Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often reSuhS in serious problems,particularly when the homeowner hires unlicensed persons. in this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require, i sari of the permit application, that the homeowner certify that helshe understands the responsibilities of a Supervisor. Mark Holmes August 29, 2005. I saw that in the street file that there was a use variance issued to Ms Lovasco-Sutton for this property December 18, 1996. The Variance#is 1996-152. This variance ran with Ms.Lovasco- Sutton only. Upon the sale the property was in violation of current zoning.' wrote my First letter to Mark and Austin Holmes October 11, 2005. Property: The subject property is a 0.3-acre lot improved with a one-story, four-bedroom of 1;271 so. ft. dwelling built in 1950: According to the,Building Division files, in 1996 the Assessor's Office noticed that the structure had been divided and a second separate studio apartment added.. Wellhead Protection/Septic System: The property is located in.a Wellhead Protection Overlay District and is subject to the,local Board of ` y' Health 330 Rule as well as State Title;5. The on-site septic system was installed in 1993 and sized for a three bedroom. At that-time the pro pertywas in a Groundwater Protection Overlay District and subject to the local 330:Rule: Sometime after 1993, but prior to 1996, at least one more bedroom was.added to the property as noted by-the Assessor's Record.`As it currently appears, the property has 4 bedrooms but a septic system sized to that of a three bedroom. The lot is In the RB Residential B Zoning District where one single family dwelling is allowed. One of the town's Assessors,while conducting an inspection, found a second dwelling unit on the site,which is assessed as a single family home. The owner has submitted an application for a variance at the request of the Building Commissioner. No zoning relief has been obtained prior to this application. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on U October 22, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 04, 1996,at which time the Board found to grant the Variance with conditions. Board Members hearing this appeal were Ron Jansson,Gene Burman, Emmett Glynn, Richard Boy, and Chairman Gail Nightingale. Karen Lovasco-Sutton represented herself before the Board and submitted a memo to the file. Hearing Summary: Ms. Lovasco-Sutton explained to the Board that originally this apartment was to be used as a family apartment for her terminally ill daughter,who chose not to live there. They now rent the apartment to a young woman who is deaf and mute. She was sent to the Petitioner through the Barnstable Housing Authority which pays her rent. The property is in an RB Residential B Zoning District, which allows renting of rooms and a family apartment(by Special Permit)If it is to occupied by a family member. In consideration of the Variance, Ms. Lovasco-Sutton stated: ,� • This would not!be detrimental to the neighborhood, as there is currently a duplex adjacent to this property:- • The Petitioner will limit the occupancy to one person. • By not renting to three lodgers, but rather a single person,it would be less intense on the ground water. ` •: There could be any restrictions deemed applicable placed on the deed. - The money they receive for the apartment allows them to pay the mortgage: Town of Barnstable-Zoning Board of Appeals Decision and Notice-Appeal No.96-152 Lovasco-Sutton • This apartment services an individual with special needs. The Building Commissioner stated the unit is currently_illegal and the only way to legitimize the use is to seek zoning relief. The unit is helping a handicapped individual and if relief is granting, the unit should be monitored with proper conditions. Public Comment: No one spoke in favor or in opposition to this appeal. Ron Jansson told the Applicant that the Board seldom grants Use Variances. The hardship she experiencing is the same hardship many other people through out the town are experiencing right now. If the Board were to grant relief, his feeling is that it would be participating in spot zoning. This-is not a family apartment than what the Applicant is seeking. The size of the lot is very small (less than '/3 of an acre) and near a pond. Although, Mr. Jansson does sympathize with the Applicant this use is not allowed. Renting the unit to a handicapped, although commendable, is not a reason in and of itself to allow an illegal use. Lodgers are allowed, but lodgers do not have separate kitchens. There is also a concern that the Barnstable Housing Authority is paying the rent for an illegal rental unit. If this is granted, Mr. Jansson felt the Board would be setting a precedent for others in the Town who are seeking a Use Variance. . In rebuttal, the Petitioner indicated she would never rent the other rooms in the house. She was told she could have this apartment.unit if she just removed the stove, however the quality of life for the individual currently using the apartment would be greater enhanced if she were allowed the ability to cook for herself. When asked if she would lose the tenant if she were to remove the stove, Ms. Lovasco-Sutton replied, "No." The Building Commissioner agreed that the stove is a major deciding factor in determining if this is an apartment, but through an on-site inspection, the Building Department reviews the house to see if only the stove needs to be removed or other alterations are needed to takeaway the capability of having two kitchens where they are not allowed. Richard Boy also stressed there may be a hardship, but a hardship does not constitute variance conditions. Gene Burman stated that each'case must be dealt with on an individual basis. Findings of Fact: With reference to Appeal Number 1996-152, the following are the findings of fact: 1. The property is located at 90 Dunn's Pond Rd., Hyannis, MA in an RB Residential Zoning District and consists of.3 acres, improved with a 1,200 sq. ft. wood-frame house built in 1950 which contains a separate studio apartment in addition to the principle dwelling space. 2. The Petitioner is seeking a Use Variance pursuant to Section 3-1.1(1)(A) to allow a second dwelling unit on in an RB Residential B Zoning District. 3. The Petitioner has not cited any Variance conditions as required under MGL Chapter 4OA, Section 10. However, the Petitioner has described a hardship (financial and otherwise). 4. By limiting the use of the apartment to a single person, the Petitioner would be actually aiding the ground-water by not having up to three renters of single rooms which would produce more seepage than a single person. The Petitioner,would be allowed the three renters as a matter- of-right, if the kitchen were removed. 5. The adjoining parcel of land currently has a-duplex. 6. Granting the Use Variance, which is something the Board has previously been reluctant to do, ` would not be a substantial detrimental to the neighborhood affected. Nor would it be in derogation of the sprit and intent of the Zoning Ordinance in the Town of Barnstable. 2 f Town of Barnstable-Zoning Board of Appeals Decision and Notice-Appeal No.96-152 Lovasco-Sutton Decision: Based on the findings of fact in Appeal Number 1996-152, a motion is made to grant the relief being sought with the following terms and conditions: 1. The studio apartment shall be permitted as per sketch plans submitted by the applicant with the Application received by the Zoning Board of Appeals. It shall not be enlarged beyond its current size. 2. The studio apartment unit is to be limited to no'more than bedroom. Occupancy shall be limited to one person. 3. This Variance is not transferable and"is only issued to the Applicant. 4. The owner must continue to reside at this location as long as both units are occupied. VOTE: AYE: Richard Boy, Gene Burman; Emmett Glynn and Chairman Gail Nightingale. NAY: Ron Jansson Mr. Jansson stated he voted in the negative as he felt the Use Variance power that has been given to.the Zoning Board of Appeals has been questioned over the years and the Board runs the risk of having that power taken away. Plus, the conditions stated are not unique to only to this homeowner, as many people in the Town of Barnstable have similar situations and would like to do the same thing. Order: Appeal Number 1996-152 has been Granted with conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on U October 22, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 04, 1996,at which time the Board found to grant the Variance with conditions. Board Members hearing this appeal were Ron Jansson,Gene Burman, Emmett Glynn, Richard Boy, and Chairman Gail Nightingale. Karen Lovasco-Sutton represented herself before the Board and submitted a memo to the file. Q Hearing Summary: Ms. Lovasco-Sutton explained to the Board that originally this apartment was to be used as a family apartment for her terminally ill daughter,who chose not to live there. They now rent the apartment to a young woman who is deaf and mute. She was sent to the Petitioner through the Barnstable Housing Authority which pays her rent. The property is in an RB Residential B Zoning District, which allows renting of rooms and a family apartment(by Special Permit)if it is to occupied by a family member. In consideration of the Variance,Ms.LovascoSutton stated: • This would not be detrimental to the neighborhood,as there is currently a duplex adjacent to this property. • The Petitioner will limit the occupancy to one person. - By not renting to three lodgers,but rather a single person,it would be less intense on the ground water. • There could be any restrictions deemed applicable placed on the deed. The money they receive for the apartment allows them to pay the mortgage. r • Town of eamalable-Zoning 80Wd Of Appeals Decision and NOW-Appeal No.96.152 Lovasco-SuMn This apartment services an individual with special needs. The Building Commissioner stated the unit is currently Illegal and the only way to legitimize the use is to seek zoning relief. The unit is helping a handicapped individual and If relief is granting,the unit should be monitored with proper conditions. Public Comment: No one spoke in favor or in opposition to this appeal. Ron Jansson told the Applicant that the Board seldom grants Use Variances. The hardship she experiencing is the same hardship many other people through out the town are experiencing right now. If the Board were to grant relief,his feeling is that it would be participating In spot zoning. This is not a family apartment than what the Applicant is seeking. The size of the lot is very small (less than 113 of an acre)and near a pond. Although,Mr. Jansson does sympathize with the Applicant this use is not allowed. Renting the unit to a handicapped,although commendable,is not a reason in and of itself to allow an illegal use. Lodgers are allowed, but lodgers do not have separate kitchens. There is also a concern that the Barnstable Housing Authority is paying the rent for an Illegal rental unit. If this is granted,Mr.Jansson felt the Board would be setting a precedent for others In the Town who are seeking a Use Variance. In rebuttal,the Petitioner indicated she would never rent the other rooms In the house. She was told she could have this apartment unit if she just removed the stove,however the quality of life for the Individual currently using the apartment would be greater enhanced if she were allowed the ability to cook for herself. When asked if she would lose the tenant if she were to remove the stove, Ms. Lovasco-Sutton replied,"No' The Building Commissioner agreed that the stove is a major deciding factor in determining if this is an apartment, but through an on-site inspection,the Building Department reviews the house to see If only the stove needs to be removed or other alterations are needed to take away the capability of having two kitchens where they are not allowed. Richard Boy also stressed there may be a hardship,but a hardship does not constitute variance conditions. Gene Burman stated that each case must be dealt with on an individual basis. Findings of Fact: With reference to Appeal Number 1996-162,the following are the findings of fact: 1. Granting the Use Variance,which is something the Board has previously been reluctant to do, would not be a substantial detrimental to the neighborhood affected. After the appeal period has elapsed,and if no appeal has been taken,the Town Clerk shall certify the decision and a fully signed decision is mail to the representative. That certified decision must be recorded at the Barnstable County Registry of Deeds for it to be in effect. A copy of that recorded document should be submitted to the Board's files and is required for a building permit application. The rights granted under a Variance shall lapse unless they are exercised within one(1)year of the date of the certified decision. If an appeal is taken,the outcome of your request will be determined by the courts. Please review all applicable zoning rules and regulations prior to applying.
