Evers and Charles A. Lindberg applied for a Special Permit pursuant to Section 240-92.13 — Nonconforming Buildings or Structures Used as Single and Two-Family Residences. This section of the Zoning Ordinance allows the expansion of a preexisting nonconforming single family dwelling by Special Permit providing the expansion will not be substantially more detrimental to the neighborhood. The property is located at 191 Fifth Avenue, Hyannis, MA as shown on Assessor's Map 245 as Parcel 106. It is located in the Residence B (RB) Zoning District. The Applicants propose to demolish an existing garage and breezeway and construct a new garage with living space above. The existing property is located in the flood zone and the new construction will bring it into compliance with flood zone regulations. According to the site plan submitted, the subject lot is 10,000 square feet and is located within FEMA Flood Zone AE (EL 12). The lot is nonconforming in that it contains 10,000 square feet where 43,560 square feet is required and the existing dwelling is nonconforming in that it has a 3.9 foot side setback where 10 feet is required in the RB Zoning District. All other bulk regulations are conforming. According to the Assessors records, the lot contains a principal one bedroom dwelling of 1,960 gross square feet (1,176 square feet of living area) with an attached one car garage, and was constructed in 1947. The lot overlooks marsh and an inlet waterway which drains into Nantucket Sound. Procedural & Hearing Summary Special Permit Application No. 2018-005 to demolish an existing garage and breezeway and construct a new garage with living space above was filed at the Town Clerk's office and the office of the Zoning Board of Appeals on December 18, 2017. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on January 10, 2018 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were . Alex Rodolakis, Jacob Dewey, Paul Pinard, David Hirsch and Herbert Bodensiek. Attorney Paul Tardif represented the Applicants before the Board. Attorney Tardif described the project and stated the homeowners must lift the dwelling 18 inches to comply with FEMA regulations. The project includes demolishing the existing garage and breezeway and constructing a new garage with living space above, and breezeway. Attorney Tardiff provided the Board with an email from an abutter, Thomas Sousa, in support of the application. Findings of Fact At the hearing on January 10, 2018, the Board unanimously made the following findings of fact in Special Permit Application No. 2018-005, a request to demolish an existing garage and breezeway and construct a new garage with living space above: 1. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Section 240-92 allows for the expansion or alteration of a preexisting nonconforming structure used as a single-family residence with a Special Permit. 2. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The Board found that the alterations would have very little impact to the public good or to the neighborhood. 3. The proposed expansion of the dwelling will not be substantially more detrimental to the neighborhood than the existing building or structure. Special Permit No. 2018-005 is granted to Staci A Evers and Charles A.
