The use of the property dates back to 1893. It is a 380+/-private member association that maintains the course, clubhouse and facilities. In Appeal 2001-16,the applicant is petitioning the Board to overrule the Building Commissioner to allow a building permit to be issued, as-of-right, for the construction of a new pro shop on the property. This appeal is also related to two others before the Board, Appeals 2001-17 and 18. Together.these appeals are seeking to expand the clubhouse facilities and the pro-shop out building. Appeal 2001-16 is only related to the pro shop out building Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 06, 2000. An extension of time for holding the hearing and for filing of the decision was executed between the applicants and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 21, 2001, at which time the Board found to overrule the Building Commissioner and have the building permit for the pro shop issued as-of-right. At the opening of the hearing, Vice Chairman, Gail Nightingale cited that there were only four members present to hear the appeal. She cautioned the applicant that with only four members a unanimous vote is needed to granted the relief sought. The applicant agreed to go forward with a four member Board.•Board Members hearing this appeal were; Tom DeRiemer. Randolph Childs,Jeremy Gilmore and Gail Nightingale,Vice Chairman. The applicant was represented by Attorney John Alger. Also present were Mr. Brown,the architect and Peter O'Keeffe,president of the Hyannisport Golf Club. Mr. Alger presented his case to the Board. He cited that the history of the club and the use of the property dates back over 100 years. From a zoning perspective,the locus was first before the Board in 1967 and later in 1970. In those appeals (1967-010 & 1970-74A),the Board found that the use of the premises was non-conforming. After those appeals,the Zoning Ordinance was amended to permit a golf course of this type as a conditional use. Under that section of the Ordinance,-Section 3- 1.1(3)(B)(b) -which read with reference to private golf courses: "No accessory buildings are located on the premises except those for storage of golf course maintenance equipment and materials, golf carts, a pro shop for the sale of golf related articles, rest rooms, shower facilities and locker rooms." Based upon this, Mr. Alger argued that the pro shop should be permitted as an accessory building and use, and furthermore it is as-of-right and permits should be issued without relief from the Board. The public was invited to speak and no one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of February 21, 2001,the Board unanimously found the following findings of fact: 1. In Appeal 2000-16,the applicant is the Hyannisport Club, located at 2 Irving Avenue, Hyannisport,MA, and is shown on Assessor's Map 266 as Parcel 031. The locus is zoned Residential F-1, and is in the AP,Aquifer Protection Overlay District. 2. The applicant has appealed the decision of the Building Commissioner not to issue a building permit. The applicant seeks to build a pro shop on top of the existing golf cart storage building as accessory to the Hyannisport Golf Club. The project was previously permitted by Building Permit#35968, issued by the previous Building Commissioner. 3. The Hyannisport Golf Club,having been in operation since 1897,predates zoning of the town. The site was first before the Board in Appeal 1967-10 in which the Board found that the use and building were legal non-conformities. It was again before the Board in Appeal 1970-75A for a Special Permit to expand that non-conforming use. 4.. After 1970,the Zoning Ordinance was amended to allow for golf courses as a conditional use and further granted certain accessory buildings and uses as-of-right. One of those uses being a pro shop for the sale of golf related articles. Decision: Based on the findings of fact, a motion was duly made and seconded to overrule the Building Commission's decision and allow for the construction of the pro shop as-of-right. The applicant sought the permit to build a pro shop on top of the existing golf cart storage building. The public was invited to speak and no one spoke in favor or in opposition to this-appeal. A letter was received and a copy is in the file from the neighboring parish of St. Andrews by the Sea, favoring the proposal. After evaluating the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 6. A site plan has been reviewed and approved by the Site Plan Review Committee 7. No neighborhood opposition has been expressed to the Board. 8. With the proposed improvements to the building, it will visually be more appealing and add to the neighborhood. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the applicants'request for a special permit, subject to the following terms and conditions: „ 1. Development of the site shall be as proposed in plans presented entitled"Renovations to Clubhouse Facilities,Irving Avenue, Hyannisport, MA" and consisting of sheet Al through A5 and PS-1, drawn by Brown&Lindquist,Architects, dated 12 May 2000. 2. Development of the site shall be as proposed in a plan presented entitled"Proposed Clubhouse Renovations, 2 Irving Avenue, Hyannisport, MA and consisting of sheets C1, drawn by Baxter, Nye &Holmgren, Inc., dated 10 October 2000 and last revised 11/10/00. 2 3. This capacity of the premises shall remain as it is presently licensed for- 100 persons for the lounge area and 175 persons for the ballroom area. 4. The parking provided is adequate at this time given that there is no increase in the capacity of the lounge and ballroom. The applicant has plans to expand on-site parking and has submitted those plans to Site Plan Review for approval. 5. The structures on this lot including the existing principal structure, shall be required to meet all applicable building, health and fire codes. The vote was as follows: AYE: Tom DeRiemer. Findings of Fact: At the hearing of February 21, 2001,the Board unanimously found the following findings of fact: 1. In Appeal 2000-18,the applicant is the Hyannisport Club,located at 2 Irving Avenue, Hyannisport,MA, and is shown on Assessor's Map 266 as Parcel 031. The Hyannisport Golf Club,having been in operation since 1897,predates zoning of the town. • The site was first before the Board in Appeal 1967-10 at which time the Board found that the use and building were legal non-conformities. It was again before the Board in Appeal 1970-75A for a Special Permit to expand that non-conforming use. 4. The application falls within a category specifically exempted in the ordinance in Section 4-4.4(2) Alteration or Expansion of Pre-Existing Non-Conforming Building for a grant of a Special Permit, 5. After evaluating the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 6. A site plan has been reviewed and approved by the Site Plan Review Committee 7. No neighborhood opposition has been expressed to the Board. 8. With the proposed improvements to the building,it will visually be more appealing and add to the neighborhood. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the applicants'request for a special permit, subject to the following terms and conditions: 1. Development of the site shall be as proposed in plans presented entitled"Renovations to Clubhouse Facilities,Irving Avenue,Hyannisport,MA" and consisting of sheet Al through A5 and PS-1, drawn by Brown&Lindquist,Architects, dated 12 May 2000. 2. At the same time a septic system permit was obtained and installed for both the cart barn and ProShop. The ProShop sits entirely on top of the cart barn which is largely underground. Between June 1993 and August 1995 the cart barn portion of the project was completed but the Club elected not to go ahead with the ProShop. They would now like to proceed. I enclose herewith a copy of the permit and a copy of portions of the site plan. Can we simply renew this permit at this time? I would like to point out that this is very similar to a permit that the Wianno Club got to expand their ProShop without the necessity of going to the Board of Appeals. As you know, we have recently filed a site plan review for major alterations for the clubhouse itself. This,because of sideline requirements and other matters, is being submitted to the Board of Appeals. We would, however, very much like to proceed with tiie clubhouse. The use of the property dates back to 1893. It is a 380+/-private member association that maintains the course, clubhouse and facilities. ` . In Appeal 2001-18,the applicant is seeking a Special Permit under Section 4-4.4(2) Alteration or Expansion of Pre-Existing Non-Conforming Building. The applicant seeks to substantially renovate and expand the existing clubhouse by,addition of kitchen,vestibule, hallway, elevator and storage area. This appeal is also related to two others before the Board,Appeals 2001-16 and 17. Together these appeals are seeking to remake and expand the clubhouse facilities and the pro shop out building. Appeal 2001-18 is only related to the expansion of the club house. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on. December 06, 2000. An extension of time for holding the hearing and for filing of the decision was executed between the applicants and the Board. T'r.as d"1 advertised' an notices se wvu«a a$in aCcvruanCe wits• i L 0,a ter v he hearing was opened February 21,2001, at which time the Board.found to grant the special permit for expansion of the club house. - Afthe opening of the hearing,Vice Chairman, Gail Nightingale cited that there were only four, members present to hear the appeal. She cautioned the applicant that with only four members a unanimous vote is needed to granted the relief sought. The applicant agreed to go forward with the four member Board. Board Members hearing this appeal were; Tom DeRiemer. Randolph Childs, Jeremy Gilmore and Gail Nightingale,Vice Chairman. The applicant was represented by Attorney John Alger. Also present were Mr. Brown, the architect and Peter O'Keeffe, president of the Hyannisport Golf Club. Mr. Alger presented his case to the Board. He cited that the history of the club and the use of the property dates back over 100 years. From a zoning perspective,the locus was first before the Board in 1967 and later in 1970.. In those appeals (1967-010 & 1970-74A),the Board found that the use of the premises was non-conforming. After those appeals,the Zoning Ordinance was amended to permit a golf course of this type as a conditional use. Mr. Alger stated that the proposed expansion would only improve operations and not intensify the use. The improvements would bring the building up to code and visually improve it and provide modern day conveniences. Mr. Brown presented the plans for the building noting that it would have a handicapped elevator, new locker rooms, improved storage and kitchens area,new interior freezer and ., Mr. Alger stated that the proposed expansion would only improve operations and not intensify the use. Mr. Brown presented the plans for the building noting that it would have a handicapped elevator, new.locker rooms, improved storage and kitchens area,new interior freezer and food storage area, new handicapped entrance. The new improved lounge area would remain at a maximum capacity of 100 persons and the improved ballroom area would remain at the current capacity of 175 persons. Parking would remain as is which now stands at 88 spaces total. Plans are presently before site plan review to increase the parking by providing some 29 new spaces on-site. The public was invited to speak and no one spoke in favor or in opposition to this appeal. A letter was received and a copy is in the.file from the neighboring parish of St. Andrews by the Sea, favoring the proposal. Findings of Fact: At the hearing of February 21, 2001,the Board unanimously found the following.findings of fact:. 1. In Appeal 2000-18,the applicant is the Hyannisport Club, located at 2 Irving Avenue, Hyannispoirt, MA, and Is.shown on Assessor's Map 266 as Parcel 031. The lochs is zoned Residential F-1, and is in the AP,Aquifer Protection Overlay District. 2. The applicant has applied,fora Special Permit under Section 4-4.4(2)Alteration or Expansion of Pre-Existing Non-Conforming Building. The applicant seeks to substantially renovate and expand the existing clubhouse by 2,480 sq.ft. 3. The Hyannisport Golf Club;having been in operation since 1897,predates zoning of the town. The site was first before the Board in Appeal 1967-10 at which time the Board found that the use and building were legal non-conformities. It was again before the Board in Appeal 1970-75A for a Special Permit to expand that non-conforming use. 4. The application falls within a category specifically exempted in the ordinance in Section 4-4.4(2) Alteration or Expansion of Pre-Existing Non-Conforming Building for a grant of a Special Permit, 5. After evaluating the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 6. A site plan has been reviewed and approved by the Site Plan Review Committee 7. No neighborhood opposition has been expressed to the Board. 8. With the proposed improvements to the building, it will visually be more appealing and add to the neighborhood. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the applicants'request for a special permit, subject to the following terms and conditions: 1. Development of the site shall be as proposed in plans presented entitled "Renovations to Clubhouse Facilities, Irving Avenue, Hyannisport, MA" and consisting of sheet Al through A5 and PS-1, drawn by Brown &Lindquist,Architects, dated 12 May 2000. 2. Development of the site shall be as proposed in a plan presented entitled"Proposed Clubhouse Renovations, 2 Irving Avenue, Hyannisport,MA" and consisting of sheets Cl, drawn by Baxter, Nye &Holmgren,Inc., dated 10 October 2000 and last revised 11/10/00. 2 3. This capacity of the premises shall remain as it is p presently licensed for- 100 persons for the lounge area and 175 persons for the ballroom area. 4. The parking provided is adequate at this time given that there is no increase in the capacity of the P gP q g P Y lounge and ballroom. The applicant has plans to expand on-site parking and has submitted those plans to Site Plan Review for approval. 5.
