Schernig, Director Art Traczyk, Principal Planner Applicant: Property Address: 2 Irving Avenue,Hyannisport,in Assessor's Map/Parcel Map 2 arce Area: 156 Acres Zoning: RF-1 Residential F-1 Zoning District Groundwater Overlay: AP Aquifer Protection District Filed April 15,1997 Public Hearing,May 28,1997 Decision Due July 11,1997 Background: The locus of this appeal is the Hyannisport Club, a private 156 acre, 19 hole golf course, including tennis courts, a private club house of 7,594 sq.ft. originally built in 1905, a pro shop of 240 sq.ft., a storage and maintenance building of 3,280 sq.ft. and a two story single family dwelling of 1,608 sq.ft. dated to the 1800's. (See Attached Locus Map&Assessors Cards) The petitioner is seeking to construct a 20'x 24' pro shop with 10'x 7' toilet and a 25'x 40' storage shed in connection with the golf operation. (See Attached Applications&Site Plan) The applicant has applied for two special permits as follows: . • Appeal Number 1997-67 Special Permit pursuant to Section 44.5(2) Expansion of a Pre- Existing Non-conforming Use to permit construction of a 20' by 24 foot"Tennis Pro Shop and a 10' by 7'toilet facilities. The shop and toilet located upon a proposed 30 foot by 44 foot covered deck structure of one story. The structure is to be located adjacent to the existing tennis courts. • Appeal Number 1997-58 Special Permit pursuant to Section 3-1.3 (3)(A) Conditional Uses- Public or Private Regulation Golf Courses subject to the provisions of Section 3-1.1(3)(B)and Section 3-1.1(3)(B) Conditional Uses-Public or Private Regulation Golf Courses, or in the alternative Section 4-4.5(2) Non-conforming Use-Expansion of a Pre-Existing Non-conforming to construct a one-story accessory building of 25 ' by 40 feet as storage for the golf course operations. The proposed structure is to be located approximately 50 feet from the existing maintenance building. Site Plan Review: The proposed site plan.was reviewed and found approvable with Conditions by the Site Plan Review Committee on April 03, 1997. (see attached Site Plan Review Approval, Conditions Letter and Meeting Notes). Site and Zoning History: f he Zonin Board of Appeals file two previous ap peals for this locus exist. In review o f g . ppea s s, p pp Town of Barnstable-Planning Department-Staff Report Appeal No. 1997-57&58 - Hyannisport Club Special Permit 1967-10 granted a 780 sq.ft. expansion of the Pro Shop as an addition to the existing club house and provided cart storage in the part exposed basement below the addition. This Special Permit was granted as an extension of a Non-Conforming use. Zoning at that time did not permit golf courses in the.district. (see attached -Special Permit 1967-10) Special Permit 1970-75A: Granted an addition of 340 sq.ft. to the club house for expanded kitchen facilities. This Special Permit was granted as an extension of a Non-Conforming use. Zoning at that time did not permit golf courses in the district. (see attached -Special Permit 1970-75A) On July 11, 1973, zoning was amended to provide for Public and Private Golf Courses as a Conditional use in all Residential Zoning Districts(Article No. 6). Staff Review: The Hyannisport Club, a golf course with tennis courts and clubhouse, predates the enactment of zoning in this area of the Town (1949 for Hyannisport). Golf Courses today are a Conditional Use in the RF-1 Zoning Districts as per Section 3-1.3(3)(A) and subject to the provisions of Section 3-1.1 (3)(B). (See Attached -Section 3-1.1 (3)(13)) One of those provisions specify, that; "No accessory buildings are located on the premises except those for storage of golf course maintenance equipment and materials, golf carts, a pro shop for the sale of golf related articles, rest rooms, shower facilities and locker rooms. From the Zoning Board of Appeals files, it appears there is not a Conditional Use Permit issued to the Golf Course, under today's zoning, Section 3-1.3(3)(A), however there are outstanding Special Permits for expansion of non-conforming use. The Planning Department has taken the position that once the zoning is amended and a previous non-conforming use becomes a conditional use within the district, then the guidelines for changing should become those cited as per the conditional use requirements and those conditions imposed under the prior Special Permits. This thinking is based upon Section 4-4.5 Non- conforming Uses that states; "A pre-existing non-conforming use may be changed to a Principal Permitted Use as-of-right. A pre-existing non-conforming use may be changed to a conditional use by special permit as provided for within the zoning district in which it is located, or to another non-conforming use as provided for herein. This thinking would conclude that the rest room and maintenance facility should be permitted as-of-right. The only relief that may be needed is for the Pro-Shop as it relates to tennis. Recommended Conditions: The following conditions are for the"Pro-Shop" and its covered deck area only, which are to be located just beyond the top of a Coastal Bank and to be permitted as an expansion of a Nonconforming Use under Section 4-4.5(2). 1. Development of the proposed Pro-Shop" shall be in accordance with plan presented titled"Site Plan of Proposed Tennis and Maintenance Buildings at Hyannisport Club"-pro shop plan view- as last revised dated 4-7-97 drawn byNye,Baxter& NInc. and as represented in architectural plans P drawn b resented to Site Plan Review cited as New Club House for Hyannisport Club", y P Y Kenneth Sad ler Associates and dated 3-11-97 Sheet Numbers A200 and A500. 2. The use of the pro-shop and deck area may include the serving of beverages and snakes to club members and their guest only. 4. There shall be no food preparation in the building. Commentary: The Board will recall that previous concerns for Golf Courses also were raised during the recent expansion of the restaurant at lyanough Hills Golf Course(Appeal No. 1996-34). Consideration should be given to revisiting zoning as it relates to.Golf Course. Today Golf Courses typically have add more year- round activities for both economic and to meet public demand and changing preferences. It is not unusually to find tennis and hand ball courses (both outdoor and indoor), restaurants, function rooms, health clubs, skeet shooting,running tracks and a host of other exercise and social facilities being added. Section 3-1.1 (3)(B), the Accessory Uses to a golf course should be revisited. Given that these courses are large land areas and concerns for nitrate loading are lessen. Chase stated that the Club was seeking permission to extend an existing non-conforming use for the construction of a 101x341 addition to the kitchen. Mr. Chase said that the alter- ations which the Club desired to make were necessary to comply with certain requirements of the Board of Health. The proposed addition is to be constructed at the rear of the existing club- house and. would be approximately 80' from St. Andrews Church. St. Andrews Church was represented by Mr. Angier who stated that not only was there no objection, but that the Church was willing to cooperate with the Club since a portion of the premises are used jointly. It was the opinion of the Board that the extension of the kitchen facilities was reasonable. The Club has been operating for almost 70 years and have not added appreciably to the non- conforming use.
