Background M
OCW Retail-Hyannis, LLC has petitioned for Special Permits for the construction of an 8,050
square foot building for restaurant and retail use, together with a new entrance-only curb cut on
Route 132 and related parking and infrastructure improvements. The subject'properties are located
at 990 lyannough Road(Route 132) and 65 Independence Drive, Hyannis as shown on Assessor's'
Map 295 as Parcel 015-X02 and Map 294 as Parcel 004. They are in the HB Highway Business, B
Business and IND Industrial Zoning Districts and the Groundwater Protection Overlay District. The
properties are collectively known as the Southwind Plaza Shopping Center.
Special Permit relief was requested in accordance with Section 240-25.C(1) - Conditional Uses to ,
allow for up to four tenant spaces for restaurant and retail use in the HB District. Special Permit
relief is also requested in accordance with Section 240-93(B)—Alteration/Expansion of a
Nonconforming Building/Structure to expand the preexisting nonconforming lot coverage from the
existing 56.4% to the proposed 61.2% lot coverage. The Groundwater Protection Overlay District
requires that"no more than 50% of the total upland area of any lot shall be made impervious by the
installation of buildings, structures, or paved surfaces."
The Petitioner also requested to modify Special Permit No. 1997-23 to allow a proposed right-turn
only entrance into the site off Route 132. The proposed right-in only entrance will be approximately
250 feet from the existing right-in/right-out entrance to the west of the Border's store. As part of
the permitting for the'Border's store, the developer obtained a Conditional Use Special Permit (No.
1997-23) from the Board to allow retail uses in the HB District. During the review of that permit, the
Board sought assurance from the developer that a drive, formerly located on the west side of the
project area, would be closed prior to opening a new curb cut. Condition Nos. 9 and10 of Permit
No. 1997-23 required closure of the curb cut previously located on the project site.
OCW Retail-Hyannis owns the project site, the Border's site, and the Southwind Plaza shopping
center. These properties were unified into one lot by a perimeter plan recorded in 2007. The Cape

Cod Commission reviewed the proposed development and concluded that the Development of
Regional Impact decision issued for the Border's site on December 5, 1996 would need to be
modified as a result of the vehicular; pedestrian, and loading interconnections proposed between
the.sites._ On'November 2,.2011, the Commission approved a,modification of the Border's DRI
Decision to,allow for site and infrastructure changes proposed with the subject development. -
The new retail/restaurant building is proposed to be 8,050 gross square feet and have a maximum
of four tenant spaces. Based on the plans submitted by the Applicant, the initial configuration will
dedicate two tenant spaces for restaurant use and two for retail use. Associated site improvements
include 103 parking stalls, landscaping, lighting, and stormwater improvements. Vehicular and
pedestrian cross-access is proposed between the new development and the Border's site. Two
access points to the project site are proposed: a new right-in only access from Route 132 and a
connection to the existing access road off of Independence Drive into the Southwind Plaza
shopping center.
Procedural & Hearing Summary
Appeal No. 2011-054 for a Special Permits pursuant to Section 240-25(C)(1), Section 240-93(B)
and for modification of Special.Permit No. 1997-23 was filed at the Town Clerk's Office and at the
Office of the Zoning Board of Appeals on October 18, 2011. A public hearing before the Zoning
Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL
Chapter 40A. The hearing was opened December 14, 2011 at which time the Board found to grant
the Special Permit subject to conditions. Board Members deciding this appeal were Board Chair
Laura F_ Shufelt, Craig G. Larson, Alex M. Rodolaxis, George T. Zevitas and Brian Florence.
Attorney Eliza Cox represented the Applicant before the Board. Also present were Kelly Burke,
Wilder Companies, Matthew Eddy, Baxter Nye Engineering, Randy Hart, VHB, and an architect
from Allevato. Attorney Cox reviewed the project area and the existing conditions of the Southwind
Plaza Shopping Center. She reviewed the proposed project, including the site layout, elevations
and landscape plan. She provided a history of prior Zoning Board and Cape Cod Commission
permits and reviewed the relief requested. Attorney Cox discussed the project's compatibility with
surrounding land uses and conformance with regional and local comprehensive plans. She
presented the results of a traffic study conducted for the project,which concluded the development
and the proposed access would have no adverse impacts on the roadways or safety. Attorney Cox
addressed the Special Permit request to increase impervious surface coverage of the site and
compared the proposed coverage figure to surrounding properties. She emphasized the positive
economic impact of the project for the Town and its benefit to the entire shopping center.
The Board asked for clarifications on the traffic study and discussed the proposed right-in only
access. Randy Hart,VHB, reviewed thecrash�data forthe`Board: He-indicateda comprehensive
review of access to the shopping center was planned by the Applicant.
Public comment was requested and no one spoke in favor of or in opposition to the request.
Findings of Fact
At the hearing of December 14, 2011, the.Board unanimously made the following findings of fact
for Special Permit No. 2011-054:
1. OCW Retail-Hyannis, LLC has petitioned for Special Permits for the construction of an
approximately 8,050 square foot.building for restaurant and retail use, together with a new
entrance=only,curb cut on Route 132 and related parking and infrastructure improvements in
the Southwind Plaza shopping center.

Permit relief is also requested in accordance with Section 240-93.13—Alteration/Expansion of a
Nonconforming Building/Structure to expand the preexisting nonconforming lot coverage from
the existing 56.4% to the proposed 61.2% lot coverage.' And, the Petitioner requests to modify
Special Permit No. 1997-23 to allow a.proposed right-turn only entrance into the site'off Route
132.
3. The subject properties are located at 990 lyannough Road (Route 132) and 65 Independence
Drive, Hyannis MA as shown on Assessor's Map 295 as Parcel 015-X02 and.Map 294 as
Parcel 004. They are in the HB Highway Business, B Business and IND Industrial Zoning
Districts and the Groundwater Protection Overlay District.
4. The application falls within a category specifically excepted in the ordinance for a grant of a
special permit. Special Permits are requested pursuant to Section 240-25(C)(1) Conditional
Uses to allow retail and restaurant uses in the Highway Business District and Section 240-
93(B)Alteration/Expansion of a Preexisting Nonconforming Structure to allow for an expansion.=
of the preexisting nonconforming lot coverage. Further, the Applicant requests to modify
Special Permit No. 1997-23.
5. The Site Plan Review Committee approved the proposed development at a formal hearing on
October 13, 2011. The Site Plan Review Coordinator issued a letter dated October 17, 2011
approving the proposed site plan. .
6. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the
Zoning Ordinance and would not represent a substantial detriment to the public good or the
neighborhood affected.
7. The use will not substantially or adversely affect the public health, safety, welfare, comfort or
convenience of the community. ;
8. The proposed alterations and expansion of the non-conforming lot coverage will not-be ,
substantially more detrimental to the surrounding neighborhood.
The vote to accept the findings was:
AYE: Laura F. Shufelt, Craig G. Larson, Alex M. Rodolaxis, George.T. Zevitas and Brian Florence

Decision
Based on the findings of fact, a motion was duly made and seconded to grant Special Permit No.
2011-056 subject to the following conditions:
1. Special�Per mit-2011•-054-is•.granted°to OCW Retail—.Hyannis,. LLC to allow retail and
restaurant uses in 8,050 square foot building'with:up.to_four tenant spaces.--S
2. Special Permit 2011-054.also allows expansion of preexisting nonconforming impervious '
surface coverage on the property from 56.4% to 61.2%.
3. Special Permit.2011-054 modifies Special Permit 1997-23 to allow a right-in only access from
lyannough Road/Route 132 to the proposed development. The right-in only access shall be
permitted in addition to the existing right-in/right-out access that is located approximately 250
feet to the west. All other conditions of Special Permit 1997-23 shall remain in full force and
effect. -
4. The proposed retail/restaurant development shall be constructed in substantial conformance
with the plans entitled "Southwind Plaza, 990 lyannough Road &65 Independence Drive,
Hyannis, MA for OCW Retail — Hyannis, LLC c/o the Wilder Companies, Ltd"•drawn and.
stamped by Baxter Nye Engineering and Surveying, dated October 6, 2011. Further the

building shall be constructed in substantial conformance with the elevations entitled "Southwind
Plaza, Hyannis, MA" for Wilder Companies by Allevato, dated October 6, 2011.
5. The development shall be in compliance with all conditions of the Site Plan Review Committee
letter dated October 17, 2011.
6. Signage shall be installed at the new right-in only access as recommended by the Site Plan
Review Committee to discourage unauthorized left turns.
7. Final building elevations and landscape plans shall be approved by the Growth Management
Department Director for consistency with the plan referenced in Condition No. 4 herein prior to
issuance of building permits.
8. The decision shall be recorded at the Barnstable County Registry of Deeds and copies of the
recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building
Division prior to issuance of a building permit for the proposed development.

Special Permit No. 2011-054 to allow restaurant and retail use in the HB District, increase the
impervious surface coverage to 61.2% of the lot and modify Special Permit No. 1997-23 to allow a
new right-in only access has been granted subject to conditions. This decision must be recorded
at the Barnstable Registry of Deeds for it.to be in effect and notice of that recording submitted to
the Zoning Board of Appeals Office. The relief authorized by this decision must be exercised
within two years unless extended. Appeals of this decision, if any, shall be made pursuant to MGL
Chapter 40A, Section 17, within twenty (20) days after the date of the filing of this decision, a copy
of which must be filed in the office of the Barnstable Town Clerk.
