Relief Requested &Background
The application before the Board is for a special permit to allow for the temporary maintenance and use
of a trailer for business purposes, specifically for`seasonal'storage. The site is a developed with a three-
bay commercial/industrial;one-story building of 7,497 sq.ft. built in 2000. The site is located along
Enterprise Road in an area that has seen considerable redevelopment.
• Sometime after the construction of the building, a trailer/container units appeared on the site. According
to the April 26, 2001 site plan review file,the trailer/units measures 8 feet wide,40 feet long and 8 feet
high. It is apparently used for storage of seasonal inventory and may be needed for 3 to 5 years.
Procedural &Hearing Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
May 04, 2001. An extension of time for holding the hearing and for filing of the decision was executed
between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly
advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened
July 25, 2001, at which time the applicant requested and the Board granted a "Withdrawn Without
Prejudice."
Board Members deciding this appeal were Daniel M. Creedon, Gail Nightingale, Richard L. Boy,
Randolph Childs and Chairman Ron S.Jansson. The applicant, Ray Tricca, owner of Linray Fitness
Superstore, represented himself at the hearing. The applicant described the storage unit as storage
containers, and not a trailer. He cited the need for such, due to required volume buying of retail goods.
He noted that having moved from his previous location, he suffered a reduction in floor area and,there
fore, needed the bulk storage unit. The board members discussed the fact that the applicant owns the
entire building and only recently built it. It was noted that the applicant has applied, seeking a special
permit,to allow for a"Prohibited Use'. The board questioned if a variance would be needed rather than a
special permit.
After discussion,the applicant requested that the appeal be withdrawn without prejudice.

withdrawn without prejudice.

Linray Fitness Superstore, Ray Tricca, has applied for a Special Permit,under Section 2-6.1(3),to allow a
temporary container for bulk storage. The property is shown on Assessor's Map 294, Parcel 045 and
commonly addressed 87 Enterprise Rd., Hyannis, MA in a Business Zoning District.
Background & Review:
The application before the Board is for a special permit to allow for the temporary maintenance and use
of a trailer for business purposes, specifically for`seasonal'storage. The site is a developed with a three-
bay commercial/industrial, one-story building of 7,497 sq.ft. built in 2000. The site is located along
Enterprise Road in an area that has seen considerable redevelopment.
Sometime after the construction of the building a trailer appeared on site. According to the.April 26,
2001 site plan review file,the trailer measures 8 feet wide, 40 feet long and 8 feet high. It is apparently
used for storage of seasonal inventory and may be needed for 3 to 5 years. The trailer occupies one
parking space to the back of the building.
The proposal was reviewed at Site Plan Review on April 26, 2001 and found approvable with conditions
that:
• The trailers shall be completely screened (fenced) from view.
• .The units shall not be installed on jacks, but shall remain on a flat surface.
The applicant has applied for relief in the form of a special permit—citing Section 2-6.1. That section also
references back to Section 2-5 Temporary Uses. Those sections read as follows:
"2-6 Prohibited Uses
"2-6.1 Application and Scope: The following uses are prohibited in all zoning districts:

3) A trailer parked, stored or occupied for living or business purposes, except as specifically provided
for in Section 2-5 herein.
"2-5.1 Temporary Use Regulations: The following temporary uses are permitted in all zoning districts:
1) Temporary occupancy of a trailer during construction of a permanent home provided, however, a
Special Permit is first obtained from the Zoning Board of Appeals.
2) Temporary occupancy of a trailer for living purposes by non-paying guests for a period not
exceeding twenty (20) days in any calendar year provided,however,that the owner of land upon
which the trailer is to be located first obtains a permit from the Building Commissioner.
3) Temporary occupancy of a trailer as a construction office incidental to development of or
construction on the premises on which the trailer is to be located provided, however,that a
permit is first obtained from the Building Commissioner."
It appears that the special permit provisions for temporary uses of a trailer may only apply to residential
construction.
For background,there has been increased concern over business & office use of trailers. The Zoning �.
Ordinance appears to prohibit the use of trailers for business use. Building and Planning Division staff
have been in contact with several businesses on this issue (Cape Cod Potato Chip Corp., CVS Corp. and
The Bike Zone). In these cases, staff suggested that the available relief appears to be that of a temporary
variance. Staff has also placed one of these businesses in contact with a neighboring business that has
vacant space in an attempt to solve a storage problem. '~

In this particular case, the building is relatively new and built be the applicant. The need for seasonal
storage space should have been foreseen. According to parking calculations fn , d in the original 1999
Site Plan for the development of the building, 40 sq.ft. was committed retail businS use and 2qj 4�0
sq.ft. was co tted to storage (see attached.parkin _calculation chart).
The Board may wish to inquire of the applicant exactly h6tv'tlie building is eiiig used. Why there is-
insufficient storage given that 2,240 sq.ft. of the structure was committed to storage in the design and
development of the site.
Special Permit Findings:
The granting of a Special Permit requires the following finding of facts to be made by the Board:
• that the application falls within a category specifically excepted in the ordinance for a grant of a
Special Permit,
• that after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the
Zoning Ordinance and would not represent a substantial detriment to the public good or the
neighborhood affected.

• that a site plan has been reviewed by the Site Plan Review Committee and found approvable.
Suggested Conditions:
If the Board should find to grant a permit, it may wish to consider the following conditions:
1. Use of the building and site is limited to that cited in the 1999 approved site plan entitled"Site
Plan of land in Hyannis (Barnstable) MA" prepared for Raymond A. Tricca and dated 9-27-99
last revised 1-27-00. In that plan 5,240 sq.ft. is committed to retail business use and 2,240 sq.ft.
is committed to storage space.
2. The applicant shall delinedate and segment within the structure 2,240 sq.ft. reserved as storage
use only. That area shall generally not be avalible to the public as retail sales area.
3. The conditions of Site Plan Review,that the trailers shall be completely screened(fenced)
from view and that the units shall not be installed on jacks, but shall remain on a flat surface,
shall be enforced.
4. The trailer unit(s) shall not exceed 8 feet high, 8 feet wide, 40 feet long and shall be for storage
only.
5. The trailer units shall be removed within 3 years.

Information and Instructions
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As Quoted from the "law", an employee is defined as every person in the service of another under any contract
of hire, express or implied, oral or written.
An employer is defined as an individual,partnership, association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or
trustee of an individual,partnership, association or other legal minty, employing employees. However the owner of a
dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of
another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or
building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local Iicensing agency shall withhold the issuance or renewal
of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the
commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until
acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting
authority.

denied. The reason for this denial is that,due to the age of the children(less than two years nine months),
according to 780 CMR Section 308.3.1 the use group classification is I-2. Because of this use group
classification,Chapter 9 Section 904.5 requires a sprinkler system. This building presently lacks a sprinkler
system and,in all of our discussions,the installation of a system is what you wish to avoid.

Copy of Public Notice:
Linray Fitness Superstore, Ray Tricca, has applied for a Special Permit, under Section 2-6.1(3), to allow a temporary
container for bulk storage. The property is shown on Assessor's Map 294, Parcel 045 and commonly addressed 87
Enterprise Rd., Hyannis, MA in a Business Zoning District.
Background 8z Review:
The application before the Board.is fora special permit to allow for the temporary maintenance and.use of a trailer
for business purposes, specifically for 'seasonal' storage. The site is a developed with a three-bay
commercial/industrial, one-story building of 7,497 sq.ft. built in 2000. The site is located along Enterprise Road in
an area that has seen considerable redevelopment.
Sometime after the construction of the building a trailer appeared on site. According to the April 26, 2001 site
plan review file, the trailer measures 8 feet wide, 40 feet long and 8 feet high. It is apparently used for storage of
seasonal inventory and may be needed for 3 to 5 years. The trailer occupies one parking space to the back of the
building.
The proposal was reviewed at Site Plan Review on April 26, 2001 and found approvable with conditions that:
-The trailers shall be completely screened (fenced) from view.
-The units shall not be installed on jacks, but shall remain on a flat surface.

/The applicant has applied for relief in the form of a special permit- citing Section 2-6.1. That section also references
back to Section 2-5 Temporary Uses. Those sections read as follows:
"2-6 Prohibited Uses
"2-6.1 Application and Scope: The following uses are prohibited in all zoning districts:
3) A trailer parked, stored or occupied for living or business purposes, except as specifically provided
for in Section 2-5 herein.
"2-5.1 Temporary Use Regulations: The following temporary uses are permitted in all zoning districts:
1) Temporary occupancy of a trailer during construction of a permanent home provided, however, a Special
Permit is first obtained from the Zoning Board of Appeals.
2). Temporary occupancy of a trailer for living purposes by non-paying guests for a period not exceeding
twenty (20) days in any calendar year provided, however, that the owner of land upon which the trailer is to be
located first obtains a permit from the Building Commissioner.
3) Temporary occupancy of a trailer as a construction office incidental to development of or construction on
the premises on which the trailer is to be located provided, however, that a permit is first obtained from the Building
Commissioner."
It appears that the special permit provisions for temporary uses of a trailer may only apply to residential construction.
For background, there has been increased concern over business & office use of trailers. The Zoning Ordinance
appears to prohibit the use of trailers for business use. Building and Planning Division staff have been in contact with
several businesses on this issue (Cape Cod Potato Chip Corp., CVS Corp. and The Bike Zone). In these cases, staff
suggested that the available relief appears to be that of a temporary variance. Staff has also placed one of these
businesses in contact with a neighboring business that has vacant space in an attempt to solve a storage problem.
The 1999 Site Plan:
In this particular case, the building is relatively new and built be the applicant. The need for seasonal storage space
should have been foreseen. According to parking calculations submitted in the original 1999 Site Plan for the
development of the building, 5,240 sq.ft. was committed to retail business use and 2,240 sq.ft. was committed to
storage (see attached parking calculation chart).
The Board may wish to inquire of the applicant exactly how the building is being used. Why there is insufficient
storage given that 2,240 sq.ft. of the structure was committed to storage in the design and development of the site.
Special Permit Findings:
The granting,of a Special Permit requires the following finding of facts to be made by the Board:
...that the application falls within a category specifically excepted in the ordinance for a grant of a Special
Permit,
-that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning .
Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected.

Suggested Conditions:
If the Board should find to grant a permit, it may wish to consider the following conditions:

Little Feats Children's Center, Inc. is,a private, non-profit, culturally diverse early childhood program that
serves children betweens the ages of 3 months through 6 years. We are a comprehensive program, based on
the principle and appreciation of the growth and development of young children.We are strongly
committed to supporting children and families of multi-ethnic and social economic backgrounds living in
the Roxbury, Dorchester, Mattapan and Greater Boston areas. Little Feats Children's Center, Inc. promotes
positive experiences suitable to meet the needs, interests, capabilities and life situations of all families and
children.
As a viable member of the community we have been encouraged throughout our 8 years of operation to
provide not only an early childhood program for young children and support for their families, but a
partnership with secondary institutions in providing a modeled laboratory/training environment for college
level student and interns. We also are known for our collaboration with the public high schools from
general, special and alternative education programs with work-based experiences leading towards potential
careers in education.
Our Proposal
We propose to establish a similar program within the 4,500 sq ft. of space located at Lynray Plaza, 87 Enterprise
Road-in Hyannis,Mass. Our initial goal is to serve approximately 70 children between the ages of 2.9 years
through 6 years.After a period of 6 months we propose to add an infant and toddler component serving
approximately 27 children between the ages of 3 months through 2.8 years. The staffing required by the Office
for Child Care Services to meet the needs of all children should be no less than 13 staff members not including 2
Administrative Staff. We speculate that the hours of operation will be.between 7:30 a.m. through 5:30 p.m. All
