Decision and No G- �• tKARNSTABLE LAND COURT RE ,X.STki* Prime 132 LLC Appeal 2005-046-Special Permits -- � Sections 240-25(C)(1) Conditional Uses Highway Business District Retail Use,and - 240-93(B) Nonconforming Buildings or Structures Not Used as Single and Two Family Residence To allow the redevelopment of an existing gas service station into a new retail building Summary: Granted with Conditions Petitioner: Prime 132 LLC Property Address: 1140 Iyannough Road(Route 132);Hyannis,MA Assessor's Map/Parcel: Map 273,Parcel 079 Zoning: Highway Business Zoning District and a Groundwater Protection Overlay District Relief Requested &Background: ._, In Appeal No.46•of 2005,the applicant seeks to redevelop an existing vacant gas station site to retail sales. The locus is a 1.09-acre site fronting on Route 132. The site was formally occupied by the Hyannis Texacor Service Station. The property was developed in 1965 with the 2,415 sq.ft. gas station inclusive of a two-bay auto repair area. There is also a small shed of 144 sq.ft. located on the property. The proposal is to completely demolish the existing structures on the site and to redevelop the site with a new one-story, 9,785 sq.ft.,masonry and steel building,and related site improvements. The proposed building measures 103 x 95 and is located in conformity to the required setbacks for the Highway Business District. The proposed structure is to house two retail tenants. "Town Fair Tire"is to occupy 7,319 sq.ft. of the building,of which: 3,890 sq.ft. is to be storage,784 sq.ft.retail sales, and 2,645 sq.ft. is occupied by six server bays. The second retail tenant has not been identified. That second retail space has 2,466 sq.ft. Redevelopment of the site creates 34 on-site parking spaces with two curb cuts on Route 132. Interior site circulation relies upon a one-way flow around the rear of the building to access the service bays. A dumpster is proposed to the rear of the building as is a screened outdoor storage area for tires. Relief Requested: In addition to the Conditional Use Special Permit for retail sales in the Highway Business Zoning District as provided for in Sections 240-25(C)(1),the applicant has also requested a Special.Permit for the redevelopment of the nonconforming site. More specifically,that Special Permit in accordance with Section 240-93(B), seeks to retain certain nonconformities with respect to landscape setbacks and buffers, parking lot landscape requirements and lot coverage by impervious surfaces. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 05, 2005. An Extension of the Time Limits for holding the public hearing and for the filing of the decision r 1 was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with M.G.L. Chapter 40A. The ` hearing was opened June 22, 2005,at which time the Board found to grant the appeal. Board Members deciding this appeal were: Richard L.Boy,Ralph Copeland,Sheila Geiler,Jeremy Gilmore,and Chairman Daniel M. Creedon III. Attorney Edwin E. Taipale represented the applicant before the Board. Also assisting in the presentation to the Board were Mathew W.Eddy,Professional Engineer, and Michael Bavia of Town Fair Tire. Mr. Taipale presented the proposal to the Board. It was noted that the proposed structure was 9,780 sq.ft. and that Town Fair Tire was to occupy the majority of the structure. The second retail suite of 2,400 sq.ft. had not been leased at this time,but its use would be committed to a specialty type store low in traffic volume. Mr.Taipale stated that he felt the entire project could be permitted by the two Special Permits requested in this appeal in that none of the nonconformities in the site were being increased or intensify but actually being improved on. He noted that the entire site would be redeveloped and then, although they did not meet all of the current requirements of the Zoning Ordinance,the proposal was a far improved over that which exists now. Mr.Eddy discussed the plan noting that the plan does not conform to lot coverage requirements,front yard landscape setbacks, and the side yard landscape setback, as well as required landscaping for parking lots. The Board expressed concern that the lot coverage of the site was going from its existing 60%impervious coverage to 67%impervious coverage. Mr. Eddy explained that the on-site drainage would be greatly improved and that the benefits of the drainage system outweigh that concern for the increase in impervious coverage. The Board and applicant's representatives discussed the details of the site improvements. Concerns were expressed for the outdoor storage of used tires, the two curb cuts, and the landscaping plan for the site. The applicant explained that the two curb cuts were necessary for turning movements by delivery trucks. With regards to the outdoor storage of old tires, a six-foot stockade fence was to be erected around the 25 x 8 foof concrete area and, that the used tires would be picked up twice a week. Mr.Bavia submitted an informational booklet that included photographs of some of Town Fair Tire stores and typical store interiors. Support letters were also included in the document. The Board reviewed the architectural elevations and layout submitted and it was confirmed that the plans submitted on June 21, 2005 were the architectural plans and elevations for the structures, and that the structure would be finished with clapboards. , Paving of the site was discussed and the applicant agreed that solid interlocking pavers would be used. The area of the pavers can be increased if required by the Board in order to satisfy that there is no change in impervious coverage of the lot. Public comment was requested, and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of June 22, 2005,the Board unanimously made the following findings of fact: 1. Appeal 2005-046 is that of Prime 132 LLC seeking Special Permits pursuant to Section 240-25(C)(1) Conditional Uses to allow retail use in the Highway Business District and Section 240-93(B) Nonconforming Buildings or Structures Not Used as Single and Two Family Residence. The subject 2 I property is located as shown on Assessor's Map 273 as Parcel 079,addressed 1140 Iyannough Road (Route 132),Hyannis, MA in a Highway Business Zoning District and a Groundwater Protection Overlay District. The applicant proposes to replace an existing gas service station with a new retail building,parking,associated site improvements, and to allow for the alteration and expansion of pre- existing site development features. 2. According to the Assessor's records, the property was developed in 1965 with a 2,415 sq.ft. gas station inclusive of a two-bay auto repair area. The service station had been before the Board in 1983, 1986, 1996, and in 1997. A 1997 Variance No. 1997-63 was issued to Hyannis Texaco for the construction of a 1,774 sq.ft. overhead gas canopy located within the 100-foot front yard setback along Route 132. There is also a small shed of 144 sq.ft. located on the property. 3. The proposal before the Board seeks to completely demolish the existing structures on the site and to redevelop the site with a new one-story, 9,785 sq. ft., masonry and steel building, and related site improvements. The proposed building measures 103'x 95'and its location conforms to the required setbacks for the Highway Business District, including the required 100-foot setback off Route 132. The proposed structure is to house two retail tenants. One of the tenants is identified as "Town Fair Tire". Town Fair is to occupy 7,319 sq.ft. of the building,of which: 3,890 sq.ft. is to be storage, 784 sq.ft. retail sales, and 2,645 sq.ft. is occupied by six server bays. The second retail tenant has not been identified. That second retail space has 2,466 sq.ft. 4. Redevelopment of the site proposes to create 34 on-site parking spaces. Two curb cuts are proposed on Route 132. The southeasterly one is shown as an entrance to the site and the northwesterly curb cut is identified as right turn out only. Each curb cuts measure 24 feet wide. Interior site circulation relies upon a one-way flow around the rear of the building to access the service bays. The 6 service bay doors face to the rear and not onto Route 132. A dumpster is proposed to the rear of the building as is a screened, open roof,outdoor storage area for tires. 5. In addition to the Conditional Use Special Permit for retail sales in the Highway Business Zoning District as provided for in Sections 240.-25(C)(1),the applicant has also requested a Special Permit for the redevelopment of the nonconforming site. More specifically,that Special Permit in accordance with Section 240-93(B), seeks to retain certain nonconformities with respect to landscape setbacks and buffers,parking lot landscape requirements and,lot coverage by impervious surfaces. 6. The applicant has standing to be before the Board as evidenced by a copy of a Recorded Deed, Document No. 969,876 recorded June 9, 2004 from Motiva Enterprises LLC to Prime 132,LLC dated , June 3,2004,and submitted to the file. 7. A site approval letter from the site plan review committee was issued May 31, 2005. The letter enumerates eight conditions of that approval. 8. Concerns have been expressed with respect to lot coverage,paving details, and site lighting. The applicant has committed to adjusting those elements to address the Bdard's concerns. 9. The Board should note that there are eight storage containers located on the property. Apparently,the storage sheds are an encroachment from the neighboring Parkers Liquor Store. There is also an existing infringement of a paved area from the liquor store into the lot. 3 r .a+ 10. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit and after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact, a motion was duly made and seconded to grant Appeal 2005-046 for a Special Permit in accordance with Section 240-25(C)(1)Conditional Uses Highway Business District Retail Use, and Section 240-93(B)Nonconforming Buildings or Structures Not Used as Single.and Two Family Residence, with the following conditions: 1. Development of the site shall be as proposed in a set of plans submitted to the Board and entitled: "Town Fair Tire&Tenant Retail 1140 Iyannough Road(Route 132)Barnstable,Massachusetts Prepared for: Prime 132,LLC"dated 03/09/05 revised 3/25/05,and consisting of nine sheets labeled C-1 through C-9,as drawn by J.K. Holmgren Engineering,Inc., and Baxter,Nye and Holmgren Inc., with the exception that: • The proposed outdoor tire storage area shall be used only for the storage of used tires. It shall not be roofed and storage shall not exceed the height of the enclosure. • Any area of pervious paving shall be paved with interlocking pavers only. Gravel and grid pavers shall not be permitted. l • Site lighting shall not exceed 18 feet in height and shall be screened so as to shine only on the property and not into neighboring properties or the right-of-way of Route 132. Two additional lighting standards,one in each of the rear comers of the lot shall be installed. The proposed wall lights on the structure shall not be located higher than 12 feet and screened to shine on the ground only. • Lot coverage by impervious surfaces shall not exceed the existing 60% lot coverage. 2. The building to be built shall be substantially in conformity to architectural plans submitted and entitled; "Town Fair Tire Center, 1140 Iyannough Road(Route 130),Hyannis,Massachusetts- Floor Plan&Elevations", scaled 1"= F, as drawn by Milliken Associates, Architects and Planners, dated 1/31/05 last revised date of 2/25/05. The proposed structure shall not exceed one-story(24 feet to plate), 9,785 sq. ft. and shall conform to all required setbacks for the District. 3. Uses of the structure are limited to no more than two retail tenants." • One of which is a tire changing business (not including industrial type trailers)to occupy 7,319 sq.ft. of the building. Of which; 3,890 sq.ft. is to be storage, 784 sq.ft. retail sales, and 2,645 sq.ft. is occupied by the six service bays. • The second retail space shall not exceed 2,466 sq.ft. and is limited to specialty retail sales not including; food products or beverages, a convenience store,nor any type of drive through, drop-off, or pickup, including drive-through banking. • All on-site retail sales shall conform to Section 240—35 Groundwater Protection Overlay District regulations. 4 4. All signage shall conform to the requirements of Section 240-65 -Signs in B,BA, UB, HB,HO, S&D and SD-1 Districts. And there shall be neither outdoor display of merchandise nor any sign advertising the price of a product. 5. All construction and development of the site shall conform to all applicable health, fire and building codes and regulations. 6. All construction and development of the site shall conform.to all conditions of the site plan review committee as enumerated in the May 31, 2005 site approval letter. 7. All utilities shall be located underground and the property shall be served by public water and connected to the Town's Wastewater Treatment facility. 8. Any outdoor lawn sprinkler and irrigation system shall only be serviced by a private non-potable well. 9. Existing storage trailers located on the property shall be removed prior to the issuance of any building permit for the new development. 10. The building authorized in this Special Permit shall be considered full buildout of the lot and that structure shall not be expanded in area nor in footprint without permission from the Board. There shall be no storage trailers or containers permitted on the site. The only out door storage permitted shall be that of the 8 by 25 foot open air screened storage area as shown on the plan. The site was formally occupied by the Hyannis Texaco Service Station. The property was developed in 1965 with the 2,415 sq.ft. gas station inclusive of a two-bay Y`' auto repair area. There is also a small shed of 144 sq.ft. located on the property. The proposal is to completely demolish the existing structures on the site and to:redevelop the site with a new one-story, 9,785 sq. ft.,masonry and steel building, and related site.improvements. The proposed building measures 103'x 95'and is located in conformity to the required setbacks for the Highway Business - District. The proposed structure is to house two retail tenants. "Town Fair Tire'.'is to occupy 7,319 sq.ft:of the building,of which: 3,890 sq.ft. is to be storage,784 sq.ft.retail sales, and 2,645 sq.ft. is occupied by six . . server bays. The second.retail tenant has not been identified. That second retail space has 2,466 sq.ft.. Redevelopment of the site creates 34 on-site parking spaces with.two curb cuts on Route 132. Interior site circulation relies upon a one-way flow around the rear of the building to access the service bays. A dumpster is proposed to the rear of the building as is a screened outdoor storage area for tires. Relief Requested: In addition to the Conditional Use Special Permit for retail sales in the Highway Business Zoning District as provided for in Sections 240-25(C)(1),the applicant has also requested a.Special.Permit,for the redevelopment of the nonconforming site. More specifically, that Special Permit in accordance with Section 240-93(B), seeks to retain certain nonconformities with respect to landscape setbacks and buffers, parking lot landscape requirements:.and lot coverage by impervious surfaces, Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April PP 05, 2005: An Extension of the .Time Limits for holding the public hearing and for the filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with M.G.L. Chapter 40A. The hearing was opened June 22,2005,at which time the Board found to grant the appeal. Board Members deciding this appeal were: Richard L.Boy,Ralph Copeland, Sheila Geiler, Jeremy Gilmore, and Chairman Daniel M. Creedon IlI. Attorney Edwin E.Taipale represented the applicant before the Board. Also assisting in the presentation to the Board were Mathew W.Eddy,Professional Engineer, and Michael Bavia of Town Fair Tire. Mr. Taipale presented the proposal to the Board. It was noted that the proposed structure was 9,7.8.0 sq.ft. and that Town Fair Tire was to occupy the majority of the structure. The second retail suite of 2,400 sq.ft. had not.been leased at this time,but its use would be committed to a specialty type store low in traffic volume: Mr.Taipale stated that he felt the entire project could be permitted by the two Special Permits requested in this appeal in that none of the nonconformities in the site were being increased or intensify but actually . being improved on. He noted that the entire site would be redeveloped and then,although they did not meet all of the current requirements of the Zoning Ordinance,the proposal,was a far improved over that which exists now. Mr.Eddy discussed the plan noting that the plan does not conform to lot coverage requirements,front yard landscape setbacks, and the side yard landscape setback, as well as required landscaping for parking lots. The Board expressed concern that the lot coverage of the site was going from its existing 60% impervious coverage to 67% impervious coverage. Mr. Eddy explained that the on-site drainage would be greatly improved and that the benefits of the drainage system outweigh that concern for the increase in impervious_ coverage. . The Board and applicant's representatives discussed the details of the site improvements. Concerns were expressed for the outdoor storage of used tires, the two curb cuts, and the landscaping plan for the site..The applicant explained that the two curb cuts were necessary for turning movements by delivery trucks. With regards to the outdoor storage of old tires, wsix-foot stockade fence was to be erected around the 25 x 8 foot concrete area and,that the used tires would be'picked up twice a week: Mr. Bavia submitted an informational booklet that included photographs of some of-Town Fair Tire stores and typical store interiors. Support`letters were also included in the document.The Board reviewed the architectural elevations and layout submitted and it was confirmed that the plans submitted on June 21,2005 were the architectural'plans and elevations for the structures, and that the structure_would be finished with clapboards. Paving of the site was discussed and the applicant agreed that solid interlocking pavers would be used. The area of the pavers can be increased if required by the Board in order to satisfy that there is no change in. impervious coverage of the.lot. Public comment was requested,and no one spoke in favor or in opposition to the request. . Findings of Fact: At the hearing of June 22, 2005,the Board unanimously made the following findings of fact: - L . Appeal 2005-046 is that of Prime 132 LLC seeking Special Permits pursuant to Section 240-25(C)(1): Conditional Uses to allow retail use in the Highway Business District and Section 240-93(B) Nonconforming Buildings or Structures Not Used as Single and Two Family Residence. The subject 2 . property is located as shown on Assessor's Map 273 as Parcel 079, addressed 1140 Iyannough Road (Route 132),Hyannis,MA in a Highway Business Zoning District and a Groundwater Protection Overlay District. The applicant proposes to replace an existing gas service station with a new retail building,parking,associated site improvements, and to allow for the alteration and expansion of pre- existing site development features. 2. According to the Assessor's records, the property was developed in 1965 with a 2,415 sq.ft. gas station inclusive of a two-bay auto repair area. The service station had been before the Board in 1983, 1986, 1996, and in 1997. A 1997 Variance No. 1997-63 was issued to Hyannis Texaco for the construction of a 1,774 sq.ft. overhead gas canopy located within the 100-foot front yard setback along Route 132. There is also a small shed of 144 sq.ft. located on the property: 3. The proposal before the Board seeks to completely demolish the existing structures on the site and to redevelop the site with.a new one-story, 9,785 sq. ft.,masonry and steel building, and related site improvements. The proposed building measures 103'x 95'and its location conforms to,the required setbacks for the Highway Business District,including the required 100-foot setback off Route 132. The proposed structure is to house two retail tenants.One of the tenants is identified as "Town Fair Tire". Town Fair is to occupy 7,319 sq.ft. of the building, of which: 3,890 sq.ft. is to be storage,784 sq.ft. retail sales,and 2,645 sq.ft. is occupied by six server bays. The second retail tenant has not been identified. That second retail space has 2,466"sq.ft. 4. Redevelopment of the site proposes to create 34 on-site;parking spaces. Two curb cuts are proposed on Route 132. The southeasterly one is shown as an entrance to the site and the northwesterly curb cut is identified as right turnout only. Each.curb.cuts measure 24 feet wide. Interior site circulation relies upon a one-way flow around the rear of the building to access the service bays. The 6 service bay doors face to the rear and not onto Route 132. A dumpster is proposed to the rear of the building as is a screened, open roof,outdoor storage areatfor tires. 5. In addition to the Conditional Use Special Permit for retail sales in the Highway Business Zoning District as provided for in Sections 240.-25(C)(1),the applicant has also requested a Special Permit for the redevelopment of the nonconforming site. More-specifically,that Special Permit in accordance with Section 240=93(B), seeks to retain certain nonconformities with respect to landscape setbacks and buffers,parking lot landscape requirements and lot coverage by impervious surfaces;_ 6. The applicant has standing to be before the Board as evidenced by a copy of a Recorded Deed, Document No: 969,876 recorded.June 9,2004 from Motiva Enterprises LLC to Prime 132,LLC'.dated June 3,2004, and submitted to the file: 7. A site approval letter from the site plan review committee was issued May 31, 2005. The"letter enumerates eight conditions of that approval: 8. Concerns have been expressed with respect to lot coverage,paving details, and site lighting. The applicant has committed to adjusting those elements to address the Board's concerns. 9. The Board should note that there are eight storage containers located on the property: Apparently,the storage sheds are an encroachment from the neighboring Parkers Liquor Store. There is also an existing infringement of a paved area from the liquor store into the lot. 3 r r r" 10. The application falls within a category specifically excepted in the ordinance for a grant'of a Special Permit and after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. r Decision: Based on the findings of fact, a motion was duly made and seconded to grant Appeal 20057046 for Special Permit in accordance with Section 240-25(C)(1)Conditional Uses Highway Business District Retail Use; and Section 240-93(B)Nonconforming Buildings or Structures Not Used as Single.and Two Family Residence, with the following conditions: 1. Development of the site shall be as proposed in a set of plans submitted to the Board and entitled: "Town Fair Tire&Tenant Retail 1140 Iyannough Road(Route 132)Barnstable,Massachusetts Prepared for: Prime 132,LLC" dated 03/09/05 revised 3/25/05, and consisting of nine sheets labeled; C-1 through C-9,as drawn by J.K.Holmgren Engineering,Inc., and Baxter,Nye and Holmgren Inc., with the exception that: v The proposed outdoor tire storage area shall be used only for the storage of used tires. It. shall not be roofed and storage shall not exceed the height of the enclosure. t • Any area of pervious paving shall be paved with interlocking pavers only. Gravel and grid pavers shall not be permitted. • Site lighting shall not exceed 18 feet in height and shall be screened so as to shine only on the property and not into neighboring properties or the right-of-way of Route 132. Two additional lighting standards, one in each of the rear comers of the lot shall be installed. .The proposed wall lights on the structure shall not be-located higher than 12 feet and screened to shine on the ground only. • Lot coverage by impervious surfaces shall not exceed the existing 60% lot coverage. 2. The building to be built shall be substantially in conformity to architectural plans submitted and entitled; "Town Fair Tire Center, 1.140 Iyannough Road(Route 130),Hyannis,Massachusetts - Floor Plan&Elevations", scaled 1"= F, as drawn by Milliken Associates, Architects and Planners, dated 1/31/05 last revised date of.2/25/05. The proposed structure shall not exceed one-story(24 . feet to plate), 9,785 sq. ft. and shall conform to all required setbacks for the District. 3. Uses of the structure are limited to no more than two retail tenants, , One of which is a tire changing business (not including industrial type trailers)to occupy 7,319 sq.ft. of the building. Of which; 3,890 sq.ft. is to be storage, 784,sq.ft:retail sales, and 2,645 sq.ft. is occupied by the six service bays. • _ The'second retail space shall not exceed 2,466 sq..ft. and is limited.to specialty retail sales not including;food products or beverages, a convenience store,nor any type of drive through,drop-off, or pickup, including drive-through banking. • All on-site retail.sales shall conform to.Section 240—35 Groundwater Protection Overlay District regulations. 4 4. All utilities shall be located underground and the property shall be served by public water and connected to the Town's Wastewater Treatment facility. i 8. Any outdoor lawn sprinkler and irrigation system shall only be serviced by a private non-potable well. 9. Existing storage trailers located on the property shall be removed prior to the issuance of any building permit for the new development. 10. The building authorized in this Special Permit shall be considered full buildout of the lot and that structure shall not be expanded in area nor in footprint without permission from the Board. There shall be no storage trailers or containers permitted on the site. The only out door storage permitted shall be that of the 8 by 25 foot open air screened storage area as shown on the plan.
