The proposed project involves dredging 960 cubic yards of material from the irrigation pond with reuse as upland disposal, licensing the existing 1930's fill and sluice in Mill Creels. Also included is the removal of an excessive area of invasives and the construction of an extended thirteenth tee. The dredge spoil will then be graded on the slope and stabilized with indigenous grasses and maintained. For more information, please refer to the attached Site Plans and Project Description. This application is being } submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Barnstable Wetlands Protection By-law. Submit the fewest number of sheets necessary to adequately illustrate the project on 8-1/2 inch X 11 inch paper. ® A 1-inch margin should be left at the top edge of each drawing for purposes of reproduction and binding. A 1/2 inch margin is required in the three other edges. ® A complete title block on each drawing submitted should identify the project and contain: the name of the waterway; name of the applicant; number of the sheet and total number of sheets in the set; and the date the drawing was prepared: ® Use only dot shading, hatching, and dashed or dotted line to show or indicate particular features of the site on the drawings. ® If deemed appropriate by the Department, certification by the Registered Professional Engineer or Land Surveyor is included. If additional space is needed, attach extra 8-1/2" x 11" sheets of paper. ❑ Proper Public Purpose: For nonwater-d epen dent projects, a statement must be included that explains how the project serves a proper public purpose that provides greater benefit than detriment to public rights in tidelands or great ponds and the manner in which the project meets the applicable standards. If the project is a nonwater-dependent project located in the coastal zone, the statement should explain how the project complies with the standard governing consistency of the policies of the Massachusetts Coastal Zone Management Program, according to 310 CMR 9.54. If the project is located-in an area covered by a Municipal Harbor Plan, the statement should describe how the project conforms to any applicable provisions of such plan pursuant to 310 CMR 9.34(2). ® Plans: Prepared in accordance with the applicable instructions contained in Appendix A-B of this application. For initial filing, meet the requirements of 310 CMR 9.11(2)(b)(3). ® Applicant Certification:All applications must be signed by"the landowner if other than the applicant. In lieu of the landowner's signature,the applicant may provide other evidence of legal authority to submit an application for the project site." If the project is entirely on land owned by the Commonwealth(e.g. most areas below the current low water mark in tidelands and below the historic high water mark of Great Ponds),you may simply state this in lieu of the"landowner's signature". ® Municipal Zoning Certification: If required, applicants must submit a completed and signed Section E of this application by the municipal clerk or appropriate municipal official or, for the initial filing, an explanation of why the form is not included with the initial application. If the project is a public service project subject to zoning but will not require any municipal approvals, submit a certification to that effect pursuant to 310 CMR 9.34(1). ® Municipal Planning Board Notification: Applicants must submit a copy of this application to the municipal planning board for the municipality where the project is located. Submittal of the complete application to DEP must include Section H signed by the municipal clerk, or appropriate municipal official for the town where the work is to be performed, except in the case of a proposed bridge, dam, or similar structure across a river, cove, or inlet, in which case it must be certified by every municipality into which the tidewater of said river, cove, or inlet extends.. ® Final Order of Conditions: A copy of one of the following three documents is required with the filing of a General Waterways Application: (1)the Final Order of Conditions (with accompanying plan) under the Wetlands Protection Act; (2)a final Determination of Applicability under that Act stating that an Order of Conditions is not required for the project; or (3) the Notice of Intent for the initial filing (if the project does not trigger review under MEPA. ❑ Massachusetts Environmental Protection Act(MEPA): MGL 30, subsections 61-61A and 301 CMR 11.00, submit as appropriate: a copy of the Environmental Notification Form (ENF) and a Certificate of the Secretary of Environmental Affairs thereon, or a copy of the final Environmental Impact Report (EIR) and Certificate of the Secretary stating that it adequately and properly complies with MEPA; and any subsequent Notice of Project change and any determination issued thereon in accordance with MEPA. For the initial filing, only a copy of the ENF and the Certificate of the Secretary thereon must be submitted. Dredge spoils are proposed as upland reuse fill within a depression along the golf course and to extend a tee box onsite. The proposed areas to be filled are located outside of all buffer zones to resource areas, but partially within Lands Subject to Coastal Storm Flowage. For more information, please refer to the attached Site Plans. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and its promulgating regulation found at 310 CMR 10.00; 9.00 and 314 CMR 9.00 and the Town of Barnstable Wetlands Protection By-law. 2.0 SITE DESCRIPTION AND HISTORY The property located at Marchant's Mill Pond contains a fresh water pond, which is partially lined with clay along a 22 foot right of way that serves as a dam and as access to maintenance facilities. The pond flows through a sluice under the road and into Halls Creels. Also located onsite is a pump house, maintenance garages, and tennis courts associated with the Hyannisport Golf Club. The proposed disposal site is a vegetated upland (invasives) previously excavated for,material for use at the golf course. This depression is proposed to be filled with dredge spoils, graded and stabilized. Marchant's Mill Pond was created by the impoundment of Halls Creek, which flows south from Simmons Pond in Hyannis. Referring to a plan of land filed at the Barnstable County Registry of Deeds Land Court dated 1927 owners of record are shown to be Charles B. Marchant and Olando W. Marchant. The pond was separated from Mill Creek by a 22' right of way (Marchant's Mill Way) and is shown to exist in the Barnstable County Atlas in 1907. The existing homestead is sited on a knoll overlooking the pond and dates back to 1750 functioning as a farm and salt works including;growing Distichlis commercially during the Civil War, (Seven Villages a Town of Barnstable 1972). No history is provided to place or date the mill, however it is clear that the stream flowing from Simmons Pond was excavated, dammed and ponded. During BSC's due diligence in sampling the dredge spoil to be removed from the pond, a layer of clay was found to layer the bottom of the pond at minus 1 foot mean sea level. For a more detailed description of the spoils to be maintenance dredged please refer to Appendix 10. This clay appears to have been placed to prevent exfiltration of irrigation waters and continues to provide that function today. The name Marchant's Mill Way also points to the likelihood of a grist mill to have operated at the site. Also located adjacent to the site is a pump house, maintenance garages and tennis courts and the Hyannisport Golf course and areas of altered uplands within which the dredge spoil will be placed. The wetland resource areas and areas of conservation jurisdiction on the site that are protected under the Wetlands Protection Act and the Town of Barnstable's Wetland Protection Bylaw include:' • Land Under the Water (Marchant's Mill Pond) • Bordering Vegetated Wetland (BVW) — • Land Subject to Coastal Storm Flowage (Zone A10, elevation 11 feet) i Chapter 91 Marchant's Mill Road Hyannisport,Massachusetts 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Maintenance Dredge—Marchant's Mill Pond has been previously dredged (created) sometime in the late 1800's and again in 1981 (SE 3-470) to remove silt and debris and to widen and deepen the pump house channel. Special note was taken not to disturb the hard bottom and presumably the clay liner. The limits of dredging were to minus 1 foot mean sea level over a length of 180 feet and width of 40 feet and a 10 foot offset was established along Marchant's Mill Way. Based on a sketch plan the area dredged measured I IO'X80' and it is that 'area plus a small area previously permitted but not dredged, which are proposed for maintenance dredging. Approximately 960 cubic yards will be dredged and used as an upland beneficial reuse to fill a depression adjacent to the thirteenth tee at the Hyannisport Golf Course. This depression is located at the edge of the previous placement of dredge disposal. Testing of the boring samples at Groundwater Analytical, Inc. met the S-1 upland disposal standards (314 CMR 907 (2)(a)(1-6) and 907 (9)) Shoreline Placement and Upland Material Reuse Under a 401 Water Quality Certification. Construction methodology will include using a small crane initially working off Marchant's Mill Way with drag line bucket. The material will be placed in either 20 cubic yard roll-off containers or ten wheel dump trucks, dewatered and transported to the disposal site, which has a capacity to hold 850-1,200 cubic yards. Maintenance dredge will cover an area of 6,400 square feet to an average depth of minus 1 foot mean sea level for the removal of between 500 and 750 cubic yards of material. Based on the size of the crane (80 foot boom) it may be necessary to crib a sheetpile coffer dam out into the pond in order to accurately dredge the pond upon completion of the coffer- dam material will be removed and excavated. A pond elevation board will be placed in order to measure dredge depths and the pond will be lowered appropriately to enhance dredging and will be drawn down in 6 inch increments to protect fisheries. In total the project will take two weeks to complete. Timing will be in the late fall prior to ice formation and is projected to take two weeks. For more information, please refer to the site plans attached. 4.0 MITIGATION Proposed dredging will be completed as per the special conditions of State, Federal and Local permits of all permitting authorities involved. Timing considerations will be based around migratory and breeding animals to minimize impacts. Onsite disposal of dredge spoils reduces the carbon footprint and gas consumption of the trucking company. Landfill space is at a premium especially with the limited area available on the Cape so this will prevent material from being sent to the landfill. Finally, during the project several invasive species will be removed from the disposal site to be planted with natives. This reduces or at least slows the spread of invasives around the resource area and the landfill will be vegetated in an upland seed-shrub mix which is self sustaining (no fertilizer). Species to be used include Little Bluestem (Schizachyrium. scoparium), Sheep Fescue (Festuca ovina), Sweet Vernalgrass (Anthoxanthum odoratum), Junegrass (Poa pratensis), Panic-grass (Dichanthelium acuminatum), Prairie-Switchgrass (Panicum virgatum), interspersed with Sweet-Fern (Comptonia peregrine), Bayberry (Myrica pensylvanica) and Beach Plum (Prunus maritime) all indigenous species. Also Butterfly Bush (Asclepias tuberose), Seaside Goldenrod (Solidago sempervirens), Common Milkweed (Asclepias syriaca), Queen Anne's Lace (Dancus carota), New England Aster (Symphyotrichum noval-angliae) and .New York Aster Chapter 91 Marchant's Mill Road Hyannisport, Massachusetts (Symphyotrichum novi-belgii) will be inter-planted to provide nectar for the fall migration of Monarch, Red &.White Admiral, Tiger Black & Spice Bush Shallow Tails, Vieroy, Baltimore Checkers, Painted Ladies and a host of other recorded butterflies using the area in September — October. Of note is the Sweet-Fern a nitrogen fixer which will provide nitrogen from the atmosphere through root nodules in a form usable by the plants, negating fertilization. Finally, the bottom of the dewatering basin is of medium sand allowing for ease of dewatering.
