Based on that review, Hyannis Toyota was authorized to reuse the 1040 Iyannough Road'lot as-of- right as it did not intensify a legally created, pre-existing nonconformity in the use. However, for the 1056 lyannough Road lot, the Building Commissioner determined that relief would be needed. Therefore, the applicant is before the Board seeking a Conditional Use Special Permit for the 1056 Iyannough Road lot to be used for parking of vehicles for retail sales and parking for vehicles to be maintained. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 6, 2008. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. A November 17, 2008 letter from Attorney Brian J. Wall as Trustee of the 1056 lyannough Road Nominee Realty Trust, the owner of the property and as the attorney representing the applicant, Hyannis Enterprises,the lessee of the lot was entered into the file to show standing. The hearing was opened November 19, 2008,at which time testimony was taken and the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were, William H. Newton, Michael P. Hersey; Craig G. Larson, George. T.Zevitas and Board Chair, Laura F.Shufelt. Attorney Brian J.Wall represented the petitioner at the public hearing. He presented the history of the, use of the subject lot as it relates to the abutting lot at 1040 lyannough Road and neighboring lot at1020 lyannough Road, upon which the Toyota dealership is located. He noted that use of 1056 lyannough Road lot for parking of vehicles dates approximately to 1985. Given zoning at that time in 1985,the use of the lot for auto sales and/or for parking of vehicles as accessory to an auto dealership would have needed a conditional use special permit or have been able to establish the use as a legally created, pre-existing use. That could not be documented for the 1056 lyannough Road lot and therefore, the application for relief was filed. Attorney Wall presented the plan for improvement to the lot noting that the plan has been reviewed and approved by the Site Plan Review Committee. He stated that the use of the lot does not include any on-site maintenance as that use would not have been permitted under the Groundwater Protection Overlay District provisions. The plan is in compliance with Groundwater Protection requirements including imperious lot coverage. With respect to Section 240-25.C(1)(a) findings,Attorney Wall noted that the use has existed on the property for over 20 years. Although it has been conducted without proper zoning permits it existed without any problems, issues or complaints being filed. He cited this should be sufficient evidence for the Board that the use will not substantially adversely affect the public health, safety,welfare, comfort or convenience of the community. After evaluation of all the evidence presented at the public hearing by the petitioner, the proposal fulfillment of the spirit and intent of the Zoning Ordinances without substantial detriment to the public good or the neighborhood affected as the subject lot has been used for auto sales for a number of years and the proposal is accessory to the existing Hyannis Toyota dealership. Granting of the permit would not adversely affect the public health,safety,welfare,comfort or convenience of the community. 4. A site plan has been reviewed and found approvable in accordance with Site Plan Review provisions of the Ordinance and is subject only to the issuance of a special permit. Decision: Based on the findings of fact,a motion was duly made and seconded to grant Conditional Use Special Permit No. 2009-070 subject to the following conditions: 1. This Special Permit is issued to Hyannis Enterprises, Inc., d/b/a Hyannis Toyota for 1056 lyannough Road (Route 132), Hyannis, MA. It is issued to allow the lot to be`development with a 3,500 sq.ft.showroom for retail sales of automobiles and a 1,200 sq.ft., car wash as well as the parking of vehicles that are for sale or to be serviced. All uses and buildings on the 1056 lyannough Road lot are to be accessory to Hyannis Toyota's retail sales and service of vehicles on the 1040 and 1020 lyannough Road lots. 2. There shall be no mechanical servicing of vehicles on this lot as maintenance of vehicles is prohibited in the Groundwater Protection Overlay District in which the lot is located. 3. The car wash shall not be open to use by the public. 4. The lot shall be improved as per plan submitted and entitled "Site Plan & Landscape Plan of#1056 lyannough Road Hyannis, MA prepared for Hyannis Toyota" dated July 14, 2008 revised through October 13, 2009 as drawn by Down Cape Engineering, Inc. The construction shall be according to plans entitled "Proposed Dealership Building for Hyannis Toyota, Route 132, Hyannis, MA" dated 8-7-09 by ConSery Group Inc.,consisting of one page(All)and plans entitled "Car Wash, Hyannis MA" by Arlen Company LLC.,General Contractors, dated 09/14/09 and consisting of 3 sheets(A-1,A-2 and S-1). 5.
