According to the Building Division file, a 1996 inspection documented that the units were that of lodging and no full kitchen existed in the unit. The unit is a one bedroom unit located in an area of the basement. That addition was permitted in 1971. Procedural Summary: This appeal was filed at the Town Clerk's Office and the Office of the Zoning Board of Appeals. A public hearing before the Zoning Board of Appeals Hearing Officer was duly advertised and notices were sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on August 22, 2001,at which time the Comprehensive Permit was granted with conditions. The Hearing Officer, Gail Nightingale,presided over the public hearing. The applicant,Deborah Gigante, represented herself at the hearing. Also present were Paulette Theresa-McAuliffe, Program Coordinator, Office of Community and Economic Development;Art Traczyk, Principal Planner, Planning Division; Thomas Lynch,Barnstable Housing Authority; and Bob Shea, Inspector. Findings as to Standing and The Comprehensive Permit: The Hearing Officer made the following findings of fact: 1. The applicant had submitted a copy of a recorded deed,No. 110674, recorded in May 01, 1987, documenting her ownership of the property. A site approval letter dated August 20, 2001, from Kevin Shea,Director, Office of Community&Economic Development, cited that the application was reviewed and found to meet the threshold criteria established for the Accessory Affordable Housing Program. The subsidizing agent and program is the Town of Barnstable, Office of Community and Economic Development, Community Development Block Grant. 2. The applicant is Deborah Gigante with an address of 64 Hampshire Way,Hyannis,MA 02601. She is requesting a Comprehensive Permit to convert a lodging unit into an accessory affordable apartment rental unit. The unit was once is a pre-existing unpermitted apartment that existed prior to 1987. The apartment unit was documented by the Building Division as being in existence in 1995, prior to the November 16,2000, enactment of the "Accessory Affordable Housing Program". The unit qualifies for the program. 3. The unit is a one bedroom unit that staff estimates at approximately 640 sq.ft. located on the lower level of the single family dwelling. 4. Town staff has reviewed the application and the Barnstable Housing Authority has completed an inspection of the unit. The.May 11,2001,inspection found that the unit was in need of some. minor repairs in order to bring the unit up to today's standards. The noted items included repairing the lock on the sliding glass door leading in and out of the unit and installing a proper egress in the bedroom. The applicant is aware that the Building Division of the Town shall inspect the unit to assure it meets with all state and local building codes prior to the issuance of occupancy permit. 5. The house is connected to the public water supply. The 1971 building permit documents that the addition conformed to the then requirements of an on-site wastewater septic system. 6. The applicant shall comply with the "Accessory Affordable Housing(Amnesty) Program Affidavit" signed by the applicant and shall comply with Article LXV of the Town Ordinances,which includes their agreeing to sign the "Regulatory Agreement&Declaration of Restrictive Covenants". 7. The applicant understands that the affordable unit will be rented to a person or family whose income is 80% or less of the Area Median Income (AMI) of Barnstable-Yarmouth Metropolitan Statistical Area (MSA) and further agrees that rent (including utilities) shall not exceed the rents established by the Department of Housing and Urban Development (HUD). 8. The Barnstable Housing Authority has committed to the monitoring of this affordable rental unit. The maximum allowable rent for two people for this one-bedroom unit in today's dollars is $774.00,including utilities. The tenant's annual income for one person cannot exceed $29,250.06 and for two people cannot exceed$33,400.00. The applicant has requested that occupancy be restricted to no more than 2 persons. Based upon the findings, the Hearing Officer ruled that the applicant has standing for an affordable housing Comprehensive Permit under MGL Chapter 40B and the Town of Barnstable's program for Pre-existing Dwelling Units in Existing Structures,Article 65 of the General Ordinances. The project is also deemed consistent with local needs because it adequately promotes the.objective of providing affordable housing for the Town of Barnstable without jeopardizing the health and safety of the occupants provided all conditions of the Comprehensive Permit are strictly followed. Ruling and Conditions: 2 Based upon the findings, a ruling was made to grant the Comprehensive Permit in accordance with MGL Chapter 40B. The grant of this Permit is to the applicant Deborah Gigante, residing at 64 Hampshire Way, Hyannis,MA. It is issued to allow for an existing one-bedroom lodging unit to be converted to an accessory affordable rental housing unit in an owner-occupied single family dwelling in accordance with the following conditions: 1. Occupancy of the affordable unit shall not exceed two people. 2. To meet the requirements of affordability, the cost of housing(including utilities) shall not exceed 30% of the 80% of the median income for a single individual or two people as the case may be for the Barnstable-Yarmouth MSA. Rents and utilities for the affordable unit shall not exceed limits set by the U.S. Department of Housing and Urban Development (HUD). Those limits can be secured from the Barnstable Housing Authority or from the agent of the town implementing this program. Today it is the Program Coordinator. 3. All leases shall have a minimum term of one year. 4. Those items identified in the May 11,2001,inspection as in need of repair and improvement shall be done. The applicant shall have the unit re-inspected by the Building Division to assure that all necessary improvements are made to meet minimum state building and fire-codes. 5. The applicant may select their own tenant(s) provided the tenant(s) meet all requirements of the program and provided that person(s) income is reviewed and approved by the Barnstable Housing Authority as a qualified individual. The applicant will be required to work with the Housing Authority to provide information necessary to document that the tenant(s) qualify. The unit shall be rented on an open and fair basis. When a vacancy occurs, the unit must be listed as available with the Barnstable Housing Authority and Housing Assistance Corp. The applicant must notify the monitoring agent of a vacancy whenever it occurs. 6. Every twelve months the applicant shall review the income eligibility of those individuals occupying the unit. No later than July 30th of each year, the applicant shall file with the Barnstable Housing Authority a yearly affidavit listing the rent charged and income level of the occupant(s). The applicant shall provide any additional information deemed necessary to verify the information provided in the affidavit. Upon any report from the Barnstable Housing Authority that the terms and conditions of this permit are not being upheld, the Zoning Board of Appeals or its Hearing Officer shall have the ability to hold a hearing to show cause as to why this permit should not be revoked. The Authority may charge a fee for the yearly review and monitoring service not to exceed that normally charged. 7. This Comprehensive Permit shall not be transferable to any other person or entity without the prior approval of the Hearing Officer or Zoning Board of Appeals. If the ownership of the property is transferred, the Barnstable Housing Authority shall be notified within 60 days the name and address of the new owner. 8. All parking for the dwelling and accessory unit shall be accommodated on site. No over night parking of vehicles shall be permitted within the right of way of Hampshire Way. No overnight parking of commercial vehicle shall be allowed on the property. No lodging shall be permitted and no conditional use special permits shall be issued to this property for the duration of this comprehensive permit. 9. This Comprehensive Permit must be exercised and the unit occupied within 12 months of its issuance or it shall expire. Ordered: Comprehensive Permit 2001-94 has been granted with conditions. This decision, the Regulatory Agreement and Declaration of Restrictive Covenants,Agreement Affidavit and all other necessary 3 documents shall be recorded at the Barnstable County Registry of Deeds for it to be in effect. The relief authorized must be exercised in one year. Appeals of this decision,if any, shall be made`to the Barnstable Superior Court pursuant to MGL Chapter 40A,.Section 17,within twenty (20) days after the date of the filing of this decision in the office of the Town Clerk. The defendant was to be a boarder with a bed roan, bath roan and sitting roan with kitchen priveledges. At a point in time in June last, the defendants female companion took-up residency with him and systematically emrked on a scheme to change the "boarder status" of the defendant to a "tenancy". Being that the defendant was (is) a boarder, when I could not get.his female companion, Karen Smith, to leave, I started my action to evict by terminating a tenancy at will, rather than obtain a trespass order against Karen Smith. 3. In respect to the issue of inability to find another residence, I find this claim to be frivilous. There are more than sufficient available rentals in the classified advertisements. It is my belief that the defendant.has embarked on a scheme to confound the eviction process because of the discovery of the attached "Fadiibit A" which was found on the ground outside of the defendants door. (copy.attached) Although it is intended as a guide to a tenants rights in the face of an unjustified eviction,' in this case it is clearly being used to the effect of an-ABUSE OF PROCESS. PL1IM'IFF'S CLAIM FOR DAMAGES 1. The defendant is the only person to occupy the subject premises since it was recarpeted as a result of an oil tank leak. The carpet now has many cigarette burns and-is badly soiled to the point that it will require replacement. The cost of the new carpet as installed was $1,000.00 ( one thousand dollars ). I hereby make claim for $1,000.00 against the defendant for damage to the carpet. 2. Along with damages to the carpet, there are several cigarette burns on the acrylic bath roan sink that were not there when the defendant took occupancy. I hereby make claim for $150.00 against the defendant for damage to the bath room sink. 3. Being that the defendant had little or no furniture, I allowed him the use of and antique mahogany table that was in excellent condition valued at $450.00.
