Norris Objective: Final inspection of framing Progress: The framing is complete for the most part, aside from the deck. Observations: • Two hold downs shown on.drawing S2.06 were found to be missing at the 1st floor level. • The roof valley beginning at line F has been shaved from 11 %4' depth to about 10 %" of depth. The contractor also inquired about shaving down several of the roof rafters in that same area. This valley is also notched at the support. Recommendations: • The hold down at the front of wall 3-1(drawing S2.0B) will be moved to the front of the house, inside the exterior wall. The missing hold down at column .line 5.1 will not be necessary due to the adjacent column, and overhead beam. • The roof valley shaved to 10" depth meets code. The rafters in that same area can be tapered to a minimum depth of 7 '/4" at the ends. The notch will be acceptable. Geotechnical Engineers November 22, 2004 Ivan Bereznicki Associates 9 Wendell Street Cambridge, MA 02138 Attention: Mr. Ivan Bereznicki Reference: 9 Island Avenue; Hyannisport, Massachusetts Foundation Engineering Report Gentlemen.- This letter report documents the results of our subsurface investigation and foundation design study for the proposed residence to be located at 9 Island Avenue in Hyannisport; Massachusetts. Refer to the Project Location Plan (Figure 1)for the general site location. Existing Site Conditions and Proposed Development The project site is located at 9 Island Avenue in Hyannisport, Massachusetts. Fronting onto Island Avenue to the north, the site is bounded by the Nantucket Sound.on southern side and by private property on the eastern and western sides. It is understood that the approximate 43,460 square foot.site was formerly occupied by a wood-framed house located near the middle of the site. It is further understood that the wood-framed structure has generally been demolished, except for the southern.perimeter foundation wall. Based on the site plan, the basement and first floors of the former structure were at Elevation +14.7 and Elevation +22.7, respectively. With the exception of the former structure and a paved driveway on the northern.portion of the site, the remainder of the site generally consists of landscaped areas. Site grades slope downward from about Elevation +25 near the middle of the site to about Elevation +10 and Elevation +5 at Island Avenue and Nantucket Sound; respectively. The proposed construction will generally consist of a residence occupying a footprint of about 1,900 square feet. It is understood that the proposed residence will be about 2'/Z-stories in height and will be benched into the existing hillside to accommodate the change in elevation across the building footprint, thus, creating a walk-out first floor on the northern side and a walk-out second floor on the southern side of the proposed residence. The proposed residence is also understood to include a patio and a deck on the northern and southern sides of the residence, respectively. The footprint of the proposed residence will generally replicate the footprint of the former residence. Based on the information provided by Ivan Bereznicki Associates, the finished first, second and"half story"floors will be at about Elevation +14.7, Elevation +24.5 and Elevation +34.5, respectively. Elevations as referenced herein are understood to refer to the National Geodetic Vertical Datum (NGVD). Subsurface Conditions On November 12, 2004, three borings (B-2, B-3 and B-4) were performed at the site by Carr-Dee Corp. of. Medford, Massachusetts under contract to McPhail Associates, Inc. The location of boring B-1 was inaccessible at the time of our field work due to existing construction equipment and thus, was not 30 Norfolk Street Cambridge,Massachusetts 02139 617/868-1420 617/868-1423 (Fax) ASSOCIATES,INC. The approximate boring locations are as,indicated on the Subsurface Exploration Plan (Figure 2), which is based on a progress site plan provided by Ivan Bereznicki Associates. A detailed description of the subsurface conditions encountered at each of the explorations is presented on the boring logs attached to this letter. The generalized subsurface conditions across the site were inferred primarily from these explorations, but also from our general knowledge of the local geology. The subsurface conditions encountered in the explorations are described below. At boring B-2, the ground surface was.covered by an approximate 5-inch thick concrete slab. Beneath the slab at boring B-2 and immediately below ground surface at borings B-3 and B-4, the explorations encountered a fill deposit extending to depths of about 5.5 to 10 feet below the existing ground surface. In general, the fill was observed to consist of a very loose to compact, light brown to brown, fine to coarse sand with a trace of gravel and silt and containing a trace of topsoil and brick. Underlying the fill at borings B-2 and B-4, deposits of former topsoil and subsoil were encountered that consist of loose to compact dark brown to orange-brown silty sand with a trace of gravel. The topsoil and subsoil deposits were about 1.5 and 2.5 feet in thickness and extended to depths of about 7 and 8 feet below the existing ground surface at borings B-2 and B-4, respectively. Underlying the existing fill or topsoil/subsoil deposits, a beach dune deposit was encountered at depths ranging from about 7 to 10 feet below the existing ground surface, corresponding to about Elevation +7.5 and Elevation +4.5, respectively. The beach dune deposit was not penetrated at any of the boring , locations. In general, the beach dune deposit was observed to consist of a loose to compact brown sand with a trace of silt and gravel. At the completion of the field work, laboratory sieve analyses were performed to determine.the gradations and confirm the visual classification of the beach dune deposit. Grain-size distributions of typical samples of the deposit are provided in Figure 3. Groundwater levels observed within the completed boreholes varied from 13.5 to 14.5 feet below the existing ground surface, corresponding to about Elevation +1 and Elevation 0, respectively. The groundwater levels indicated in this report represent levels only at the time and locations of our borings. It is anticipated that future groundwater levels across the site may vary from those reported herein due to factors such as normal seasonal changes,.periods of heavy precipitation, and alterations of existing drainage patterns. Foundation Design Recommendations and Construction Considerations Based upon the relatively modest structural loadings anticipated to be generated by the proposed residence and the subsurface conditions encountered during the exploration program, it is recommended that the proposed building be supported on a pile foundation system that transfers the building loads through the existing fill and former topsoil/subsoil deposits to the underlying loose to compact beach dune deposit. The most economical type of pile for support of the proposed residence is considered to be a pressure injected footing (PIF) that is installed through the existing fill and former topsoil/subsoil deposits and into the upper portion of the natural beach dune deposit. Based upon the anticipated structural loadings, it is recommended that the PIFs be designed for a maximum design capacity of 50 tons per unit in compression. ASSOCIATES,INC. Ivan Bereznicki Associates November 22, 2004 Geotechnical Engineers Page 3 Due to the similarity in density between the fill and the natural beach dune deposits, it may be difficult to determine the transition between the fill and the natural soil during installation of the PIFs. Thus, it is recommended that the PIFs be installed to a minimum depth of 15 feet below the former basement slab or to about Elevation -0.5, to insure that the foundations bear in the natural beach dune deposit. The PIFs should be installed utilizing cased shafts. A 50-ton PIF is a relatively short pile driven through the unsuitable soils, and then "based up' in the upper portion of the underlying natural sand deposit. The base consists of zero slump concrete having a 28-day compressive strength of at least 4,000 psi driven and compacted in 5 cubic-foot batches by a drop hammer delivering not less than 100,000 foot-pounds of energy per blow. The number of blows of the drop hammer per 5 cubic-foot batch has been empirically correlated with pile capacity. After completion of the base, the pile shaft is formed by placing concrete into a corrugated metal shell having a minimum diameter of approximately 11 inches which has been attached to the enlarged base. The cased shaft should be dry and thoroughly cleaned to the bottom prior to concrete placement. Shafts that are excessively distorted, or leak excessively, should be rejected and replaced. The minimum center-to-center pile spacing should not be less than 3 feet in accordance with Section 1820.4.6 of the Massachusetts State Building Code(the Code). Columns supported by less than three piles should be designed to accommodate a 3-inch eccentricity between the centroid of the column and the centroid of the supporting pile group. Seismic pile reinforcement should be provided in accordance with Section 1820.1.2.2 of the o C de.. Based upon the provisions of Section 1817.4 of P P the Code, a pile load test is not required for this project since the recommended end bearing pile capacity does not exceed 50 tons. Pile caps and grade beams adjacent to unheated areas should be provided with a minimum 4-foot thickness of soil cover as frost protection. Interior pile caps and grade beams should be located such that the top of the foundation concrete is a minimum of 6 inches below the bottom surface of the slab. Obstructions to pile driving activities encountered in the fill within a depth of 10 feet from the working grade should be removed by the earthwork contractor. Below a depth of 10 feet, a determination of the need to remove the obstruction or to redesign the pile cap around the obstruction should be made on a case-by-case basis. It is not anticipated that ground vibrations caused by the PIF installation will cause damage to nearby structures, however, due to the proximity of existing adjacent structures and the loose nature of the existing site soils, it is recommended that the Contractor perform a preconstruction survey of the adjacent buildings before the start of PIF installation and that vibration monitoring be performed during PIF installation. Prior to placing fill materials for the proposed lowest level slab, the surface of the slab subgrade should be proof compacted by at least six passes of a large, walk behind vibratory drum roller. All soft and/or compressible areas detected by the proof compaction should be removed and backfilled with gravel fill consisting of a well-graded natural sand and.gravel with a maximum of 8 percent by weight passing the No. 200 sieve. The lowest level slab of the residence should be designed as a conventional slab-on-grade underlain by a polyethylene vapor barrier placed directly over a minimum 9-inch thickness of'compacted 3/4-inch crushed stone which is spread across a thickness of filter fabric that covers the subgrade. Ivan Bereznicki Associates November.22, 2004 Geotechnical Engineers Page 4 it is understood that the proposed residence will be"benched" into the hillside, requiring that portions of the lowest level slab be below grade. Thus, it is recommended that the lowest level slab be provided with perimeter and underslab drainage systems in order to protect against groundwater intrusion. All below-grade walls should receive a troweled-on bitumastic damproofing and be backfilled with a minimum 2-foot width of gravel fill. Alternatively, a prefabricated drainage product such as Miradrain 6000 may be installed directly along the exterior foundation wall and tied into the perimeter drainage system. Should a prefabricated drainage product be utilized on the perimeter walls, the walls may then be backfilled with ordinary fill. Based on the laboratory test results and our visual observations, the existing fill and beach dune deposit are not suitable for use as gravel fill, however, these materials may be used as ordinary fill. The perimeter drainage system should consist of a 4-inch diameter perforated PVC pipe having its invert located no higher than 12 inches below the underside of the lowest level slab. The pipe should be pitched down at a minimum 0.5-percent slope in the direction of flow and be embedded within a minimum 6-inch thickness of crushed stone surrounded by a thickness of filter fabric such as Mirafi 140N, or equivalent. The underslab drainage system should consist of a series of 4-inch diameter perforated PVC pipes located within the 9-inch thick crushed stone drainage layer and should be surrounded by a minimum 6- inch thickness of crushed stone. The drain pipes should be pitched down at a minimum 0.5 degree slope. The perimeter and underslab drains should flow by gravity to a storm drain line or other suitable location as determined by the Project Civil Engineer. Below-grade foundation walls receiving lateral support at the top and bottom(i.e:, restrained walls) should be designed for a lateral earth pressure corresponding to an equivalent fluid density of 60 pounds per . cubic foot. Cantilevered or unrestrained retaining walls may be designed utilizing a lateral earth pressure corresponding to an equivalent fluid density of 40 pounds per cubic foot subject to the walls being provided with positive drainage to prevent hydrostatic pressures from acting on the walls. To these values must be added the pressures attributable to earthquake forces per Section 1612.4.9 of the Massachusetts State Building Code. Lateral forces can be considered to be transmitted from the structure to the soil by passive pressure against the foundation walls utilizing an equivalent fluid density of 120 pounds per cubic foot providing that the walls are designed to resist these pressures. Lateral forces can also be considered to be transmitted from the structure to the soil by friction on the base of footings using a coefficient of 0.50, to which a safety . factor of 1.5 should be applied. Seismic Design Considerations For purposes of determining the total lateral seismic force or base shear for earthquake design, this site is considered to be an S3 soil site as defined by Table 1612.4.1 of The Code. Therefore, the site coefficient "S" should be 1.5. Based upon our analysis of the subsurface data collected at the site and typical grain- size distributions of the beach dune deposit, the bearing stratum is not considered to be subject to liquefaction during an earthquake based on the criterion of Section 1805.3 of The Code. The purpose of this involvement would be to review the structural foundation drawings and foundation notes for conformance with the recommendations presented herein and to generate the pile specification section for inclusion into the Contract Documents for construction. It is further recommended that McPhail Associates, Inc. be retained during the construction period to observe the pile installation in accordance with the provisions of the Massachusetts State Building Code and the provisions of the Contract Documents. Our involvement during the construction phase of the work should minimize costly delays due to unanticipated field problems since our field engineer would be under the direct supervision of our project manger who was responsible for the subsurface exploration program and foundation design recommendations documented herein. The 0.49-acre undersized lot is developed with a one-story,single-family dwelling,originally constructed in 1979. This property is serviced by public water and private on-site septic disposal. The applicant has submitted drawings of the existing building,layout that shows it to be three-bedrooms with a living area of 3,490 sq.ft.located on two levels. The applicants are seeking to expand and renovate the existing structure with the addition of some 1,236 sq.ft. of living area. The applicant has submitted two applications to the Board. Appeal 2004-42 seeks a Special Permit in accordance with Section 4-4.3(2)Nonconforming Buildings or Structures Used as Single and Two-Family Residences and MGL Ch. 40A,Section 6 to allow for the renovation and addition. Appeal 2004-043 seeks a Variance to Section 3-1.3(5) Bulk Regulations,Minimum Lot Area,and Minimum Side Yard Setback to allow for the renovation and addition. Procedural&Hearing Summary: Appeal 2004-42 was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals.on January 14,2004. 'A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened March 17,2004 and continued to May 12,2004 at which time the Board found to grant the special permit. Board Members deciding this appeal were Richard L.Boy,Randolph Childs,Sheila Geiler,Gail Nightingale and Ralph Copland who was also Acting Chairman. Attorneys Patrick M.Butler and Eliza Cox represented the applicant. Peter Sullivan from Sullivan Engineering was also present. Mr.Butler presented photos of the existing building and noted features of the property stating that due to the coastal bank the project would require an Order of Conditions from the Conservation __ - 4 Commission. Mr.Butler described the proposal and noted that he was prepared to go forward on a Section 6 finding. He also noted that the Board of Health approved a variance to the septic system. The Board questioned a trellised area that intruded into the rear corner of the lot. Mr.Butler explained that the retaining wall was already in place and the trellis structure was being added to that structure. Ms. Cox stated they filed under 40A Section 6 and 4-4.3(2)Nonconforming Buildings Used as Single Family Residences. She pointed out the criteria for findings and stated that the reconstruction regardless of intensification in area of the new dwelling could be authorized by the Board because it would not represent a substantial detriment to the neighborhood.Ms. Cox noted the neighboring homes and cited that 8 letters of support from abutters have been entered into the file. The issue of the number of bedrooms arose and it was clarified that the Board of Health has issued a septic permit for three bedrooms total. Public comment was requested and no one spoke in favor or in opposition to the request. The Acting Chairman noted that eight letters of support were received from abutters. Findings of Fact: At the hearing of May 12,2004,the Board unanimously made the following findings of fact: 1. Joan B. Hill and David B.Hill,Trustees have applied for a Special Permit in accordance with Section 4- 4.3(2)Nonconforming Buildings or Structures Used as Single and Two-Family Residences and MGL Ch. 40A,Section 6 to allow for the renovation of and the addition of 1,236 square feet to their existing nonconforming single-family dwelling. The property is located as shown on Assessor's Map 265,Parcel 022 addressed as 9 Island Avenue,Squaw Island,Hyannisport,MA in a Residence F-1 Zoning District. 2. The property is located on Squaw Island in Hyannisport and fronts on Nantucket Sound. According to the Assessor's record the 0.49-acre lot is developed with a one-story,single-family dwelling. The original construction dates back to 1979. This property is serviced by public water.and a private on-site wastewater disposal system. The Assessor's record states that the existing dwelling has six-bedrooms and a living area of 2,246 sq.ft. The applicant has submitted drawings of the existing building layout that shows it to be a three bedroom home with a living area of 3,490 sq. ft.,located on two levels. 3. The applicants are seeking to expand and renovate the existing structure with the addition of-approximately 1,236 sq.ft. of living area. According to plans,the first floor will be enlarged by 229 sq. ft.,the second by 85 sq. ft.,and a new half story of 922 sq.ft. The interior is to be renovated and the finished dwelling is to have three bedrooms plus a den and an office. 4. The lot is undersized and the existing and proposed building conforms to the required setbacks,however,an existing deck structure does infringe into the required side yard. The Building Commissioner has determined that one of the building walls—the front wall-is being completely removed and'a new wall constructed outside of the existing building footprint. In his letter of December 16,2003,the Building Commissioner cited that he has determined that the existing"wall is not being retained and incorporated into the new structure. Therefore,this does not meet the policy guidelines for an alteration/expansion set by [his]office." The Commissioner has instructed the applicant's to seek Section 6 findings with regards to the proposed alteration/expansion,as it is his interpretation that the proposal constitutes a demolition/rebuild of the structure on a pre-existing non-conforming lot. 5. The property,as shown on site plans,is within the jurisdiction of the Conservation Commission. Accordingly,the proposed work necessitated filing of a Notice of Intent. In response thereto, on July 11, 2002,the Barnstable Conservation Commission issued an Order of Conditions to the Applicants.At the time of the filing of the Notice of Intent,the jutting out of the first floor wall under the existing roof 2 ry overhang was not proposed. Accordingly,due to minor changes to the site plans since issuance of the Order,the Applicants are in the process of requesting an amended Order of Conditions. Based upon preliminary consultations with Rob Gatewood from Conservation Department,the Applicants anticipate appearing before the Commission in the next several weeks on this request to amend the existing Order. 6. The locus is not within a Wellhead or Groundwater Protection Overlay District and therefore,not subject to the Title 5's "440"limitation on nitrogen loading not the"330 Rule." 7. The location of the dwelling is within 50 feet of the top of the costal bank and the redevelopment will require an Order of Conditions from the Conservation Commission. 8. The proposed new dwelling conforms to the required setbacks applicable under the Residence F-1 Zoning District in which it is located. 9. The existing use of the property is that of three bedrooms with a living area of 3,490 sq.ft.located on two levels and the proposed new structure is to be that of a three-bedroom,4,726 sq. ft.,two and one-half story, single-family dwelling. 10. The new dwelling is a reconstruction of the existing building,although there is intensification in building on the nonconforming lot,the new dwelling would not be substantially more detrimental to the neighborhood than the existing dwelling. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the permit for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non-conforming lot. The 0.49-acre undersized lot is developed with a one-story, single-family dwelling,originally constructed in 1979. This property is serviced by public water and private on-site septic disposal. The applicant has submitted drawings of the existing building layout that shows it to be three-bedrooms with a living area of 3,490 sq.ft.located on two levels. The applicants are seeking to expand and renovate the existing structure with the addition of some 1,236 sq.ft. of living area. According to plans,the first floor will be enlarged by 229 sq.ft.,the second by 85 sq.ft.,and a new half story of 922 sq. ft.will be added. The interior will be renovated and after renovations the dwelling will have four-bedrooms plus a den and an office room. The Building Commissioner has determined that one of the building walls—the front wall-is being completely removed and a new wall constructed outside of the existing building footprint. In his letter of December 16, 2003, the Building Commissioner cited that he has determined that the existing"wall is not being retained and incorporated into the new structure and therefore,the proposal does not meet the policy guidelines for an alteration/expansion set by [his] office." The Commissioner has instructed the applicants to seek Section 6 findings with regards to the proposed alteration/expansion as to whether it is an intensification or not. The applicant has submitted two applications to the Board. Appeal 2004-42 seeks a Special Permit in accordance with Section 4-4.3(2)Nonconforming Buildings or Structures Used as Single and Two-Family Residences and MGL Ch.40A,Section 6 to allow for the renovation and addition. Appeal 2004-043 seeks a Variance to Section 3-1.3(5) Bulk Regulations,Minimum Lot Area,and Minimum Side Yard Setback to allow for the renovation and addition. Procedural&Hearing Summary: Appeal 2004-42 was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 14,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened March 17,2004 and continued to May 12, 2004 at which time the Board found to grant the special permit. Board Members deciding this appeal were.Richard L.Boy,Randolph Childs,Sheila Geiler, Gail Nightingale and Ralph Copland who was also Acting Chairman. Attorneys Patrick M. Butler and Eliza Cox represented the applicant. Peter Sullivan from Sullivan Engineering was also present. Mr. Butler presented photos of the existing building and noted features of the property stating that due to the coastal bank the project would require an Order of Conditions from the Conservation Commission. Mr. Butler described the proposal and noted that he was prepared to go forward on a Section 6 finding. He also noted that the Board of Health approved a variance to the septic system. The Board questioned a trellised area that intruded into the rear corner of the lot. Mr.Butler explained that the retaining wall was already in place and the trellis structure was being added to that structure. Ms. Cox stated they filed under 40A Section 6 and 4-4.3(2)Nonconforming Buildings Used as Single Family Residences. She pointed out the criteria for findings and stated that the reconstruction regardless of intensification in area of the new dwelling could be authorized by the Board because it would not represent a substantial detriment to the neighborhood.Ms. Cox noted the neighboring homes and cited that 8 letters of support from abutters have been entered into the file. The issue of the number of bedrooms arose and it was clarified that the Board of Health has issued a septic permit for three bedrooms total. Public comment was requested and no one spoke in favor or in opposition to the request. The Acting Chairman noted that eight letters of support were received from abutters. Findings of Fact: At the hearing of May 12,2004, the Board unanimously made the following findings of fact: 1. Joan B. Hill and David B. Hill,Trustees have applied for a Special Permit in accordance with Section 4- 4.3(2)Nonconforming Buildings or Structures Used as Single and Two-Family Residences and MGL Ch. 40A,Section 6 to allow for the renovation of and the addition of 1,236 square feet to their existing nonconforming single-family dwelling. The property is located as shown on Assessor's Map 265,Parcel 022 addressed as 9 Island Avenue,Squaw Island,Hyannisport,MA in a Residence F-1 Zoning District. 2. The property is located on Squaw Island in Hyannisport and fronts on Nantucket Sound. According to the Assessor's record the 0.49-acre lot is developed with a one-story, single-family dwelling. The original construction dates back to 1979. This property is serviced by public water,and a private on-site wastewater disposal system. The Assessor's record states that the existing dwelling has six-bedrooms and a living area of 2,246 sq.ft. The applicant has submitted drawings of the existing building layout that shows it to be a three bedroom home with a living area of 3,490 sq. ft.,located on two levels. 3. The applicants are seeking to expand and renovate the existing structure with the addition of.approximately 1,236 sq.ft.of living area. The lot.is undersized and the existing and proposed building conforms to the required setbacks,however,an existing deck structure does infringe into the required side yard. The property,as shown on site plans,is within the jurisdiction of the Conservation Commission. Accordingly,the proposed work necessitated filing of a Notice of Intent. In response thereto,on July 11, 2002,the Barnstable Conservation Commission issued an Order of Conditions to the Applicants.At the time of the filing of the Notice of Intent, the jutting out of the first floor wall under the existing roof 2 overhang was not proposed. Accordingly, due to minor changes to the site plans since issuance of the Order,the Applicants are in the process of requesting an amended Order of Conditions. Based upon preliminary consultations with Rob Gatewood from Conservation Department,the Applicants anticipate appearing before the Commission in the next several weeks on this request to amend the existing Order. 6. The locus is not within a Wellhead or Groundwater Protection Overlay District and therefore,not subject to the Title 5's "440"limitation on nitrogen loading nor the"330 Rule." 7. The location of the.dwelling is within 50 feet of the top of the costal bank and the redevelopment will require an Order of Conditions from the Conservation Commission. 8. The proposed new dwelling conforms to the required setbacks applicable under the Residence F-1 Zoning District in which it is located. 9. The existing use of the property is that of three bedrooms with a living area of 3,490 sq.ft located on two levels and the proposed new structure is to be that of a three-bedroom,4,726 sq. ft., two and one-half story, single-family dwelling. 10. The new dwelling is a reconstruction of the existing building,although there is intensification in building on the nonconforming lot,the new dwelling would not be substantially more detrimental to the neighborhood than the existing dwelling. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the permit for the demolition and reconstruction with expansion of a single-family dwelling on an undersized non-conforming lot. The reconstruction shall comply with all setback requirements and is subject to the following conditions: 1.
