A Mr.Cahoon, who died in November of 2000,had owned the property. Due to the extensive fire damage to the house GZ and the age of the non-damaged portion of the structure Mr.LeBouef has concluded that it would be more economical,and more beneficial to the neighborhood,to remove the damaged existing house and shed and r,,4 replace them with the proposed house. The property is presently located in a Residence B District. The current setback requirements are a twenty foot front yard setback and ten-foot side and rear-yard setbacks.The existing house meets these setback requirements.The proposed house would also meet these setback requirements. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 17,2003. Apublic hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 20,2003,at which time. the Board found to grant the appeal. Board Members deciding this appeal were;Richard L.Boy,Ralph Copeland,Ron S.Janson,Gail Nightingale,and Chairman Daniel M.Creedon III. Attorney John W.Kenney represented the applicant before the Board. Mr.Kenney presented the background and history of the property. He explained that the applicant is seeking to raise the existing Bk 17746 Pg 4 #115318 dwelling and reconstruct a new dwelling on a new footprint of 720 sgft.of living area plus a garage of 352 sq.ft. The reconstruction would complywith all of the current setback requirements. If allowed,the applicant would bring the site into compliance with modem building codes.The new dwelling would be a substantial improvement in appearance over the existing dwelling.The style of the house is a traditional shingled Cape Cod home. The addition of a garage will help to reduce the possibility of clutter in the yard. The propertywill continue to be served by town water and would be benefited by a new Title 5 compliant on-site septic system. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of August 20,2003,the Board unanimously made the following findings of fact: 1. Jack LeBouef has applied for Special Permit findings under MGL Chapter 40A,Section 6 for the demolition and reconstruction of a single-family dwelling on a non-conforming lot. The property is shown on Assessor's Map 289 as Parcel 116 and is addressed as 12 M Street,Hyannis,MA in a Residence B Zoning District. 2. The locus is an undersized lot of 6,536 sq.ft.or 0.15-acres,approximately. Zoning today requires a. minimum lot area of one-acre in the Residence B Zoning District. The dwelling that exists on the lot suffered major damage from a fire approximately 3 r/s years ago. 3. That existing fire damaged dwelling contains approximately 528 sq ft.of living area. The applicant is proposing to demolish this structure and reconstruct a new single-family dwelling of approximately 720 sq&of living area. in addition,there is to be an attached garage of 352 sq ft. 4. The proposed new dwelling will conform to the required setbacks for the zoning districts and therefore, the new dwelling does not intensifythe non-conformity. The proposed new dwelling and renovated garage would not be substantially more detrimental to the neighborhood than the former. 5. The proposal is for the demolition and reconstruction of a single-family dwelling on a non-conforming lot and as ruled in the"Dugas"Case,the Board must make finding as to the intensification of the non confonnitywith regards to the new dwelling on the lot. The proposed new dwelling does not intensify the nonconformity and therefore it is a"reconstruction'as contemplated in M.G.L.Ch.40A 56. 6. The proposed demolition and reconstruction would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact,a motion was duly made and seconded to'grant the permit for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non-conforming lot. The reconstruction shall comply with all setback requirements and is subject to the following conditions: 1. At no time will anyparking,storage or construction materials or items be permitted in the right-of-way of Hill Street or within 5 feet of the neighboring propertyexcept as may be needed for landscaping purposes,or for utilities,or by agreement with neighboring land owners. b. The smoke appears to be coming from the rear of the house across the street from her. She stated she could not see any flames and was unsure if it was smoke from a wood stove or fireplace. I responded on 822 wit'7 FF Lawrence and FF Storie driving. We arrived on location: side 1 of 12 Hill Street, and noted smoke in the area and then noted smoke coming from the attic vents, windows and around the door frame at 12 Hill Street. I requested fire alarm to respond a full first alarm assignment for a structure fire. I assumed comrrandrnterior operations and requested that 829 do ventilation and primary search with the thermal imager when they arrived on scene. The house was a single story, wood frame, 25' by 25' dwelling. There was a light blue Oldsmobile Cutless Calais with Massachusetts registration ff 267-CER parked only five feet from the front door on side 1. Neighbors reported that the sole occupant may still be inside the house. 822's crew stretched a 1 314" handline to the door on side I. My initial report was of a fully charged house, possibly occupied, with smoke pounng out of the doorway on side 3, appeared to be self-vented. I broke the glass on the door on side 1 but was unable to unlock the door so we forced entry. FF Lawrence and myself advanced the line into what was the living room and we noted free burning fire coming up from the basement. There was a large hole in the living room floor and we also noted fire above us on the ceiling. We encountered moderate heat and found no sign of flashover. FF Lawrence began extinguishment and I utilized our thermal imager checking for an occupant. We advanced around the hole in the floor to check the bedrooms. Primary search of the bedrooms and the bathroom was negative. 802 arrived on scene and command was passed to him. He ordered 829 to stretch another 1 3/4" handline to side 3 and gain en" through the door. They entered in through the kitchen and we met with this crew in the small hallway and second and third searches were done throughout the house which tamed up negative. 826 s crew was ordered to the basement and found 8 partially collapsed floor from the level above. The basement was a partially full basement with the remainder being a crawl space. FF Simkins did fall down into the basement sustaining an injury to his pelvis (see attached Fire Fighter Injury Report). There was no one found in the basement. As additional crews arrived on scene, Command assigned them various tasks, including ventilating the roof and securing the gas to the house. Com FJectric was also called and they arrived to shut off pourer to the house. My crew exited the building for now SCSA bottles and I began a preliminary investigation. I spoke with Ms. Jean Fisher (08-12-56) at 108 Greenwood Ave. (508-771.5241). She stated that she knee, the occupant, Walter Cahoon, and that he is a diabetic. Shs stated that she arrived home at 1710 hours sharp tonight and noted a light haze of smoke across the road but felt it was a neighbors wood stove. She stated that she is gone most of the daytime and had not seen Mr Cahoon for quite some time. I then spoke to the reporting party, Tanirah Edwards (information: on her listed above). She stated that she arrived home at approximately 1845 hours tonight and noted the smoke in the area, but she too felt it was a neighbors wood stove. At about 1900 hours, she stepped outside to check the origin of the smoka, because she stated it was getting worse, and this is when she felt she needed to call 911. Shortly after hanging up with the Fire Department, she said she reard a "BOOM" coming from inside the house but she never did see any tire. I telephoned the Cape Cod Hospital and spoke with the Emergency Room. I was told that a Walter Cahoon was admitted, there on November 9, 2000 and was listed as discharged at 0401 hours on 11-21-2000. Apparently Mr. Cahoon di9d in the hospital ICU unit at 0401 hours on 11-21-2000. Chief Brunelle, Deputy Chief Melanson, Fire Prevention Officer Hubler and Fire Investigator Officer Scot McMahon from the Barnstable Police Cepartment began the fire ground investigation.
