The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINITION OF HOMEOWNER
Persons)who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is intended to'
be, a one or two-family dwelling,attached or detached strictures accessory to such use and/or farm structures. A
person who constants more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be
responsible for all such work performed under the building permit. (Section 109.L 1)
The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other
applicable codes, bylaws,rules and regulations.
The undersigned"homeowner certifies that.he/she understands the Town of Barnstable Building Department
minimum inspection procedures and requirements and that he/she will comply with said procedures and
requirements.

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the
State Building Code Section 127.0 Construction-Control.
HOMEOWNER'S EXEMPTION
The Code states that "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section.(Scetion ID9.),I -Licensing of construction Supervisors);provided that if the homeowner engages a parson(s)for hire to do such
work, that such Homeowner shall act as supervisor."
4-any homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(sec Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this ease,our Board cannot proceed against the unlicensed person as it would with a licensed
supervisor. The homi Towner acting as Supervisor is ultimately responsible,
To ensure that the homeowner is fuI1y aware of his/her responnbilitics,many communities require,as part of the permit application.,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a.form currently used by

DEAR MRS.URENAS;
I AM WRITING IN REGARDS TO THE VIOLATION.-NOTICE I RECEIVED TODAY.
WHEN I LAST SPOKE WITH YOU, I HAD ADVISED YOU THAT I HAD REMOVED ALL ADDITIONAL
SIGNS FROM THE HYANNIS STORE. THE REMAINING TWO SIGNS, THE OVERHEAD & THE PYLON
SIGNS WOULD BE THE. ONLY TWO SIGNS WE WOULD WANT TO RETAIN. AS I EXPLAINED, AT THAT
TIME, WE WERE IN THE PROCESS OF A TRANSITION, AT PAT RILEY'S NEVADA BOB'S & THAT
SINCE THE SIGNAGE WOULD NEED TO BE CHANGED, AS SOON AS THE PAPERS WERE SIGNED,
(TRANSITION PAPERS)I WOULD SUBMIT THE PROPER REQUESTS FOR SIGNAGE, TO REFLECT
SAID CHANGE.
ON APRIL 20, 1994 I WAS GIVIN THE AUTHORIZATION TO BEGIN THE NEEDED CHANGES.
THE PERMIT APPLICATIONS HAVE BEEN SUBMITTED TO OUR SIGN COMPANY, METRO SIGN OF
WILMINGTON, MA (508-657-6117) . THEY ARE COMPLETING THE SPECS & SIGN PLANS,
j UPON RECEIPT OF THIS INFORMATION, I WILL IMMEDIATLY "SUBMIT THE PERMIT APPLICATION.-
THE LAST ITEM WOULD BE THE BANNERS ON THE BACK SIDE OF OUR MERCHANDISE GRIDS, WHICH
FACE THE WINDOW. SINCE THESE BANNERS WERE NOT ATTACHED TO THE WINDOW, I DID NOT
REALIZE THEY WERE A VIOLATION. I INSTRUCTED THE STORE MANAGER TO. REMOVE THEM, UPON
RECEIPT OF THE NOTICE.
PLEASE ADVISE ME IF. THESE ARE ACCEPTABLE STEPSAND AS I HAD PREVIOUSLY STATED, MY
ONLY GOAL WAS TO DO ALL THE NECESSARY APPLICATIONS ONCE, AT THE COMPLETION OF THE
COMPANY TRANSITION, WHICH, UNFORTUNATLY, TOOK LONGER THAN I ANTICIPATED.
