Barnstable Police were called after I was made aware that, "Richard Durant"had once again entered our property located at 98 High School Road in pursuit of One of the Foreign J-1 Visa Female Students we house here at this property & location with them working at local Company's here in Barnstable during their College Schooling Vacations. Officer Botsford and his partner interviewed the Female Student and she explained the situation that this Richard Durant, (who looks to be in his 50's)has been attempting to convince the Student, (age 20)to go out with him. She also works with this person at the Burger King here in Barnstable County and he has also been confronting.her at the work place and even as she's been walking to and from her Job.!. wv Each time this young female student has said No.! to this, (Richard Durant)but he's persisted..!. On or about Christmas, he actually entered our property with No Invitation and went to our dining room seeking out this female student in an effort to get her to leave with him again.!. He made comment that he was,"Good Friends with the Property Manager, and he was welcome here any time.! This being the complete opposite of the Truth with me ordering him OFF the Property last Spring with him attempting to enter and even move in here.! In response,he exited the property last spring and was not seen here since that time. But, in retaliation for his being ordered off the property,he constructed a Scathing Letter of False Accusations against this address, claiming it was being run as a, "Concentration Camp"in addition to countless additional falsehoods of Unconformable Lies.! He then submitted this, Letter of Retaliation"to the Barnstable Fire Department for review. In turn, we were subjected to a Full Inspection by all Town Inspectors with No Findings of any Violations what so ever with this being a Licensed Inn and, "Up to Code.!" And now,this, "Richard Durant"is again returning to our property in an effort to get to our J-1 Student.! With my explaining this to Officer Botsford, both he and his partner walked just Two Doors Down to the property of Mr. Danny O' Sullivan's in an effort to speak with this, "Richard Durant"to explain to him that he must Not step foot on our property again or Harass anyone of our J-1 Student. Unfortunately,we did not have Richard Durant's last name available at that time and the Officers did not find him to be at that address at that time. In turn the Officers returned to our property and explained that we should get this persons last name and to advise them once we had that information. The further advised both myself and this Young Female Student to contact them If we had any further problems with Richard Durant in the future. We thanked them for their efforts and said.good day.! Since that time,we have obtained the person in questions full name. I am submitting all additional communications between the Agency that places Students with-us, the Employer this Student is working for and the Student below for submission into this Barnstable Police Case File#12-117-OF In case of any further attempts of retaliations against this Female Student by, ".Richard Durant" . You are ordered to repair the second floor wooden deck within seven (7) days of your receipt of this notice. A building permit shall be obtained for the needed repairs. [In the alternative,you may choose to hire a structural engineer to make a determination in regards to the structural integrity of the second floor wooden deck. You shall ensure the structural engineer submits a written report detailing his/her findings and recommendations.for any necessary repairs to the Public Health Division within seven(7) days. And he said the process and license to do business cost either$35.00 or $50.00 annually. But he further advised me that whatever you need to do to get your property up to code would of course cost me more. I then asked, "in your opinion sir, do you think I would have to spend very much to meet the requirement?" And he responded with a no, your property looks to.be in pretty good condition, all you would likely need are some Hard Wired Smoke Detectors and Fire Extinguishers place in specific locations. And maybe a few other minor adjustments such as Exit Signs and such. So I said thank you and I'll think about it. And it wasn't more than a week or so passing by and I decided, why not.!. It's a nice location, I don't expect to be relocation any time soon and even though Mr. Daluze said I'm not in violation by renting to one person without a license, I guess I'll invest the $50.00 and see what the Inspectors have to say for what this property might need. To get it to be a licensed lodging house. So, I went way up in the Top Floor of the old City hall building and asked for a Lodging House application. I filled it out and paid the $50.00 fee. All Five of the Inspectors came,Mr. Jenkins, Mr. Buddy Martin and Mr. Daluze sent second in command for the Building department. And I don't recall the rest of their names but ALL FIVE of the Town Inspection departments show up at our address!. They went through the entire property and gave me a basic list of things needed to be done as Mr. Daluze had explained would occur. In turn, I did all the repairs and adjustment they asked of me and about two weeks later they came back,respected and they property passed Code. And that's what I explained to YOU Ms. Anderson on this past December 23`d,2014. I got My First Lodging House License and that is EXACTLY how I came to established The Embassy Lodging & Shelters. But, after explaining this to You, MS. Robin C. Anderson; I recall hearing you say something like, "I need to see Proof!" I was again taken back by your comment but again I stayed composed and said well, if you care to look at this e—mail I have a copy of here, (please view attached file) you will notice that I am here today filing for a renewal of my License. And I did also contact legal counsel and asked their advice and it was suggested that I correspond with you in writing and make the request for what exactly it is that you need from me to resolve these issues you seen to be at hand. Attorney Hopkins stated that after reviewing a number of documents, and after, discussion with Mr. Maloney and Mr. Scali, they are not going to contest the fact that he has used more than 6 rooms and has had. more than 12 people at the lodging house. He stated some mitigation might be appropriate. He asked to give background on The EmbassyLodge. As far as he reviewed g ie ed some documents and found that there is annual rental registration for that location (Certificates of Registration for 104A and 104B). There was discussion and evidence given that Mr. Maloney had relied on the wording for rental registration that he did not have to count individuals under the age of 22 for the apartments and the lodging house. Mr. Sullivan stated that he did need to comply with Chapter 501, Section 31.for the number of rooms and lodgers listed on his License for 98 High School Road: A motion was duly made by Mr. Burman, seconded by Mr. Sullivan and a unanimous vote taken for findings that the license holder has admitted to using more rooms and having'more people than those for which he is licensed. A motion was duly made by Mr. Burman, seconded by Mr. Sullivan and a unanimous vote taken for a guilty finding. . Mr. Hoxie suggested the licensee comply with the restrictions on his license, allow all inspections and maintain a proper register. Mr. Burman suggested we add a $1,000 fine. A motion was duly made by Mr. Sullivan that the licensee be given a warning and that he comply with the restrictions on his license, allow all inspections and maintain a proper register, and Mr. Hoxie seconded the motion. Upon.our,viewing of the whole house, we observed some very disturbing conditions. The first of these conditions is that the premise is over crowded. The license for that lodging house is set at a capacity of six lodging rooms with twelve lodgers. In conducting our inspection, we found eight rooms many with bunk beds which consisted of a queen size bed on the lower half and a double size bed on the upper half. Along with these bunk beds, there was a twin in the same room which amounts to each'of these rooms having the potential of two persons in the queen size bed, one or possibly two in the double bed and one person in the twin bed fora potential total of four or possibly five in each of these rooms. The. break down is as follows: 3 rooms off kitchen: #1 - 3 twin beds #2 - 1 queen, 1 double #3 - 2 twin beds Second floor: #1 - 1 queen, 1 double, 1 twin -- #2 - 1 queen, 1 double, 1 twin #3 - 1 queen, 1.double #4 - 1 queen, 1 double, 1 twin go :b Lid Z ( u3� Elul #5 - 3twin With two persons in each queen bed and one person in the double and twin beds, the potential is therefor there to be eight persons on the first floor and eighteen persons on the second floor for a total of twenty-six persons. If there were two persons in the double beds that would add another five persons for a potential total of thirty-one persons. We also observed fold out beds in some of the storage areas, which would indicate that there could also be others placed in beds. On this property, there also appears to be a so called owner's quarters located over the garage. We asked: permission to view this part of the Licensed Premises, but were denied. The owner claims that is not part of the license but the license Js for 98 High School Road and there is no distinction in the buildings and therefore; should be open for inspection. This department also suspects that the house next door 104 High School Road, which according to the Assessor's records is in the same ownership, is in use also as a lodging house. There is no license for this on file. The directional signage for the rules of the house is the same as 98 High School There were also observations by the Zoning Enforcement Officer of persons going back and forth between the two properties which share a common driveway. This.department would like to request a license hearing to resolve these very serious and dangerous situations.
