At the formal site plan review meeting held February 7,2019,the above proposal was found to
be approvable by the Site Plan Review Committee subject to the following:
• Approval is based upon, and must be substantially constructed in accordance with, site
plans entitled"Plan Showing Modifications to Existing Parking Areas at 0 & 9 Engine
House Road,Hyannis" 1 Sheet, dated January 21, 2019 and revised per staff comments
February 7, 2019; and 2 photometric plans:p0 Engine House Road dated July 18, 2016;
and, 0& 9 Engine House'Road dated January 21; 2019; all plans prepared by Sullivan
Engineering& Consulting, Inc., Osterville,.MA.
• Modification of Planning Board Special Permit 2016-03 for lot.0 Engine House Road;
and, a new Planning Board Special Permit is required for 9 Engine House Road for a
parking facility located in both the TD and.WP Districts.
• Separate use of the adjoined lots in the future will require reconfiguration of the plan and
modification of the Planning Board Special Permit.

• If stacking becomes an issue with the provision of one kiosk on 0 Engine House Road for
the two adjoining parking lots, applicant-will need to install an additional kiosk.
• A fence will need_ to-be installed separating the area of the two uses onsite at 9 Engine
House Road.
• Installation of a stop sign at the 0 Engine House Road exit from the parking lot is
required.

• For 0 Engine House Road only, aesthetics of any revisions to fencing, signage, lighting
and other exterior features will require the approval of the Hyannis Main Street
Waterfront Historic District Commission.
• A Town Manager Hearing to amend the existing Private Lot License for 0 Engine House
Road and a new license application for 9 Engine House Road will be required.
Applications may be made with the approve site plan upon the granting of the Planning
Board Special Permits and prior to the expiration of the appeal period.
• HP signage compliance with ADA regulations for all the Hy-Line Engine House Road
lots will be confirmed at the inspection stage.
• Applicant must obtain all other applicable permits,licenses and approvals required.
Upon completion of all work, a registered engineer or land surveyor shall submit a certified"as
built' site Plan and a letter of certification, made upon knowledge and belief in accordance with
professional standards that all work has been done in substantial compliance with the approved

Proposal: Site improvements are proposed to develop and operate a self catered,kiosk-controlled,

time limitations, for ferry and general parking on the easterly portion of 0 Engine House
Road and on the entirety of 183 Iyannough Road, Hyannis. Shuttle service to and from
this lot to the Hyline lot near Bismore Park will be provided. Use the existing building at
183 Iyannough Road, which formerly housed'Pufferbellies nightclub, will be used for
dry storage for Hyline Harbor Tours, Inc. under the use-designation: "Public
Transportation Maintenance Facility". No equipment maintenance,repair or storage of
hazardous materials is proposed.

Hyannis", 1 sheet, scale 1"=30 ft,.dated January 30, 2018 with final revision February 13, 2018;
and, drainage report dated February 13, 2018 both prepared by Sullivan Engineering &
Consulting, Inc. Osterville for R.F. &R.M, LLP.
• Planning Board Special Permits are required for a Public-Transportation Maintenance Facility
and a Parking Facility located in the Transportation District and Wellhead Protection Overlay
District. Planning Board relief from interior parking lot landscape requirements will also be
required.
• Service and testing of existing drainage is required to ensure that it functions properly prior to
the building permit stage.'

Background
RF & RM, LLP sought a Special Permit pursuant to Section 240-24.1.9.B(1) to establish a pay
to park parking lot within the Wellhead Protection Overlay District. The lot was previously an
accessory parking lot to a nightclub; the lease-'for the nightclub has since been terminated by
the property owner. The proposal was for a 117 space gravel parking lot with drive aisles a
minimum 14 feet in width and served by a kiosk.
The subject property is a 58,569.squ6re foot lot; the-request applies to the western portion of
the lot only. The property is accessed from the "paved access road" that runs through the
Commonwealth of Massachusetts property. The eastern portion of the property is impacted by
a Commonwealth Electric Company easement.
Procedural & Hearing Summary `
Special Permit Application No. 2016-03 requesting a parking..lot in the Wellhead Protection
Overlay District was filed at the Town Clerk's office and office of the Planning Board on July 22,
2016. A public hearing before the Planning Board was duly advertised and notice sent to all
abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened
on August 22,.2016 and continued to September 12, October 24; November 14, November 28,
and December 12, 2016 and January 9, 2017 at.which time the Board found to grant the special
permit subject to conditions. Board Members deciding on this application were Raymond Lang,
Mary Barry, David Munsell, Paul Curley, Steven Heiman and Mark Ferro.
Attorney Dan Creedon represented the Applicant before the Board; Phillip Scudder and Marty
Reilly were also present. The Applicant presented the request and the proposed plan, stating
the parking lot would help alleviate congestion at the harbor, as well as for Main Street
businesses whose parking lots are occupied by ferry customers. The potential users of the lot
were discussed, along with options1or future shuttle service: The Board deliberated extensively
regarding the Site Plan approval process through which the parking lot'was approved. They
discussed the layout of spaces, the landscape buffer, stall sizes and aisle widths. Stormwater
drainage and the requirements of the Wellhead Protection Overlay District were discussed. In
response to requests for public comment, Felicia Penn spoke about the overall picture of
parking around the harbor and expressed hope there would be coordinated shuttle service;
Dominick Alessandro spoke about neighborhood preservation at the January 9, 2017 meeting.

Findings of Fact
'At the hearing on January 9, 2017, the Board unanimously made the following findings of fact
for Special Permit application No. 2016-03:
1. R.F. & R.M., LLP for"0" Engine House Road, Hyannis Map 328, Parcel 241, has applied for
a Special Permit under Section 240-24.1.9.B.(1)for a pay to park parking lot with 117
parking spaces which development will include grading of existing pervious parking area, .
placement of parking kiosk machine, protective bollards, curb stops, signage, and landscape
buffer.
-2. The subject lot is 58,569 square feet in area and is located in the Transportation Hub District'
(TD)and Wellhead Protection Overlay District(WP)as shown on the record plan.
3. The plan has been found approvable in accordance with Section 240=98 through 105,
Site Plan Review by the Site Plan Review Committee on July 20, 2016, subject to various
conditions.
4. The landscaping as shown on the record plan satisfies the requirements of the Design and
Infrastructure plan and the spirit and intent of the zoning ordinance.
5. The application falls within a category specifically excepted in the ordinance for a grant of=
a special permit. The Applicant applies for a Special Permit under Section 240-24.13 HVB,
Hyannis Village Business, (B)Special Permits, (1) Parking Facilities.
6. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of
the Zoning Ordinance and would not represent a substantial detriment to the public good or
the neighborhood affected.
7. The proposal meets one or more of the special permit granting criteria of Section 240=
24.1(E):
a. The development maintains or improves pedestrian access and outdoor public
spaces;
b. The development contributes to the historic and maritime character of the Hyannis
Village area;
c. The development provides for or contributes to alternative transportation or travel
demand management.
Section 240-24 9 9 D (I)
8. The nature and extent of the risk of contamination to the proposed well that will result from
the grant of the special permit is unchanged from existing conditions.;
9. The nature and degree to which the proposal eliminates existing threats to the public water
supply is lessened due to the elimination of spaces over existing lot use;
10. The overall effectiveness of existing land uses and/or protective measures on the public
water supply well are slightly less intense and so more protective than existing lot use;
11. Grant of this special permit accommodates an overriding community interest with a more
properly maintained and less intense parking lot facility.
Sections 240-48 through 240-52
12. -Each off-street parking space has a minimum dimension of nine feet by 20 feet excluding

safety requirements.
13. Drainage facilities are designed and constructed to contain stormwater runoff on the
premises.

Section 240-53
16. The preceding requirements:.of this,§ 240-53 do not apply as this parking lot was
constructed and in use prior to.March 11, 1999 and conformed to all applicable regulations
when established.
Decision
Based on the findings of fact, a motion was duly made and seconded to grant Special Permit
No. 2016-03 subject to the following conditions:
1. The subject property shall be improved and the parking shall be located as shown on the
record plan entitled "Plan Showing Modifications to Existing Gravel Parking Area at 0
Enginehouse Road, Barnstable (Hyannis) Mass."Prepared for R.F. & R.M., LLP dated July
18, 2016 as revised through August 22, 2016 as drawn and stamped by Sullivan
Engineering & Consulting, Inca
2. This Special Permit shall apply to the western portion of the lotus shown on the record
plan referenced in Condition No. 1.
3. The conditions of the July 20, 2016 Site Plan Review letter are hereby incorporated as
conditions of this Special Permit.
4. The landscaping as shown on the plan of record shall be installed and maintained by the
parking lot owner/operator for the duration of this use.
5. The parking operation permitted herein shall be a self-service operation using a kiosk.
There shall be no gate and no parking attendants without prior approval from this Board.
Soliciting parking shall be prohibited.
6. A total of 117 parking spaces are permitted as follows: 98 spaces to be 9:ft. by 20 feet, 5
Handicapped spaces to be 8 ft. by 20ft, 14 spaces to be 8.5 ft. by 18.5 ft. for compact cars
only. All spaces will have curb stops and the aisles shall be a minimum of 14 feet.'
7. Lighting design specifications and alighting plan shall be submitted to the Town Engineer
for review and written approval prior to.commencement of the pay to park use. Such
approval shall be submitted to the Building Commissioner and forwarded to the Planning
Board.
8. Operation of the parking lobs subject to approval of a license from the Town Manager's
Office.
9. Signage and other exterior improvement design are subject to approval by the Hyannis ;
Main Street Waterfront Historic District Commission.
10. The parking lot shall be monitored by video cameras, installation of u'hich shall be verified
by the.Town prior to commencement of the use.
11. This permit shall,be recorded at the Barnstable-County Registry of Deeds and copies
submitted to the Planning Board'and Building Division prior to commencement of the use.
12. This permit must be exercised,within 2-years from the date it is filed with the Town Clerks
Office. The permit when finalized and signed by the Town Clerk must be recorded at the
Barnstable County.Registry of Deeds. A copy of the recorded decision shall be submitted to
the Building Division and the Planning Board prior to the issuance of any building permit.

Signage identifying the daily rate, emergency contact information and other required notice to
customers as set forth in the Town of Barnstable Parking Lot Regulations revised December 13,
2011 by the Town Manager, must be installed.

I find this plan to be not approval due to deficient dimensional provisions however, the
expressed assurance by DC Melanson of HFD that the plan as presented does not
interfere with emergency response requirements is comforting. Based on this
endorsement, I am inclined to allow the proposal to move forward in order that the
Planning Board may review the proposal and consider the applicant's argument for relief.
Parking Lot Standards
The ordinance is silent on residential parking requirements unless it is a mixed use or
multi-family complex. The design standards imposed for commercial lots may apply
here as well given the fact that the public is invited to use the site and will be parking
their own cars on the lot for a fee.
Although,the principal declared use of a private parking lot differs from the typical
commercial complex proposal, the fact that the proposed lot is not residential/single or
two family may actually define its status as a commercial lot by default.
