My client opened a design center in the property located at 73 Falmouth Road, Hyannis, Massachusetts. They have a free standing roadside sign containing 30 square feet of signage (see photo enclosed herewith dated 2/10/2010). They requested a permit to add additional signage over the portico above the entrance way to their gallery and were told that the roadside sign consumed all of the allowable signage for this location. After reviewing the zoning ordinance, I do not agree with that conclusion. The property at 73 Falmouth Road houses two businesses, California Closets and Marvin.Design Gallery. The entire building has approximately 70 feet of - frontage on Falmouth Road. California Closets has approximately 40 feet of frontage and Marvin Design Gallery has approximately 30 feet of frontage. It was -explained to my client that in applying the provisions of the Town of Barnstable sign ordinance to determine the amount of signage allowed they can only count the frontage for the portion of the building they occupy. Section 240-62 deals with the determination of area of a sign. Section 240-62 E provides as follows: "For the purposes of these regulations, the area of a building face or wall shall be calculated by using a height of no more than 10 feet - from the ground multiplied by the width of the building front." Section 240-65 deals with signs in business and highway business districts. Section 240-65 A provides that "Each business may be allowed a total of two signs." This section of the ordinance clearly anticipates that there may be more that one business located in a building. Section 240-65 C states that "The total square footage for all signs of each business shall not exceed 10% of the area of the building wall facing a public way or 100 square feet, whichever is a lesser amount." To determine which limitation applies you have to look back to Section 240-62 E to determine "the area of the building wall facing a public way". Pursuant to the provisions of Section 240-62 E, you calculate the area of the building wall facing the street by using a height of no more than 10 feet from the ground multiplied by the.width of the building. It does not limit each business to the width of the portion of the building it occupies. Section 240-65H lends additional support to the conclusion that the sign code anticipates there being more than one business in a building and allowing each business to use the full amount of frontage to calculate the amount of signage allowable. Section 240-65 H provides as follows: "When two or more businesses are located on a single lot, only one free standing sign shall be allowed for that lot, except as provided in this section, in addition to one wall or awning sign for each business. If approved by the Building Commissioner, the free standing sign can include the names of all businesses on the lot." This section limits the multiple businesses to having only one free standing sign on the lot. However, it authorizes each business to have an additional sign on a wall or awning for the business. The proposed wall sign over the portico to my client's gallery meets this description (see the photo of the proposed sign enclosed herewith). The manner in which the Town of Barnstable is interpreting the sign ordinance could result in a business having no right to any signage. If for example, you had a rectangular shaped building housing two businesses with one in the front and one in the rear, only the business in front would be entitled to a sign. The business in the rear of the building would not be entitled to any sign due to a lack of frontage. Clearly that is not the intent of the ordinance. The sign proposed for the portico over the entrance to my client's gallery is 10 feet long by 44 inches tall. The sign would consist of approximately 37.5 square feet. This would be in addition to the 30 square feet of signage that my client has on the free standing sign along the side of Falmouth Road. The total square footage of 67.5 feet is within the total signage allowed under the zoning ordinance when you apply the provisions of Section 240-62 E as written. My Client is hosting a Hyannis Area Chamber Business of Commerce Business After Hours on September 21, 2011. It is their hope that they can put their sign above the portico prior to this event. I ask that you reconsider your staff's decision to deny the application for a sign permit for this sign and to grant them I the permit so that they can install the sign prior to the Chamber of Commerce event. The committee gave a negative response to my inquiry as.to.the possibility of adding a beer and wine license to my client's business known as the Craigville Beach Grille. After reviewing the DCPC regulations for the Craigville Beach District it is my opinion that my client should be allowed to proceed to the Licensing Authority to request a Beer and Wine License. I am writing to request that the committee reconsider its decision. The Craigville Beach Grille is a "Small-Scale Food Service" establishment as defined in Section 240-131.3 of the reaulations. The business is located within the Craigville Beach Neighborhood Overlay District as set forth in Section 240- 131.7. Under Section 240-131.7 F.(1)(b) a Small-Scale Food Service Establishment is a permitted use in the Craigville Beach Neighborhood Overlay District. 7 The definition of Small-Scale Food Service Establishment is silent as to the service of any kind of beverage. It does not specifically allow the service of soft drinks or, conversely, prohibit the sale of alcoholic beverages. However, a rational interpretation of the definition of a Small-Scale Food Service Establishment would include the'service of beverages. The issue,.is whether adding a beer and wine license to a conforming use constitutes an expansion or alteration of an existing conforming use. If this food service establishment was located in another district and was an allowed use, no further zoning relief would . be required to add a Beer and Wine License. Even if you consider the addition of a Beer and Wine License to be an expansion or alteration of a conforming use, Section 240-131.4 (d) of the regulations specifically states"Changes, expansions, or alterations of existing conforming or non conforming usesrand structures lawfully existing are permitted subject to the following:". Although this section clearly states that changes, expansions or alterations to conforming uses are permitted, it does not set forth any criteria to which a change, expansion or alteration of a conforming use is subject. Since this section of the regulations allows for changes expansions or alterations of conforming uses and does not set forth criteria that must be met the addition of a beer and wine license to a Small-Scale Food Service establishment should be allowed as a right, subject only to Licensing Board approval. I ask that you review the earlier decision made by the committee interpreting the DCPC regulations based upon the contents of this letter.
