The new canopy location would improve the nonconforming setback to Route 132 and create a new nonconforming setback along Hinckley Road, requiring additional variance relief. Additional relief was sought to allow for a new access configuration on the site. There are three access points proposed: one 25'wide right-in, entrance-only access on Route 132, one 17.5'wide entrance-only access on Hinckley Road, and one 22' exit-only.access on Hinckley Road. The Applicant sought to amend the conditions of Variance No. 1995-21 to allow the proposed access plan. The conditions proposed for amendment are: 1. That the existing two curb cuts on Route 132 be reduced in width from 45 feet to 25 feet. 2. That the existing curb cut on Hinckley Road be reduced in-width from 77 feet to 25 feet. The applicant sought to completely demolish all existing improvements on the site and construct a new self-service BJ's fueling station. The proposed improvements included a new canopy, eight fuel pumps(16 fueling stations), an attendant's kiosk and associated.driveways, landscaping,lighting, stormwater improvements and utilities. The subject property is a .48 acre parcel located at the corner of lyannough Road/Route 132 and Hinckley Road in Hyannis. The uses of the property were retail gasoline sales and automotive service. The property was improved with a 1,536 sq.ft service station built in 1955, four fuel pumps (eight dispensers), and a 30'x 44'canopy. There were four points of access to the site, including two curb cuts.on.Route 132 allow left and right turns into the site. There were two Zoning Board decisions on record for the property. Variance No. 1995-21 granted relief from the font and minimum side yard setback requirements in the HB District to permit the construction of a 30' x 47' canopy over the existing gas pumps. The variance allowed the canopy to be located two (2)feet from the property line along Route 132 (100' required)and fifty(50)feet from Hinckley Road (10' required). Special Permit No. 1995-43 granted relief to allow additional impervious coverage"to the extent required to complete the canopy improvements and the Town of Barnstable Zoning Board of Appeals—Decision and Notice Appeal No.2015-038—Atlantic Development improvements to the curb cuts in the four driveways, two of which are on Route 132 and two are on Hinckley Road", but not to exceed 89%. This relief was filed, heard and decided concurrently with Special Permit No. 2015-039. Procedural &Hearing Summary Variance No. 2015-038 for setback relief in the HB District and to amend the conditions of Variance No. 1995-21 was filed at the Town Clerk's office and office of the Zoning Board of Appeals on June 15, 2015. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on June 22;'2015 and continued to August 12, 2015 and August 26, 2015 at which time the Board found to grant the variances subject to conditions. Board Members deciding this appeal were Brian Florence, Alex Rodolakis, George Zevitas(opposed), Matthew Levesque, and Robin Young. Attorney Michael Scott represented the Applicant before the Board. Also present were D.J. MacKinnon, Principal of Atlantic Development, Patrick Netreba, Manager of Site Development for BJ's , Alissa O'Malley, Manager of Environmental Health and Safety for BJ's, Bill Gobiel from Bohler Engineering, John Dzwonczyk from JGD Associates, and Randy Hart from VHB. Attorney Scott provided a summary of the relief requested. He provided a brief summary of the property and the proposal. He reviewed the new stormwater management system and indicated that they had agreed to a peer review of the on-site stormwater management. He reviewed site access, stating there would be an elimination of curb cuts on lyannough Road as well as modification of curb cuts on Hinckley Road. Bill Gobeil from Bohler Engineering reviewed the site layout and the proposed access and one way circulation. He reviewed the tanker truck circulation and proposed landscape plan. He confirmed Atlantic would be eliminating the septic system and connecting to public sewer. He indicated the stormwater system was designed to meet and exceed the stormwater requirements and policies and emergency shut-off valves were provided in the event of a spill. The Board and the Applicants discussed potential for traffic queuing. The Board expressed concerns regarding the driveway onto lyannough Road and driver's adhering to the one-way traffic pattern as designed. John Dzwonczyk, PE from JGD Associates, reviewed the proposed three new, double-walled, underground fuel storage tanks, noting that they would be continually monitored. Randy Hart from VHB reviewed the traffic study and the proposed-points of,ingress and egress, noting the proposal was an improvement over existing conditions. Mr. Hart reviewed the prospective ITE trip generation data and other empirical traffic data for the site. The Board Chair requested public comment and Attorney Bruce Gilmore, representing the Barnstable Municipal Airport discussed past traffic studies done for the area. He discussed the terminal expansion and the installation of the median on Route 132. Attorney Gilmore expressed concerns about the project in light of the heavy traffic volume. He:also discussed concerns about the use and potential pollution of the sole source aquifer. The Board discussed an independent review of the traffic study and the need for updated traffic counts to reflect peak season numbers. The Site Plan letter, which required additional access improvements, was also noted. The Board voted to continue the hearing to August 12th, noting that two members would not be available until August 26th. On August 12th, the hearing was opened and continued to August 26th without any discussion. On August 26th, Atlantic Development presented a revised site plan showing a drive on Route 132 allowing only right-in only turns and the extension of the median on Route 132 to the property line to further prevent left-hand turns. The revised site plan was reviewed. Attorney Scott presented the results of the peer review of the stormwater system conducted by Atlantic Design Engineers and t confirmed that they had complied with all recommendations. 2 I - Town of Barnstable Zoning Board of Appeals-Decision and Notice Appeal No.2015-ft38-Atlantic Development Randy Hart, VHB, presented additional findings from a gap analysis conducted for the site. He discussed the safety and operational improvements that would result from the proposed access changes and median installation. He compared the data in the report to data from three other stores, noting that two were stand-alone stores and the one with the highest counts was connected to a BJs store. Colleen Mederios from McMahon and Associates presented the findings of the peer review to the Board. She indicated that VHB has responded to a number of the.comments by providing the gap analysis and additional data. She stated that the analysis had been conducted in accordance with professional standards. She discussed Level of Service(LOS) on the roadways and indicated that Atlantic was accounting for their own traffic. When asked about past traffic studies, she indicated that it was industry practice to look at existing conditions and projected conditions going forward. The Board inquired about the underground storage tanks and improved safety. Deputy Chief Dean Melanson reviewed the process for tank removal and installation, along with ongoing operations. He reviewed their roles as first responders to any spill event. He confirm they had met with the applicant and did not have any outstanding concerns at that time.- Ron Persuitte, Chair of the Barnstable Municipal Airport Commission expressed concerns about the ability of Hinckley Road to handle large volumes of traffic and additional traffic queing in other locations as a result of the additional traffic added by the proposed station. Bud Breault, Airport Manager reiterated Mr. Persuitte's concerns and inquired about groundwater monitoring wells. Findings of Fact At the hearing on August 22, 2015, the Board unanimously made the following findings of fact for Appeal No. 2015-038, a request by Atlantic Development for a variance to construct.a gas station canopy and to modify conditions regarding access in Appeal No..1995-21: 1. Atlantic Development has applied for variances for the construction of a 40'x 113'fueling station canopy located 50.4'from Route 132 and 8'from Hinckley Road. The new canopy location improves the nonconforming setback to Route 132 and creates a new nonconforming setback along Hinckley Road, requiring additional variance relief. 2. Atlantic also seeks an amendment the conditions of Variance No. 1995-21 to allow the proposed access plan. Variance No. 1995-21 permits two curb cuts on Route 132, each 25 feet in width; and only curb cut on Hinckley Road, 25 feet in width. The Applicant is proposing one, right-in only curb cut on Route 132, 25 feet in width; one entrance-only curb cut on Hinckley Road, approximately 17.5 feet in width; and one exit-only curb cut on:Hinckley Road, approximately 22 feet in width. 3. The subject property is located at 590 lyannough Road/Route.132, Hyannis, MA as shown on Assessor's Map 311 as Parcel 017. It is in the Highway Business Zoning District and Groundwater Protection Overlay District 4. There are circumstances related to soil conditions, shape, or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located. The shape and size of the property and the fact that it is a corner lot, no development could occur on the property in compliance with the required setbacks. The established setbacks would result in a triangle-shaped building envelope that could not be used. 5. A literal enforcement of the provisions of the zoning ordinance would involve substantial hardship, financial or otherwise to the petitioner. Failure to issue variance relief would be a substantial hardship as a canopy is a necessary component of a modern gas station,offering both convenience for customers and increased environmental:protection by preventing precipitation from mixing with any spills. A canopy, or other development, could not be constructed on this property if it were to meet all setback requirements. i 3 Town of Barnstable Zoning Board of Appeals—Decision and Notice Appeal No.2015-038—Atlantic Development 6. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. A traffic study conducted by VHB, Inc, peer reviewed by McMahon and Associates, Inc for the Board, confirmed that while the proposed use will result in an increase in traffic volumes, the proposed site design and neighboring roadways will be able to process the traffic. The Board also finds that the proposed site plan is an improvement over existing conditions as it will result in the removal of 27-year old tanks and replacement with new state of the art double walled, monitored tanks that meet all code requirements. Further the applicant is constructing a new canopy that will provide both convenience for customers and increased environmental protection by preventing precipitation from mixing with any spills. The vote to accept the findings was: AYE: Brian Florence, Alex M. Rodolakis, Matthew Levesque, Robin Young NAY: George Zevitas Board Member Zevitas voted in the opposition, stating he thought-the proposal would be a substantial detriment to the public good and that the Applicant has failed to show otherwise. Decision Based on the findings of fact, a motion was duly made and seconded to grant Variance No.2015- 038 subject to the following conditions: 1. Variance No. 2015-038 is granted to Atlantic Development for the redevelopment of a property at 590 Iyannough Road, Hyannis into a self-service fueling station. Relief is granted for: a. The construction of a 40'x 113' canopy located 50.4 feet from Route 132 and 8 feet from Hinckley Road. b. To amend Condition Numbers 1 and 2 of Variance No. 1995-21 to allow the proposed access plan, as shown on the plan referenced in Condition No. 2 herein. 2. The site shall be redeveloped in substantial conformance with the plans entitled"Site Development Plans for proposed Retail Fueling Facility"drawn and stamped by Bohler Engineering, dated (last revised)7-21-15 (sic), 13 sheets; as revised to be in compliance with the recommendations of the report entitled"Engineering Review of Proposed Stormwater Management System- Proposed Retail Fueling Facility" prepared by Atlantic Design Engineers dated August 10, 2015. 3. The use and development of the site shall be in compliance with the Site Plan Review approval dated July 21, 2015. 4. The use of the site for automobile service and repair shall be.relinquished. 5. No retail sales of convenience store items shall be permitted; the station shall only sell fuel. This condition shall not preclude the sales of BJs memberships on-site. 8. All fuel deliveries shall be scheduled and monitored by the Applicant; no"drop in"deliveries shall occur. 9. July 22, 2015;August 26,2015 Recording Information: Deed: COT 184956 Plan: 11519-E Background In Petition No. 20.15-039, Atlantic Development sought a Special Permit for extension of a preexisting nonconforming site dimension per Section 240-93 and:expansion of a preexisting nonconforming use per Section 240-94(B). The applicant sought-to completely demolish all existing improvements on the site and construct a new self-service BJ's fueling station. The-proposed improvements included a new canopy, eight fuel pumps (16 fueling stations), an attendant's kiosk and associated driveways, landscaping, lighting, stormwater improvements and utilities. Relief was sought to extend existing noriconformities regarding impervious area, specifically to increase the amount of impervious area from 73.2%to 84.8% of the lot. In the Groundwater Protection Overlay District, a maximum of 50% of the lot may be made impervious by the installation of buildings, structures and paved surfaces. Special Permit No. 1995-43 allowed an increase in impervious surface coverage as necessary to construct the canopy, but not to exceed a maximum of 89% of the lot. Approximately 73.2% of the site was impervious area. The Petitioner sought improvements which would render 84.8% of the lot impervious. Further, the Petitioner sought to expand the volume of fuel storage in a Groundwater Protection District by replacing three(3)underground fuel storage tanks with a total volume of 36,000 gallons with three new underground fuel storage tanks with a total volume of 64,000 gallons. Within the Groundwater Protection Overlay District, underground fuel storage tanks and"storage of liquid petroleum products of any kind" are prohibited. The proposal eliminated the use of the property for vehicle service and repair, which is also prohibited in the GP Overlay District. The subject property is a .48 acre parcel located at the corner of lyannough Road/Route 132 and Hinckley Road in Hyannis. The uses of the property were retail gasoline sales and automotive service. The property was improved with a 1,536 sq.ft service station built in 1955, four fuel pumps (eight dispensers), and a 30'x 44'canopy. There were four points of access to the site, including two curb cuts on Route 132 allow left and right turns into the site. There were two Zoning Board decisions on record for the property. Variance No. 1995-21 granted relief from the font and minimum side yard setback requirements in the HB District to permit the construction of a 30'x47'canopy over the existing gas pumps. The variance allowed the canopy to be located two (2)feet from the property line along Route 132 (100'required)and fifty(50)feet from Hinckley Road(10' required). Special Permit No. 1995-43 granted relief to allow additional Town of Barnstable Zoning Board of Appeals—Decision and Notice Special Permit No.2015-039—Adantic Development impervious coverage"to the extent required to complete the canopy improvements and the improvements to the curb cuts in the four driveways, two of which are on Route 132 and two are on Hinckley Road", but not to exceed 89%. This relief was filed, heard and decided concurrently with Variance No. 2015-038. Procedural & Hearing Summary Special Permit No. 2015-039 for the extension of a site nonconformity and expansion of a preexisting nonconforming use was filed at the Town Clerk's office and office of the Zoning Board of Appeals on June 15, 2015. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in:accordance with MGL Chapter 40A. The hearing was opened on June 22, 2015 and continued to August 12, 2015 and August 26, 2015 at which time the Board found to grant the special permit subject to'conditions. Board Members deciding this appeal were Brian Florence, Alex Rodolakis, George Zevitas(opposed), Matthew Levesque, and Robin Young. Attorney Michael Scott represented the Applicant before the Board. Also present were D.J. MacKinnon, Principal of Atlantic Development, Patrick Netreba, Manager of Site Development for BJ's , Alissa O'Malley, Manager of Environmental Health and Safety for BJ's, Bill Gobiel from Bohler Engineering, John Dzwonczyk from JGD Associates, and.Randy Hart from VHB. Attorney Scott provided a summary of the relief requested. He provided a brief summary of the property and the proposal. He reviewed the new stormwater management system and indicated that they had agreed to a peer review of the on-site stormwater management. He reviewed site access, stating there would be an elimination of curb cuts on lyannough Road as well as modification of curb cuts on Hinckley Road. Bill Gobeil from Bohler Engineering reviewed the site layout and the proposed access and one way circulation. He reviewed the tanker truck circulation and proposed landscape plan. He confirmed Atlantic would be eliminating the septic system and connecting to public sewer. He indicated the stormwater system was designed to meet and exceed the stormwater requirements and policies and emergency shut-off valves were provided in the event of a spill. The Board and the Applicants discussed potential.for traffic queuing. The Board expressed concerns regarding the driveway onto lyannough Road and driver's adhering to the one-way traffic pattern as designed. John Dzwonczyk, PE from JGD Associates, reviewed the proposed three new, double-walled, underground fuel storage tanks, noting that they would be continually monitored. Randy Hart from VHB reviewed the traffic study and the proposed.points of ingress and egress, noting the proposal was an improvement over existing conditions.' Mr. Hart reviewed the prospective ITE trip generation data and other empirical traffic data for the site. The Board Chair requested public comment and Attorney Bruce Gilmore, representing the Barnstable Municipal Airport discussed past traffic studies done for the area. He discussed the terminal expansion and the installation of the median on Route 1'32. Attorney Gilmore expressed concerns about the project in light of the heavy traffic volume. He-.also discussed concerns about the use and potential pollution of the sole source aquifer. The Board discussed an independent review of the traffic study and the need for updated traffic counts to reflect peak season numbers. The Site Plan letter, which required additional access improvements, was also noted. The Board voted to continue the hearing to August 12th, noting that two members would not be available until August 26th. On August 12th, the hearing was opened and continued to August 26th without any discussion. On August 26th, Atlantic Development presented a revised site plan showing a drive on Route 132 allowing only right-in only turns and the extension of the median on Route 132 to the rproperty line to further prevent left-hand turns. The revised site plan was reviewed. Attorney Scott presented the 2 Town of Barnstable Zoning Board of Appeals—Decision and Notice Special Permit No.2015-039—Atlantic Development results of the peer review of the stormwater system conducted by Atlantic Design Engineers and confirmed that they had complied with all recommendations. - Randy Hart, VHB, presented additional findings from a gap analysis conducted for the site. He discussed the safety and operational improvements that would result from the proposed access changes and median installation. He compared the data in the report to data rfrom three other stores, noting that two were stand-alone stores and the one with the highest counts was connected to a BJs store. Colleen Mededos from McMahon and Associates presented the findings of the peer review to the Board. She indicated that VHB has responded to a number of the:comments by providing the gap analysis and additional data. She stated that the analysis had been conducted in accordance with professional standards..- She discussed Level of Service (LOS)on the roadways and indicated that Atlantic was accounting for their own traffic. When asked about past traffic studies, she indicated that it was industry practice to look at existing conditions and projected conditions going forward. The Board inquired about the underground storage tanks and improved safety. Deputy Chief Dean Melanson reviewed the process for tank removal and installation, along with ongoing operations. He reviewed their roles as first responders to any spill event. He confirm they had met with the applicant and did not have any outstanding concerns at that time. Ron Persuitte, Chair of the Barnstable Municipal Airport Commission expressed concerns about the ability of Hinckley Road to handle large volumes of traffic and additional traffic queing in other locations as a result of the additional traffic added by the proposed station. Bud Breault,Airport Manager reiterated Mr. Persuitte's concerns and inquired about groundwater monitoring wells. Findings of Fact At the hearing on August 22, 2015 the Board unanimously made the following findings of fact for Appeal No. 2015-039, a request by Atlantic Development for a special to expand a preexisting site nonconformity and expand a preexisting nonconforming use: 1. Atlantic Development has applied for a Special Permit for extension of a preexisting nonconforming site dimension per Section 240-93 and expansion of a preexisting nonconforming use per Section 240-94. The applicant seeks•to demolish the existing building and site features(pavement, landscaping, fuel storage tanks, utilities, etc)and construct a new self-service BJ's fueling station with canopy, attendant's kiosk-and associated driveways, fuel storage tanks, landscaping, utilities, etc. Special Permits are sought to extend existing nonconformities regarding impervious area and fuel storage. 2. The subject property is located at 590 lyannough Road/Route 132, Hyannis, MA as shown on Assessor's.Map 311 as Parcel 017. .It is in the Highway Business Zoning District and Groundwater Protection Overlay District 3. Section 240-93 allows for the alteration and expansion of nonconformities. The Applicant seeks to allow an increase in the impervious surface coverage on the lot from 73.2% to 84.8%. In the Groundwater Protection Overlay District, a maximum of 50%of the lot may be made impervious by the installation of buildings, structures and paved surfaces. Special Permit No. 1995-43 allowed an increase in impervious surface coverage as necessary to construct the canopy, but not to exceed a maximum of 89% of the lot. 4. Section 240-94(B)allows for the expansion of a preexisting nonconforming use. Within the Groundwater Protection Overlay District, underground fuel storage tanks and "storage of liquid petroleum products of any kind"are prohibited. The Applicant'seeks to expand the preexisting nonconforming use of underground storage tanks and storage of liquid petroleum by adding three new underground storage tanks containing a total of 64,000 gallons of fuel. The total increase in hazardous materials proposed on the site is 28,000 gallons. The proposal 3 Town of Barnstable"Zoning Board of Appeals—Decision and Notice Special Permit No.2015-039—Atlantic Development eliminates the use of the property for vehicle service and repair, which is also prohibited in the GP Overlay District. 5. A Site Plan Review approval issued for the project on July 21,2015. The letter states that"for reasons of safety, final plans must depict the redesigning of the entrance from lyannough Road which absolutely discourage left turns into the site from this entrance." The Town Engineer and Hyannis Fire Department Fire Prevention Officer are on record stating the final plan submitted to the Board is approvable. 6. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. A traffic study conducted by VHB, Inc, peer reviewed by McMahon and Associates, Inc for the Board, confirmed that while the proposed use will result in an increase in traffic volumes, the proposed site design and neighboring roadways will be able to process the traffic. With respect to the impervious surface area and increase in fuel storage, the Board finds that the proposed site plan is an improvement over existing conditions as it will result in the removal of 27-year old tanks and replacement with new state of the art double walled, monitored tanks that meet all code requirements. 7. The proposed alterations and expansion are not substantially more detrimental to the surrounding neighborhood. With regard to the additional impervious surface the Board finds that the proposed stormwater management system will be an improvement over existing conditions and positively improve stormwater recharge. With regard to storage of fuel, the Board finds that design, operation and monitoring of the underground tanks, in addition to an improved stormwater system and emergency spill response plan, will provide protections to mitigate the additional volume of fuel storage at the site. 8. The structures associated with the proposed expansion of the use are nonconforming. The Applicant seeks variance relief with Appeal No. 2015-038 for the relocation of the gas station canopy. 9. The proposed use and expansion is on the same lot as occupied by the use nonconforming use on the date it became nonconforming. The use is located on,Lots 246, 247 and 248 as shown on Land Court Plan 11519-E. 10.The proposed new use is'not expanded beyond the zoning district in existence on the date it became nonconforming. The nonconforming use is located within the Groundwater Protection Overlay District. 11.To reduce the impact on the neighborhood and surrounding properties,the number of curb cuts on the site has been reduced and the entrance on Route 132/lyannough Road has been restricted to allow right turns only. The vote to accept the findings was: AYE: Brian Florence, Alex M. Rodolakis, Matthew Levesque, Robin Young NAY: George Zevitas Board Member Zevitas voted in the opposition, stating he thought-the proposal would be substantially more detrimental to the surrounding neighborhood and that the Applicant has failed to show otherwise, Decision Based on the findings of fact, a motion was duly made and seconded to grant Special Permit No. 2015-039 subject to the following conditions:' 1. Special Permit No. 2015-039 is granted to Atlantic Development for the redevelopment of a property at 590 lyannough Road, Hyannis into a self-service fueling station. Relief is granted: 4 I , Town of Barnstable Zoning Board of Appeals-Decision and Notice Special Permit No.2015-039-Atlantic Development a. To expand existing nonconforming impervious area from 73.2%to 84.8% of the lot; and b. To increase the nonconforming use of the property for.fuel storage by replacing 30,000 gallons of fuel storage with three new underground fuel storage tanks with a total storage capacity of 64,000 gallons. 2. The site shall be redeveloped in substantial conformance with the plans entitled"Site Development Plans for proposed Retail Fueling Facility"drawn and stamped by Bohler Engineering, dated (last revised) 7-21-15 (sic), 13 sheets; as.revised to be in compliance with the recommendations of the report entitled "Engineering Review of Proposed Stormwater Management System - Proposed Retail Fueling Facility"prepared by Atlantic Design Engineers dated August 10, 2015. 3. The use and development of the site shall be in compliance with the Site Plan Review approval dated July 21, 2015. 4. The use of the site for automobile service and repair shall be relinquished. 5. The construction and operation of the gas station shall be conducted in compliance with the Stormwater Operations and Maintenance Plan. 6. The site shall be staffed by two employees at all times it is open. The employees shall have spill, prevention, control and countermeasure training as outlined inIhe Summary of BJ's j Environmental Spill Program and certified by the Commonwealth in gas station operations. 7. No retail sales of convenience store items shall be permitted; the station shall only sell fuel. This condition shall not preclude the on-site sales of BJ's memberships. 8. All fuel deliveries shall be scheduled and monitored by the Applicant; no"drop in"deliveries shall occur. 9. The improvements to Route/132 lyannough Road,which include the extension the center raised median, shall be complete and approved by the Department of Public Works prior to any Certificate of.Occupancy for the fueling station. 10. The decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building y Division prior to issuance building permit. The Applicant proposes to demolish the existing structure and canopy at the property and construct a new self-serve gasoline service station with an attendant's kiosk and associated improvements. The proposed signage that is the subject of the application will be installed as part of the redevelopment of the property. As depicted on the plans, the following signage is proposed for the property: • Two Canopy Signs (identified as Al and A2 on the plans); • Two Four-sided diesel signs to placed on the diesel pumps (B 1 and 132); • One Canopy Sign identifying canopy height (C); • One Pylon Sign (P 1); • Directional and Safety Signs (D-K); and • Pricing signage. Section 240-65(A) of the Barnstable Zoning Code (the "Code") allows a total of two. signs per business. Section 240-69, Gasoline Station Signs, allows additional signage located on each pump at the station. The proposed signage for the property includes two signs on the canopy (A 1 and A2) along with one pylon sign(P 1). Further, three signs are necessary to provide proper notice of the property due to the location and design of the property. The proposed signage meets the area requirements of the Code. Under Section 240- 65(C), the total area of all signs cannot exceed the lesser of 100 square feet (sf) or 10% of the area of the building fagade. Here, as there is no building fagade, and only a small kiosk, the signage cannot exceed 100 sf. As shown on the plans, the two canopy signs (A1 and A2) are 24.35 sf and the pylon sign is 36 sf(only one side of a two sided sign is used to calculate area per Section 340-62(D)). This totals 84.7 sf, meeting the 100 foot maximum allowed. The proposed pylon sign will be similar in size to the existing pylon sign and will comply .with the height limitations of Section 240-65(B). The plans (Sheet 5) depict a typical sign post and support with a total height of nine feet in compliance with the Code. The canopy signs and pylon sign will be internally illuminated and will comply with the Code as to intensity (240-77), will not impact adjacent properties or vehicles on adjacent ways, and do not incorporate flashing, moving or intermittent lights (240-61(b)). Finally, the proposed directional,safety and pricing signage comply with the Code. While Section 240-75 allows for up to four directional and safety signs that each does not exceed one sf in area, it also provides the discretion to allow additional and/or larger signs as necessary where the site requires such. Here, the applicant proposes a canopy sign indicating the height of the canopy (C), signs (D-K) directing traffic (wrong way), directing customers to pumps (B 1-B2) and providing warnings (emergency shut off, employees only, and directions for use). Because the-station has access from two streets, one of which is a major thoroughfare (Iyannough Road), additional safety signage that exceeds the area limitations is warranted. In addition, the existing signage at the property includes many of the same types of signs proposed (See Sheets 6 and 7).
