Hazard sought permission to construct a two story building for use as a Medical, clinic on premises located on Route 2$, Hyannis$ in an RCI District. Dr. Hazard was represented by Attorney Richard C. Anderson. Mr. Anderson was asking for a Special Permit under Section I, Para- graph 14u of the Zoning ,BF-Laws which required the operator of the profession to have his principal home or dwelling an the premises. He asked for relief from this requirement,: and based.his argwment on Article 136 dated Nisrah 25: 1972. Mr. Anderson stressed that the Baard of Appeals has the quthority to grant this as a SpecialPermit. However, in annier to a. questi.on by a Board member as to vhe-they a Special Permit or a Variance was being sought, Mr. Andareon stated that he would'accept a Variance, and that the application had been written to allow 'the alternative. The Board found that.vhat was being asked was in excess of what is allowed in Section T, paragraph 15, Sub paragraphs a, D and F. The intent of the Zoning By-lax waeld be derogated if this requ9st vu granted by a Special Permit. The Board found they -could not grant relief in this particular in- except by Variance. The Petitioner indicated to the ward that he mould not live on the pzw dyes, as required under the Special Permit section.. . With respect to the E�uestion of V*risnoe, there vas no evidence of Restrictions imposed substantial hardship within the meaning of Chapter 40A, Sea. 3,5, which related to the land involved. There were no oanditions ea- pscially affecting this parcel. The Board found that to allow this use in a residential district would derogate from the Zoning By- Laws. The vote of the Board was unanimous in denying this Petition. The Board of Appeals found.................................................... Attorney Stephen Jones represented the petitioner's. Peter Daigle and Steve Nowack, who are appealing a decision of the Building Inspector and petition for a Special Permit/Variance to construct an 8200 square foot office/retail building at Richardson Rd., and Route 28, Centerville. in a Highway Business zoning district. Per the recommendation of the Department of Public Works, new Plans have been submitted that comply with the concerns addressed by the DPW. The proposal is for"'the cofistruction of a two-story building to contain a total of 8200 square feet - the petitioner to occupy the first floor as well as Nowack Realty, while the second floor to be office space - presently divided into twelve (12) suites. In addition, the site to contain 70 parking spaces - to be no exit or entrance onto Route 28 - see Plans modified to eliminate the entrance on Route 28 and also widen the entrance on Richardson Rd., to twenty four (24) feet. Ron Jansson made a motion to deny variance relief with reference to the rear setback - the motion was seconded by Dexter Bliss - The Board voted unanimously to deny the variance request as there are no variance conditions present - no hardship presented. Ronald Jansson made a motion to grant the Special Permit with the restrictions that the reconmendations of the Department of Public Works be complied with, and that the use be limited to professional office use only. The motion was seconded by Dexter Bliss. In addition, the Board requested that a copy of the new revised Plan be submitted, based on the imposed restrictions. Luke Lally, Gail Nightingale, Ronald Jansson and Dexter Bliss all voted to grant the Special Permit to construct an 8200 square foot office building at Route 28 and Richardson Road, Centerville . I had perceived that we had had a productive discussion with you, Eliza Cox, Growth Management staff and the Town Manager regarding the Town's concerns relating to the proposed move of Blanchard's Liquors,to Route 28; a congested traffic corridor in close proximity to the Barnstable Middle School, a housing development and a church. I thought that this discussion had resulted in a firm commitment on your part to explore alternative sites. When I subsequently spoke with you, I indicated that it would be logical to first pursue alternative locations, because obviously if an alternative location was feasible, it would be counterproductive for your client to invest money on additional traffic studies and the like. In the event that the investigation of alternative sites proves unproductive, then the Town would be willing to review in more detail the traffic issues you raised. However, this is all with the understanding, as we discussed in our initial meeting, that the Town would reserve its right to refer the matter to the Cape Cod Commission as a discretionary referral if staff still determined that the regional impacts of the proposal merited referral. On your agenda was a discussion of the proposed plans by Donald Corey,owner of Blanchard's Liquors, for the construction of a new liquor store on the land which he recently purchased on Route 28 in Centerville_.__, This is the location of the land previously owned by the Knights of Columbus. As direct abutters to the back residential lot purchased by Mr. Corey,we would like to make several comments based on the discussion which Nancy heard at your meeting today. We would like to see as many of the proposed parking spaces as possible be located in the front of the proposed building, as are indicated on his plan.These spaces would be along the Route 28 side of 0- the proposed new building to be constructed. It is strongly suggested that additional parking spaces 0 needed be located along the westerly side of the proposed building. We request that any spaces r� developed behind the proposed building be kept to an absolute minimum. We value our privacy and the quiet of QuissetVillage. This is what drew us to Quisset Village 23 years ago. We very much like Mr. Corey's plans for the new Blancihard's Liquor store. We support this new development as long as any noise generated by this enterprise be mitigated as much as possible. Mr. Corey is respectful of this need and has assured us that noise will be kept under control. Mr. Corey has shown us plans for the planting of evergreen trees along the treed ar.6as behind the proposed new building. It was at our request to him that this be done to help buffer noise and sounds coming from this new development. Our property abuts the treed area to the rear of the existing Knight of Columbus building. This treed area has always acted as a buffer to our property and any noise generated by the Knights of Columbus. It is imperative that this treed area be maintained as currently exists. Mr. Corey's plans do not call for any cutting of the treed area in question. We would ask that your Committee not put any stipulations on the development of the new liquor store which would cause any of the existing trees to be removed for any reason.
