No site modifications are contemplated. Dear Attorney Boudreau: At the formal site plan review meeting held November 1, 2018, the Site Plan Review Committee found the above-referenced application to be approvable subject to the.following: • Approval is based upon and must be constructed significantly in compliance with site plans entitled "Hyannisport Club, 2 Irving Avenue" one sheet, dated October 25, 2018 prepared by Baxter Nye Engineering& Surveying, Hyannis; and, floor plans and elevations, 8 sheets, prepared by Paul F. Weber, Architect, LLC,Newport RI; also, letter from Matthew Eddy,,P.E. identifying septic flow calculations and approved by the Health Department. • The granting of a special permit from the Zoning Board of Appeals for the expansion of a non- conforming building will be required. • Hans Keijser, Water Department Supervisor;DPW, noted that the 4" domestic water line also feeds the church next door and recommends that separation of the water service be included as a part of any substantial future development: • Fire alarm and sprinkler system will need to be extended to cover the proposed additional square footage at the building permit stage. • Subsequent to the granting of relief from the Zoning Board of Appeals, the Hyannisport Club Inc.'s licenses are required to be amended with updated descriptions of premises. • Applicant must obtain all other applicable permits, licenses and approvals required. N Upon completion of all work, a registered engineer or land surveyor shall submit a certified"as built" site plan and a letter of certification, made upon knowledge and belief in accordance with professional standards that all work has been done in substantial compliance with the approved site plan(Zoning Section 240-105 (G). We agreed the 7,326 gpd actual condition would be the permitted design flow used for allowable use allocation. 2) The original design contemplated 50 lounge seats at 20 gpd/seat. Per our discussion we agreed these lounge seats would be the same as the country club dining room seats and therefore would only require 10 gpd/seat. a) Title 5 contemplates the higher lounge design flow for a standalone tavern/lounge use. These seats being part of the country club would fall under the typical country club dining room seat flow. 3) Based on the above two statements we have calculated the following uses are supported by the existing septic system: a) 300 country club dining room seats x 10 gpd/seat=3,000 gpd i) 4,500 gallons of grease trap supports 300 seats(the grease traps control the seat count). b) 212 Country Club Lockers x 20 gpd/locker=4;240 gpd c) This Total identified septic flow is 7,240 gpd which is less than the 7,326 gpd the systems supports. In conclusion,the existing septic system supports 300 dining room seats and 212 lockers which provides for the current use and proposal at the clubhouse. Please contact me with any questions. It is improved with an 11,080 sq. ft. clubhouse and tennis courts. The property is located in an RF-1 Residential Zoning District which permits golf courses as a conditional use. The Hyannisport Club predates zoning in this area of town (having been in operation since 1929)and is, therefore, a pre-existing nonconforming use. The petitioner is proposing to construct a 500 sq. ft. addition to the northeast side of the clubhouse in order to cover an existing storage shed and cooler for the kitchen,which have been subject to vandalism. The petitioner is also proposing.to construct a 200 sq. ft. hallway addition to connect the pro shop to the bag storage area. The clubhouse is currently nonconforming with respect'to the minimum 15 foot sideyard setback required on the property; being situated approximately 7 feet from the east side lot line. The proposed kitchen addition will encroach to within approximately 1.1 feet from the east side lot line at its closest point. The proposed hallway addition meets setback requirements. The petitioner is seeking a Special Permit pursuant to Section 4-4.4(2) Nonconforming Building or Structure Not Used as Single or Two-Family Dwellings, to permit a proposed addition to encroach an additional 4.7 feet into the minimum 15 foot sideyard setback to within 1.1 feet of the east side lot line. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 28, 1999. A 60 day extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 15, 1999, at which time the Board granted the requested Special Permit subject to conditions. Hearing Summary: Board Members hearing this appeal were Gene Burman, Ron Jansson, Gail Nightingale, Richard Boy, and Chairman Emmett Glynn. Attorney John Alger represented the applicant. Present was Peter O'Keeffe, President of the Hyannisport Club. s, Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-106-Hyannisport Club Special Permit,Section 4-4.4(2)Expansion of a pre-existing nonconforming building Attorney Alger reported the Hyannisport Club has existed for many, many years on over 100(+)acres. The club shares a parking lot with the adjacent church. The church uses the parking lot on Sundays(and special occasions)and the club uses it the rest of the time. Currently, there is a outside shed and cooler on the property that has been subject to vandalism. The applicants are seeking to construct an addition to the side of the clubhouse to enclose the shed and cooler area. The covered area will be the same,just the storage and cooler will now be located inside the structure. There will be no increase in the membership and no increase in the use of the property. The actual structure of the building will encroach closer to the boundary than the previous structure and thus violate the bulk regulations. On the other side of the building, they are proposing an addition to the pro shop, however, that does not need relief from.the Zoning Board of Appeals. Attorney Alger mentioned it so the Board would be aware of all the construction taking place on the site. Attorney Alger submitted a letter dated April 30, 1999 from Cornelia Cook, Senior Warden, St.Andrews By-The-Sea Episcopal Church, which states they have no objection to the proposal. There is a"cross agreement'between the church and the club. Attorney Peter O'Keeffe reported the Senior Warden has seen renderings of the addition and has stated she has no problems. He stated he would get a"newer" letter if the Board wanted, however, they felt that was not necessary. The applicant is seeking a Special Permit pursuant to Section 44.4(2)of the Zoning Ordinance which Attorney Alger stated may be granted without substantial detriment to the public good or the neighborhood affected. The proposal fulfills the spirit and intent of the Zoning Ordinance. The site plan was found approvable on June 10, 1999 by Site Plan Review. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of September 15, 1999, the Board unanimously found the following findings of fact as related to Appeal No. 1999-106: 1. The petitioner, the Hyannisport Golf Club, is seeking a Special Permit pursuant to Section 4-4.4(2) Nonconforming Building or Structure Not Used as Single or Two-Family Dwellings. 2. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 15, 1007. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened May 28, 1997, at which time the Board made findings that no relief was necessary. Board Members hearing this appeal were Gene Burman, Ron Jansson, Richard Boy, Tom DeRiemer, and Chairman Gail Nightingale. Attorney John Alger represented the applicant. Hearing Summary: Attorney Alger explained that the applicant is seeking to add a tennis pro shop to the Hyannisport Club. They are also adding a storage shed. There is some question as to whether zoning relief is needed. The Hyannisport Club is 100 years old and the tennis courts predate.zoning. The applicant is seeking a Special Permit for the pro shop pursuant to Section 4-4.5(2)Expansion of a Pre-Existing Nonconforming Use. The shop will be located near the tennis courts within the required setbacks and not located near any residences. It will provide bathroom facilities and give an area for people to watch the tennis matches. This proposed addition would not be detrimental to the neighborhood affected and would be within the spirit and intent of the Zoning Ordinance. The pro shop received Site Plan Review Approval and approval from the Conservation Commission. The storage shed for the golf facility has received Site Plan Review Approval. The Building Commissioner indicated a Special Permit is needed. However, the Board felt that this could be done as a matter-of-right under Section 4-4.5(2). Mr. Crossen stated if the Board felt no relief was necessary, he did not see any problem. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the Hearing of May.28, 1997, the Board unanimously found the following findings of fact as related to Appeal Number 1997-58: 1. The petitioner is seeking a Special Permit in both appeals to expand a pre-existing nonconforming use, as well as a Special Permit(Appeal Number 1997-58)for Conditional Uses- Public or private regulation golf courses subject to the provisions of Section 3-1.1(3)(B)or in the alternative Section 4- 4.5(2) Expansion of a Pre-Existing Nonconforming Use. 2. The property in issue is located at 2 Irving Avenue, Hyannisport, MA, in the RF-1 Residential F-1 Zoning District and the AP Aquifer Protection District. 3. The property has been conducted as the Hyannisport Club for 100 years and is a pre-existing nonconforming use,which has the benefit of that term. It predates zoning and therefore is .nonconforming in accordance with the existing Zoning Ordinance. In Appeal Number 1997-57, the Petitioner is seeking to add a 20 foot by 24 foot tennis pro shop and a bathroom which will be located upon a proposed 30 foot by 44 foot covered deck structure of one story. The structure will be located adjacent to the existing tennis courts and will not intrude into any sideline setback requirements. 5. Both the pro shop and the storage shed facility, are uses that are accessory to and customarily incidental to facilities such as golf courses. 6. Since these are accessory uses, no relief from the Zoning Board of Appeals is required. Decision: Based on the findings of fact in Appeal Number 1997-58, a motion was duly made and seconded that it has been determined that Special Permit relief from the Zoning Board of Appeals is not needed for this new construction.
