MCKEAG At a regularly scheduled hearing of the Barnstable Zoning Board of Appeals , held on June 21 , 1990 , notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts , the petitioner, Donald P. McKeag, through Attorney Richard Anderson, petitioned the Board for a Variance from Section 3- 1 .3 (5) , Bulk regulations , of the Zoning Bylaw to allow construction of a one-car garage not in compliance with the side yard setback requirement. The petitioner's property is located on Irvi_ng Road, Hyannis, MA and is shown on Assessors" ,Map as- lof 6 •. It is in the Residential F- 1 Zoning District. Plans drawn by Barnstable Land Design were submitted to the Zoning Board of Appeals file. One Plan is entitled "Landscape Site Plan for Proposed Garage" , dated April 12 , 1990. The other Plan is entitled "Detached Garage Plan and Elevations" , dated March 31 , 1990. A Plan prepared by Down Cape Engineering, entitled "Site Plan, lot 6 Irving Avenue, Hyannisport (Barnstable) , Mass . " , dated January 22 , 1987 was also submitted to the Zoning Board of Appeals file. Attorney Richard Anderson presented the petition to the Board. The petitioner requested the Variance in order to allow a proposed one-car garage to be located only five. ( 5) feet from the side lot line. The side yard setback in the Residential F- 1 Zoning District is. fifteen ( 15) feet. The garage will be located on the eastern side of the property at the end of the existing driveway. The garage will measure 22' x 12. 5' and it will stand fifteen ( 15) feet from ground . level to the peak of the roof. The- garage will match the existing dwelling' s exterior clear cedar shingles and asphalt roof. Attorney Anderson stated that the petitioner has installed a new septic system. Mr. Anderson. made reference to the Plan 2 prepared by Down Cape Engineering and he stated that the septic system is located in the only appropriate site on the lot. Board of Health regulations require that any structure must be located a minimum of ten ( 10) feet from the septic system. Mr. Anderson stated that, according to the Plan prepared by Down Cape Engineering, the proposed garage is located 10. 5 feet from the septic system. Mr. Anderson stated that the lot slopes sharply for most of its length. The only area where there is no severe slope is the area where the driveway is and where the proposed garage will be located. In addition, the west side of the property is extensively landscaped with plantings and stone walls. FINDINGS OF FACT: Based on the information presented, the Zoning Board of Appeals made the following findings of fact: 1 . Based on the information presented, the petitioner has demonstrated that Variance conditions exist; 2 . There is an existing septic system located in. the ground that, according to the petitioner's attorney, can only be located at its present site. Board of Health regulations require that no building be constructed within ten ( 10) feet of a septic system; 3 . The petitioner has demonstrated that due to the topography of the lot, the garage can not be built at any other location on the lot; 4 . The lot's particular topographic features , both natural and man-made, create a unique situation. This unique situation creates a hardship for the petitioner; and 5 . The grant of the relief sought would not be in derogation of the spirit and intent of the Zoning Bylaw nor would it create any detriment to the public. The vote on the findings of fact was as follows : AYES:. BOY, BURMAN, JANSSON, LALLY, NIGHTINGALE NAYES: NONE . DECISION: Based on the information presented and the findings of fact, at a meeting held on , by a motion duly made and seconded, the Zoning Board of Appeals voted to grant the relief sought with the following conditions : 3 1 . The garage shall be constructed as set forth in the plan submitted to the Board; 2 . The garage shall be constructed in conformance with the side yard setback sought. All other setbacks for the garage shall be in conformance with the setback requirements set forth in the Zoning Bylaw; 3 . The garage shall be only one story in height; and 4. The garage shall never be used for living purposes. " Many Home Owners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q, Rules and Regulations for Licensing Construction Supervisors, Section 2.15) . This lack of awareness often results In serious problems, particularly when the Home Owner hires unlicensed persons. In this case our Board cannot proceedthe unlicensed person as it would with licensed Supervisor. The Home Ownernacting as, supervisor is ultimately responsible. To ensure that the Home Owner Is fully aware of his/her responsibilities, many communities require, as part of the permit application, that the Home Owner certify that he/she understands the responsibilities of a supervisor .
