Dear Mr. Daluz :
Please be advised that the undersigned represents John and Marilyn
Rogers, who are abutters to property located at 71 Harbor Road in'
Hyannis, Massachusetts, for which the above Building Permit was
issued on January 14, 1986 .
My clients have reason to believe that the current construction pro-
ject consisting of the renovation of an existing garage on the
premises, will include living quarters, bathroom facilities, and.
possible kitchen or cooking facilities. Locus, which consists of a
single-family residence and the garage at issue lies within a Resi-
dence B District. Because this district permits only a detached one-
family dwelling, the current work at the garage is not permitted
under the Zoning By-Law.
Although the original garage, which was constructed over 40 years
ago, contained -a commode and sleeping quarters for a chauffeur, my
clients believe that this particular use of the garage was abandoned
several years ago and has therefore been abandoned in excess of two
years. Furthermore, my clients suspect that the current renovations
represent a significant modification of the original use of the
garage, and as a result, consist of an extension or modification of
a non-conforming use. Accordingly, the current construction is not
a lawful renovation of an existing non-conforming use, but is an
attempt to restore or extend a non-conforming use that was abandoned.
Pursuant to Massachusetts General Laws, Chapter 40A, Section 7 , I
hereby request on behalf of John and Marilyn Rogers, that you enforce
the Zoning By-Laws of the Town of Barnstable, by revoking the above
Permit.
