Business Longtime Mall Barbers Move To New Shop The barbershop located in the Cape Cod Mall for the past 42 years is no more.The barbers,Dick Souza,Rick Kopala,and Matt Kundel,have not closed up shop,but rather moved to a new location down the street in Hyannis. After Small retired,Rick Kopala stepped in.A few years ago,Dick and Rick added a third barber to the shop when Matt Kundel relocated to Cape Cod from New York with his wife and young family. u The decision to move out of the mall and into anew location has been in the works for some time.When the barbershop's lease with the Cape Cod Mall came up for renewal,Souza and Kopala started thinking about taking a step back and passing the torch to Kundel. Kundel jumped at the opportunity to run the business and started scouting locations in Hyannis,where the three barbers could set up a new shop.Kundel found an ideal location in a former real estate office on lyannough Road and purchased the building last year. Over the course of the past few months,Kundel renovated the space to fit the needs of the barbershop.The new Cape Cod Barber shop opened for business on Wednesday,January 2,2013. It is served by public sanitary sewer. Access to the site is provided from Route 132 and a driveway interconnection with the new Stop & Shop. Mr. Kundel proposed to reuse the building for a three chair barber shop. The second floor would be used for storage and offices for employees of the barber shop. The Applicant proposed to re- stripe the paved area in front of the building with three parking spaces, including one handicapped accessible space. A parking and access agreement was executed by James Murphy and Atlantis lyanough Realty, LLC, owner and developer of the abutting Stop & Shop property. This perpetual easement grants the subject property owner the use of seven (7) parking spaces on Atlantis' property, along with associated rights of ingress and egress. This agreement was executed pursuant to the Cape Cod Commission Development of Regional Impact decision for the Stop & Shop development (see DRI No. JR20035 Condition TF18). Procedural & Hearing Summary Special Permit No. 2012-048 to allow a barber shop at 1170 lyannough Road was filed at the Town Clerk's Office on July 27, 2012 and was also filed at the office of the Zoning Board of Appeals. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 22, 2012 at which time the Board found to grant the request subject to conditions. Board Members deciding this appeal were Board .Chair Laura F. Shufelt, William H. Newton, Craig G. Larson, Alex M. Rodolakis, and George T. Zevitas. Town of Barnstable Zoning Board of Appeals—Decision and Notice Special permit No.2012-048-Matthew Kundel(Cape Cod Barber Shop) Attorney Steve Pizzuti represented the Applicant before the Board. Attorney Pizzuti presented the proposed use to the Board, explaining it would be a three-chair barber shop with offices and storage on the second floor. He indicated that the use was moving from the Cape Cod Mall to this location. Attorney Pizzuti stated that parking would be provided in front of the building, in addition to the seven spaces that are located on the Stop & Shop property. Public comment was requested and no one spoke in favor of, or in opposition to, the request. The Board commented that they thought it was an appropriate reuse of the building. Findings of Fact At the August 22, 2012 hearing, the Board unanimously made the following findings of fact for Appeal 2012-048, a conditional use special permit request filed by Matthew L. Kundel to allow the operation of a barber shop at 1170 lyannough Road: 1. Matthew L. Kundel is requesting a Conditional Use Special Permit to operate a barber shop in a 770 square foot building on lyannough Road (Rte 132) in Hyannis. The subject property is a 2,613 square foot parcel located between the new Stop & Shop supermarket and Parker's liquor store. 2. The property is connected to public sanitary sewer. 3. A site plan has been reviewed and found approvable by the Site Plan Review Committee: The Site Plan Review Committee reviewed the proposal and issued a letter dated June 6, 2012 approving the plan, subject to the grant a Conditional Use Special Permit. 7. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 8. The use does not substantially adversely affect the public health, safety, welfare, comfort or convenience of the community. The vote to accept the finding was: AYE: Laura F. Shufelt, William H.
