Barnstable Building Division Zoning Enforcement MS.Robin Anderson 200 Main Street Hyannis,MA. 02601 RE: 104 A.&B.High School Road,Hyannis,NU. Certified# 7003 2260 0001 8555 9041 MS. Anderson, In response to our phone conversation this past Thursday,February 26th. I've enclosed a copy of what I've spent several days working on for the Health Inspector, Mr. O' Connell who is also located there in your building at 200 Main Street, Hyannis, MA.. My assumption prior to speaking with you was that he would be the contact person to resolve the issue of the#104 A. & B. High School properties with what we contend as a being legitimate Two Family home. Of course,.in addition to the"alleged Infractions" levied by his department, also for the 104 -A. High School Road apartment. For your review, I've enclosed a copy of the eight page response we forwarded to Mr. O' Connell's concerns, dated 02-27-2009, Certified Number: 7003 2260 00018557 9575. I'll ask that you please take the time to review it's full contents. I certainly understand that, (as you stated by phone last week)there are"holes in the recording process & system in Barnstable County"and sometimes things are not properly addressed or recorded as they should be. With that, I'll ask that you take into consideration the time frame and procedures that were in place back there in the late 1980's. As I hope you're able to observe within my communication to Mr. O' Connell, I've done my best to reconstruct the process we undertook to meet the requirements of the Town Code present during that time period. You further suggested we should, "do our best to produce Tangible Evidence to make our case that the 104 High School Road property is in fact a Two Family" as we claim. I submit that I've done just that within the eight pages produced for both Mr. O' Connell and now for you also. Within that communication it clearly gives the names of Three Barnstable Inspectors involved, the Building Commissioner we worked with who was,at that'point&time the person in charge of such undertakings and decisions. In addition to the company, (S.V. Raleigh) and person in charge there that we worked with. i A company mind you that was suggested to us by the Building Commissioners Department, to be certain such a project would In fact be performed properly at that. address that company being a1icensed entity in Barnstable County and the State of Massachusetts. And please keep in mind, this was no simple task, and this company, (S.V. Raleigh)was secured not only be certain we were in compliance with Town Code but so we would also . be certain all work being done was proper thereby avoiding any risk or Injury to future tenants once it was completed. Upon the (S.V. Raleigh) company being engaged to do this project, a Permit from Town Hall was, "pulled" as was the terminology used by Mr. Raleigh for the undertaking of such, (to re-install the Two Separate Electrical Meters on that home) as they were so many years prior to our even purchasing that property. For S.V. Raleigh Company to complete this process they first had to contact Commonwealth Electric Company to send a large yellow Service Vehicle out to drop or disconnect the electric service line from the Pole to the House. S.V.Raleigh Company then split those Utilities in Two by installing two Brand New Separate Electric Meters on the back side of that structure. Then Installing a large "Conduit Pole" also on the back side of that home to carry the Newly Installed Separate Electric Meters Power to the Two Electric Service Panels he also Installed on the wall in the basement of that property. Following that process, service from Commonwealth Electric Company was once again requested, (I believe the following day.) They came out and reconnect the New electric cable to there pole from that property and then turned on,the service or power to that now Two Family Home. Upon completion of the scheduled, (and Town Permitted work) Mr. Raleigh, "called for Inspection" from the Town of Barnstable's Electrical Inspectors department to confirm we were"Up to Code and in compliance"with his efforts. I believe it was no more than 24 hours following his request of"Calling for Inspection" before a Town Inspector came out to that address. He reviewed the completion of S. V Raleigh's work and passed it for final Inspection. Again, I stress the point that was not a simple process whereby, "someone"would have simply attached Apartment Numbers to the exterior wall of a home and then began calling it a two family. Additionally, dividingwalls=wereah_ en.constructed within the Interior of that property, a New Kitchen Sink and counter top and Stove were also installed in the rear apartment. Also needing electric wiring run to them,-(again work achieved by S.V. Raleigh Company.) r. i Two more points of interest that should most definitely be taken into consideration: We've held a Lodging House License for the adjacent property at 98 High School Road I believe since 1981. This property being right there, abutting that home at 104 A. &B. High School Roads driveway. It's actually a double wide driveway for both structures to be using. When purchasing that property at 98 High School Road it was nothing more than a simple, Three Bedroom Home back in 1980/81. From that point forward, (and over these past 29 Years)we have made Immense and countless Structural advancements and adjustment. Bring that property & address to what is presently, a Six Bedroom with Seven Private Baths, Licensed Lodging House/Bed& . Breakfast facility,to include a Managers apartmerit.today,. I'll have you know, every single Improvement done at that address, (over these past Twenty-nine years)has first been presented to, reviewed by and then authorized through the Building Commissioners Departments. iAnd then Permitted by and of course Inspected by that very same Barnstable County Building Inspectors Department and the associated departments following such procedures of work and Improvements being appreciated. Not once have we done anything without first seeking the approval of Commissioner Daluze or whoever was in charge of Licensing and or Permitting at that point&time. In addition,we have never, (not once ever) been refused our renewal for this Lodging House License at that location.Nor has it ever been Suspended or Revoked for any Infractions what so ever.! Specifically and from my recollections, we have never had any Code Violations beyond, (or more serious than)a Fire Extinguisher not having a current recertification Tag from Ralph Perry's Company displayed on it, or a simple Light bulb being out in one of the EXIT Signs or a battery being dead in one of the Emergency Exit Lights.. That's it.! And all these claims can be easily Confirmed as Exact&Precise Truth by Inspector Eric Heubler at the Hyannis Fire Department with his coming and going while Inspect our Inn annually for more years than I can recall.! With us having such a clear& clean record of following Town of Barnstable Rules, Regulations and Building Code, To a T at that location, what could possibly be the motivation for us to do such a thing as you're suggesting at a property just Ten Feet away.?For what your suggesting has occurred at that 104 High School Road address there's plain& simply No Logic.! Please, take note: For these past Twenty-nine years,we (as I've explained)have had all of the Barnstable Code Enforcement Officers and Inspectors arriving at and parking in our rear parking lot. area of 104 & 98 High School Road there in Hyannis, MA. for our"Annual Lodging house License Renewal process. And then, with each of them walking the length of our driveway down to enter the front door of our Inn, (sometimes in groups)to conduct there"Annual Inspections"of the entire property at 98 High School Road, as is required to retain our Lodging House License. Following there interior Inspections, they would continue by filing back outside of the Inn and conduct an Exterior Inspection of all four sides of the Inn and it's property to be certain there were absolutely no Infractions of Code that property, structurally or otherwise. I'll ask that you consider returning to the structure in question at 104 #A. &B. High School Road and simply view it's proximity to the location of our Inn. If you do,you will observe that it's clearly the adjacent home right there across the driveway, (just ten feet away from our Inn.) I'll ask that you observe the Bold Black Numbers &Letters mounted on the exterior wall of that home facing the long, (and only possible access driveway between both of the properties.) Bold Numbers clearly posted and located at each of the two side entrance doors of#104- A. & 104-B. High School Road. You might also take note of Two New Black Mail Boxes mounted next to or above each of those Bold Numbers & letters stating#104-A. &#104-B. High School Road. Those Black Mail Boxes for each of the Units are Newly Installed, (just two years ago) by myself with the original one's I also personally mounted in those exact same locations needing to be replaced. Due to there rusting away to the point of the bottoms of them rotting out over these past 19 YEARS since that property was properly authorized by Commissioner Daluze to be converted back into a Two Family residence. And as can also be seen, the Black numbers & letters in question that signify the property as two separate rental units are faded away to a light color of Grey/Black from there being installed there on that exterior wall of the house for the past Nineteen years of Winters and summer and weathering of all sorts also. Presently, I don't have a photo here in California of the#104-A. numbers axed to that -structure but sadly, with us loosing a Very Dear family friend this past April 71h. to a tragic accident,we do of the#104-B. I'll apply those photo's here &now for your review: _ EZ. . 7 T Plg a 4 These numbers&yletter were purchased by me, brand new, some 19 years ago upon Mr. Steve Raleigh completing the Instillation of the Two Separate Electric Meters at that address. And then, the Town Inspector coming to that property the following day to pass his work and that property as a Two Family Home. With that being explained,I'll ask that you consider this: With your visiting the property & address in question and then drawing the opinion you did, that it is not a properly zoned two family home. Why would and how could it possibly be that Five (or more)Inspectors who Converged on,those two properties, (Nineteen times,Annually) over these past Nineteen Years with them standing in that exact same location that you stood in,Never Once raise the Questions you presently are that a"Violation of Town Code"has been committed.? Again that's, "approximately"Five Inspectors over 19 Consecutive Years of Visits to that same location. That would be somewhere in the area of a grand total of One Hundred Visits by Barnstable Town Inspectors. With all of them, being trained and experienced Officials who look for Code Violations every day of there life long careers staring directly at those Bold Black House Numbers &Letters I personally affixed to the side of that home following the process as explained above afforded us the Right to Transform that home into it's previous status as a Duplex. I'm just curious If you find this information, (that can be viewed as Nothing less that FACT)to be Compelling Evidence as confirmation that our claim that the address in question was approved as for what it presently is and has been for some 19 YEARS now. And, according to Commissioner Daluze and the Book/Ledger he personally allowed me to view in his Office, showed written Proof that the 104 High School was a Multi Family Dwelling may years before I even came along. And I'll ask that you please, not take what I'm attempting to articulate too you as offensive in any way. In reality, that couldn't be any further from the trust. I'm simply concerned and yes, extremely frustrated by this situation so many years after the fact and also from your comments to me by phone this past Thursday,February 26th. that I am"only speaking Hear Say"when I offered these explanations to you as it they developed back in 1989 or 1990. I'm hopeful, (from what I've explained to you in this correspondence)that it's more than clear, I'm stating FACT when I speak about, our Annual Lodging House License and the amount of Inspectors who visually reviewed everything on those properties each of the 19 Years since the Legal Transformation of 104 was completed bringing it back to a Two Family Home. Additionally: What I've expressed to you above Is Complete Truth.! I am an x-resident of Barnstable County but for the twenty plus years I did In fact reside there. And during those, "twenty some years" I pursued and then held the position as a 'Notary Public following my by taking of the Oath in Boston two times over 14 Years for two consecutive terms to assist the people of Barnstable County with there legal needs. As time passed, I was compelled to resign my position once I relocated here to California with this state being my official place of residency now. But,My Word is who I am.. i In addition to that FACT, I'm in possession of Tax Filings for our Realty Trust to include that property at 104 A. &B. as being filed with the Federal government a Two Family since I believe 199.0. I've also received and paid separate Electric Utility Bills for that same time period, (19 Years) that have clearly state on each one for all these years, 104-A. & 104-B. High School Road. To be honest, I'm confident that"If'we work together;(respectfully)to resolve this situation, it can easily be put it behind us while at the same time helping you and your department fill in at least some of these"Holes" as you referred to them in the System you're employed to represent there in Barnstable. I don't know what the procedure might be to address such a situation but If I'm required to seek out a Variance or whatever the term might be, I'd appreciate not only your expertise but guidance. Our business manager is presently working with Mr. O' Connell to address the"alleged" Infractions listed in the nine page response I'm produced for you. I'm certain he will be more that willing to assist with this"alleged Infraction" also. I'd like you to know, I'm simply a retired Truck Driver/Inn Keeper, living on a Pension but from what I've expressed above as clearly being truth&reality for these past Nineteen Years, I'm of the opinion that the term,"Grandfather Clause" Cry's out in this mater. Let's move forward to see what can be done to resolve thing amicably. Next Subiect of great concern: The only reason I was able to place a call to you, Ms. Anderson was due to our business manager, Mr. Reynolds receiving a document with your Information on it. This came to us through the discovery process at Barnstable Court with regard to a MS. Donahue who last resided at#104-A. High School Road.. What I'm trying to understand is why such a document would be produced and then, Immediately provided:to an x-tenant of ours. Especially with nothing more than an"Allegation of Code Violation"mind you, from you &the Enforcement department you're employed by there in Barnstable. And this being for the apartment she previously resided in for no more than three months while trashing and destroying it as we were going through the process to see her removed for non payment of rent. In addition to several other violations of her lease agreement. I'm quite concerned about your motivation for providing the Ms. Donahue with a document of Unfounded&Unsubstantiated Allegations as if it was already confirmed as fact that we had done something terrible wrong at that property. It appears this was done so she could, (in turn) further her facade before the Courts that she had been unfairly and unjustly treated by us for renting a property that was "Not Legal." Next concern: If, (as it appears from the phone conversation)we, (you& I) shared last month on the 26th. that there is a discrepancy to be resolved regarding the status of 104 A. &B. High School Road. Why is it that we have not appreciated any such communication of this, "alleged violation"from you or your department to date? Specifically, the original document or complaint you intentionally produced a copy of for this disgruntled x-tenant to wave around in the Court room, hoping to sway Justice in her favor for an"alleged" Town Code Infraction. This being something we haven't even been allowed the opportunity to view, let alone respond to or seek Due Process for or resolution of. Even at this late date being more than a week after this case involving Ms. Donahue was to be herd, (but fortunately continued by our legal Council)in Barnstable Court. We still are without any communication from you or your department even suggesting an Infraction of Town Code regarding 104 A. &B. High School Road and the total amount of apartments there might possibly have been committed by us?In fact, if it wasn't for Ms. Donahue presenting our Business Manager, Mr. Reynolds with a copy of her copy of these"allegations"from your department this past February 26th. we still wouldn't know there was anything going on at all. Well, with the exception of Ms. Donahue walking out of Court a winner by promoting these False, Unfounded Accusations as reality of course. It's iust not logical that you could not have known how to contact us. #1.MS. Donahue made the complaint on the 104 High School Road address to your departments as soon as she was informed we were in fact evicting her. Obviously, someone responded to 104 High School Road to answer her complaints. #2. She made you aware of Mr. Reynolds being her land lord with him residing right there next door at the Inn at 98 high School Road. Located just Ten Feet away from 104 High School Road. #3. Our address is clearly posted on the large black sign on the front lawn below the words"Embassy Inn"as well as our phone number and address. A sign that's in plane view for anyone who comes into of exit's our driveways. In addition, several of our Emergency Phone Numbers, (Including mine and my e-mail address) are clearly posted on the front door of the Inn at 98 High School Road. Right there, steps from where your departments were call to by Ms. Donahue for her attempts at develop Fog around her Eviction process. #4.All that, in addition to the very same walls and locations where the House Numbers mentioned above at#104 A. &B. are located have my Emergency Contact Information . permanently attached right there, in plain view. Please examine the photo below that show those very same Notices: a • 7 ''+ -$ N. - Again,we have been in business there on High School Road for almost 30 Years now. We make certain we can be contacted, (In case of Emergency) 24-7-365, coast to coast. Ms. Donahue was in possession of a document, (or copy of such) from the Code Enforcement Department you-are employed at. A Notice that we should have been made aware of. Please, "If'you can, explain this to me,why is she holding such a Notice of Complaint and or Violation from your department yet we have appreciated nothing at all from you or your department to date on the matter? jIt's my present opinion that Ethic's are clearly being compromised there within your department towards us. I'll ask that you try your best to keep an open mind from this point forward. Do what's right, follow procedure and Simply Be Fair. Our legal council is being update a on a weekly basis at most regarding this situation. We work very hard to exceed expectations as a business entity in Barnstable County and always have. We do our best to provide very respectable accommodations at both our Inn and within those two apartments at 104 A. & B. High School Road. I'd hope you can see from reviewing this correspondence, (in addition to)MR. O' Connells Certified copy# 7003 2260 0001 8557 9575 that what I've stated is correct. I'll be patiently awaiting you're response to the rest of my question within this lengthy correspondence to date. This so we are afforded the proper Time frame, Clear Information& Due Process to fend off these False Allegations of "alleged Code Violations"by your department and then to Once Again restore our credibility in Barnstable County to what it's been for nearly Three Decades now. And finally, I have but three concerns I would greatly appreciate your assistance with If at all possible.: #1. I'll respectfully request you produce any possible information on the whereabouts of the Inspectors named within this correspondence that might still be with us and any "possible address"we're we might attempt to correspond with them in an effort to secure conformation of our position in the mater of"alleged Code Violation." #2. Who and what phone number we must contact to seek out Old Records of Permits Issued in Barnstable County in the 1980's into the early 1990's. i #3. Who might be in charge of and where would Archived Town Records, Documents and such be held and stored. Such as the Note Book/Ledger's from Commissioner Daluze's Department that I made mention him producing that day back in 1989 in his office up on the 5t1i. floor at the Old Town Hall Building Inspectors Division. We would , (if possible) appreciate an e-mail address to correspond with you at. Or the name and position held of whomever we're going to be required to work with to resolve these allegations to prevent any further miscommunications or delays from developing during this process we seem to have before us again, some Nineteen Years after the fact.! I really don't know what more could or should have be expected from us to see the 104 High School property properly adjusted in your files or register but by God, lets get to it.! . And again, Please be certain,a copy of this document, (in addition to the one compiled for Mr. O' Connell)will be presented to our Attorney back there Barnstable. In addition to the Courts as our response to that elusive Notice of"alleged Code Violation"you were so quick to produce for Ms. Donahue that she was so proud of waiving around in our Managers face in court last month. We will standby for further& future communication from you now. And so there will be no additional or future problems or confusion in communicating with us, I will also provide our mailing addresses for you below. This situation being yet another perfect example of exactly why we are so diligent with our efforts&procedures when conducting business affairs in`Barnstable County." Thank—you for You're Time.! Timothy O' Connell, On 02-23-2009 I placed a call to at(508) 862-4644 explaining that with my, residing here in California, I just received your"Notice to Abate Violations"as stated below. I explained that I will be asking our appointed business manager, (MR. Harry Reynolds) to meet with you as son as possible to address these concerns, I greatly appreciated your response that you would be kZd-enough to walk Mr. Reynolds, through the process to be heard at the "Next Agenda"date. Hopefully by that time we will have everything corrected to your satisfaction. To be clear, were attempting to address these issues for property located at#104—A. high School Road, Hyannis, MA. as listed below: #1.Door leading to rear Deck not properly secured to hinges. This mater is presently in the process of being reviewed and corrected. . - #2. Window cranks not operational. This mater is presently in the process of being reviewed and corrected. #3.Missing tile in bathroom, One Burner on kitchen Stove non-operational This mater is presently in the process of being reviewed and corrected: #4. Electric outlets in living room not operational. This mater is presently in the process of being reviewed and corrected. #5. Ceiling Height not to standard of New construction. Apparently, (after speaking with you) it's come to light that this home was built in the 1800's and we're seeking exclusion for, (or of)this infraction. #6. Smoke Detectors not operational in apartment. Approximately three months earlier when the Complaining Tenant took up occupancy we made certain that all Smoke Detectors were operational and strategically Installed throughout the Apartment with Brand New;9Volt Battery's in place. --Each Smoke Detector was Tested and in workidg order before we let the Keys out for this unit. - Regardless, this.mater is presently in the process of being reviewed & corrected. #7. No Carbon Monoxide Alarms were observed Installed: I.must apologize for this one,we were not aware such a device was required. This mater is presently in the process of being reviewed&corrected. #8. Certificate of Registration. Apartment not registered with Town of Barnstable. This being nothing less than perplexing.?.I will give an in-depth explanation of our position below. We've held a Lodging House License for The Embassy Inn located at 98 High School Road for some 29 years to date. Approximately 1989 we purchased 104 High School Road, (right next,door.). Annually we are required to have Town Inspectors examine our Inn for Code. Enforcement to be certain we meet the minimum.standards in place. We've always strived to exceed these minimum requirements and been praised by the Inspectors for such. Up until approximately Ten Years ago we would be visited by the Health Inspector, Building Inspector, Gas Inspector, Fire Inspector&Electrical Inspectors each year for our Inn's review, directly across the driveway from this property in question at 104 High School Road.. Upon all of these Inspectors converging on our property each year to review our Inns -Safety & Health condition, back in the year of 1989 (or 1990) several of them, (Mr. Buddy Martin in particular but also Mr. Jenkins)made comment once they realized we had purchased 104 High School Road that it was in fact originally a"Multi Family Dwelling."And that If we ever decided to see it returned to such a status that we should. go td Town Hall and make the request before the Commissioner. MR. Joseph Daluze was the original Building Inspector who we had our Inn's yearly or annual Lodging House License reviewed by for many many years in the past. 1980 or 1981 was the first time if memory serves me correctly but at that point in 1989, he was holding the position of Building Commissioner for Barnstable County. Following the suggestion of the Inspectors I went to his office up on, (I believe)the Fifth Floor of the Old Town Hall Building. I explained to Mr. Daluze that we had recently purchased the property at 104 High School Road, Hyannis, MA. and that I was Informed that I would need to speak with him to see If it was possible to reinstate that property as a Multi Family Dwelling with it. . being such in years past. He then Invited me to view some type of,-(I believe Black) Book or Ledger he pulled up from behind the counter as he began paging through it. Within a minute or two he located a Page and turned the book around on the counter top to show me. There were numerous properties listed inside this open book&page. On the page in this book of records pointed to one section. I looked closer and I saw writings that specified that the property at 104 High School Road was in fact previously recorded as multifamily dwelling. _Commissioner Daluze_commented to me.that it was.certainly small house but designed. and recorded as Three Family or Three Unit Structure years earlier. He further explained that sadly, at some point, (prior my even moving to Cape Cod)an older gentleman, with a serious drinking problem lived in the rear one of those three small attached units. Commissioner Daluze explained that this old man had apparently fallen- asleep with a cigarette burning. This one bedroom unit(of the three located at 104 High School Road)was positioned where the rear deck area of the home is presently situated. Commissioner Daluze further explained that the Fire that ensued, gutted, that unit completely and costing this old man his life. At that point Commissioner Daluze stated that"Under the Grandfather.Status or Clause" he could see No reason not to reinstate, that home located at 104 High School Road as a Two Family duplex but he further expressed that would be the extent of the status he would allow with that third unit now being completely demolished and removed. He did state that he would first need to run his intentions by something referred to, the "Planning Board"or"Sight Plan Review"as it was being called at that point. I assumed this would possible be a lengthy process but Commissioner Daluze actually picked up his Office Telephone right then&there placing a call to someone in that department. There was another office just next to the partitioned or dividing wall of Commissioner Daluze's Office where I heard a gentleman pick up his.phone as soon as . the call was placed. Commissioner Daluze explained exactly what I was seeking to be approved at that address at 104 High School Road I'm not one hundred percent certain but I believe I recall the voice of this man as being another Inspector I had met at our family's Inn over the years. I'm not aware of his first name but his last was Martin also, (but Not Buddy Martin)another Inspector Martin. Commissioner Daluze explained to Mr. Martin exactly what he had shown to me in that large Barnstable Book/Ledger and in turn, I heard this person's voice in the adjacent Office respond to Commissioner Daluze that, "he saw No Reason for this mater to go before Sight Plan Review," (and or)the Planning Board as I mentioned. Commissioner Daluze then placed the phone back down on the hook and said very well, your request is granted to re-instate that address at 104 High School Road back to it's original classification and status as being a`.`Multi Family Dwelling." But again, he made it perfectly clear that with the present structural design of that building it would onlybe permitted to be a Two Family Home, not a three family as it was originally. Following that process and final decision by Commissioner Daluze I was advised to contact a Licensed Electrician& Company by the name of S.V. Raleigh to make the adjustments for the second Electric 'Meter's Instillation through the Electric Company- I then sought out and employed this Mr. Stephen V. Raleigh of S.V. Raleigh Corporation, Hyannis, MA. In turn, following my employing.Mr. Raleigh, he contacted Building Commissioner Daluze to confirm the legality of what I was requesting his company to do. Commissioner Daluze authorized the process as we had agreed to in his office the. previous week At that point Mr. Raleigh contacted me and advised that he would proceed with contacting Commonwealth Electric Company to schedule a"Disconnect Date"where by the Electric Company would need to have a Truck come out to that address and shut down the power at the pole. Thereby allowing-Mr. Raleigh to remove & install what I recall him referring to as a"Heavy Conduit Pole on the side of the house at 104 High School Road to properly carry the New Electric Service Cable for both Meters 104-A&. 104-B.to that home to be-properly connected so the Electrical Inspector from Barnstable would be able to pass it upon Inspection. Following this process, Mr. Raleigh installed Two New,S'eparate Electric Meters on the home and then, Two New Electric Panels.in the basement-of the property splitting the power throughout the home.in half for 104-A..& 104-B. High:School Road:. My assumption up until receiving this notice from your department,(some 19 years after this process had been completed)was that we followed-the correct&c legal process to see this'.mater done.according to the Regulations set forth in Barnstable County at that time. Everything I'.ve explained above is as true to fact as I recall it.If there is any doubt in my recollection or validity of this matey or the process as I've explained it above, please. consider speaking with any of the parties I've mentioned within this document, (Mr. Joseph Daluze,MR. Buddy Martin,a second_MR. Martin,Mr. Jenkins-or a Mr. Steven Raleigh of S.V. Raleigh Corporation. I'm confident each and every one of them will confirm my explanation above. With that being explained, "IF"it's deemed necessary for us to do anything else to see this mater resolved in the eyes of Barnstable County;,please explain exactly what that process would be and we will certainly follow your instruction to bring this mater to a proper close to the best of our ability, again.! As for the party who brought your department to the 104 High School Road address with her complaints in the first place. She personally, (or her 16 year old son or friends) caused many of the"alleged" Infractions as stated above. Upon her realizing that we were moving forward with the evicting process due to her failing to pay her agreed rent in addition to several other. issues the business manager Mr. Reynolds was having with her and her"guests" she in turn called your department to build a False Defense. We took this person(and her minor son) in just.months earlier, (this past fall)through the process of Housing Assistance Corporation advancing the sum of$3000.00 to us on her behalf to help her get out of a Motel setting. The apartment in question at 104-A. High School Road was just renovated last summer with all New Carpets,New-paint,New bathroom flooring, Working& Installed Smoke Detectors in Each-Room, a New Burner purchased and Installed for the stove in question. We did everything possible to make that address as comfortable& safe as we could. As is always the case prior us renting any units at 104 A-B or 98 High School.Road. In turn, this woman appeared extremely grateful once we agreed to let that unit out to her:. Additionally: If you'll take a moment to review the attached e-mail below, you'll see that this woman had No Complaints about any of these "alleged"problems to either Mr. Reynolds, (the property manager) or myself(as can be clearlyviewed iewed within her e-mail enclosed below dated 01-09-2009). Again,No Complaints Until she was Served Notice to..Vacate that apartment. The term,"Disgruntled" comes to.mind with what were left to deal with now that she's Turned. In Her Apartment Key and Vacated that Apartment as of February 13th 2009 as was confirmed in Barnstable Court on that same date. Now, she has nothing but Complaints. In addition, she pleading that the Courts order us to return$3060.00 the Housing Assistance Corporation provided on her behalf to see her&her Son place in that apartment in the-first place.! On top of that, apparently she's in Court, waving some letter around that she acquired from your Department or Code Enforcement, claiming that we were never even supposed to be renting that apartment in the first place because it's not an apartment.? We need to find.resolution to this situation and I'll ask that everyone in your department please be patient,Not Jump to conclusions but allow Due Process to see that this mater is resolved amicable before passing Judgment on something that took place some Nineteen Years ago.! It's most unfortunate but people such as this woman are the epitome of what causes land lords to be-so cautious &.difficult when considering renting to people in her position. She hurts others who are sincerely in need by the actions she's taken. This woman has Steady Income from Unemployment, sh&has Steady Income from Child Support yet she refused to.meet her agreed obligation to us and completely disrespected the accommodations we.provided her with! Regardless,we are working diligently to correct what this Tenant has done too and at that property and apartment. Upon the completion of our effort to repair all damages, we will certainly be more than willing to notify and allow you Mr. O' Connell,(or anyone in your departments) access to view all repairs of the infractions as listed above. Prior, (of course)to our re-renting that unit again to anyone in the future. I hope this correspondence helped to addresses everyone's present concerns. It's certainly helped Me to VENT our Frustrations with this situation while trying our best to abide by the Rules &Regulations set forth in Barnstable County.! Reynolds" is certainly yours but of course that leaves him with little if no options but to see you removed from that apartment by Court Order.. Of course, I'm not certain with my-being so far removed.from that situation but as far as I've been able to understand, you've.failed to keep your word to pay rent on a timely J manor: MR. Reynolds is Not expected to chase after anyone who agrees to do what you agreed to do in your rental agreement. PAY Your Rent on Time.! Next problem is this Electric Bill that you seemed to feel you had the option to leave in my name for the past feew months. I clearly recall you stating that you addressed this mater upon you taking occupancy but you did Not.! You claimed you were going to change it into your name a month ago, but you did Not.! Only under notice of my intentions of ordering the Electric Company to SHUT OFF the POWER in my name did you finally do as you were required to do before you moved in. And even now I'm still left with a Bill well over$100.00 for Electricity you failed to take responsibility for. The process for you to correct this additional debt-levied-against my name was clearly laid out in my two page letter to you some weeks ago. I strongly suggest you review that letter in it's entirety, contact the Electric Company and do as you should do.! Take responsibility for your power usage from the date listed on your Lease for that apartment. Lastly, you suggest I look into securing a more reasonable Manager for those properties. I'll tell you here and now that If I were back there and I had to deal with what MR. Reynolds is clearly putting up with from you and the excuses you've given not only him but me in this e-mail.,I would have been to the Court House to file for Eviction of you- sooner than he did. You are Not in the position to be calculating.how much you.feel is owed for your rental unit according to your opinions. You were given ample time&consideration and concessions on numerous occasions in the short lived.relationship that is coming to an end soon. You were clearly made aware of Notice to Vacate and still you failed to do what's logical. I j . Now there are Court Cost, filing Fee's, MR. Reynolds time and trouble to go to file in Court: Time for him to sit in Court and explain what is reality in your situation to the Judge. Arrearages in Utilities of Electricity in addition to the need to Top off the Oil Tank you've been using. All of this will be laid out and presented in,a proper format for the Courts, unfortunately as we have been required to do in previous situations. In turn,we will ask for and receive a Judgment against you for your "Lackadaisical Approach"to this mater. A Judgment that we will then secure an Order through the.Courts to Garnish your Payments from Child Support and from any future Employer you "might" end up working for.. MS. Donahue, you hold a lease for an apartment. An apartment that we came to an y agreement to let out to you for a set rate. We adjusted this rate based on Your WORD to do as you agreed to do. You have, clearly failed to keep your WORD. Yet in turn you seem to think you can hold us to our word. My suggestion to you is this, do as you are required to do and Vacate that Apartment as soon as you possible can. Clearly, at this point there is no way to correct the damage of what's gone on between you and MR. Reynolds. MR. Reynolds has a limited capacity of responsibility there with regards to You&that apartment. He is required to collect rent and deposit rent and schedule any required repairs need to keep that apartment in working order, That's it.! All of this that has been going on is Nothing less that Smoke &Mirror's to Muddy the Waters of REALITY. It's more than apparent that You clearly & simply do Not want to pay the RENT. Also using profanities is counter productive when discussing MR. Reynolds and what's he's been subjected to for merely trying to do his Job. So, do as-you choose but please keep in mind, the Meter is.Running at that address and it's presently in Your NAME and Your Responsibility for Everythingthat's hat's going on there.! You do not decide what's owed for what and when,we will show the Courts exactly what you owe If it goes that.far. Now, I've taken time out of my day and life to compile this second correspondence-to and for you to help you understand the situation. I will not be doing so again.
