Property is developed (1945)with 2 commercial buildings. One is a 1945 used as a retail (Best for Less)
re-sale of appliances and furniture. The other building fronting lyannough Rd is a 19401 story concrete
block building used for lawn mower repair/sales.The site is 0.88 acres located in the TD zoning district
and the WP water overlay zone.
08/06/2018
Called to the site by HFD. Bob McKechnie and R.'Anderson reported to the site. HFD advised that
Rescue transported a female from a camper in the rear of the Best for Less property. Found rear site to
be filled with appliances,storage containers/box truck(full of household trash and one with furniture&
appliances). Numerous appliances are outside as well as an old RV and a boat.
In the far rear is a camper admittedly occupied by Harvey Powell and Amy Grass. Harvey provided
contact information and said as soon as Amy is released from CCH they would be returning to Virginia.

I have reviewed information related to the above store and its location in 3,800 sq.ft. of the 22,500+/-sq.ft. retail &storage
building at 276 Route 28 - Bornstein's Building. Although I do not agree with the previous Building Commissioner's
evaluation and conclusion to permit the redevelopment as-of-right, the fact is that the structure is there.
The building permit was issued with the parking calculations that approximately 1/3 of the space for storage, 2/3 for retail
(less a few sq.ft.for office). The applicant seeking to locate within - Peter L. Pepper-discussed the proposal with me. As
noted to me, he would use 1/3 of his space for storage- keeping with the approximate overall building use ratios.
My recommendation would be to permit this building to be occupied as-of-right provided the ratios of storage to retail are
maintained. This is a specialty furniture store and traffic should not be of concern.
have communicated this recommendation to Ron Jansson,ZBA Chairman, and he concurs with my thinking that the
building is there and tenants should not be held accountable for the developer's past issues. It should be noted that if this
decision should be appealed the Board would then handle it. (My impressions of the Board members are that many felt
that the redevelopment should have secured a Conditional Use Permit and an Expansion of a Non-conforming Structure
special permit.)

After careful consideration of the entire realm of this project, I am of the opinion that the
Town of Barnstable is fully capable of reviewing the aforementioned application
currently before you. I understand that you have been informed that the request to
upgrade Nightingale Lane by Site Plan Review may not be assured. Be advised that the
owner has voluntarily agreed to upgrade this road. With this assurance, I am confident
that the final decision of the Site Plan Review shall include this as a contingency to
approval. I, therefore inform you that this project shall remain under the sole jurisdiction
of the Town of Barnstable. A Commission referral shall be issued at such time that
mitigating circumstances or other amendments change the complexion of the project. i

Regarding: Change of Use Application by Sailfish Partners,LP mq'tel use to

Project: Change the use of and rehabilitate the Angel Motel prgYperty on
Route 132 to a 20,000 square foot retail store.
Access and Traffic- The new store will have ingress and egress from both Route 132
and Nightingale Road. The project is to include and therefore be
conditioned upon(a)Nightingale Road being rebuilt to meet
current Town of Barnstable road standards and(b)the!Route 132
driveway being divided into separate enter and exit lanes with no
left turns for either entering or exiting motor vehicles. ;Applicant's
Traffic Engineer and Cape Cod Conti nission's Staff Transportation
Engineer agree that new vehicle trips are below the Regional Policy
Plan's thresholds for traffic impacts.
Statement as to Town Writers opinion whether or not the Town of Barnstable through its

Review subjects: Barnstable Zoning Ordinance provides for review of a
developments affect on the sidewalks and streets,including traffic

development site, convenient and safe access for fire fighting and
emergency rescue vehicles both within the development site and in
relation to adjacent streets;convenience and safety of vehicular and
pedestrian movement within the development site and in relation to
adjacent streets, properties or improvements; satisfactory methods
for drainage of surface water; satisfactory methods for etorage,
handling and disposal of sewage,refrse and other wastes.

Approvals required: The project can not go forward without:
(1) a plan approved by Site Plan Review. Site plan standards,
among other matters, include the placement of building, structures,
fences, lighting and f xtures on each site such that they;do not
interfere with traffic circulation, safety, appropriate use and
ergoyment of adjacent properties.
(2)Approval of the Zoning Board of Appeals. The Bdard of
Appeals has the power and authority to deny the proposal in
addition to other reasons,where it determines the project,if
granted,would result in substantial detriment to the public good or
the neighborhood affected;would nullify or substantially derogate
from the intent or purpose of the Town's Zoning Ordinance; not be
in in the best interests of the Town including concern about traffic,
The Board of Appeals has imposed no left turn entrance and exit
requirements on other sites on Route 132. The Board`of Appeals
as an alternative to denial can impose conditions and restrictions
that are necessary to have the project comply with the Town's
Local Comprehensive.Plan and that will control and mitigate any
negative impacts.
Opinion: Will the Town of Barnstable be at risk if the Change of Use
Application is allowed and the project is reviewed by the Town and
not by the Cape Cod Commission?

Dear Members of the Regulatory Committee:
The Barnstable Department is&ware of the plans of Sailfish
Partners,L.P. to change the use of and rehabilitate the Angel Motel property on Route 132 in
Hyannis to a 20,000 square foot retail store. I understand that.a Change of Use Application is
pending before the Cape Cod Commission Regulatory Committee that, ifapproved,will result in
the project being rex^ewed by the Iovm ofFarnstaole regulatory agencies and not by the Cape
Cod Commission as a Development of Regional i-mpal.
It has been explained to me that access to and from the new otore Mll be from both Route
132 and Nightingale Road. The proiect is to include and therefore be conditioned upon(a)
Nightingale Road being rebuilt to tnoet current Town of Barnstable road standards and(b)the
Route 132 driveway being divided into separate enter and exit lanes with no left turns allowed for
either entering or e66ng motor vehicles. The Zoning Board of Appeals has imposed;this type of
configuration on other sites both on Route 132 and on other roadways in the Tovm of Barnstable.
In my opinion, the Town of Barnstable through its various departments and boards is
capable of adequately revietivir - the projwt and of making decisions to protect the community.
This power includes-the Town's right to deny the re-use request if the reuse as proposed is not in
the best interests of the comrnunity.
Town review of the project, as provided for in the Barnstable Zoning Ordinarwe,will
include the development's affect on sidewalks and streets,including traffic to mid froin the site
and on the area roa6vays as well as internal site development. The Zoning Board of Appeals as
an alternative to denial ca_n impose conditions and restrietions that are necessary to have the
Project comply with the Town's.Local Comprehensive Plan and that«ill control and mitigate anv
negative impacts,
In my opinion,the Town of Barnstable will not be at risk If the Change of'[Jse Application
is allowed and the project is reviewed by the Town and not by the Cape Cod Commission.

Sailfish Partners' applications to the Town of Barnstable to redevelop and change the use
of the Angel lvtotel site with fi outage on both Route 132 and Nightingale Lane will &dude a
provision that the deteriorated portion of Nightingale sane be paved to meet oxTent!standards.
Any approval Sailfish Partners receives will be based and conditioned on the plans an!d application
submitted.
Sailfish Partners had requested a finding from the Gape Cod Commission that the proposal
for the site, which includes improvements to Nightingale bane, should be classified as a change of
use that does not require review as a Development of Regional Impact, If such a finning is made,
in my opinion it will be based on the applicant's representations regarding Nightingale Lane,
If the application to the Town does not include the improvement to Nightingale Lane it
will not be the project which has been relieved of re�,iew. As such, the Tovm would irefer it to the
Cape Cod Comrld3sion for re-view.
I feel confident Town of Barnstable through its various regulatory boards and
departments, which for altering nonconforming buildings requires Board of Appeals approval,has
the oversight powers,time and capacity to thoroughly review and condition the proposal to
prow-t the best interests.of the coinmunity. Sailfish Partners Limited Partnership would
appreciate your advising the Cape Cod Commission of your opinion regarding the Town ability
and willingness to review the proposal.
