Mr. Milnes'contractor is doing the spreading of the stone on his own driveway.As far as I can see,the complaint of Mr. Milne, relative to the destruction of his driveway, has been satisfied and I no longer have any objection of the issuance of occupancy. Regarding the issue of Mr. Burns and Mr. Milnes driveway width,this is not specified in the"Road Opening Permit Regulations"and I don't have regulatory authority over that issue. I hope this is the end of the towns involvement with this issue. I spoke to the property owner regarding the driveway complaint I received on this property. Engineering has a road opening permit on file for the new driveway. Since the neighbors complaint is that their driveway was damaged by the installation of the new driveway @#37 Harbor Road, I still need to resolve this issue. Please hold occupancy and any road bonds you may have in file until I can resolve this complaint. I left a message with Mr. Burns and I will attempt to contact him again regarding this issue. I spoke to Tom Perry and he said that the CO could be held until I resolve the complaint. Lots 1; 2, & 4 have existing houses on them. Note: lot #4, 33 Harbor Road, utilizes a separate drive. Apparently, the new owner of Lot#3, 37 Harbor Road, (Mr. Richard Burns, of Weymouth, Massachusetts), is intending to split the 20' common driveway down the middle and create two (2), 10' driveways, (as shown on the Plan dated April 24, 1984). Mr. Burns plans to create the split by erecting fencing, starting at the Harbor Road driveway entrance, which I have learned Lot#1, 49 Harbor Road, has used for 41 years, and Lot# 2, 39 Harbor Road has utilized as access for 7+ years. From a functional standpoint, this will not provide acceptable access for fire department vehicles to access the structures on these sites, as required by the Building Code (780 CMR:9.03.1.1.2) Each property owner has a ten foot wide strip of,land. Ten feet is the minimum acceptable clearance width needed to.nay.igate a fire, engine in a straight line.--Additional width is needed to accommodate-our apparatus for turning. With the driveways not being accessible to pass a fire truck, our fire hose will have to be pulled in from the street. The expected distances of 125 - 200 feet, (please see subdivision plan book 386 page 88, map 306.174.2), exceed that of our prepacked hose on the fire engines. This will necessitate the addition of more hose. Hand laying fire hose up these driveways will delay our response to a fire in these buildings, and prevent us from bringing additional apparatus into the fire. This scenario would cause additional property damage, and could ultimately effect the life safety of the occupants. Not being able to bring an ambulance up close to the buildings is an additional concern. Life saving equipment and personnel accessing a patient in need will be delayed. The patient's comfort care would be negatively impacted while being hand carried down a long driveway to an ambulance parked far away. It is our opinion that the driveway access plan, as currently laid out, will hinder Fire and EMS access to the properties, and a better arrangement needs to be worked out. From a safety standpoint, we feel the parties would be better served by a single common and shared drive, such as, the 16' driveway shown on an earlier plan dated and recorded at the Registry of Deeds, September 5, 1958, Plan Book 143/page 113.
