Hyannis Texaco property which is identified as Barnstable Assessor Map 273, Parcel 79 (the "Property"). Prior to purchasing the Property, however, Mr. Carter would like to ascertain whether he will be able to utilize the Property for particular business purposes. Accordingly, pursuant to the provisions of Massachusetts General Laws Chapter 40A, Section 7, I hereby request your determination as to whether the proposed use' of the above-referenced property as detailed herein will be permitted under the Barnstable'Zoning By-law. Statement of Facts - l.. The Property is located on Route 132 in Hyannis, Massachusetts. June 16, 2003 Page 2 2. The Property is approximately 47,545 square feet (1.2 acres) in size and has approximately 200 feet of frontage on Route 132. 3. The Property has two existing curb cuts. 4. The Property is situated partially within Zone "HB" (Highway Business) and partially within Zone `B" (Business). 5. The primary structure situated on the Property is a garage set back from the road about 57 feet. The structure has two (2) service bays, an office/waiting area, lavatories and a storage area. 6. There are additional structures on the Property including gasoline pump islands; a canopy; and relatively small structure housing pollution remediation equipment. 7. Upon information and belief, the Property has been used for a significant amount of time as a gasoline station with automobile service and repair. 8. Additionally, the Property has been used for used car sales. A copy of the current Class II Motor Vehicle Sales License is enclosed herewith. Statement of Intended Use Mr. Carter intends to use the Property for used motor vehicle sales with an associated automotive service and repair business. Mr. Carter's intended use wound include the following activities: (1) on-site storage and display of used motor vehicles for sale (subject to conditions of applicable licenses issued by the Town); (2) sales of used motor vehicles (subject to the conditions of Used Car Dealer's Licenses to be issued by the Town); and (3) service and repair of motor vehicles. Mr. Carter would seek a transfer the existing Class II Motor Vehicle Sales License from the existing business to his own business. Additionally, Mr. Carter would seek approval to display and sell more used cars than authorized by the existing License. The service station and garage have been in existence since at least 1965 and have evidently. remained unchanged as to their use since that time. In 1997 a variance was granted to allow for construction of a 50' x 40' canopy in the front yard setbacks. The Zoning Board of Appeals decision for this variance states that"There shall be no use on the lot other than the gas station use". It is unclear where and how the used car sales came into play. This question needs to be answered to our satisfaction before we can determine what needs to be done to this site as far as ` zoning is concerned. I look forward to your response. O'Keeffe presented the appeal before the Board. Also present were Attorney Richard Largay;Alan Micale,Senior Project Manager; Frank Fetto, and Kevin Wentworth, owner of Hyannis Texaco. Attorney O'Keeffe reviewed the proposal before the Board. The proposal is to have a canopy sized at 45' x 40'with a mansard roof of black asphalt shingle and without signage on the canopy. The edge of the canopy along Route 132 will now be approximately 7 feet from the roadway or 28 feet from the travel portion of the road. It is approximately 13 feet from ground level to the base of the canopy. Attorney O'Keeffe discussed the curb cuts aloe Route 132. Presently, one curb cut is 22 feet wide and the other ee 9 is 27 feet wide. The station services school buses and tour buses and the wider curb cut is needed to help with their turning radius. As to Variance conditions,Attorney O'Keeffe explained that the station itself, the pumps, and all the d tanks, are all current) within the 100 foot setback. This is a situation unique to this lot. underground t 9 � y There would be a hardship if the relief were not granted as the canopy is necessary to remain competitive. The proposal will be a benefit to the site because the two pumps closest to the mad are being moved three feet back and the new pumps are state of the art in terms of both safety and convenience. The total number of pumps and nozzles will remain as presently on the site. The new pavement at the pump area will provide a fuel catchment area. On-site catch basins will be upgraded to include oillwater separators. As to traffic concerns,this project will restrict traffic to right turns only which is an improvement over what Is currently allowed at the site. Attorney O'Keeffe stressed that the applicant can only control the flow of traffic exiting out of the site. Alan Micale explained the canopy extinguishing system as approved by state and local fire department. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the Hearing of November 65, 1997,the Board found the following findings of fact as related to Appeal No. 1997.63: 1. The Petitioner is Hyannis Texaco. The property in issue is located at 1140 Route 132, Hyannis,MA as shown on Assessor's Map 273, Parcel 79 in the HB Highway Business Zoning District. The lot size totals 47,454 square feet, and Is located in the GP Groundwater Protection District. 2. The building in Issue is a gasoline station. The use is a nonconforming use. The structure(the gas station and the gas tanks)predate the HD Highway Business Zoning District, and as a result are preexisting nonconforming in terms of their location. 3. With reference to the Variance,the applicant seeks relief from the bulk regulations-Section 3.3.6(5), to establish a canopy to afford protection for the pumps that service the gasoline station. In particular, the applicant is seeking to locate the canopy not less than seven(7)feet from the actual layout of Route 132 and twenty-eight(28)feet from the actual paved portion of Route 132. 4.. The buildings that exist have existed there for quite some time. The pumps have to be located in a certain area-usually to the front- and therefore the location of the pumps is governed by the location of the gasoline station itself as well as the underground tanks that would service the gasoline pumps. 5. The pumps have to be located where they are due to the topographical features of that particular portion of the land. This creates certain topographical features of this land. In particular,the location of the buildings in close proximity to Route 132. This is the hardship for which relief is being sought. 6. The proposed features of the canopy are such that they involve state-of-the-art public safety features to include fire suppression and environmental features to include containment of the hydrocarbons in the event of a spillage at this particular site. 7. Granting the variance relief requested would not be in derogation of the spirit nor intent of the Zoning Ordinance since eight out of ten gasoline stations along this area have canopies, some of which come closer to the road than this canopy. Rebuild Provision This is a short Ordinance change requested by the Building Division and the Zoning Board of Appeals. As a result of a recent court case, any request to demolish an existing building and re- build on an undersized residential lot requires approval from the Zoning Board of Appeals. Without specific authorization in the Ordinance, re-construction should be of dimensions substantially similar to the original structure. This issue is also made more critical by the fact that the great majority of loots in the town do not conform to current zoning requirements, which have been as low as 7,000 sq ft in some areas, and are now as high as two acres in the RPOD district covering approximately half the town. There are 16,408 single family dwellings in the town on lots less than one acre in size. Without density provisions however, mansionizing would be exacerbated if applicants are allowed to re-build as of right. Options to deal with this issue are as follows: 1. Continue as present. The Building Commissioner requires that an addition to a house on an under-sized lot retain the existing four walls of the dwelling, or go to the Zoning Board of Appeals for relief. The advantage to continuing in this manner is that each case is then reviewed by the ZBA on an individual basis. 2. Allow expansion or re-building as of right on non-conforming developed lots without any { density guidelines, other than yard setback requirements. This could be done by an Ordinance amendment. -However, such amendment would exacerbate the trend towards tear downs and excessive re-building on small lots, which would especially 2 f - noticeable in areas where there is a strong neighborhood character characterized by small scale buildings of traditional New England architecture on small lots. This issue is addressed in the Comprehensive Plan in the Coastal Resources, Policy 2.2.5.2 as follows: Policy 2.2.5.2: The prevailing architectural character of Barnstable's historic coastal villages (Barnstable, Beach Point, Cotuit, Craigville's Christian Camp Meeting Association, Osterville, Wianno and others) and harbors(Hyannis and Barnstable) should be preserved. New development and redevelopment should reflect the traditional maritime character and architecture styles of the area and should be designed to maintain and enhance views of the shoreline from public ways and access points as identified in the Town of Barnstable Open Space Plan. 3. Allow expansion or re-building on developed, non-conforming lots as of right subject to density guidelines. Floor Area Ratios are the usual, preferred method of relating density to the size of the lot, and are common in more sophisticated Ordinances. A maximum percentage of lot coverage could be employed but can result in buildings being pushed to increased height in order to gain the desired interior area, which is even more inappropriate in some areas of traditional Cape Cod architecture. FARS were as follows: Fish Hills: 0.28; Barnstable Village, Commerce Rd: 0.22 t As stated above, there are 16,408 developed, under-sized lots that would be subject to a re- build provision. In addition there are 1,123 undeveloped lots less than an acre in size, many of them grand fathered,.and scattered all over town. It is recommended that if FARs are to be considered, that they be applied to ALL residential lots. SAMPLE, DRAFT ORDINANCE This is a rebuild provision only, and does not apply FARS to all residential lots town- wide. It may also require a change to the Non-conforming Use Section of the Zoning Ordinance. Subject also to review by the Legal Department. It is recommended that the FARs be applied to all single-family lots, if the FAR approach is taken. Section 4-4.2 Nonconforming lots 3. Past Activities: At the opening of this public hearing.on June 11, 1997,.the Zoning Board of Appeals addressed this petition as a repetitive petition due to a similar appeal((Appeal No. 1996-118)that was denied by the Board on September 05, 1996. In its ruling on the repetitive petition, the Board did find that"specific and material changes in the conditions"on which the earlier decision was denial had been made to the plans. The findings were based on the reduction in'size of the canopy from 40X50 feet, to 45X40 feet, and an increase of the setback from Rt. 132 from the 2 feet proposed in 1996, to 7 feet. This finding was communicated to the Planning Board for concurrence by them to the findings as required under MGL Chapter 40A, Section 16- Repetitive Petitions. In granting of the Variance the Board must find that: . unique conditions exist that affect the locus but not the zoning district in which it is located, a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. An evaluation of all the vidence presented at the public hearing by the petitioner and interested parties as it relates to the fulfillm t of the spirit and intent of this ordinance without substantial detriment to the public good or the neighbor od affected. A site plan has been reviewe nd found approvable in accordance with Section 4-7 herein subject only to the issuance of a Special Per it (Site Plan No. 16-97 was reviewed and approved by Site Plan Review on May 7, 1997). In addition, the Zoning Ordinance in Sectio -4.4 requires alterations to a pre-existing nonconforming building to obtain a Special Permit from the Zo ing Board of Appeals. If the use is also nonconforming, then the provisions of Section 4-4.5 apply. In this casi the gas station is a retail use which will be nonconforming in the HB Highway Business Zoning District, where my offices and banks are permitted. Section 4-4.5 states that for an expansion of a pre-existing noncon rming use, several requirements must be met and the Board can impose conditions for better circulation and i reased open space, as follows below: Section 4-4.5 2) Expansion of a pre-existing no conforming use A pre-existing nonconforming use shall not be expand and/or intensified except by Special Permit from the Zoning Board of Appeals. B)The proposed use and expansion is on the same lot as occupied by the nonconforming use on the date it became nonconforming. C)The proposed new use is not expanded beyond the zoning district in existence on the date it became nonconforming. D)At the discretion of the Zoning Board of Appeals, improvements may be required in order to reduce the impact on the neighborhood and surrounding properties including but not limited.to the following: 1) greater conformance of signage to the requirements of Section 4-3; 2) the addition of off-street parking and loading-facilities; 3) improved pedestrian safety, traffic circulation and reduction in the number and/or width , of curb-cuts; 4) increase of.open space or vegetated buffers and screening along adjoining lots and roadways; 5) accessory uses or structures to the principal nonconforming use, may be.required.to be brought into substantial conformance with the present zoning. Staff Review&Recommendation: The new proposal was reviewed at Site Plan Review and a letter stating the plans were deemed approvable was sent to the applicant. (See attached Site Plan Review Approval dated May7, 1997) The proposed setback is an improvement over the previously proposed 2' setback, both in the increased setback and the reduction of overall size of the canopy. The applicant has expressed willingness to eliminate use of vivid colors and signs on the canopy, and to use a gable rather than a flat roof. The applicant was,also willing to remove storage trailers at the rear of.the site which are not being used. The property is located in the GP Groundwater Protection District,where 50% of the site is required to be pervious and 30% left in its natural state. This could be accomplished at least in part by removing some of the pavement to the rear of the lot,which apparently is not used for parking or circulation. An area of at least 40' x 200' at the rear of the lot is unpaved. This is 8,000 sq. ft. or 17% of the lot(47,545 sq. ft. area). It is recommended there be no further paving on the lot. At present there is a Request for Qualification (RFQ) issued from the Public Works Department seeking . qualification for redesign of Route 132 between Phinney's Lane and the Mid Cape Highway. The present . thinking is to design this section with a four lane roadway and a center median (paved or planted). At this particular locus, the Comprehensive Plan proposes a four lane roadway with a median and sidewalks. Although no detail plans are in the making.for this section of Route 132. This concept if implemented will take up all of the available existing 80 foot right=of-way and perhaps require,some additional easements for. sidewalks, drainage and utilities. Staff Recommendations: Canopies in association with gas,station are standard across the country. Granted,due to the small lots upon which.many station sit in Barnstable, it is problematic when today's"standard" station canopies are applied. The zoning issues in many instances are setbacks from roadways, fit of the structure to the surrounding neighborhoods, signage and possible distraction to the motorist. The hearing was opened September 25, 1996, at which time the Board found to deny.the Special Permit Board Members hearing this'appeal were Ron Jansson, Richard Boy, Emmett Glynn,Tom DeRiemer, and . Chairman Gail Nightingale. Attorney Peter O'Keeffe represented the Applicants. Also present were Attorney Richard Largay; Kevin Wentworth, owner and operator of the Hyannis Texaco; Frank Fetto, a. Texaco representative; and AI Micale, the Engineer for the project Hearing Summa y: Attorney O'Keeffe gave a brief overview of the project He displayed a poster of the proposed 50' x 40' canopy which falls within the current 100 foot setback requirement Another improvement includes replacing the pumps with newer, more modem pumps:.:Attorney.Q'Keeffe stated that the widening of Route 132 that occurred a few years ago,put the pumps closer to the hardened surface of the road. With regards to Variance conditions,Attorney O'Keeffe explained that the"structure'creates a unique situation. The entire lot, the underground tanks and-most of.the building itself should be considered a "structure"and are-all within the 100 foot setback. Since-this is where the pumps-are located and.the canopy 1s to go over the pumps, the canopy must be within the setback. It would be a great financial hardship(actually,unfeasible)..to move the entire building*and all.the pumps within the 100 foot setback. Plus, the canopy'is needed to remain in the competitive market —of the 10 closest service stations, eight have canopies., Mr:O'Keeffe listed the reasons why the canopy is a necessity-protection from weather conditions, the lighting inside the canopy is better, and people can pay for their transaction with a credit card right at the pump and not have to leave their car unattended. The new dispensers are beneficial in that they have a"break away system"that autofiiatically shuts off the system in an emergency. Plus the Zoning Board of Appeals..Decision and Notice Appeal No..1996-118 Marula Trust 11-Star Enterprise-Hyannis Texaco —-- system would shut down if the pumps-were accidentally run into. Attorney O'Keeffe suggested that because there will be the same number of fueling stations, there will'be no change to the traffic flow and therefore would not adversely affect the area. The canopy is really only a roof with no sides and will not block the view of any passing motorists and acts.as a barrier allowing the attendant time to clean up the spill before the gasoline has.a chance to mix with the rain and possibly run off into the road. There will be no writing or signs on the canopy. It is the standard Texaco canopy with all the words and Texaco Star symbol removed.The base of the canopy is 13'6'above ground level and the total height is 17±feet. Mr. O'Keeffe stressed that even though'the canopy.is within the setback it is actually twenty five feet from traffic when you take into consideration the buffer zone and.the white line at the edge of the road. Therefore, it is not in anyone's direct vision and not within the traffic flow. With regards to hours, the station is now open 6:00 AM to 1.1:00 P.M., Monday through Saturday. On Sunday, the hours are 6:00 AM to 10:00 PM. These hours will not change. Public Comments: No one spoke in favor or in opposition to this appeal. The project has received Site Plan Review Approval, however, the applicant was"urged to redesign the canopy to fit into the regional architecture.' Mr. O'Keeffe stated'the Architect from Texaco was not sure exactly what was meant by that request, but if that were the deciding factor, the applicant would try to redesign the canopy. The applicant would be willing to work with the Building.Commissioner to try to redesign the canopy. Findings of Fact: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact 1. The applicant is seeking a Variance to Section 3-3.6 (5) Bulk Regulations.(Front Yard Setback)to allow construction of a x 40'canopy over gas dispensers. 2. The property is the Hyannis Texaco-Route 132 Gas Station located at 1140 Route 132, Hyannis and shown on Assessors Maps as Map 273, Parcel 79. It contains a 2,415 sq. ft. gas station which has an inspection station and indoor service area (each occupying one bay) and is located in the HB' Highway Business Zoning District,with a small portion of the lot in"the B-Business District— 3. The applicant is requesting a Variance to allow construction of a 40'x 50' canopy over the gas pump islands. 4. A 100' setback*is required under the Zoning Ordinance and the applicant proposes a 2'setback. 5. The proposed 2'setback will bring the canopy practically adjacent to Route 132. This is a very busy section of roadway,with entrances to Festival Mail, Crossroads Condominiums, Cooke's Seafood, Red Lobster, etc. all within a very short stretch. .A canopy could pose an additional distraction in this area, particularly given possible lighting and sighage, the proposed large size and lack of adequate setback to Route 132. 6. The petitioner has been before the Zoning Board of Appeals four times previously for the same request starling with Appeal Number 1983-76 and the requests were denied. T . The applicant is proposing to construct a canopy over the pumps which will be 7' from the layout for Route 132. Zoning Relief Requested • Appeal No. 1997-63: The applicant is requesting a variance from Section 3-3.6 5) Bulk Regulations for the 7' setback from the Route 132 layout for the proposed canopy. • Appeal No. 1997-64: The applicant is requesting a Special Permit pursuant to Section 4-4.4 for alteration of a pre-existing nonconforming building to allow alteration of the gas station which is located within the 100' setback. Consideration as a Repetitive Petition: A similar application was filed in August, 1996, as Appeal No. 1996-118. That appeal was a request for a variance from Bulk Regulations to locate a 40' x 50' canopy 2'from the front lot line, which is similar to the variance relief from Section 3-3.6 5) Bulk Regulations now being requested in Appeal No. 1997-63. This request is for a somewhat smaller canopy of 40' x 45'. This canopy is proposed to be located 7' from the street layout, rather than 2' as previously proposed. Because of the similarity in the two appeals, the Board may wish to review the present request for a variance in Appeal No. 1997-63 with regard to Section 16 of Massachusetts General Laws Chapter 40A, Repetitive Petitions. According to this section, the same appeal may not be granted if a Zoning Board of Appeals has f . Town of Barnstable- Planning Department-Staff Report-Hyannis Texaco Appeal No. 1997-63 Variance Pursuant to Section 3-3.6(5)Bulk Regulations Appeal No. 1997-64 Special Permit for Alteration of Pre-Existing Nonconforming Building acted unfavorably on a previous appeal within the previous two years. The Board may wish to make a finding that this appeal is substantially different from the applicant's previous request. If the Board finds this to be a Repetitive Petition, the law requires that before they take action, there must be a favorable vote of four of five Zoning Board of Appeals members that there were"specific and material changes in the conditions upon which the previous unfavorable action was based." The Planning Board must also give consent to a Repetitive Petition, and there must be a favorable vote by six out of seven Planning Board members. All parties in interest must be notified when this question will be considered. Staff suggests that the Zoning Board of Appeals hearing be continued for thirty days to a date certain to allow time for parties in interest to be notified and for the Planning Board to hold their hearing. Variance: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Special Permit: A decision of the Zoning Board of Appeals on an application for a Special Permit shall be based on the following: A) Whether or not the application falls within the category specifically excepted by this ordinance. B) An evaluation of all the evidence presented at the public hearing by the petitioner and interested parties as it relates to the fulfillment of the spirit and intent of this ordinance without substantial detriment to the public good or the neighborhood affected. C) A site plan has been reviewed and found approvable in accordance with Section 4-7 herein subject only to the issuance of a Special Permit. (Section 5-3.3 2) Special Permit Provisions, Standards for Granting Special Permits) In addition, the Zoning Ordinance in Section 44.4 requires alterations to a pre-existing nonconforming building to obtain a Special Permit from the Zoning Board of Appeals. If the use is also nonconforming, then .the provisions of Section 4-4.5 apply. In this case, the gas station is a retail use which will be nonconforming in the HB Highway Business Zoning District, where only offices and banks are permitted. Section 4-4.5 states that for an expansion of a pre-existing nonconforming use, several requirements must be met and the Board can impose conditions for better circulation and increased open space, as follows below: Section 4-4.5 2) Expansion of a pre-existing nonconforming use A pre-existing nonconforming use shall not be expanded and/or intensified except by Special Permit from the Zoning Board of Appeals. In granting a special permit for expansion of a pre-existing nonconforming use, the Board must find that the proposed expansion, and/or intensification will not be more detrimental to the neighborhood and that the following requirements are met: A proposed expansion of the use shall conform to the established setbacks for the zoning )Any p 9 district in which it is located, or such greater setbacks as the Zoning Board of Appeals may Town of Barnstable-Planning Department-Staff Report-Hyannis Texaco Appeal No. 1997-63 Variance Pursuant to Section 3-3.6(5) Bulk Regulations Appeal No. 1997-64 Special Permit for Alteration of Pre-Existing Nonconforming Building require due to the nature of the use and its impact on the neighborhood and surrounding properties. B)The proposed use and expansion is on the same lot as occupied by the nonconforming use on the date it became nonconforming. C)The proposed new use is not expanded beyond the zoning district in existence on the date it became nonconforming. D)At the discretion of the Zoning Board of Appeals, improvements may be required in order to reduce the impact on the neighborhood and surrounding properties including but not limited to the following: 1) greater conformance of signage to the requirements of Section 4-3; 2) the addition of off-street parking and loading facilities; 3) improved pedestrian safety, traffic circulation and reduction in the number and/or width of curb-cuts; 4) increase of open space or vegetated buffers and screening along adjoining lots and roadways; 5) accessory uses or structures to the principal nonconforming use, may be required to be brought into substantial conformance with the present zoning. Staff Review & Recommendation: The new proposal was reviewed at Site Plan Review and a letter stating the plans were deemed approvable was sent to the applicant. (See attached letter and Site Plan Review Meeting Notes of March 20, 1997.) The proposed setback is an improvement over the previously proposed 2'setback, both in the increased setback and the reduction of overall size of the canopy. The applicant has expressed willingness to eliminate use of vivid colors and signs on the canopy, and to use a gable rather than a flat roof. However, no elevations of the canopy have been provided. The applicant was also willing to remove storage trailers to the rear of the site which are not being used. The property is located in the GP Groundwater Protection District, where 50%of the site is required to be pervious and 30% left in its natural state. This could be accomplished at least in part by removing some of the pavement to the rear of the lot, which apparently is unused for parking or circulation. An area of at least 40'x 200' at the rear of the lot is unpaved. This is 8,000 sq. ft..or 17%of the lot(47,545 sq. ft. area). It is recommended there be no further paving on the lot. If the Board finds to grant the variance-and/or Special Permit, they may wish to consider the following conditions: 1. There shall be no further pavement of the lot. 2. No use other than a gas station is permitted without specific authorization from the Zoning Board of Appeals. No sale of items other than those relating to use as a gas station will be permitted. 3. There shall be no increase in the number of pumps at the gas station. 4. All signs must meet the requirements of the Town of Barnstable zoning ordinance. No signage shall be permitted on the canopy. It is owned by Marula Trust, and has been in essentially the same..ownership since it was constructed in 1965. It contains a 2,415 sq..ft. gas station which has an inspection station and indoor service area (each occupying one bay,) and is located in the HB Highway Business Zoning District, with a small portion of the lot in the B Business District. The applicant is requesting a variance to allow construction of a 40' x 50' canopy over the gas pump islands. A 100' setback is required under the zoning ordinance and the applicant proposes a 2' setback. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 07; 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 25, 1996, at which time the Board found to deny the Special Permit. Board Members hearing this appeal were Ron Jansson, Richard Boy, Emmett Glynn, Tom DeRiemer, and Chairman Gail Nightingale. Attorney Peter O'Keeffe:represented the Applicants. Also present were Attorney Richard Largay; Kevin Wentworth, owner and operator of the Hyannis Texaco; Frank Fetto, a Texaco representative; and Al Micale, the Engineer for the project. Hearing Summary: ------- ----- _..-_. Attorney O'Keeffe gave a brief overview of the project. He displayed a poster of the proposed 50' x 40' canopy which falls within the current 1.00 foot setback requirement. Another improvement includes replacing the pumps with newer, more modern pumps. Attorney O'Keeffe stated that the widening of Route 132 that occurred a few years ago, put the pumps closer to the hardened surface of the road. With regards to Variance conditions,Attorney O'Keeffe explained that the"structure"creates a unique situation. The .entire lot, the underground tanks and most of the building itself should be considered a "structure" and are all within the 100 foot setback. Since this is where the pumps are located and the canopy is to go over the pumps, the canopy must be within the setback. It would be a great financial hardship (actually unfeasible) to move the entire building and all the pumps within the 100 foot setback. Plus, the.canopy is needed to remain in the competitive market —of the 10 closest service stations, eight have canopies. Mr.. O'Keeffe listed the reasons why the canopy is a necessity-protection from weather conditions, the lighting inside the canopy is better, and people can pay for their transaction with a credit card right at the pump and not have to leave their car unattended. The new dispensers are beneficial in 'that they have a "break away system"that automatically shuts off the system in an emergency. Plus the Zoning Board of Appeals..Decision and Notice Appeal No. 1996-118 Marula Trust II-Star Enterprise-Hyannis Texaco system would shut down if the pumps were accidentally run into. Attorney O'Keeffe suggested that because there will be the same number of fueling stations, there will be no change to the traffic flow and therefore would not adversely affect the area. The canopy is really only a roof with no sides and will not block the view of any passing motorists and acts.as a barrier allowing the attendant time to clean up the spill before the gasoline has a chance to mix with the rain and possibly run off into the road. There will be no writing or signs on the.canopy. It is the standard Texaco canopy with all the words and Texaco Star symbol removed. The base of the canopy is 13'6"above ground level and the total height is 17+ feet. Mr. O'Keeffe stressed that even though the canopy is within the setback it is actually twenty five feet from traffic when you take into consideration the buffer zone and the white line at the edge of the road. Therefore, it is not in anyone's direct vision and not within the traffic flow. With regards to hours, the station is now open 6:00 AM to 11:00 P.M., Monday through Saturday. On Sunday, the hours are 6:00 AM to 10:00 PM. These hours will not change. Public Comments: No one spoke in favor or in opposition to this appeal. The project has received Site Plan Review Approval, however, the applicant was"urged to redesign the canopy to fit into the regional architecture." Mr. O'Keeffe stated the Architect from Texaco was not sure exactly what was meant by that request, but if that were the deciding factor, the applicant would try to redesign the canopy. The applicant would be willing to work with the Building Commissioner to try to redesign the canopy. Findings of Fact: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact: 1. The applicant is seeking a Variance to Section 3-3.6 (5) Bulk Regulations (Front Yard Setback)to allow construction of a 50' x 40' canopy over gas dispensers. 2. The property is the Hyannis Texaco- Route 132 Gas Station located at 1140 Route 132, Hyannis and shown on Assessor's Maps as Map 273, Parcel 79. It contains a 2,415 sq. ft. gas station which has an inspection station and indoor service area (each occupying one bay) and is located in the HB Highway Business Zoning District, with a small portion of the lot in the B Business District. 3. The applicant is requesting a Variance to allow construction of a 40' x 50' canopy over the gas pump islands. 4. A 100' setback is required under the Zoning Ordinance and the applicant proposes a 2' setback. 5. The proposed 2' setback will bring the canopy practically adjacent to Route 132. This is a very busy section of roadway, with entrances to Festival Mall, Crossroads Condominiums, Cooke's Seafood, Red Lobster, etc. all within a very short stretch. A canopy could pose an additional distraction in this area, particularly given possible lighting and signage, the proposed large size and lack of adequate setback to Route 132. 6. The petitioner has been before the Zoning Board of Appeals four times previously for the same request starting with Appeal Number 1983-76 and the requests were denied. 7. Granting this Petition would be substantially more detrimental to the already overly congested area and to allow this would be in derogation from the spirit and intent of the Zoning Ordinance. Decision: Based upon the findings a motion was duly made and seconded to deny the relief being sought. .
