal request for a variance. The Petitioners have two lots which together are less than 10,% below the required square footage and it required to build one house on the lot, which is in excess 'of twice the size of most lots in the area that have already been built upon, an unnecessary hardship would be created. Therefore, the Board finds as it found on May 5, 1976, that a hardship as defined in Chapter 40A of the Massachusetts General Laws, Ter. Ed. Paul J. .& Rosaria Merlesena, have appealed to the Board of Appeals and petition for a variance to allow construction of single family dwellings one each on two lots with insufficient square footage and width at Daisy Hill Road, Hyannis in an RB Zoning District. The PEtitioners were represented by Attorney James Wilson of Hyannis. Petitioners have-owned locus, lots 147 and '148 in plan submitted, for approximately 20 years and, until a 1972 zoning change to 10,000 square foot lots,; locus contained two buildable 1¢.ts. Now, .however, Petitioners find themselves with one lot of 18,000 square feet in an area developed on lots of 8,000 square feet. Petitioners had hoped to build a retirement home on one lot and sell the other to finance the retirement home and it would be financially unfeasible for Petitioners to build a house on the 18,000 square foot lot. Therefore, Petitioners have a hardship to their lot, which'is unique to this area 'and to build on lots which are substantially the size of the other lots in the area, would not be detrimental to the area or in derogation of the by-law. A question was raised as to the square footage of the lots in regard to a town taking of the road and a portion. of the lot which was returned to Petitioners. It was agreed that, if Petitioners could substantiate ownership of that portion of the lot not taken by the Town for the road, this would be a minimal variance. Attorney Wilson agreed to substantiate ownership of this portion of the lot through the land court and on May 5 , 1976, submitted such document to the. Board. The Board found that this was a minimal request for variance. Petitioners have two lots which are less than 10% below the required square footage and -if" required -to build- one house on the lots will have a lot which -is in r excess of twice the size of most of the lots in the area, which are already built upon. Therefore, the Board found that there was hardship as defined -in Chapter 40A of the Massachusetts General Laws, Ter. ed. as amended, which was unique to locus and that to allow one single family dwelling to be built upon each of these lots in an area already developed on lots of similar size, would not be detrimental to that area nor in derogation of the Barnstable Zoning By-Law as revised April 2, 1975. Therefore, the Board voted unanimously to ,grant this variance as applied for.
