DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two,-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,bylaws,rules and regulations. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such ,. work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. Decisions of the Zoning Board of Appeals Nos. 1972-90 and 1972- 91 as recorded and rerecorded and letter 'from- Board Chairman indicating nc restriction. on life of variance; 4 . Deed from the O'Donnells 'to Mark L. Tomaiolo and Carol-Lynn Tomaiolo of LOT 7 recorded on January 26, 1996 and from mark L. Tomaiolo to the current owner of record of locus, Carol-Lynn Tomaiolo, recorded on .March 20, 1997; 5 . Deed of LOT E from the O'Donnells to Jonathan M. Bischof et ux, the current owners of record, recorded on July 14, 2000; and 6 . Under the Zoning Enabling Act in place when the above variance: decisions were rendered, there was no time limit within which the variance must be exercised other than, perhaps, "radically changed conditicAB at the locus, including changes brought about by JUN-06-2003 14:06 KILROY AND WARREN 15087757526 P.03f26 r v revisions of a zoning ordinance or by-law" , see Hogan v. Hayes, 474NE2d1158 (1162) , copy enclosed. In that case, the Court, in dictum, suggested that a variance issued prior to the effective date of Chapter 808 of the Acts of 1.975 (in Barnstable that date was November 5, 1977) , probably has unlimited life subject to the above cited radical . changes possibly terminating 'the rights granted . thereunder. As indicated above, a building permit was presumably issued to the Bischofs for the construction of a single family residence on LOT 8 in 2001 . A determination must have been made by the permit issuer that no radically changed conditions at the locus had occurred so that the relief allowed by the variance decision was Still in effect. The general area, as shown on the subdivision plan and assessors, plans and records is comprised of lots similar in size to the locus and on most of which lots are located existing single family residences . Most all of the lots in the general area are undersize under the current acre zoning. It is my opinion that you may grant a permit to my clients for the construction of a single family residence on LOT 7 as allowed by the variance decision without any additional relief from the ZBA. In that case, the Court, in dictum, suggested that a variance issued prior to the effective date of Chapter 808 of the Acts of 1975 (in Barnstable that date was November 5, 1977) , probably has unlimited life subject to the above cited radical changes possibly terminating the rights granted , thereunder. As indicated above, a building permit was presumably issued to the Bischofs for the construction of a single family residence on LOT 8 in 2001 . A determination must have been made by the permit issuer that no radically changed conditions at the locus had occurred so that the relief allowed by the variance decision was still in effect.. The general area, as shown on the subdivision plan and assessors' plans and records is comprised of lots similar in size to the locus and on most of which lots are located existing single family residences . Most all of the lots in the general area are undersize under the current acre zoning. It is my opinion that you may grant . a permit to my clients for the construction of a single family residence on LOT 7 as allowed by the variance decision without any additional relief from the ZBA.
