By letter of August 24, 2004 ,Timothy Bennett , Bennett Eng. has requested a continuance of the date for compliance. Bennet Engineering respectfully requests an extension of time to complete the design of new handicap parking and van accessible handicap parking at the above-mentioned facility. This extension is the last the Board will entertain, any further delay in bringing the facility into compliance will result in a FINE hearing. Reported violations, include the following items: Section: Reoorted violation: 23.2.2 Complainant reports that a van accessible parking space is not provided. 521 CMR requires that one in every eight accessible spaces, but not less than one, shall be van accessible, See 521 CMR 23.4.7. 23.3.1 Complainant reports that all of the accessible parking spaces serving the building are not located on the shortest accessible route of travel from adjacent parking to an accessible entrance. 23.6 Complainant reports that where sidewalks are provided at parking spaces, a curb cut (sidewalk ramp) is not installed at each specially designated space or pair of spaces, so that the handicapped persons are not required to enter the stream of traffic to attain access to sidewalks. If the alternative described in Section 23.5 is used, the curb cuts shall be installed where the center aisle meets the sidewalk. Under Massachusetts law, the Board is authorized to take legal action against violators of it's regulations, including but not limited to, an application for a court order preventing the further use of an offending facility. The Board also has the authority to impose fines of up to $1,000.00 per day, per violation, for willful noncompliance with its regulations.
